commission hearing. christie, good morning. >> reporter: good morning to you, marla. well, ross mirkarimi tried to get this resolved in the courtroom to get his job back as san francisco sheriff. but a judge didn't agree with the arguments he was presenting. so now the whole thing heads here to san francisco city hall where it will go before an ethics commission, which will begin by trying to figure out the whole process and protocol for this hearing that starts at 4:30 this afternoon. mirkarimi was only sworn in in early january days after an altercation with his wife. he pleaded guilty to a domestic violence intervention class. but ed lee stepped in to suspend him without pay. the plan initially calls for written briefs from both sides and then later it could include testimony for the whole thing could take weeks. earlier, mirkarimi's attorney told us it seems kind of vague. >> you could have this ethics commission composed of these

particular members, decide these are the rules we're going to play by for this hearing. five years down the road, in separate removal proceedings for somebody else, it could be complete lip different rules. that just shows you there are no standards for this proceeding and that it's fundamentally unfair. >> now, the commission is made up of five members. it sends its recommendation to the board of supervisors who will then decide if mirkarimi will keep his job. 9 out of 11 members would have to agree. reporting live in san francisco, christie smith, "today in the bay." new this morning, a very brave gas station employee going above and beyond the call of duty wrestling away a gun from a would be robber. police say just before 10:00 last night, a woman walked into the station near the coliseum and witnesses say she pointed a gun at the cashier and said give me your money and threatened to shoot. a customer who doesn't want to be identified says the employee

grabbed the woman, forced her out the door and managed to grab the gun in the process. the suspect took off. >> he's very brave. i felt he was an angel sent. i've never been in that type of situation before. i thank god he did what he did. >> and this morning, police right now on the lookout for that suspect. we are told, fortunately, nobody was hurt. new this morning, a horrifying accident overnight in the east bay. but incredibly the driver's going to jail, not to the hospital. take a look at this video coming into our newsroom. an suv slamming into a concrete divider on southbound 880 in oakland near the broadway exit. happened about 3:00 this morning. and as you can see here, burst into flames. it came very close to tumbling off the highway and down a 40-foot drop. now here's the thing, can you believe it? the driver was only slightly hurt. he told police he was cut off by another driver. no other cars were involved, and the driver is being held on

suspicion of drunk driving charges. just a few hours from now, students returning to classes at oikos university in oakland. if you recall, it was three weeks ago today a gunman went on a rampage killing six students and a staffer on the campus. details on wihy some students won't be back. >> reporter: good morning, john. there are plenty of reminders as we push into the front entrance, there's still plenty of bouquets of flowers, wreaths, memorial banners, paying tribute to the victims. not all students are coming back to this campus. one student who survived after being shot in the arm, she told a local newspaper she was not going to return to class. if she had to be back in this building. one goh allegedly shot and killed six students and one staff member. a neuropsychologist who specializes in treating trauma says most of the 100 students

have been suffering some level of post-traumatic stress by replaying the events of that day over and over again. >> the bottom line is they have to move on and make new associations with that university. and the more time that's put between the shooting and their new associations, the more comfortable they're likely to feel. >> again, it's only been three weeks since that shooting. the president of oikos says there should be a bigger group of students coming back here to the campus tomorrow morning for an open house type of event. once again, though, we are not talking about the nursing students. they are set to go to fremont's unitech college campus to resume classes there. as for the suspect, he may enter a plea as early as april 30th. it's 5:05, pg & e is fighting a lawsuit by the survivors of the explosions of a payout that could reach billions

of dollars. hundreds have sued the utility since the september 2010 explosion. they're seeking punitive damages in addition to millions -- the blast was accidental and argued there is no evidence of the wrong doing required for punitive damages. the civil trial is set for july. a memo shows the pipeline had a history of bad wells. the recently uncovered document detailed an investigation into a 1988 leak miles south of the blast. the leak was likely caused by a defective seam weld, the same problem that contributed to the san bruno explosion. pg & e says they were not definitive and did not require to test the entire pipeline. it is 5:06 right now. one of the nation's largest grocery chains taking a hit at the register.

safeway facing several challenges. a declining stock value brought on by increased competition and a recent talk of a takeover. the company also at odds with the union over a labor deal. safeway the second largest super market chain in north america. and despite the recent problems, it took in more than $43 billion in sales last year alone. could you take the heat this weekend? it was hot. >> i enjoyed the heat. >> me too. meteorologist christina loren tracked in some rain in the bay area. >> we're getting another roller coaster ride. you won't need that heavy jacket in places like livermore and sunnyvale. as we head throughout the day today, we're slated to hit the 70s. another nice warm afternoon. a little bit of fog out there with preventing the fog from really settling in are the gusty winds still coming down. as we head throughout the day today, we'll see the winds start to drop off a little bit. but overall, that's what's keeping the fog from forming. once you lose that wind this morning, it could become a

problem. mike and i have our eyes peeled. the rain is slated to return this week and we're expecting quite a bit of it. we'll talk about when that's slated to arrive. as you can see here, another gorgeous day. 69 degrees at 4:00 p.m. inland, by the bay, 65, touch cooler at the coast today, 4:00 p.m., 63 degrees. your seven-day forecast in my next report. let's check that drive on monday. >> we're going to check on that disabled vehicle we heard about just off that richmond bridge. well, it's eastbound 580, the marina bay parkway off ramp. updates from chp as they arrive, it is the off ramp as the lane blocked by this. the other lane is open. traffic flows smooth on to the bridge. further south, this is the car fire. yeah, the car fire is out southbound 880 right around broadway or 7th. guardrail damage, likely later on in the day, there may be crews out there to do the repair work. keep that in mind, but a smooth drive so far as that has

revolution could have serious effects on europe's recovery. >> who would've ever thought we'd be following french politics so closely. europe is america's biggest trading partner. it's in extreme danger of major recession. and the decision french voters make will have a real effect on the country, the continent, and eventually perhaps even us. president nicholas sarkozy did not get enough votes over the weekend to prevent a runoff. it's possible he'll lose to this man. holla holland. holland rejects most of the plan put in place by germany and france to save the european economy. france and germany have been pushing their neighbors for austerity. cut programs, reduce pension, and it's pretty clear if sarkozy loses in france, that plan will collapse and then you have france and germany on opposite sides of a major issue. also over the weekend, the international monetary fond and the world bank pledged hundreds of billions of more euros in support of europe if europe continues on that path of

austerity. there is concern that spain could face bankruptcy and there are not enough euros in the bank to bail that country out. meanwhile, here in america, for news before the bell, let's talk to jackie from cnbc world headquarters. good morning, jackie. >> good morning to you, scott. well, the futures are down sharply this morning. following some disappointing economic data out of europe. manufacturing activity is slowing down across the pond, which is renewing recession fears over here. european and asian markets are in the red today. there's no economic data today in the u.s., but it's a busy week ahead with reports on housing, consumer confidence, and first quarter gdp. also a heavy week for earnings. all set to report. on friday, we saw the dow closing up 65 points to 13,029, snapping the two-week losing streak, the nasdaq falling seven points to 3,000. meantime, companies may be ready to step up hiring. a new survey finding that 39% are expecting hiring to pick up

in the next six months, that's up from 27% feeling that way in january. higher demand for workers may also lead to bigger paychecks. 44% of companies say that wages are rising. but the class of 2012, however, may have a harder time getting a job than they expected. government data showing that half of young college grads are unemployed or under employed. there's strong demand in science, education, and health, but not arts and humanities. average wages for bachelor degrees are down in the past decade. that's a mixture of good news and bad news there. guys, back over to you. >> thank you much. and also john and marla, a new ipo to talk about. netflix is going to report after the bell. we'll talk about that coming up. >> another ipo. all right. >> that time of year, isn't it spring has sprung in the tech and business market. >> was this one of the warmest weekends in a while? >> saturday was the hottest day of the year so far. >> and we spent part of it together. >> yes, we did, marla and i were dancing.

wait till i post that video, marla. it's going up. 57 in oakland, 59 in sunnyvale, good morning to you. you're waking up, getting ready for the new week. trying to pick out an outfit for today. think spring today, think spring tomorrow, then you're going to think winter as we head through wednesday and thursday. a mean system on the way. especially when you consider the fact it's going to bring our temperatures back into the 50s right by the bay. cooler weather on the way. you'll get two days of 70s before we hit that cooler weather. wind out of the west/southwest at 22 miles per hour in fairfield. what's happening is high pressure that kept our forecast nice and sunny over the weekend is now moving off to the east allowing for more of that onshore flow. that's what cooled us off yesterday. we had the low clouds hugging the coast. today, marine layer's going to push inland. we're going to be about 5 to 8 degrees cooler than we were yesterday. and the showers arrive. a little bit of activity tomorrow morning at 5:00 a.m. we're not expecting the bulk of the moisture from the next system to push through until

our camera man -- won't let me out of the road here. the volume picks up just a tad bit, these folks making their way at the onramp with no metering lights. southbound side, very light volume by the tully road. smooth drive continuing along the lower bay shore. dumbarton, no overnight construction, and 192, nice smooth drive, as well. watch the high-rise here and may be gusts of winds from time to time. bay bridge has a wind advisory. and that is a possibility. over on the other side of the bay, a smooth drive northbound, 880, picking up the volume a bit in both directions. southbound, no problems, and smooth coming off of that castro valley y. >> thank you, mike. 5:18 now. welcome news for drivers today. gas prices are dropping. nationally, prices fell more than 5 cents a gallon over the past two weeks according to the

san jose, a little traffic flowing out there. mike will tell us about the roads, christina will fill you in on the skies and the weather, it's 5:22. i'm sure you've heard, do you have a case of the mondays. how about the cubical blues. why not try walking while you work at your desk. there's growing trend to get office workers up and at them. blue cross in boston has several walk stations, basically treadmills with computers and phones. workers can sign up for one-hour shifts. blue cross says the employees are more productive, engaged, and active. >> we are seeing people walking up and down the stairwells and not taking the elevator much more so than they have in the past. >> those of you wondering if this is really necessary, consider this, in 1960, almost half of all american jobs required some sort of moderate physical activity. today, it's less than 20%. >> we've got a little treadmill under here so my feet are

working. research done by walgreens shows nearly half of adults are unaware of recommended vaccines for their age groups. seniors should get a pneumonia vaccine, chickenpox could return in a form of painful shingles. there is medication to help reduce its severity. whooping cough on the rise due to parents not receiving the necessary booster shots. and people should also get diphtheria and tetanus shots every ten years. 5:23. good morning to you. it was a little bit too warm for me to run outside. i was on a treadmill this weekend. >> is that right? >> yeah, it's too hot. >> i like the way -- >> you know it's hot when marla's on a treadmill. that's my barometer. she's right, though. she's smart because anybody who did spend any duration of time outdoors, you were actually subjected to potential heat exhaustion. it was warm enough for that around the weekend. and temperatures really came down yesterday from the highs on saturday. we broke records across the bay

area. yesterday's highs, low 80s, today we're talking about the low to mid-70s. and this morning, starting out nice and mild. we do have a bit of a windchill factor out there because in addition to the cool conditions, winds are sustained at 22 miles per hour in fairfield. so winds will be a factor this morning and this afternoon. calming down by this evening. highs today, 75 degrees in livermore, 72 for san jose and 64 degrees in san francisco where you'll have cloudy conditions for the most part today. that marine layer is back. i'll let you know when you'll be breaking out that umbrella how many days this week you'll be using it. that's your clue. let's check your drive with mike. >> we'll look at the south bay again. couple of things to point out. we have blips showing up with the yellow. speeds dipping down below 40. that's likely an adjustment as more cars hit the roadway and it's taking time to recalculate. we'll track those issues. this debris southbound or whatever hazard was there, southbound 17 at hamilton has

cleared. we'll get you a live look at the san mateo bridge. a smooth drive here and no wind advisories set for this bridge itself. but watch the high-rise. i just decided to take a look at the cameras since we talked about it and it is holding steady with an easy drive, as well, guys. back to you. >> thanks. well, experts now say a bright light and loud explosion that rattled parts of california and nevada were likely caused by a meteor shower. the sound of a loud boom yesterday morning prompted a flood of calls to 911. the explosion rattled windows and shook homes from sacramento to bakersfield. some people even reported seeing a fire ball streak across the sky at the same time. >> there was just a really low rumble that started getting louder and louder and louder like a rocket taking off, then it finally started shaking the house and everything. >> probably scares chickens too. >> yeah, what was that? >> i think it was roosters. >> experts say the meteor likely broke up above earth somewhere over the sierra southwest of reno.

more on the changes on campus that students can expect. stephanie, good morning. >> reporter: marla, good morning to you. not all the students will be coming back here to the oakland campus. the nursing students are headed to a fremont campus that really when we're here we can't really imagine how the students are feeling. those who are headed back here. you see there are still flowers, memorial banners. even the pictures of the seven people, six students and one staff member who lost their lives here just a little over three weeks ago. now, the school president says that classes do resume today adding that there may be a bigger group of students here tomorrow for an open house type of event. back in this building where former student one goh shot and killed seven people. we spoke with a neuropsychologist who says it's likely the majority of the 100 or so students have been suffering some level of post-traumatic stress. >> it's a terrible tragedy. this man is now locked up. it's not likely to happen again,

but it's not expected to be very dramatic, at least in the start. instead, the commission will begin by trying to figure out the whole process and protocol for this. there was only one other misconduct hearing that they handled, and that was in 2007 for former supervisor, and that wasn't completed because he resigned after the opening session. he was convicted of extorting bribes. ed lee suspended mirkarimi without pay after he pleaded guilty to a misdemeanor count of unlawful imprisonment for an altercation he had with his wife. this hearing allows the city opening briefs with evidence coming a week later and then mirkari mirkarimi's response will come two weeks later and then the city has a chance to reply to that. the tentative plan calls for written briefs and then possibly witnesses and testimony. the commission, what they do is look at all the facts here and then they make a recommendation to the board of supervisors who will ultimately decide whether

or not he gets to keep his job. reporting live in san francisco, "today in the bay." a man fighting for his life after a home invasion/robbery attempt over the weekend. two armed men entered a house on donna maria way near west 3rd street on friday night demanding money and marijuana. and during that struggle, the 23-year-old resident was shot and critically injured. both robbers got away. a reward right now is being offered for information leading to an arrest. occupy protesters threatening to shut down the golden gate bridge next month. the unions planning to picket may 1st to protest contract negotiations with the bridge district. if any of those unions do go on strike, the occupy movement says it will shut down the bridge in a show of solidarity. the bridge district is already warning commuters that could lead to some serious traffic delays. 5:33, a very warm weekend is prompting a reminder for pet owners. the spca is asking people not to leave their animals inside

locked cars. they say an open window or parking in the shade is not enough to prevent the possibility of brain damage and heatstroke. the best advice if you find your pet suffering from the excessive heat is apply cold water or ice packs to the animal's head and body. >> christina loren, a big-time animal advocate. she is i'm sure onboard helping out those furry little friends. >> yeah, always got to think of them this time of year. and not because of the heat. you don't want to leave them in the car obviously, but it's also pet season as it gets warmer. you know you've got to prevent those illnesses. so make sure you get the medicine. 57 degrees in oakland, it's warm enough out there already for a nice spring-like day to develop. even though we're going to have mostly cloudy conditions today, sun will be limited just about all day long. but it's starting out so mild out there. and enough breaks within those clouds to warm us up to 64 degrees by noon and 69 degrees at 4:00 p.m. holding on to the mid-60s by the

bay at 4:00 p.m. tomorrow, dropping off to the low 60s. and then as we head through the midsection of the week, we have rain on the way. we'll time out that system coming up. first, let's check your drive. >> we'll check on that again, but i want to show you highway 4. usually the suspect where we check the first slowing in the bay. speeds below 20 right around g street, "l" registering 30. and towards bay point with no slowing once you get there all the way through concord, smooth for 680. 580, slows even further now as you're coming out of the altamont pass in toward livermore and slowing continues toward north flynn, a 16-minute drive and slowing at the dublin interchange, as well in the westbound commute direction. no problems through castro valley. a little blip shows up here and there from time to time for 238. smooth drive in the south to the san mateo bridge for 880. and north, we have a nice drive through oakland, as well.

expected to testify. edwards right now facing six criminal charges. and if convicted of them all, he faces up to 30 years in prison and more than $1 million in fines. well, the trial this morning of neighborhood watch volunteer george zimmerman charged with killing 17-year-old trayvon martin, the neighborhood watch volunteer is out of jail. george zimmerman posted $150,000 bail and was then released just before midnight. zimmerman's current location being kept a secret for his safety. as condition of his release, he's wearing a gps monitor device that has to check in with authorities every three days. and he cannot carry a gun. 5:40 now. this week, lawmakers in washington are expected to spar over a cyber security bill. the white house wants private companies to meet certain standards to prove their computer networks are protected from cyber crime. debate. good morning. >> reporter: yeah, marla, this is going to come as a shock, another controversy, another reason for gridlock here on capitol hill. the focus is cyber security. and a bill coming up this week in the u.s. house. it is called the cyber intelligence sharing and protection act which would encourage companies to bolster their security and share information with the government. but would not make those disclosures mandatory. that would be mandatory if a senate bill passes. the senate bill sponsored by joe liberman of connecticut, an independent and susan collins of maine, a sort of moderate republican is being backed by the white house because it would mandate stronger security and more -- more cooperation with the department of homeland security in rebuffing cyber crimes. the idea here is the -- the white house says there is a very real threat right now. not just of cyber threat from

countries like china and russia, but also cyber terrorism. perhaps a tax on electrical grids or water supplies, so the white house says this is necessary. but republicans on the hill and in the house who say the last thing this economy needs right now, the last thing businesses want is another layer of responsibility reporting to uncle sam. marla? >> okay, brian. we'll have to see where this goes from here. thank you. in arizona, the search continues for a missing 6-year-old girl. a candle light vigil was held for the girl. she was last seen friday after being put to bed. her parents found her missing the following morning. police say they found a possible entry point in their home. congressional committees want to dig deeper into that secret service prostitution scandal. the senate homeland security committee wants to find out if what went on in colombia was an exception or pattern of

55 degrees in san jose as we head throughout the second half of the day, up to 68 degrees by noon in livermore and then we'll round out the day in the mid 70s in the warmest cities across the bay. as of tomorrow morning, we could be tracking some showers on the radar. we'll talk about when, how much rain we're expecting when the bulk of the moisture comes through when that storm system arrives. that's coming up in the next report. first let's check your drive at 5:55 with mike. northbound 101, just got reports of a stalled vehicle, a disabled vehicle i should say. a northbound 101 right around san antonio road and we have maybe your fast lane partially blocked. stay over to your right as you're passing northbound. the southbound side is fine coming out of palo alto. heading into the south bay, things are moving northbound. that's where it's building, the circle north of 680. the volume really picking up with those headlights northbound under that 680 interchange.
