i'll show you what else will be a problem for you this morning. and this is what it looks like right now at the golden gate bridge toll plaza as the morning commute starts to pick up on this tuesday, tax day, april 17th. this is "today in the bay." good tuesday morning, everybody. it is straight up 6:00. i'm john kelley. >> new this morning, a man is dead after flames trapped him inside his pickup truck overnight in san jose. the chp says the truck ran off the road and burst into flames on northbound 680 just south of capitol expressway. officers say the truck and the grass surrounding it were both on fire when they arrived on scene just after 12:30. they cleared the scene after the coroner was called. and this morning, oakland police searching for a man who beat and sexually assaulted a woman near lake merritt.

christie smith is live in oakland where a $5,000 reward is being offered. crazy scene out there. good morning, christie. >> reporter: good morning to you. this is a really popular place for runners and people getting exercise even at this hour. we've probably seen at least 50 women running by. i've been speaking with them this morning and mostly they haven't heard what happened here. that a woman says that she was forced into that car near lake merritt and sexually assaulted. this is on lake shore on the side of the lake near our lady of lourdes church. we have new video. the 34-year-old woman says it was about 3:00 in the morning sunday, she was leaving a friend's house walking, when a man pulled up, told her to get in, but she got out, he forced her into the car and hitting her to get her to stop screaming. i just talked to a woman who said she didn't know about the attack. >> you know, the earlier, you know, as the light comes out and just about half an hour or so, it feels like there's more people, there's lots of people

out. people you see all the time. so there's a sense of community around walking the lake. >> police say he pushed that woman out of the car. she was treated at a hospital and released. as you mentioned, there's a $5,000 reward being offered for information leading to the arrest of this attacker. but not much in the way of suspect information. we know he was driving a dark four-door sedan. he's in his 20s. police reminding people to be extra careful coming and going and also getting in and out of your car. reporting live in oakland, christie smith, "today in the bay." 6:02. this morning, one man is dead, another is in the hospital after a shooting near oakland's mills college. the 19-year-old driver of a red camaro crashed monday afternoon. police say he and his 21-year-old passenger had been shot. the passenger died at the scene. witnesses say at least 8 to 10 shots were fired at the car, about 4:30. a tan mid-sized car was seen

leaving the scene. today there are new leads in the search for south bay teen sierra lamar. "today in the bay's" bob redell is live in san jose with what detectives right now are working on. bob, good morning. >> good morning, john. we have learned of these new leads at the sheriff department they have in the disappearance of sierra lamar could have been cold from dna, hair fiber, or fingerprint evidence. but that's as specific as the sheriff's department is getting with us. the 15-year-old morgan hill girl has been missing for just over a month now. this information coming from crime lab analysis of items found in the search for her. it's not clear if this came from her purse and clothes, her cell phone, or the used condoms and empty box of handcuffs. those are all items that were found in different areas near her home in morgan hill since she disappeared march 16th. this week, investigators are continuing their searches of local bodies of water using side

scan sonar and divers if necessary. yesterday, a huge crowd of sierra's family and friends marked the one month since her disappearance by releasing hundreds of balloons. they were all pink in color, that is her favorite color. and each one had tied to it a handwritten message of hope and prayer for her safe return. >> it was really hard. it's hard to talk about. >> just hoping all of those messages -- i hope they're going to bring her back to us. >> tomorrow at burnett elementary in morgan hill, the klaas kids foundation will conduct another one of the volunteer searches. again, you show up between 8:00 and 1:00, make sure you have photo i.d. to prove that you're at least 18 years of age. reporting live here at the santa claer ra county sheriff's office in san jose, bob redell, "today in the bay." the founder of klaas kids foundation will be testifying on

two death penalty proposals. mark klaas, his 12-year-old daughter polly was kidnapped and killed in 1994. her killer has been on death row for 16 years. today, he will testify in support of a senate bill that would end the automatic appeal of death sentences and a senate amendment that would transfer death sentences from the supreme court to appeals court. we are learning more about the sailors lost at sea over the weekend. the waves washed the crew of the low-speed chase overboard during a race on saturday around the islands. the coast guard rescued three people. the search was called off for five others. the victims were remembered with a moment at monday night's giants game. alex bush was a ball girl when barry bonds broke the record. alan kahill was a fixture at the san francisco yacht club in belvedere. >> known as irish alan. always had a quick wit, good sense of humor.

you could hear him down the docks. laughing and joking away. quite the character, but very good sailor. >> 43-year-old mark grew up in belvedere. and 25-year-old jordan fram was weeks away from graduating from dominican university. while the community mourns, crews looking into how to remove the boats which were struck on the rocks and the islands. u.s. fish and wildlife says it's an area and it's a habitat for birds and seals, and removing the vessel should be very, very difficult. 6:06 this morning. deadly twisters that struck thousands of miles away are hitting close to home for a north bay neighborhood. the press democrat reports santa rosa native and gulf war veteran darren joule tried to get his daughters into a cellar in fargo, north dakota.

he and his daughter were killed inside a mobile home. his 8-year-old daughter is critically injured. fargo is 14 miles away from the town of woodward which was hit by a monster twister just after midnight sunday killing six people. forecasters say about 75 tornadoes touched down and four great plains states during an outbreak of severe storms over the weekend. >> yeah, the middle of the country just getting devastated by all of that madness out there. well, 6:07 right now. you said some of that weather affected what we got out here, as well, right? >> yeah, it's the same system. that brought 750 plus lightning strikes to the bay area. once it moved over the rockies, amplified, and then that system made its way into the great plains and utter devastation. our thoughts and prayers go out to everybody out there. here we have a much different scenario shaping up. overall, we are looking at a quiet weather pattern that's going to last all week long. this spring has been really active so far. finally, getting a taste of

spring that will last longer than seven days. 65 degrees at noon today, inland, comfortable conditions, you'll be at 67 degrees by 4:00 p.m. and we're talking about comfortable conditions today if that's not warm enough for you, if you don't like the low 70s, we've got the 80s on the way. you just have to wait a little bit longer. high pressure sets up over the great basin, drives the winds offshore. and we're talking about the potential for isolated 90s. i'll tell you where in my next report. that seven-day outlook ready to go first. let's see how busy your drive is. >> getting busier. more folks headed to the bay bridge. no major problems unless you're coming through the caldecott tunnel. that's where you watch for a bumper that is in the lanes right now. reported from an earlier accident, use that right bore, and you should be okay. traffic still relatively light for the caldecott and no slowing on the approach. we're looking at a heavier volume now coming out of the altamont pass. 18-minute drive registering through livermore, but the exclamation point westbound reports of some sort of traffic hazard. no details on what it is.

but a couple of chp units heading over there. i'm worried about the potential for traffic break. we'll watch that and slowing northbound 101 at oakland road. we'll give you the details as we find them. no lanes reported blocked. >> thanks so much. 6:09. a favorite perk of the sunday trips to san francisco may soon end. the city's municipal transit agency is expected to approve a plan to begin enforcing parking meters on sundays from noon until 6:00 p.m. right now meter parking is free on sundays. the city says all meter money will add up to almost $2 million. the board is also looking at a proposal to raise the price of traffic tickets by $5. >> just in case you forgot, it is d-day, as in deadline for taxes. and protesters marking the occasion throughout the bay area. occupy oakland rallying in solidarity with postal workers facing possible layoffs. that protest set for 3:30 outside the main post office on seventh street. and at 3:00, a separate rally will take place at the civic

center, post office, and oakland to thank california for paying their taxes. similar events will also be held in san francisco. well, you've had two extra days to file your return, but if you need more time, you can file for a six-month extension. you must make that request by midnight tonight. but you still have to pay your estimated tax bill at the same time. and if you fail to pay, rather, you will incur interest charges and fees in addition to what you already owe. and if you happen to be one of those people squeezing by, barely making that tax deadline, bay area post offices, they've got you covered. three bay area post offices will provide curb side dropoff until closing time. the san francisco office on evans avenue will offer that curb side service until 10:00 tonight. the airport station office on field road in san francisco will be open curb side until midnight, late night hours. and the north bay office in petaluma will be open curb side until 8:00. 6:10 now, san francisco is

welcome back, everybody. tuesday morning, and that's a nice way to wake up. beautiful shot of san jose, the mountains, the clouds, maybe a little bit of fog. watch yourself on the roads, might be a little cloudy. christina will tell you about nice weather. 6:14. conflict allegations questions are being raised in the case against george zimmerman. the neighborhood watch volunteer who killed trayvon martin. zimmerman's attorney asked the circuit judge to reaccuse herself because her husband works with the attorney who is providing legal commentary on the case for a cable news network. zimmerman is due back in court friday for a bail hearing. he has pleaded not guilty to second-degree murder charges for shooting and killing the unarmed teenager last february.

one of the judges in the trial of the man accused of killing 77 people in norway has stepped down. he reportedly posted on facebook that he thought brevik should face the death penalty for last year's massacre. there is no death penalty in norway. breivik is defending his actions on the stand saying he did it out of "goodness, not evil." it is 6:15. a private company will pay millions of dollars to block cell phone calls and texts in and out of california prisons. california prison guards took more than 15,000 contraband phones from inmates just last year. now, this deal with global tell link won't cost taxpayers a dime. that's because the company owns pay phones prisoners can use legally inside prisons. so they're betting once cell phone service is cut, inmates will have to start using those pay phones all over. this morning, online bullying is a target of a new bill heading for the state senate. the measure would make it easier

your temperatures are starting out nice and mild in the mid-50s. you don't need that heavy jacket. we'll see that patchy fog right to start and then we'll start to see a lot of clearing. in fact, san jose right now, just a thin layer left over. setting up for a beautiful day. isolated 70s and warmest cities across the bay. and the 80s return. as we head through the end of your week. high pressure's in control right now. still getting an onshore flow. little area of low pressure did cross to our north. we'll see a little bit more cloud cover today than we did yesterday. overall, just about as warm and then wednesday, things really start to heat up around here. might be a little bit too hot for some people as we head through friday and saturday. that seven-day forecast in a moment. 73 degrees in redwood city and 70 degrees in concord. right by the water, staying on the cool side, places like fremont, oakland, east shore upper 60s. all works out like this as we head throughout the next few days. 78 degrees, warming you up on thursday. we're still going to keep those clouds in the mix. then friday, we lose those clouds and jump to 85 degrees.

great beach day saturday, 84 degrees inland, and that means 74 degrees in santa cruz. 17 will be jam packed, mike. how does it look now? >> a lot lighter than it is on 17 getting to the beach i think this weekend. we'll look into the south bay with 101 -- a typical build in most spots. this was made a little worse because of a distraction northbound 101. distraction for most, two cars involved. well, that's just an accident. that's what they call it on the shoulder at oakland road. slowing from 680 up to the scene, speeds into the 30s. we'll watch to see how that ripple effect affects the approach. 580 is a smoother drive, but livermore shows the slowdown and then this, the shift, not slow anymore. the slow down where we have the earlier traffic hazard still unspecified by chp but did clear it from the roadway, whatever it is in the center divide. and we'll get a live look outside and see how 880 looks past the coliseum. a nice smooth drive on the approach past high street. light volume for here heading up to the toll plaza.

no metering lights. back to you. the fight in the bay area court this week over software has the potential to embarrass a whole lot of people. >> well, good morning. it's a bit like a divorce filing. on the surface, it's kind of routine, but the potential for someone to say something really awful on the witness stand has us all watching the oracle-google fight. these are two of silicon valley's giants in court over patents. at issue is whether google used programming language belonging to oracle to run its cell phones. after one day of testimony the only damning thing we saw was an e-mail that seemed to indicate they knew they were using someone else's property. how are we doing on the sun deal says then google ceo eric schmidt? is it time to develop a non-java solution to avoid dealing with them? oracle of course bought sun. shares in apple continue to sink. no one can put a finger on why

other than profit taking. do watch spain, that country's selling bonds at 2.6%. that's a bad sign. the u.s. government pays just .15% for equivalent credit. and yesterday, we talked about this video coming out of the cochella music festival. there was no bit of music we could include where you could hear it. thrilling the crowd despite the fact that 2pac's technically dead. reanimation of this has been so good. the creators of it are thinking about taking 2pac on world tour with living rappers snoopdogg and dr. dre. it's something called a peppers ghost. if you remember the picture frames at disney world's haunted mansion, same kind of thing. it's been around for hundreds of years. you take a sheet of glass and a reflection in there becomes sort of a ghost and that's how they did 2pac.

welcome back, it is 6:25. president obama's so-called buffet rule could not make it past the senate. senators voted 51-45 in favor of the bill. but it needed 60 votes to keep it alive. the vote fell mainly along party lines. the measure would've made the tax rate for the wealthiest americans at least 30%. supporters of the bill called the senate action a setback but say they will continue to fight for passage. meantime, congress right in the cross hairs in a brand new report out today. a government watch group releasing its annual pig book which looks at pork barrel spending in the federal budget. "today in the bay's" tracie potts live with a look at who is spending on pork projects. >> hey, good morning, we are waiting to see exactly what the 2012 pig book will say.

the last time we saw it was in 2010 because the budget process was a mess last year, they weren't able to pull the numbers together. but in 2010, what we learned was there was 728 pork projects in california, totaling $635 million, sounds like a lot, but california only ranks number 40 out of 50. nowhere close to the top when it comes to these line item expenditures that are stuck in the federal spending bills. in fact, hawaii had the highest spending $251 per capita, compare that to just $17 per capita in california. the idea here is that they try to call attention to things that are specific to a particular small group or an area like, for example, in the last book they highlighted almost $5 million that was given to wood utilization research that went to 11 different states. >> interesting stuff, tracie, thanks very much. >> time to check that forecast.

but this happened about 3:00 in the morning on sunday. a woman tells oakland police that she was out here. she was walking to her car and she was sexually assaulted. we show some new video this morning of the neighborhood. the 44-year-old tells police it happened on lake shore, closest to our lady of lourdes church. she says she was walking home when the man pulled up and told her to get in the car. then he jumped out of the car and forced her in hitting her to get her to stop yelling. this morning, women exercising near the lake say it's the first they've heard of it but they say they travel in numbers to try to stay safe. >> i want to be watching it probably 3:00 in the morning. the earlier, you know, as the light comes out in just about half an hour or so, feels like there's more people, lots of people out. people you see all the time. so there's a sense of community around walking the lake. >> now, police say the woman was eventually pushed out of the car and she was treated and released

at a hospital. a $5,000 reward is being offered for information leading to the arrest of that attacker. so far, though, not much of a suspect description to offer you. police saying he was in his 20s and was in a dark four-door sedan. but oakland police are reminding poli people to be extra careful. be extra careful getting in and out of your car. reporting live in oakland, christie smith, "today in the bay." today a 17-year-old girl released from custody after refusing to appear in court with a man accused of raping her. a judge ordered the victim to jail a week ago after she refused to show up at two court appearances involving her alleged attacker. prosecutors telling the judge the appearance was necessary. but the girl's attorney says the whole ordeal has been unnecessary. >> i do believe it should not have happened in the first place. i do believe that there were less extreme measures to obtain her statement.

>> the judge has since apologized for his decision. meantime, the girl has been released to a secret location with a gps monitoring device to keep track of her and her whereabouts. the defendant facing three counts of rape and sexual assault. 6:36 this morning, a napa woman is facing numerous charges including driving under the influence of drugs after allegedly running down an elderly bicyclist. officers say 23-year-old jenna rubio hit the bicyclist monday morning. the 77-year-old victim was wearing a helmet. but he still suffered major head trauma and internal injuries. the charges against rubio include driving under the influence of marijuana and prescription drugs. a bill to regulate medical marijuana will get its first hearing in sacramento. assembly man tom amiano introduced bill that would not only allow medical marijuana sales but also allow sales for a profit. the proposal would create a nine-member board of medical

marijuana enforcement which would manage a medical marijuana fund created out of state fees and fines. it is 6:36 right now. and checking out that forecast looking into the week ahead. yeah, looks like suntan weather and sunglasses, right, christina? >> that's right. something we haven't been able to talk about so far this spring. but, hey, if you're like me, you can almost see through your white pasty skin, the good news is, you will be able to get that tan on as we head through today and tomorrow, we're going to see cloud cover. we're talking about a lot of sunshine thursday and friday. and temperatures climbing into the 80s. so it's going to be really comfortable. even right by the beach. today it all works out like this. patchy fog mainly at the coast. sun and clouds later on today with the building breeze and 80s return. i'll show you when we get to my seven-day forecast. by noon, 65 degrees inland. you saw christie smith live out there in oakland. she doesn't need that jacket this morning. so good indication that it's not all that cold out there just yet. and with high pressure firmly in

control of our weather pattern, it's going to be nice today. temperatures ending up in the 70s. then as we head through the second half of your week, high pressure sets up over the great basin. it's going to drive those winds offshore. and that's our warming trend. offshore flow starts, really kicks into high gear thursday, friday, saturday. talked about the 80s. i'll show you how that works coming up in moments. 6:38. let's check your drive with mike. first the accident with bumper lanes in the middle bore of the caldecott tunnel. now another accident westbound 24. i don't know which it's affecting. expect that to slow as you approach. an accident on the westbound upper deck incline for the bay bridge just past the toll plaza, there's some slowing heading up the incline and likely have slowed down those metering lights, as well. prepare for more back up as you're coming off the curve from emeryville and berkeley itself. a live look outside as northbound 101 at the 680 underneath there. and a couple of accidents. one at oakland road has cleared adding to the congestion here and 280 and 680, accidents right around the interchange.

good morning to you. it is 6:45. a bizarre story out of illinois. angry swans blamed for the death of a kayaker. investigators think the man got too close to a nesting area and the swans attacked flipping his kayak sunday morning. the birds continued to attack once he was in the water and the man drowned before he could make it to shore. and we are learning more about the sailors lost at sea over the weekend. waves washed the crew of the

low-speed chase overboard during a race on saturday. the coast guard rescued three people, however the search has been called off for five others. the victims were remembered with a moment at monday night's game. alex bush was a ball girl for the giants when barry bonds broke the home run record. elmer morisee was from ireland. >> known as irish alan, always had a quick wit, good sense of humor. you could hear him down the docks. laughing, joking away, quite the character. but very, very good sailor. >> 43-year-old mark casanan grew up in belvedere. he painted scenes of the sport he loved. and jordan framas weeks away from graduating from dominican university. while the community mourns, crews are looking into to how to remove the boat which is stuck along the rocks.

process we've been telling you about and temperatures are going to be in the 70s. take a look at this picture. i wanted to really point a couple things out here. taking a live look at san francisco to start. you get that natural coolant that pushes inland courtesy of onshore flow. as of thursday and friday, we lose that natural coolant and temperatures are going to skyrocket as a result. but today and tomorrow, we still have onshore flow in effect. so it all works out like this. taking a live look at san jose. we still have mostly cloudy conditions here, but not as much low cloud cover. and as a result, we're going to see these clouds break apart over the course of the next hour, hour and a half. full-on sunshine for the first part of today. between 3:00 and 4:00, the clouds start to roll back in and same deal as yesterday. mostly cloudy conditions as we finish off the day. but hey, temperatures are going to be able to climb into the 60s by noon, you'll be at 62 in fremont, temperatures really comfortable at noon in napa, 64 degrees there, and we'll round out the day with plenty of low 70s like we did yesterday. we will see that breeze picking

up. high pressure still firmly in control. however, we're not going to rule out the chance for a stray shower, especially up in sonoma county. i think marin will stay nice and dry. that chance is there about 10% to 20%. wednesday, the warming trend kicks into high gear. it all works out like this, low 70s today, same deal for tomorrow, by thursday, like i said, we lose that fog to start. and as a result, temperatures soar up to 85 degrees with the completely clear start friday, saturday, holding on to that warmth and then temps tumble on sunday. only to 70 degrees inland, but you will notice that difference if you're trying to hit the beach, saturday is your day to do so. let's get to work on time, mike is here. >> and we're looking at a slower drive, northbound 101, fewer accidents in this area. that accident to the shoulder and no major slowing there, but northbound 101 at 280 right at the interchange, an accident clearing from the connecter there. and that's in the backup. that starts at capital expressway going up to san jose san jose international airport. 87 and 85, your traditional slower spots.

typical pattern, lighter for the south bay this traffic tuesday, but it's there nonetheless. highway 24, a couple of accidents on the oakland side of the caldecott tunnel slowing with that 40, so expect a slower drive coming through the caldecott and heading through the maze. at the maze, little congestion there and the two incidents at the bay bridge toll plaza and the incline both cleared from chp incident reports but heading toward that toll plaza with the metering lights a little slower now and a live look outside. we'll see 880, southbound side an incident at 8th street clearing to the shoulder, as well. 6:50. this morning, new clues in the search for a morgan hill teenager now missing for more than a month. bob redell is live in san jose where crime lab results are giving deputies new leads in this sierra lamar case. bob, good morning. >> yeah, good morning to you, marla. and we have learned this evidence could include dna, hair fibers, or fingerprints evidence. and this from this evidence,

they say they have these new leads into the disappearance, that's about as specific as the sheriff's office is getting with us. a 15-year-old morgan hill girl missing for just over a month now. this information coming from crime lab analysis of items found in the search for her in that time. it's not clear if this came from her personal clothes, cell phone, or used condoms or empty box of handcuffs. those are all items found near her home in morgan hill. investigators were also continuing their searches of local bodies of water near morgan hill using side scan sonar and then divers if necessary. yesterday, a huge crowd of sierra's family and friends marked the one-month since her disappearance by releasing pink balloons into the sky, pink was her favorite color. and each one had a handwritten note of hopes and prayers of her safe return. >> it's really hard.

live in oakland right now where police are offering a reward to try to help find this suspect. good morning, christie. >> good morning to you. yeah, this is really a popular place in oakland. it was packed with runners and people walking their dogs. what's happening is that a woman says that she was forced into a car near lake merritt and driven away and sexually assaulted about 3:00 in the morning on sunday when she was walking from a friend's place. this is on lake shore, the side of the lake closest to interstate 580 and our lady of lourdes church. police say a man pulled up and told the woman to get in the car. she didn't and she says he got out and forced her in. and then hit her to get her to stop screaming and drove a few miles away and beat her again. the woman was treated at a hospital and released. police are offering a $5,000 reward for information leading to that attacker, but so far, not a lot to go on in terms of a suspect description. police telling us he's in his 20s and was driving a dark

four-door sedan. live in oakland, christie smith, "today in the bay." >> excuse me, 6:53 now. a toddler whose parents died in a murder/suicide. winn shot his ex-girlfriend, 39-year-old emmanuel winn and then himself in a strip mall saturday. their 17-month-old daughter was strapped in her car seat nearby and was not hurt. she's been cared for by the state until a relative can take custody. it is tax day and some people are using that occasion to protest. occupy oakland rallying in solidarity with postal workers facing possible layoffs. that protest is scheduled for 3:30, it's outside of the main post office on 7th street. and at 3:00, a separate rally taking place at the civic center post office in oakland to thank californians for paying their taxes. the group will also demand corporations and wealthy

and emotional clues. well, europe's money troubles still a thorn in the market side. business and tech reporter scott mcgrew has an eye on it all for us. good morning, scott. >> yeah. the pain in spain falling pretty much on everyone. concern over how much spain has to pay for credit has dragged on the markets last couple of days, although we're doing all right this morning. dow industrials up 94 points. nasdaq up, as well. apple shares, they've been a boat anchor on the nasdaq. apple accounting for 12% of that index. so where apple goes, too does the index. it's been down all week and a couple of weeks now. but okay today. we do hear president obama will unveil new plans to try to control the rising costs of oil by making it more difficult for speculators who have to pony up more money to make their trades that kind of thing. republicans have been hammering the president on high gas prices and we don't know exactly what mr. obama will announce. but i think you can make the
