good morning, everybody. thank you very much for joining us. the time now is straight up 6:00. i'm john kelley. >> and i'm laura garcia-cannon. a man had to be airlifted to a hospital after an overnight shooting in richmond. live with the latest. christie? >> reporter: good morning to you, laura. well, they just towed the victim's car a few minutes ago. all that's left is from the driver's side window that's all over the ground there. when police arrived, they found the victim slumped over the steering wheel in the car he was sitting in that was hit at least eight times with bullets. the driver said the windows were completely shot out. they told me the victim was airlifted to the medical center. and they're not sure of his condition. and they're trying to figure out if the shooter was on foot or if the shooter was in a car. a second white sedan showed up

on the scene investigators say and was believed to be the victim's relative. what they do know is that at about 3:00 in the morning, their shot spotter technology spotted multiple shots at south 7th and virginia and the south side of richmond. they got here really quickly and they immediately started speaking with potential witnesses and, of course, medical crews dealing with the victim. at this point, we do have calls into the richmond police department, and they're expected to have more information for us coming up soon. reporting live in richmond, christie smith, "today in the bay." >> 6:01 right now. ross mirkarimi goes to court today to fight his suspension. he wants city attorney dennis harera off the case. mirkarimi says it's a conflict of interest for him. yesterday mirkarimi gave two interviews. he gave his version of what happened in the domestic violence incident involving his wife. he says he and lopez were in a car arguing about a trip, lopez

wanted to take to a native venezuela. he turned the car around and returned home to resolve the argument. he grabbed her arm when she tried to get out of the car. today the very first shovel will be turned in construction of the project in santa clara. bob redell is live right now. at the new site right next to great america park. and i know it's early, but they popping any champagne out there yet? >> no, i haven't heard the corks popping. i'm sure they're going to wait until afternoon in the very least. good morning to you, john, and it'll be clearly more than v.i.p.s in hard hats and shovels in the dirt. they've got quite a set up on the grounds where the new stadium will be put in. and looks like it's going to be quite a party. and in the eyes of the backers, they have a lot to celebrate. considering there was a lot of doubt this day was going to happen, but ter 5 1/2 years of debate, negotiation and a vote by taxpayers, the city of santa

clarabu has taken the 49ers fro san francisco. this evening, the team will break ground on a brand new $1.2 billion, 68,500 seat stadium complex, this will be built across the street from the headquarters and right across from great america. some clearly not happy this team that's been in their city for so long is leaving. you've got season ticketholders excited about getting out of candle stick but not happy with the seat pricing that's going to be much higher in this new stadium. and you've got people here in santa clara upset that taxpayers are having to shoulder a chunk of the cost for these new digs. >> when hp pavilion was being proposed, there were a lot of people against the pavilion, but now you can't find a person who voted against it. i think it's going to be successful and of course once we host that super bowl, people are going to be excited about it. >> that's santa clara's mayor jamie matthews. construction will begin pretty much right away once the ground

is broken. and there's a lot of rush to get this done because they want this new stadium in place for the 2014 football season. reporting live here in santa clara, bob redell, "today in the bay." this morning, charges are pending in an investigation targeting a south bay community service group. nbc bay area has learned the santa clara district attorney will charge two people as the mexican-american services community agency. the case stems from a 2009 financial scandal involving two of the agencies south bay charter schools. workers tell the paper they believe their employees were skimming from employee wages to cover operating costs. a brief glimmer of hope turning into outrage in the search for missing south bay teenager. the santa clara county sheriff's department says somebody apparently hacked into sierra lamar's twitter account and tweeted a rap lyric from a song. investigators at this point don't know who posted the tweet. the 15-year-old's public account. but they say somebody may have

previously known her password. the teenager has been missing since march 16th. this morning, oakland police are searching for a gunman who shot and killed a young father out walking his baby. the 24-year-old man was pushing his child in a stroller wednesday afternoon when someone shot him at the lockwood gardens housing complex at east lawn street and 65th avenue. the man died at the scene -- the baby was not hurt. well, pg & e may be facing a hefty new fine this morning. the utilities commission considering a resolution to pay $3 billion into the state fund. this coming after pg & e failing to comply with the request. the commission meets at 9:00 in san francisco. next fall, san jose state will open the first ever dorm devoted to lgbt students. converting the 12th floor into the unity house. unity house's resident adviser

says it'll be a place where everyone can go to express themselves. well, this morning, dozens of berkeley high students are suspended from school in an apparent attendance scam. administrators say students hacked into the computer and cleared absences charging fellow students for the service. now it appears at least four students got their hands on an administrative password that gave them the access to the online data base. 50 students have now been suspended, three could be expelled. 6:06. an emotional plea in san bruno to save the school. dozens of families appealing to the school board members, not to close the elementary school. parents say many of the young students are still traumatized by the 2010 pg&e gas pipeline explosion. they believe closing the school will only complicate the recovery. >> he'll have the second grade teacher who he knows next year.

so, yeah, it's definitely not helping our situation at all. >> a committee report says closing a school will only save the district about $200,000. parents say they're willing to help raise that money. the district is holding a hearing on the matter next week. it is 6:07 right now. and it seems that meteorologist christina loren is playing the role of heat miser this morning. >> that's right, i'm cranking it up as a matter of fact as of saturday. but today, not too shabby. 55 degrees to start in sunnyvale. in fact, let's tell you what you can expect at the beaches today. pacifica. try this on for size. 75 degrees with wind out of the west at 15 to 25 miles per hour. half moon bay 73 degrees. if you can get the day off and hit the beach, it's going to be spectacular in santa cruz, our warmest beach city, 76 degrees. you just can't beat that. overall, we're looking toward a nice day with temperatures holding on to the low 70s, 4:00

p.m. inland, upper 60s on the bay at 4:00 and 59 degrees at the coast. i've got that weekend forecast ready to go. big difference between saturday and sunday. stay tuned for that. 6:08, first, let's get you out the door on time with mike. >> getting out a little early if you're driving through san jose. 101 northbound at alum rock. i showed you the approach, slow southbound, as well now. this car reportedly hit the center divide and may have gone across the freeway to the slow lane and that would be a cause for the slowing on the northbound side. but debris possibly an issue for the southbound side or at least distraction. we'll watch that as it continues to flow into the south bay. we're also looking at the issue. the onramp is open northbound 880. wanted to clear that up. there may be a disabled vehicle partially affecting your drive to the freeway. let's get a live look outside and see how things are shaping up. across the bay, bay bridge, nice easy flow. no delays right now. we expect those metering lights on in just a few minutes. so far, a smooth drive into the

city or out of it. back to you. >> appreciate it. well, a b.a.r.t. employee fighting to keep his job after pulling a little bit of a robin hood caught giving away free tickets. the station agent accused of giving away $300 worth of tickets to a teenager. he says he was trying to make sure that the boy got to school after his father died last year. now, the worker says he is friends with the boy's grandfather and was only trying to be kind. a personnel hearing is scheduled for tomorrow. 6:09. pleasanton moving forward with a plan to build 500 apartments south of the city's b.a.r.t. station. an affordable housing developer will be able to build 18 new buildings including retail space two sides, eight acres at the corner of owens drive and willow road. and another eight acres at hacienda. 54 of the units will be set aside for low-income families. and new this morning, microsoft opening up the doors

well, developing out of the middle east right now. reaction from both the taliban and afghanistan's president regarding those graphic photos that show u.s. troops posing with remains of afghan suicide bombers. on this story from the newsroom with all the latest developments. good morning, marla. >> good morning. in just the last hour, hamid karzai openly condemned the photos that were published by the l.a. times calling them

"disgusting." just now the taliban spokesman issued a statement saying, "we strongly condemn these occupiers and their puppets who are without culture, who are brutal and inhuman." back to karzai, he warned similar incidents have sparked reaction from afghans including protests that left dozens dead. shocking testimony coming out of the trial of breivik. in just the last few minutes he told the court he planned to capture and decapitate norway's former prime minister during his shooting massacre and bombing last july. he has confessed to killing 77 people in both attacks. developing all morning out of iraq today, almost 40 people are dead, another 100 hurt in a series of blasts across baghdad and some of the northern cities. officials say extremists launched more than 20 attacks in just an hour and 15 minutes. they say these blasts resemble those carried out by al qaeda.

now other big stories i'm keeping an eye on today include a missile launch by india and that cease-fire plan for syria. john and laura? >> thank you, marla. it's 6:15 right now. murder trial of a former oakland raiders player ends in a miss trial. 44-year-old anthony wayne smith accused of killing a mechanic in 2008, a jury did not reach a verdict after nine days of deliberating. smith will remain in custody and will be retried. marijuana smokers will not be allowed to light up in some east bay parks. the park board approving a ban on smoking pot after complaints people are lighting up near families. starting today, medical marijuana smokers are banned from smoking 1,000 feet of any east bay regional park. the ban includes picnic areas, camp sites, and swim beaches. weeks after a federal raid in oakland's oaksterdam

university, it's crippled but will continue. they seized equipment back on april 2nd. administrators say work by students and instructors was gone in a matter of hours. the founder of the university dedicated to the teachings of marijuana cultivation has decided to step down. the volunteers have stepped up. >> i have to say, this community and the employees of oaksterdam are phenomenal. 45 people lost their job and they're continuing to keep it going until we can get our feet back under us. >> oaksterdam says it will continue teaching but separate from the marijuana clubs. it has now about 100 students, most of whom will be at a friday rally at a oakland federal building to urge changes to the nation's drug policies. all right. it was early in the season, but an instant classic last night at at&t park, matt cain and cliff lee going toe-to-toe. cain throws nine scoreless

innings, lee managed to get overtime in, ten scoreless innings. the game finally ending the 11th, cabrera steps up, puts the finishing touches on it. that's a single and the giants bring home the game winner and go on to win this one by final of 1-0, and the party is on. let's go, fellas. take it home. all right. here's hoping for a speedy recovery for that guy, brian wilson will be off for the season. today the 30-year-old undergoing tommy johns surgery in florida. the surgery will reconstruct his elbow replacing a torn ligament. the team manager expecting wilson to rejoin the team at home next weekend. he won't be pitching, but wilson, yeah, not able to throw until 2013 at the earliest. this is the second time he's gone through the surgery. the first time was when the right-hander had this surgery in college at lsu back in 2003.

cities. so you want to dress in layers today. high pressure bringing our numbers up by about 5 to 10 degrees from yesterday's highs. we also have that thin cirrus creating a thin veil. we're talking about full-on sunshine. and that's going to warm us up. also, we've got these warm down-sloping winds that are going to build throughout the afternoon. keep that in mind. even warmer for your friday. mid-80s. and saturday, we max out near records. this is the forecast. 87 degrees on saturday in livermore, close to a record. records are in the 90s, but we are going to be oh so close in santa rosa, 89 degrees. and you could touch on a record even in places like napa as i am forecasting 90 degrees in napa on saturday. 78 degrees for today in san jose, 75 for fremont, and 72 degrees in san francisco even getting toasty in the city right by the water. as we head through tomorrow up to 78 degrees, san francisco you'll hit 80 on saturday and that translates to 88 degrees in

but bay point still in the upper 50s. back to you. >> thank you very much, mike. well, bay area company splunk going public today. that's a long line of ipos this week. >> yeah, lots lately. opening the nasdaq this friday. and another company called info blocks will announce their shares. all this coming after several other companies launched. yelp started trading this year. that stock jumped 64% in the first day of trading. the east bay's annie's launched. they traded bunny on the new york stock exchange. here's some of the other companies i mentioned. first day of trading for splunk. it'll also be on the nasdaq friday. company officials ringing the buzzer in time square tomorrow. infoblox as a network automation company. it'll be on the new york stock

exchange on friday. a lot of pictures coming out of new york city this morning as the ceo of splunk gives a speech to his fans and his employees who are all standing off camera there. this is actually an incredibly small little room, but it's an exciting time to be opening the nasdaq which will happen in eight minutes from now. of course the granddaddy of all of them is facebook. new reports say facebook will have its official public offering may 17th. that's four weeks from today exactly. it'll raise billions that it doesn't really need. according to its paperwork, laura and john, it'll stash all that new money in u.s. treasury bonds. that's what your grandmother does with her money, facebook will do the same. so it doesn't need the money, it has billions in the bank already. but they will be going public, we think four weeks from today. >> plain conservative, that'll be a big day. >> better than keeping it under the mattress, right? coming up, three agents are gone and more punishment on the way following the secret serviau

three secret service employees out of a job this morning in the wake of a growing prostitution scandal in colombia. and now lawmakers are demanding a full report by next month. live from washington with more on this developing story. good morning. >> laura, good morning. a couple of supervisors and another agent now gone from the agency. one retired, one being fired for

cause and one resigned after this incident that leaving eight under investigation. the "new york times" says a 24-year-old self-described escort says she met some of these agents in a bar that they were drinking, she went back to the hotel room with one and then they got in a big fight that spilled out into the hallway when he only offered to pay her $30 of the $800 she said they agreed on. that's when police got involved. he ended up paying her but of course at that point this had become very public. now a number of congressional committees are looking into it, as well. >> heads don't roll in a bureaucracy that has something wrong. nothing's going to change. and i think you'll find that these people, their heads are going to roll. >> the homeland security committee has four investigators on this house oversight wants a report with details and disciplinary action by may 1st. meantime, the investigation has found so far from sources we

bay northbound 101 still jammed up because of an earlier accident. couple cars still got to get off of that highway. i'll tell you what the latest is coming up. and a live look outside. foggy start, beautiful across the bay area for your thursday, april 19th. this is "today in the bay." good morning to you, and thanks so much for joining us. 6:31 right now, i'm laura garcia-cannon. >> and i'm john kelley. a man hospitalized after being shot in the hail of bullets in a quiet richmond neighborhood. christie smith live at police headquarters with all the latest on the search for the gunman. >> reporter: good morning to you, john. and we do have new information about the victim. i just heard from richmond police and they tell me he is a 35-year-old man. it's believed that he was hit four times in the lower body. and the good news is that he is expected to survive after someone opened fire on the

cayenne he was sitting in. he was sitting at south 7th and virginia about 7:00 this morning. this is a residential area. we counted at least eight holes in the driver door and the window on the driver door was shot out, as well. he was found slumped over the steering wheel and airlifted to the medical center. investigators say they hope to talk with him a little bit later today when he's feeling better. now a second car arrived off the scene, a four-door white sedan. and police believe they may have been the victim's relative coming to the scene. right now, police are working on a press release trying to get more details to us. at this point, they don't know if the shooter was on foot or in a car and so far no suspect description to share. reporting live in richmond, christie smith, "today in the bay." also this morning, ross mirkarimi taking another step toward trying to get his job back. mirkarimi will be in court demanding dennis herera be

removed from the efforts to remove him from office. the attorneys will argue he cannot represent the mayor. mayor ed lee suspended mirkarimi last month for misconduct. he must face an administrative process at city hall to determine if he can keep his job. in an interview yesterday, mirkarimi called the case against him a fabrication and that the bruise he left on his wife's arm was an effort to shield his son from her. 6:33. the city of santa clara striking gold with today's ground breaking with the new 49ers stadium. live at the new site next to great america. groundbreaking was more than five years in the making. a lot of people celebrating today. >> reporter: yeah. good morning to you, laura. and you can hear the noise behind me. there's a lot of construction work right now. the actual ground breaking for

the stadium itself, that's not going to take place until tonight. and if you look over to the left, they've got quite a set-up for this what's going to be a party and the people that want this stadium have a good reason to celebrate. because as you mentioned, this has been roughly 5 1/2 years of debate and negotiation, a vote by taxpayers for a city of santa clara to finally be on the brigk the 49ers to the south bay. this evening, the team will break ground on a brand new $1.2 billion stadium, can c hold 68,0 fans inside. it'll be built right across the street from 49ers headquarters and next door to great america. not everybody is going to be super excited about this. you've got people in san francisco, they don't want the team to leave their city. you've got season ticketholders, they're not happy with the seat pricing that's going to be much higher in a new stadium. and then you've got people in santa clara not happy that taxpayers are having to shoulder a chunk of the cost for these new digs. santa clara's mayor.

we spoke with him. he says he's confident this is not only the right move for the city, but one that can lift it out of economic doldrums. >> it's been well debated, very public and transparent. and i have to tell you, nothing easy. it happens for something great. and so i feel like this is something great and we had to work for it. but at the end, it's going to be worth it for us. >> and the idea that they're going to start construction on this right after the ground breaking, more tomorrow morning. and there's a rush to get this done because they want this open in time for the start of the 2014 football season. reporting live here in santa clara, bob redell, "today in the bay." >> it's been emotional and tough, but school will be back in session at oikos university monday, three weeks after a gunman killed seven people on campus. most classes will be held in the same building where police say former nursing student one l goh killed six former classmates and

a receptionist. classes may be moved to a different location to spare students further trauma. administrators say they could move some of the classes to oakland's patent university or fremont's unitech college. so far, no deal made with either school. the uc davis police chief is stepping down today. led the department during that infamous pepper spray incident says she doesn't want the november 19th event to define her or the university. she's been on paid leave since the confrontation between campus police and students who set up an occupying encampment at uc davis. an independent report criticized for leading a department that is "very dysfunctional." it is 6:36 right now. sentencing being delayed in los gatos murder for hire case. it's being pushed back to early next month as new defense lawyers for convicted killer paul garcia seek to disqualify the trial judge. it accuses the bench of bias against garcia's first lawyer.

a judge from another county will rule on this request. garcia was found guilty in the 2010 killing of former bar owner mark mchealy. the san francisco parks and rec commission will discuss installing a plaque for officer brian tulvera at the monthly meeting this morning. he was shot and killed in 2006 while trying to arrest a prisoner who escaped from the work camp. if approved, the plaque will be displayed. time to check in with christina loren to see what's happening today and the rest of the weekend. looks kind of warm. >> yeah, it is going to be warm because tomorrow, what little fog we are left with this morning, this is actually going to keep your temperatures at bay today right by the bay and at the coastline. we're going to lose this fog as of tomorrow. and that means temperatures are going to skyrocket. so we're talking about the upper 70s later on today, but this morning, enjoying the mid-50s.

coming soon. it is 6:45. india says it has successfully launched a new nuclear capable missile. today in the bay is following the latest overnight developments from our newsroom. marla? >> good morning. india is the latest country to flex its nuclear muscle. and we have the video to prove it. here it is, the country saying the missile launch from india's east coast was a success. the missile is capable of reaching targets deep in china and europe. this morning, china's foreign ministry spokesman declining official comment saying only that india and china should work together as strategic partners. well, now to the latest in syria. international envoy annan announcing syria and the u.n. have reached an agreement in governing the truce monitoring. he says a team of more than three dozen observers will enforce the cease-fire deal that went into effect last week. but france is saying hundreds of monitors are needed to end the bloodshed spearheaded by the

caught up on a shooting in richmond. a man in critical condition at a local hospital right now after being struck in a hail of bullets. christie smith live at the police headquarters with the latest on the search for the suspect. >> good morning to you, john. well, i spoke with richmond police this morning. they tell me the victim 35 years old, sitting in a car when someone opened fire hitting the driver's side at least eight times. but the good news is, he is expected to survive after he was hit in the lower body at least four times. the driver's side window of that cayenne shot out and that's how it looked when police arrived at about 3:00 in the morning at south 7th and virginia. this is a residential area. and he was parked right in front of a home. an officer on scene told me that shot spotter technology signaled rapid gunfire going on and that's what brought them to the scene. the victim was airlifted and they're telling me they were hoping to talk with him a little bit later. a second car showed up, white

four-door, and police told me they thought this might be a victim's relative. so far, no suspect information to share. reporting live in richmond, christie smith, "today in the bay." 6:53. another appeal this morning from suspended san francisco sheriff ross mirkarimi. mirkarimi will be in court this morning to argue the city attorney has a conflict of interest and cannot represent the mayor while advising the city's ethics commission. mayor ed lee suspended mirkarimi last month after he pleaded guilty to charges in a domestic violence case involving his wife. mirkarimi faces an administration process to determine if he can keep his job. and this morning, oakland police searching for a gunman who shot and killed a young father who was out walking his baby. oakland police say the 24-year-old man was pushing a stroller yesterday when he was gunned down at the lockwood gardens housing complex on east lawn street at 65th avenue. the man died at the scene, the baby, however, was not hurt.

and students will return to the scene of a shooting that left seven people dead at oakland's oikos university when class resumes on monday. former nursing student one l goh facing multiple murder charges for opening fire on classmates and a receptionist april 2nd. most of the classes will be held in the same building where those shootings happened, but the university says it is possible nursing classes will be moved to a different campus. 6:54. a brief glimmer of hope turns to outrage in the search for a missing south bay teenager. someone apparently hacked into sierra lamar's twitter account and posted what turns out to be a rap lyric. investigators don't know who posted the tweet to the 15-year-old's public account, but deputies say someone may have previously known her password. the teenager has been missing since march 16th. and laura, charges are pending this morning in an investigation targeting a south bay community service group. nbc bay area has learned the

santa clara district attorney will charge two people at the mexican-american community services agency. the gilroy dispatch reports the case stems from a 2009 financial scandal involving two of the agencies south bay charter schools. workers tell the paper they believe their employees were skimming from employee wages to cover operating costs. a dream come true will be realized for south bay leaders and 49ers fans today. ground-breaking day finally for the team's new stadium in the south bay. bob redell live at the new site next to great america park this morning. bob? >> yeah, good morning to you, laura. a lot of partying will be going on tonight over at the site with all the white tents at 5:00. that's when the official groundbreaking takes place. you can see that clearly there's been a lot of work being done on this site going on right now. it's been happening for several weeks. but the actual putting the shovel in the ground to commemorate the start of the actual construction of the stadium is tonight. and this is the rendering of what this stadium will look like when it's finally built.

you're looking at a $1.2 billion complex that would seat 68,500 fans about 5 1/2 years to get to this point. the bay negotiation, of course, a vote by the taxpayers here in the city of santa clara to get the 49ers to move down here from san francisco. not everyone is key on this. you've got people in the san francisco area who don't want the team to move south. you've got season ticketholders who aren't excited about the higher prices and you've got taxpayers down in santa clara who are not big on the idea of shouldering the cost for some of these new digs. >> there was a lot of people against the hp pavilion, but now you can't find a person voting against it. i think it's going to be so successful. and of course, once we host that super bowl, people are going to be excited about it. >> construction again of the actual stadium itself supposed to start right after the ground
