showers creeping up from the south. so we typically see the showers starting in the north bay. that will not the case this morning. we are going to see the showers start something the south bay. gilroy, morgan hill, you will be first and here in san jose. we are expecting our first precipitation. by about 9:00 a.m. so we will continue to track these showers for you and let you now when the thunderstorms will arrive. and when we are going to clear out of here. we have a great looking weekend shaping up. first a check of the drive. >> boom, folks. we will take you for a look. wide shot of the maze just fine through the east bay. however, we are hearing about police activity. just got word of this. few minutes ago. 40th street at market street, christie smith from our team is heading out there to check out what's going on. again, police activity just not -- not too far from macarthur station. system just getting online and no delays reported there. we will track this as well as across the bay. disabled vehicle reported getting to the bay bridge. right there at interstate 80 where it splits from 101. st. paul but sounds like things are being moved to the shoulder. reminder, we showed thank you gold kuenn gate bridge at the top of the show.

that will be cut off from doyle drive all week and starting 8:00 p.m. friday, that will be closed on your first there. you can get there from highway 1. it will be really packed throughout the city of where the area -- avoid the area if you can. use the bay bridge into and out of san francisco if at all possible thank you very much. this morning, the local search for sierra lamar attracting national attention. america's most wanted is taping today's search. stephanie, good morning. >> good morning, jon. we are here at the search center where a volunteer should be getting here at about three hours for the usual weekly morning search. we are expecting to see a few new faces because according to the sierra lamar search team, "america's most wanted" will be filming here today. now the sierra case has been featured on the program a couple of times already but this would be the first time that the film crew was actually be here in person. spotlighting the case of the 15-year-old who has been missing for more than five weeks now.

we have had some other high-profile folks involved in the search including, of course, 49ers quarterback alex smith and his teammates who have been involved in these volunteer searches twice already. and, of course, mark klaas has played an integral role in the search. as for the investigation the sheriff's office says the crime lab has gotten some new leads from testing evidence but they are still not releasing any more details on senate. that announcement made over a week ago. so far more than 3,000 volunteers have already taken part in the searches and they are hopeful, of course, national attention will help boost this search. live in morgan hill this morning, "today in the bay." new this morning, missing 5-year-old boy in need of a heart transplant has been found safe. porter stone disappeared when his father, jeffrey stone, took him from a children's hospital in st. louis, missouri. investigators say that they left in the car with california

license plates and may have been headed to the east bay where jeffrey stone's mother lives investigators say that the boy was found with his father and grandmother in chicago early this morning. both were arrested. the boy appears to be fine. also new this morning, four people waking up safe and sound after a late night rescue in the south bay waters. two brothers and their two sons, ages 2 and 14, set out on a fishing trip around 4:00 yesterday afternoon. around 7:00, they decided to head home to discover their engine was dead. the boat became stuck in the mud near the marina off of highway 237. alameda firefighters tried to reach them by boat and then by raft. all the muddy waters out there forced a more unconventional approach. >> used a small board like some kind of board you can actually lay on. we had -- tied one end and we tied another end and we got the board to our raft, to our boat. and started -- exiting the

boat -- one at a time. >> fortunately the family reached the dry land around 11 cloak last night. more good news, nobody was hurt. 4:35. homicide investigation continues in san francisco this morning. police responded to a deadly shooting near is an. it happened just before 9:00 on the corner of plymouth avenue and fair lawn streets. the men were shot in the head and found on the sidewalk. he was rushed to a hospital and in very serious condition. police are asking anyone with information to call them. today we are getting a firsthand account of exactly what happened aboard a yacht that crashed on the fair lawn island. latitude 38.com survivor brian chong writes in detail about the crash that killed five of the eight people onboard. he says, quote, i have seen large waves before. this is unlike anything i have ever seen outside of big wave surf videos. he goes on to write a single thought races through my head -- this is going to be bad. he then adds, the best way to

describe the water in the zone is like a washing machine filled with boulders. the city of san bruno will ask residents what should be done about that gas pipeline that exploded back in 2010. that pipeline no longer active that destroyed but it is still running right underneath it. many say that it would be a relief to see it out of there and get it removed but that could take up to four months. the city right now considering another option that would keep that pipe in the ground and then just fill it with cement. residents, well, they have different opinions. >> very emotional issue to keep that pipe in our -- under our streets. not knowing it was there. >> pup is not going to be turned back on. be done with it. just one less intrusion. >> city council members decided last night to survey residents in that blast zone to get a better idea of how the majority feels. pg&e says whatever the city decides shareholders will be

covering the cost. change of plans for one of the nation's largest wireless providers. verizon is now reconsidering placing a cell tower next to evergreen elementary school in san jose. he's asking the city for more time to study other potential sites. the request could delay public ming scheduled for next month on verizon's project. some neighbors and parents are concerned over health and safety issues of the cell towers. >> san jose residents come this november deciding whether to raise the city's minimum wage. the county registrar voters say initiative started by sociology class at san jose staff qualified for the november 6 ballot. that initiative would raise the hourly minimum wage in san jose from $8 to $10. students and labor leaders gathering more than 36,000 signatures well above the required 19,000 to qualify for that ballot. good morning. 4:37. mild start to your wednesday. let's check the forecast with meteorologist christine loren.

>> good morning to you. we actually have rain on the way. we are not expecting a whole lot. let's start with your active doppler radar. showers coming down san jose. we will take you into the bay area as you can see mostly dry this morning. as we head throughout the day today we are going to see a few showers. if you live in the south bay you have a better chance of seeing the showers. than cities in nrth bay, along the peninsula, as the storm system is creeping up from the south. but tomorrow looks like we are all going to get wet with another system right on its heels. and this one is going to usher in colder weather along with it. 64 degrees at noon today. 65 at 4:00 p.m. shades of 5 to 8 degrees off of your highs from yesterday. as we head throughout the dane land temperatures on the warm side. you will need that jacket all day long by the bay and at the coast. your full forecast coming up in just a few minutes. 4:38 first. let's check your drive with mike. >> all right. folks out to -- highway 24. your commute direction westbound is fine. construction blocks all but one

lane eastbound. obviously there is no slowing in either direction. very late volume off that interchange as well. we will follow this as the morning continues. should be clearing out by about 5:00. eastbound highway 4 is closed now. off ramp. construction continues as you are traveling over into lafayette and -- antioch. noncommute direction. 65 westbound is moving just fine. overnight construction, again, tomorrow night including the westbound direction westbound reopened at 3:30 this morning. 680 southbound as you are heading down towards stone valley road, more construction going on. no major slowing. just a lane blocked southbound. tall -- a live look at 880 past the coliseum, construction crew hanging out around high street. getting set to move some of those cones that block the right lanes so far. and the off ramp at high street as well. we will follow this. there shouldn't be any major traffic breaks. back to you guy. >> okay, mike. thanks.

4:40 now. kfl's cell phone restrictions could apply into bicyclists as well. new bill in sacramento could fine cyclists $20 for riding their bikes while talking on a mobile device. the senator says the cyclists rule would supposed to be included in the 2008 legislation. that bans motorists from driving while using cell phones. but it was mistakenly left out in the drafting process. the bill is working its way through the state legislature and could reach the governor's desk later this year. my question is what if you ride a unicycle? >> i'm sure they don't want you to be on your cell phone. >> all right. it is 4:40 now. california lawmakers want to give the schools a brand-new way to raise money using school buses. we will tell you exactly how this one works. >> immigration reform takes center stage in the u.s. supreme court. the i sha the. mad cow disease discovered in the central valley. why health officials say it is

the bay bridge. traffic upper and lower moving slowly but keep in mind it is still very early. it is only 4:44. >> it is early. california's school districts are hoping to make a little extra cash by turning school buses into moveping billboards. lawmakers passed a law that would allow schools to generate revenue by selling advertising space on school buses. they are not actually sure how much money the advertisement was make. an anti-tax group cal tax it estimates ads to generate more than $30 million a year for school districts. the bill is scheduled to go before the senate education committee today. a huge day for apple. once again, that is boosting wall street this morning. that and the rest of your news before the bell let's turn it over to jackie deangelis live at cnbc world headquarters. good morning. >> good morning. the futures are higher this morning. as you said it could be due to

apple which reported second quarter profits nearly doubled crushing analysts forecasts as apple sold 35 million iphones in every corner of the globe. we saw apple shares jumping 7% in the after showers session last nature. stocks closed mostly higher yesterday on positive earnings from the likes of at&t, mmm and united tech jxactechnologies. the fed wrapping up the two-day policy meeting today as well with the decision expected at 12:30 p.m. eastern time. dow rose 74 points. closed at 13,001. nasdaq eight points to 2961. senate democrats are readying the bill to freeze interest rates on a popular student loan. the rate on is set to double to 7% in july. more than 7 million people currently have or had stafford loans. it is f the freeze is passed it would last a year. the fight is over how to pay for

your future cast for today. we can see sunshine the first part daft. the rain starts to move up. and you can see that there deep blue within the green. moderate rain on the way to san jose as you start to make your way home from work. you want to keep that in mind. we are not going see a lot of action from the system. it is the next system that comes through tomorrow. that could bring us maybe a half of an inch of rain in the north bay. not looking too significant or impressive when it comes to rainfall totals from this system or cool front behind it. nonetheless we will take whatever we can get. any drop in the bucket will help our deficit. 67 degrees at fremont today. 70 in redwood city. search-day outlook shows you by friday back in the 70s as we dry you out, warm you up and hit the 80s yet again as we head into this weekend. you want to keep that sunscreen handy. as we will have a rather high uv index sunday. back to you guy. >> thank you, christine. decision 2012 the field for november presidential election is all but certain this morning. as mitt romney sweeps five more site primaries.

romney claimed victories in pennsylvania, new york, connecticut, delaware, and rhode island. and he's fully embracing the status of presumptive nominees. romney says that president obama has failed on a host of economic measures and highlights the president's record. today is a big day for the summit supreme court. the court will hear arguments on arizona's controversial immigration law that allows police to check whether immigrants are legal. arizona claims that its crackdown does what the federal government didn't do. >> success story. you know. we still got the -- we stood for it. >> decision about somebody else's idea what the rule of law is, this is about somebody's idea of what will benefit them politically. >> if the court upholds arizona's law democrats say that they will introduce a bill that prevents states from enforcing their own rules. five other states followed arizona with similar laws. they are tied newspaper court pending this decision expected by the end of june. it is 4:50 now.

charges could be dropped for the american soldier in the crosshairs of the biggest leak of secret government files in u.s. history. a military judge ruling today on whether to dismiss all charge against army private first class bradley manning. his defense team has filed a motion saying the prosecution has been slow sharing information. prosecutors say that it takes time to gather up all the documents from various agencies. manning, of course, accused of leaking thousands of sensitive materials to anti-secrecy sites wikileaks. a gray whale tangled up in a fishing line is making its way here to the bay area. rescuers say the whale is expected to reach monterey sometime early this morning. and, yes, all tangled up in fishing line, rescuers have been just trying for days to free it. rescuers attached color eed buo keeping track of the moves it makes going north. we think the whale may be headed for alaska. actually big whale like that can
