john kelley today. >> and i'm laura garcia-cannon. >> good morning. break out that summer wardrobe for the next two days. temperatures climbing to near record levels. and we're talking about the mid-80s today. tomorrow, plenty of 90s on your temperature map. you want to dress in layers. temperatures in the 50s. we're headed toward the mid-80s. we'll take you through your full forecast first. it's a get away friday. let's check your drive with mike. >> it is a get away friday. right now, we're getting away from construction -- we're at least getting through it. let's look at 880 through the coliseum. the bright lights on high street off of the freeway. construction there, of course, but then also north from high street, the flashing lights moving you over. lane or two blocked up to fru fruitvale. nice flow through oakland and 580, as well. construction on the lower deck of the bay bridge out of san francisco into oakland. typical overnight maintenance. we'll show you a couple of spots

coming up. >> thank you very much, mike. >> thank you very much. an important court hearing for suspended sheriff ross mirkarimi. >> a judge is expected to rule at the request of the official misconduct case against him be thrown out. "today in the bay's" christie smith is live in san francisco where early indications of the news today will not be good. good morning, christie. >> reporter: the judge already listed a tentative ruling yesterday that so far he sees no reason to put a stop to efforts to remove ross mirkarimi from office for official misconduct. that ruling isn't final, though, until today. ed lee suspended him and mirkarimi is trying to show that lee may have overstepped his boundaries with this. this after an incident with mirkarimi's wife on new year's day where she ended up with a bruised arm. he pleaded guilty to false imprisonment, and his attorneys wanted the suspension overturned arguing that the definition of misconduct was somewhat vague and it had to have occurred

while she was in office. and mirkarimi was sworn in as sheriff until january 8th. we spoke with mirkarimi after yesterday's hearing. >> all i can tell you is i've taken responsibility for what has occurred. and being held accountable for it now. and that has already been adjudicated. >> reporter: now the deputy city attorney said outside of court yesterday that it's understandable that mirkarimi is trying to thwart the proceedings and added i think he's in danger and jeopardy of removal. an ethics council hearing is expected to start on monday and then it's up to the board of supervisors to decide whether or not to remove him from office. and 9 out of 11 would have to agree. christie smith, "today in the bay." 4:33 right now. champagne and confetti are gone. and this morning at the site in santa clara, the real work begins. celebrations lasted well into the night after years of planning and debating, the gold

shovels broke ground yesterday on the new billion dollar stadium. we talked to coach jim harbaugh who said it was a team effort. >> santa clara, the peninsula, the bay area, northern california, everybody that desires to be part of a team, they can be a part of our team. and this football cathedral's going to be a great testament to that. >> football cathedral. the stadium is supposed to be ready for the 2014 season. okay. so here is the time line. the stadium should be ready in time for the 2014 season. and as we mentioned, the super bowl as early as 2016. all of this adds up to big business in the south bay. santa clara says the stadium will bring in more than $40 million in economic activity. many local shops and restaurants are already bustling millions could be paid for naming rights and sponsorships. and it's not just football. this new stadium allows the south bay to get into special events like olympics trials.

the bay area's never really been able to put together a good bid for the olympic trials because we don't have a good facility. now we have the stadium, the earthquake stadium built on the other side. we're going to have a number of venues to allow us to do things we haven't been able to do before. >> and if you're a contractor, good news for you. santa clara will add more than 500 full-time construction jobs in order to complete the stadium. if you couldn't watch it live, we have the best parts of yesterday's ceremony on our website. log on to nbcbayarea.com for interviews with coach jim harbaugh, and video from the actual ground breaking, nbc bay area. some 49ers will be in morgan hill this weekend helping hundreds of volunteers search for missing teen sierra lamar. but this morning, investigators are trying to track down the person responsible for posting a fake tweet on the teenager's twitter account. detectives say they will arrest that person on charges of internet impersonation.

the 15-year-old's account was reportedly hacked wednesday for the second time and that tweet has since been deleted. sierra lamar was last seen the morning of march 16th, five weeks ago. the yacht club of tiburon is dedicating a race today to the five sailors presumably killed when they were swept overboard during a race last saturday. the body of one crew member was recoff recovered, but the other four are missing. the accident happened during rough waters during the race. tonight, there will be a moment of silence one minute before the friday night race begins. oakland police are searching for clues of a killing in a 24-year-old man gunned down in front of his 1-year-old son. happened wednesday afternoon near the coliseum. yesterday, detectives went door-to-door in that neighborhood looking for clues. police say the gunman drove up, got up and approached tyrell smith on foot and took off.

smith was a stay at home dad living at the complex and was often seen pushing his son in a stroller. >> you don't mess with nobody. all he did was take care of his kids, he might play at the park. he say what's up, smoked a cigarette with us and just be in the house and play his game and be with his kids. i don't know why anybody want to do something like that to him. >> he died at the scene. the baby was not hurt. 4:37 right now. the passengers of a delta flight that encountered a frightening emergency finally made it to m l.a. this morning. the plane had to be turned around because of a bird strike. it was all caught on tape. >> a passenger's camera was rolling moments before impact. the flock appeared, then vanished in an instant turning what should have been a smooth flight from new york to l.a. into a heart-stopping scare. just listen to the pilot's call

to the tower. >> delta, engine failure on the right engine declaring an emergency due to a bird strike. >> i was literally calling my wife to say, hey, we could be -- this might be my last flight. i was that scared. >> reporter: that's passenger grant cardone moments after the landing. he caught the whole drama on his cell phone. the assent from jfk around 3:00 this afternoon, the flutter of wings, a loud thud, and a crunching noise before the engine filled with smoke. >> being digested by the engine is basically digesting another giant piece of machinery. the pilot radioed for help and within minutes was able to land the plane. the passengers on board were all okay, just quite shaken. the legend of the bird strike that led to the miracle on the hudson, that unbelievable water landing was not something anyone onboard wanted to try again. nbc bay area news. >> luckily everyone made it out

safely. >> scary. well, let's get ready for heat in that forecast if you like the warm weather. you're in luck, christina loren, how hot can we expect it? >> oh, it is going to be hot. mid-80s today inland. that means for you're someone who works outside, you want to stay hydrated today. get that water bottle ready to go as we head throughout the day, not even peak warmth. we're talking about peak warmth on saturday and the 90s return on your temperature map. keep that in mind. we're in the 50s, 57 in concord, 54 in napa. throughout the day today, we'll quickly climb by about noon. we're talking about the mid-60s and upper 70s in places like san jose. it's going to take a little bit longer for san francisco to reach that 70 degree mark i'm still forecasting a high in the city by the bay right around 78 degrees. you just can't beat that if you're looking for beach weather. however, if you're going to be spending any duration of time outdoors today, you want to stay hydrated because this could catch you offguard.

85 in fremont and 86 degrees just four degrees shy of 90 in napa today. as we head throughout tomorrow, even warmer, we're talking about records, palo alto looks like you will be touching on a record 86 degrees in the forecast. that's a little teaser for tomorrow. i'll let you know where we're spending the 90s. let's check your drive with mike. >> more construction going on. you know, some spots are picking up a little early tonight, but we still have these over here for eastbound 80. opposite your main commute, we have eastbound 80 getting off highway 4, the off ramp is closed and the onramp closer to the bridge, that's also closed. not a major issue for traffic. you'll take your alternate off the opposite direction. i was going to tell you about 680. i'll tell you about it, it's cleared. not a problem through san ramon and a smooth drive out of the altamont pass through the dublin interchange, as well. and a live shot for the bay bridge as you cross over the water. the construction is moving smoothly through the construction zone. the lower deck, you can see some

second-degree murder charges. he says he shot the 17-year-old in self-defense on february 26th. martin was not armed. the delay in charges being filed for protes spurred protests across the country. two supervisors forced out during the investigation of a colombian scandal. and lawmakers said more could follow. >> today and tomorrow, but certainly my understanding there will be more resignations coming pretty soon. supervisor david cheney was forced to retire in the wake of the allegations. greg stokes was fired but his attorney says he plans to fight to get his job back. a third agent resigned. investigators are trying to track down the alleged escorts involved in the incident. 4:45, wall street looks for a boost this morning thanks to some good news from microsoft. for that and the rest of the news before the bell, we turn to cnbc world headquarters. jackie, good morning. >> good morning, marla.

well, the futures are slightly higher this morning. and as you said, microsoft could be providing an early boost after it posted better than expected earnings last night. sales of windows held up in a sluggish pc market. we saw stocks dropping on thursday. investors focusing on disa pointing housing and manufacturing data and continued worries about europe's debt crisis. that overshadowing good earnings reports. asian markets were mixed overnight. there's no economic data here in the u.s. today, but we are watching for more earnings reports from ge and mcdonald's. the dow lost 68 points, the nasdaq falling 23 points to close at 3,007. and the house passed a small business tax cut that the republicans characterize their answer to the buffett rule which was blocked in the senate earlier this week. the measure would cut taxes on companies with fewer than 500 workers up to 20%. those types of companies account for half of the nation's small businesses. democrats oppose it saying it doesn't require the companies to

hire more people and it will add $46 billion to the deficit at a time when there's a big cry to cut spending. and finally, cnbc has confirmed reports that american airlines biggest unions are reporting a possible takeover bid. they represent flight attendants and ground workers. american filed for bankruptcy in november. the carrier goes to court on monday to argue it should be allowed to break the union contracts as it tries to cut more than $1 billion in costs. marla, back over to you. >> okay, jackie, thank you. 4:47 right now. now that tax day has come and gone, it's time to fire up that shredder. any paper document three years or older you can now destroy. but they say hold on to the actual tax returns, those forms a little longer. >> you may want to keep it for six years just because that's, you know, more chance you may be missing something. but generally after that six years, you're generally safe unless you've done something horribly wrong. >> cover your bases.

atm receipts, bank deposit slips, pay stubs can be disposed of monthly unless they're important to future tax returns. good morning to you, 4:48. doesn't the sun give you extra spring in your step? i like the warm weather. >> it might be draining you. >> yeah. >> we almost have -- you know what, even on a warm summer day, it's rare to see the 90s. we're going to see the 90s not just for one day, sunday looking just about as warm as saturday. and the reason why is because we've got this area of low pressure slated to cool us down. it's just slowing down a little bit. it is going to bring us some rain, though, as we head through next week. i'll talk about that when we get to my seven-day forecast. 57 degrees in oakland to start. you're at 62 degrees in santa rosa. several days last week we didn't hit 62 degrees. so definitely a stark contrast from the rainy pattern we've been dealing with. temperatures skyrocketing today. even yesterday was rather warm. you probably didn't need your heater or ac. today you might need the ac.

79 degrees at noon today in san jose, and we're going to round out the day with plenty of 80s on the temperature map. even getting warmer in san jose and san francisco up to 78 degrees today. high pressure's the reason why. it sets off that offshore flow. for us, that's going to bring our temperatures up toward 90 degrees. meanwhile, southern california, they're going to get a taste of the triple digits as we head into this weekend. heat peaks on saturday and we're going to be just about as warm on sunday. all works out like this, 90 degrees inland saturday, 87 degrees on sunday. comfortably hitting the beach both says. 76 degrees on monday and then we're going to cool you off and add those showers over the course of wednesday into thursday. and we still need that rain still running a deficit. we'll talk about that coming up, 4:49, back to you, ladies. >> thanks. well, there's concern today about a goose that was apparently shot with an arrow. have you seen this? it was first spotted last friday near a school outside of sacramento. animal control says the arrow is not preventing the goose from

moving. and that eventually the arrow would disintegrate. the people that live near the park, they think the arrow may be made of plastic and it could kill the bird. >> i think it was terrible. i'm sure it was a hunter or something like that, and it wasn't a fatal shot and now the poor animal has to live with it. >> we need to catch it and get that arrow out of it. >> animal control is planning to turn the matter over to fish and game. >> that's hard to see. 4:50 right now. many drivers are ruthless when it comes to finding a parking spot. this is a new low. a woman in san francisco not giving up her spot without a bite literally. police say two drivers have their eye on the same spot in the bay view tuesday night. one car swooped into the spot angering the other driver, one thing led to another, a fight broke out. police say the woman in the car that didn't get the spot reportedly bit the other woman several times. she was arrested for aggravated assault. >> no comment. 4:50.

welcome back, everyone. waiting for the sun's arrival today. it's going to be warm. we're feeling a warm-up across the area. we'll check the temperatures with christina coming up. 4:54. uc davis has a police chief this morning after the former chief resigned following the now famous pepper spray incident. matthew carmichael was sworn in yesterday. he served while former chief annette spicuzza was on paid leave following the pepper spray incident. he was appointed chief for one year. measles are making an unwanted comeback, last year was the worst year for measles in 15 years. from 2001 to 2010 only an average of 60 measle cases and four outbreaks were reported.

cdc report shows in 2011, that number jumped to more than 200 cases and 17 outbreaks. measles is a highly contagious respiratory disease caused by a virus. a new breakthrough could change breast cancer treatment. british researchers reclassify it into ten different categories based on the genetic make-up of a tumor. this allows doctors to treat patients with personalized therapy. it could also help patients across unnecessary and toxic treatments. the new study released wednesday is the first of many focusing on genetics helping define breast cancer remedies. mike said we could look forward to the morning commute. can we? >> come on over, ladies, unfortunately this one has been returned to the store. we had construction on the roadway. eastbound highway 4, but i looked on chp their latest update seconds ago, that crew is on the move. they're getting their friday
