as soon as it is announced. well, a critical hearing just hours away for suspended san francisco sheriff ross mirkarimi. he'll be back in court asking that allegations of official misconduct against him be thrown out. "today in the bay's" christie smith is live in san francisco where the judge has already tipped his hand. good morning. >> reporter: good morning to you, marla, and happy friday. ross mirkarimi has already suffered two legal setbacks in his efforts to keep his job as san francisco's sheriff. in fact, the tentative ruling yesterday won't be final until after a hearing that is set for 9:30 this morning here in san francisco. but a judge has already said that so far he sees no reason to undo his conduct suspension or allow him to even collect a salary. mirkarimi was suspended after an incident new year's day between mirkarimi and his wife ileana lopez when the family went out for a pizza. she ended up with a bruised arm, there were domestic violence

charges a plea deal and a sentencing. mirkarimi told his side of the interview and he said he thought he was a more tender and caring person not as gruff or aggrebab. but he thought the suspension was political. mirkarimi spoke after and before the last hearing. >> all i can tell you is i've taken responsibility for what has occurred and being held accountable for it now. and that has already been adjudicated. >> reporter: his attorneys also argued that the misconduct definition is somewhat vague and would've had to have occurred while he was in office and he wasn't even sworn in until january 8th. the ethics commission hearing is expected to get underway on monday. what they'll do is look at the facts and make a recommendation to the board of supervisors who will then decide whether or not to remove him from his position. reporting live in san francisco, christie smith, "today in the bay." today marks five weeks since sierra lamar disappeared.

but they are not giving up the search. live in morgan hill where specialized teams will join the effort this weekend. good morning. >> reporter: good morning to you, laura. deputies today will be out searching for sierra lamar and following up on any leads. but they're also gearing up for a massive search tomorrow morning that will start at 9:00 and end at sunset. a total of 90 search and rescue members from santa clara county, san mateo county, santa cruz and marin counties will comb areas of morgan hill, gilroy, and san martin. search and rescue members specifically trained to scour some of the rough esther rain will also be out there as well as dogs trained to detect human remains. in another development, sheriff deputies confirmed sierra lamar's twitter account was hacked several times in the past two weeks. investigators traced one incident to someone in the philippines and have leads on the other hacking incident. volunteers from the community are also going to hold their own

search here at burnett elementary school. they will be out searching from 8:00 a.m. until 5:00 on both saturday and on sunday. and they are sending out automated phone calls to gear up and generate more people to come in and help search for sierra lamar. reporting live in morgan hill, "today in the bay." 6:04 now, police in the north bay are searching for a 15-year-old santa rosa girl who disappeared last saturday. charlotte mulinari's father says she left on a green mountain bike wearing a green jacket and carrying a backpack and may have been headed for annadel state park. santa rosa police say the girl may have been depressed. a large display of law enforcement expected today for the funeral of a sheriff's deputy killed in modesto. robert paris was shot and killed while serving an eviction notice to a tenant at an apartment complex. a lock smith brought to the

scene was also killed. police say the suspect barricaded himself in an apartment and held deputies in a standoff for several hours before eventually shooting himself. the standoff ended when the building caught fire. more than 2,000 law enforcement officers are expected for that funeral. a north bay yacht club will dedicate tonight's race to five crew members now believed dead after they were swept overboard near the islands. one body was recovered, but four crew members are still missing. the survivors say the low-speed chase was hit broadside by a large wave which knocked some of the sailors into the sea. the boat later washed up on the rocks. the yacht club of tiburon will hold a moment of silence, one minute before the race begins at 6:25 tonight. 6:05. we now know a woman shot and killed by her estranged husband in petaluma unsuccessfully tried to get a restraining order on him one week before that killing. petaluma police had been called out to deal with kevin and kim

conover five times over the past year according to the chronicle. no one was ever arrested. police say kevin conover shot his wife and then turned the gun on himself on sunday as kim walked out of a divorce attorney's office. a woman accidentally shot and wounded by san francisco police officers suing the city. jessica from napa county was shot on broadway and north beach just last september. now police were apparently shooting at a suspect but hit another bystander. the city and several officers are named in the suit seeking unspecified damages. we're going to take you back live to sanford, florida, where george zimmerman is now in the courtroom this morning. you see him dressed in a suit and tie this morning. he is a man accused of killing trayvon martin, the unarmed teenager in florida. there's been so much attention on this case. we will continue to follow the proceedings as they are just starting to get underway this morning.

welcome back here. as a live look at the hearing underway right now in sanford, florida. this is the george zimmerman bail hearing. just getting underway a few minutes ago. george zimmerman, of course the man who admitted to shooting and killing 17-year-old trayvon martin back in february earlier this year. now this hearing is to decide if he will be released on bail while he awaits trial. currently zimmerman's wife is testifying via phone right now. we will continue to monitor this hearing and bring you the very latest. another army helicopter crash in afghanistan has claimed the lives of at least four soldiers. the military confirms that black hawk went down while on a mission in the southern helmand province. leaders in the area say the helicopter was on its way to respond to a suicide attack on

morning, "today in the bay." good morning, everybody. thanks for being with us. it's 6:31, i'm marla tellez in for john kelley today. >> and i'm laura garcia-cannon. and the latest developments new this morning as the hearing is getting underway right now in sanford, florida, to decide if murder suspect george zimmerman will be released on bail. zimmerman is in court this morning. there he is in a suit and tie. his wife was actually testifying by speakerphone this morning. she is not in the courtroom this morning for her own public safety. the court is deciding if george zimmerman is a flight risk if he's let out of custody during the trial. this all stems from george zimmerman admitting to killing 17-year-old trayvon martin who was unarmed teenager. happened in florida, there's been so much national attention regarding the case. so we are closely following it for you. we'll bring you the very latest

developments as the court proceedings go on this morning. it has been exactly five weeks since sierra lamar disappeared. and sheriff deputies are planning a massive search for the morgan hill teen. "today in the bay's" maryann favro is live in morgan hill where specialized teams will join the effort this weekend. good morning. >> reporter: good morning. these are highly trained teams. 90 search and rescue members will be out here in morgan hill tomorrow. and they will also be scouring areas of gilroy and san martin. these deputies are coming from all over the bay area including marin county and san mateo county. what's new about the search? it's who was involved. men and women who are cross-trained to comb remote wilderness areas consider them the navy s.e.a.l.s of searchers. dogs trained to detect human remains will also join in the search efforts. and san francisco 49er player delaney walker will also be out at the search on saturday.

looking so good for mirkarimi. >> reporter: yeah, good morning to you, laura, and happy friday. ross mirkarimi has already suffered some legal setbacks in his effort to undo his suspension. yesterday, a judge didn't seem moved by the arguments at all. not even arguments to collect a salary while he fights this. so a final ruling isn't expected until a hearing ends a little later this morning. ed lee suspended him for what he saw as misconduct after an incident with his wife ileana lopez after the family went out for a pizza. there were domestic violence charges and a plea deal. mirkarimi has been telling his side of the story and hoping to show the judge the mayor may have overstepped his bounds by suspending him and there's the issue of timing that at the time of the incident he wasn't even sworn in. the city's attorney's office has a much different take on the whole thing. >> you know, i think there are very serious issues regarding sheriff mirkarimi's conduct that

he's going to have to answer for before the ethics commission board of supervisors and i don't think the court is going to decide that process cannot continue. i think the court's going to see the need for it. >> reporter: now that ethics commission hearing on the misconduct charges is expected on monday. what they're going to do is look at the facts and make a recommendation to the board of supervisors who will then decide whether or not to remove him from office. reporting live in san francisco, christie smith, "today in the bay." 6:35, pg&e facing fines for safety lapses in the east bay. upholding almost $17 million in penalties against the utility for failing to inspect contra costa county pipelines for gas leaks. they have agreed to pay a separate $3 million fine for problems with its recordkeeping. now, this is the first time the cpuc has been able to penalize without seeking approval first

from the full safety commission. the department was given more power to crack down in december more than a year after eight people were killed, 38 homes destroyed by that pipeline explosion in san bruno. this morning, oakland city attorneys will be back in court cracking down on motels accused of being hot beds of prostitution and child sex trafficking. city is suing to shut down the economy in near lake merritt and the national lodge on international boulevard. last october, alameda county superior court judge ordered injunctions against both motels requiring the owners to install security cameras so that police can monitor those properties. the city attorney now wants them closed for at least a year. a san francisco woman is facing charges because she did not give up her parking spot without a bite literally. police say two drivers had their eye on the same spot in the bay view tuesday night. one car swooped into the spot angering the other driver. well, a fight broke out and police say the woman in the car

that didn't get the spot reportedly bit the other woman several times. she was arrested for aggravated assault. a plan to make parking structures safer is stalling in san francisco. could take months until the board of supervisors approves the bill requiring parking lots near nightclubs to get yearly permits. they would also have to have a security plan and employee on the site until 3:00 in the morning. the city's public safety committee is considering the bill before sending it to the full board. good morning to you, christina loren tracking a very warm forecast for the weekend. good morning. >> yeah, good morning, and then we're tracking rain next week. so we continue to take you through this wild spring weather right here in the bay area. 57 degrees right now in san francisco. yes, you do not need that jacket. if you can take the upper 50s. we're headed toward the upper 70s by noon today. we're going to crank up the heat by about 5 to 8 degrees from yesterday's highs. tomorrow, even warmer. tomorrow looks like the warmest in the extended period when the 90s return.

we haven't seen the 90s for almost six months. so make sure you're ready for that. ahead, rain on the way. i'll get to that when we get to my seven-day forecast in the next report. but first, let's break it down. at noon 79 degrees inland, 60 by the bay and 70 at the coast. rounding out the day with the mid-80s. 4:00 p.m., you've got to work for the weekend before you can enjoy it. let's talk to mike about what your drive holds. >> yeah, it's going to hold on slowing going across the san mateo bridge. friday, a lighter volume of traffic. this is the westbound direction away from us, but notice the sign over on the left-hand side as you travel from the hayward side to foster city alerting you about an accident. we now hear that the left lane has reopened but two lanes are still blocked as you're approaching the incline regardless of what that sign says, that's the latest from chp. involving one big rig and the coast guard's been notified because the fuel reportedly leaking into the bay now because there's going to be some sheen. may be telling the big rig to use the right lane across the 92. the dumbarton bridge stays clear

"today in the bay's" maryann favro live where yet another search is planned for tomorrow. good morning. >> reporter: good morning, laura. well, deputies will be out here today. searching for sierra lamar and following up on new tips that have been phoned in. but they're also gearing up for a massive search tomorrow that will last from 9:00 in the morning until sunset. a total of 90 search and rescue members from santa clara county, san mateo county, santa cruz, and marin counties will comb areas of morgan hill, gil rroyg and san martin. specifically trained to scour some of the rough esther rain

and dogs trained to detect human remains will also be out here. in another development, sheriff deputies confirmed sierra lamar's twitter account was hacked several times in the past two weeks. investigators traced one incident to someone in the philippines and have leads on another hacking incident. volunteers from the community also plan to hold their own search this saturday and sunday. volunteers will meet here at burnett elementary school in morgan hill. reporting live in morgan hill, maryann favro, "today in the bay." a critical hearing underway in hours set for ross mirkarimi. back in court asking that allegations of official misconduct against him be thrown out. "today in the bay's" christie smith is live in san francisco where the judge has already tipped his hand. good morning, christie. >> reporter: good morning to you, marla. and happy friday. ross mirkarimi has already suffered some legal setbacks in his efforts to get that suspension thrown out.

a judge hasn't seen moves at all by what he's heard so far by attorneys. mirkarimi heads back to court today for a final ruling. he wants to undo the misconduct suspension and get a salary while he fights this. mirkarimi suspended without pay by ed lee following an incident new year's eve day with his wife ileana lopez. she ended up with a bruised arm over domestic violence charges, a plea deal, and sentencing. since then, he's been out telling his side of the story and fighting to regain his job as san francisco sheriff. >> all i can tell you is that i've taken responsibility for what has occurred and being held accountable for it now. and that has already been adjudicated. >> on monday he faces an ethics commission hearing. what they'll do is look at the facts and make a recommendation to the board of supervisors who then decide whether or not he'll be able to keep his job. reporting live in san francisco, christie smith, "today in the bay." this morning, we know the name of a father killed while

pushing his young son in a stroller. 24-year-old tyrell smith died wednesday when a gunman approached him on foot and shot him in the head in broad daylight. the child was not hurt. detectives went door-to-door in the oakland neighborhood wednesday asking if anyone saw anything. friends say smith was a stay at home father who doted on his young boy. a large turnout for the funeral of a sheriff's deputy killed in modesto. robert paris and a lock smith were shot to death while serving an eviction notice last week. police say the tenant barricaded himself inside the apartment and held police in a standoff for several hours before shooting himself. paris was a 16-year veteran of the department and survived by two adult children. more than 2,000 officers are expected for the funeral. a north bay yacht club will dedicate tonight's race to five crew members now believed dead after they were swept overboard.

one body was recovered, but four crew members are still missing. the survivors say the low-speed chase was hit broadside by a large wave which knocked some of the sailors into the sea. the boat later washed up on the rocks from the east side. the yacht club of tiburon will hold a moment of silence one minute before the race begins at 6:25 tonight. the skyline could be changing in menlo park. new changes to transform the downtown and el camino real corridor. these are some of the before and after pictures of the proposed changes. the plans include more than 600 new homes, buildings up to five stories high, shops, restaurants, and office space. the planning commission is set to review an environmental impact report on the project at the end of the month before passing it on to the city council. well, nasa is opening what could be the greenest building on the planet since silicon valley today. the new building at moffett field uses repurposed nasa technology to react in realtime
