garcia-cannon. >> one man is sent to the hospital. christie smith is live in oakland right now. she has all the latest what's happening out there. good morning, christie. >> good morning to you. as you said right now, oakland police have at least part of the street shut down on 40th as they are investigating a shooting that literally just happened. maybe 30 minutes ago. we are on 40th right above market. i spoke with one officer on scene who said that they are still trying to get details but got a call of shots fired, found a man down in the street. he was taken to the hospital. they are telling me at this point his condition is unknown. that this comes right after a triple shooting just last night. and the police chief coming out and saying that burglaries in the hill area, lot of residents concerned there, not related to crime prevention strategy going on in the flat lands. typically the mayor's 100th plan east and west oakland. still the most serious crimes, robberies, homicides up. 21% from last year. and the department is, of

course, down 150 officers from last year. i'm waiting to hear from an investigator that just arrived on scene. i can tell you that they are processing the scene. they are taking pictures. they are walking around looking for potential witnesses. as soon as i hear from them, i will let you know what they are h to say. that's the latest. reporting live in oakland, christie smith, "today in the bay." new this morning, 5-year-old boy in need of a heart transplant is now safe after being kidnapped from the st. louis hospital. officers say that porter stone found overnight in the you chicago area in the company of his father, jeffrey and his paternal grandmother. both are now in custody. the kidnapping triggered a nationwide amber alert and intense search was also focused on the bay area where the boy has relatives. the boy's parents have apparently been involved in a custody dispute. also this morning, a local search for sierra lamar now

going national. "america's most wanted" is taping today's search. lot of spotlight out there. >> reporter: absolutely. that's always been the hope to keep the momentum going. now, that information according to the sierra lamar search team, the numbers here, volunteers here coming to burnett elementary, search center, they have been going down, you know, in recent weeks as expected in these kinds of cases. the hope, though is that this major national attention here in person will keep that momentum going. the case of the missing 15 year old has been featured on "america's most wanted" before but this would be the first time film crews would be here in person. there have been a couple of big boosts already since sierra disappeared more than five weeks ago, including 49ers quarterback alex smith and his teammates who joined the volunteer searches here twice. mark klaas has played a big role and he did tell nbc bay area before that one of the biggest obstacles now would be keeping this case in the spotlight. the hope again is that

"america's most wanted" being here will help. as for the investigation the sheriff's office says the crime lab has new leads after testing evidence but has not released details on that. mo more,000 volunteers already coming here for the weekly searches and hope is they will see new faces this morning. also new this morning, four people waking up safe and sound today after a late night rescue in south bay waters. two brothers ages 2 and 4 set out on a shipping trip 4:00 yesterday afternoon. they decided to try to head home but discovered their engine was dead. the boat got stuck in mud near the marina off of highway 237. alameda county firefighters tried to reach them by boat. then they tried by raft. but all the muddy water out there forced a more unconventional approach. >> he used a small board like some kind of a board you can actually lay on.

we -- tied one end and tied another one and got dashboard to our raft or to our boat. >> the family did reach dry land at 11:00 last night better news, nobody was hurt including that little guy. >> the east bay second floor apartment is now peppered with bullet holes after a drive-by shooting in alameda. police say that someone fired more than a dozen times at a second floor apartment on buena vista avenue last night. the bay area news group reports the shooter drove up to the apartment building and called the victim out by name. that person appeared in the window and the shooter began firing. no one was hit. a crackdown is in the works on two fronts in the south bay against payday lenders. tonight san jose planning commission will consider a proposal to ban payday lenders from setting up shop in low-income neighborhoods. next week, santa clara county

supervisors will decide whether to make temporary ban on all move payday lending establishments permanent. payday loans can carry annual interest rates as high as 459%. >> talk about predator lending. that's out of control. 0:06. meteorologist christina loren joining us. she is right over here to tell us about what's happening today. >> we have a really good looking day shaping up. because we are going to get showers, we need that rain. but we are still forecasting the 70s in some cities. many inland cities, as a matter of fact. we will get to those numbers in just a minute. i want to point out how mild it is to start. we are in the upper 50s and low 60s just about everywhere. 60 in san mateo. headed towards the 70s in places like san jose, east bay. with showers on the way. creeping up from the south. right now the bay area is nice and dry. but we will have to see the showers start to move to the north. probably by about 11 cloak a.m. today and then -- we head throughout the evening hours we are expecting the bulk of the moisture to stay south of the golden gate bridge but still we have showers on the way, gilroy,

morgan hill, san jose. it all works out like this for today. mostly cloudy conditions. 64 degrees at noon inland. 65 at bay. 59 degrees at noon at the coast. probably need that jacket just about all day long. we have colder weather and more rain on the way for tomorrow. time that system out. let's check your drive first with mike. >> we will take you back out there. highway 24, down to one lane in the eastbound direction from basically central lafayette. no slowing. scheduled to 7:00, though. westbound direction walnut creek interchange moves very smoothly. 680 and 24 no problem. approaching the bay bridge, the brigitte self, there is an issue. you see that truck there. disabled truck reported on a lower deck. i just checked that with mark, operator there. we stopped the flashing lights heading towards the tunnel there. treasure island. we didn't see anything stopping. flow continued for the last few minutes. again, no lanes reported blocked but there is a stalled truck somewhere along the span.

welcome back. here is a live look all lit up. a clear start to your wednesday morning. we will check that forecast with christina loren in just a moment. 5:11. a powerful effort start bid students to raise san jose's minimum wage qualified important the november ballot. that will be november 6. the proposal would raise the hourly wage from $8 to $10. the initiative started as a project in the san jose state sociology class. late march, those students together with labor leaders and community groups submitted more than 36,000 students to registr registrar's office. scott mcgrew's immediate

reaction says somebody asked economic students what they think. scott, you rolled your eyes about this one. >> i did roll my eyes, yeah. the sociology students. economists thought if you raised the cost of labor, pay people, drive jobs away. makes sense. double the cost in my factory and i will use half the employees. but then someone took a closer look and found out economists were wrong. in fact, it was another economist who figured it out. michael wright usually has to think about the economy theoretically. what mute happen. but in the question of minimum wage the team had a perfect petri dish. san francisco. way back in 2003, san francisco became one of the few cities in the world to raise its minimum wage for all workers. not just city workers. above state and federal requirements. employers, restaurants, in

particular, warned paying people more would force them to lay off employees. that didn't happen. >> minimum wage increase, what happens is the workers stayed longer. than they otherwise would. and that means that the cost to the firm with all the turnover finding new workers and training them, the other workers, that those costs go down. minimum wage increase does not kill jobs. it kills job vacancies. the jobs that haven't been filled. >> the discovery by the institute for research on labor and employment at cal that everyone been futures from raising the minimum wage surprised even the economists themselves. >> since then the view of the mick professions changed quite a lot. recognizing that minimum wage need not reduce jobs.

despite that econ 101 language. and -- when i saw that in san francisco, i was surprised, too. >> you were right. lots of cities and counties set minimum wages for government workers and anyone doing business with the city only three cities in the united states have their own minimum wage that applies to everyone. san francisco, sante fe, and washington, d.c. then san jose would become the fourth. in other news, apple blew past estimates and announcing it sold a staggering 35 million iphones in the past quarter. jackie deangelis is live at cnbc headquarters with reaction. good morning, jackie. >> good morning. the futures are higher this morning. as you mentioned it could be due to apple which recorded that second quarter of profits nearly doubled. crushing the analysts' forecasts and selling the iphones in every corner of the globe. apple shares jumping 7% in after hours last night. overall, waits good day for stocks yesterday. closed mostly higher on positive

earnings from the likes of at&t and mmm and united technologies. we saw asian markets, european markets higher today and we are going to get data here in the states on demand for durable goods and earnings. just coming out from boeing, caterpillar, and eli lilly. the fed wrapping up the two-day policy meet thing afternoon with a decision expected at 12:30. the dow rose 74 points yesterday to close at 13,001. nasdaq slipping eight points to 2961. meantime the senate may vote today on a bill that could save the u.s. postal service from bankruptcy. measure would give the agency an $11 billion cash infusion but also makes it harder for the postal service to close thousands of underperforming post offices and end saturday delivery which it said it needs to do in order to become profitable again. more problems for the post office. >> thanks so much. we are going to take a look at that apple number. 35 million iphones sold in three months. >> i bought one myself. >> all right.

enough out there for that to be the case. i think if you live to the south of the golden gate bridge, you may actually hear thunder later this afternoon. low pressure starts to make its way onshore. for us, we are not going to see a whole lot of active weather until the second half of the day. right here in san jose. i don't think we will see any rain whatsoever until about 11:00 a.m. your futurecast, actually agrees. stop the clock on that futurecast. you can see a little bit of spotty activity starting to creep up from the south. looking more active towards about 4:00. stop that clock at 6:00 and you can see showers in san jose, fremont. and as we head throughout the rest of the day, that's about it. overnight we will dry out and then main cold front arrives as we head through tomorrow. that's what's going to bring rain to the greater bay area. maybe a half of an inch. whole lot even newspaper north bay. 70 in san jose. we are going to warm you up and dry out on friday. bring in the 80s back on saturday. sunday. we bring mike in right now. >> sunday, very nice.

we are looking over here. smooth drive through pittsburgh and bay point. over here we have some slowing already showing us 5:20. speeds jamming to the 50s through antioch. but eastbound we have that construction and the closure to somersville will pick up in the next ten minutes. there will be a lot of changes through antioch. i will track this for you. meanwhile as we move towards the bay bridge, we have a smooth drive through lafayette. highway 24 to the tunnel. approaching areas through the maze. slowing on the lower deck we had an earlier stalled truck reported there. that's the slowing shows up on the oakland side. seems like they are unrelated. still same area. get a live look at that -- live shot approaching the lower deck and smooth drive coming into the city. no major problem tlus the area. maps show you smooth drive down the peninsula and san mateo to san jose. an accident moved from the roadway. should be okay on the freeway. back to you. >> mike, thank you so much. it is 5:20.

we now know the punishment los angeles lakers power forward will receive for his aggression on the court. meadow world peace formerly known as ron artest has been suspended for seven games. you have seen it. hay threw that harsh elbow into the head of oklahoma city thunder player james hardin. hardin suffered a concussion. world peace says he was just celebrating a dunk. he will miss most of the first round of the playoffs and lose more than $300,000 in salary. i think that money should go to hardin. >> yeah, exactly. i'm sure hardin is making enough money and happy to have his head on his shoulders. former 49er known for his flash and drama now facing an assault charge. deion sanders cited for misdemeanor simple assault after an argument with his estranged wife. sanders tweeted his wife attacked him in their mansion. he posted a photo of his children filling out police reports. that photo was later removed.

the area north of the dublin interchange. 15-minimum drive now slowing into livermore. typical pattern as we approach 5:30. 5850 is smooth as well. no delays. blips showing up for 238 because more cars railroad r showing up there as well. no problems. back to you. in the east bay, a restaurant is now making headlines. not just with what's on the menu but actually with who is in the kitsch. the joint is called guest chef. every two weeks a different chef with his or her own menu comes into the fully finished restaurant. this is all part of a new business model which is roots in the pop-up restaurant movement. the guest chef program has been in place for five months now. the restaurant owner says that at first customers, well, they didn't know what to make of it all. but they gradually caught on to the good food from a bunch of good chefs. >> i like it. it is always new. >> that's very cool. >> keep going back. >> lunch, anybody? >> please. breakfast. 5:26 now.

man to the hospital. meantime, the crime scene has closed a busy street. christie smith is live in oakland with the latest. good morning. >> reporter: good morning to you, marla. i spoke with the sergeant on dewitt yea couple much minutes abo and said unfortunately the man who was shot here overnight has died. he was taken to highland hospital in oakland. after he was found down in the street. the major crime section is on the way here to come and take over what's now a homicide investigation. this is at 40th in west oakland above market. investigators say that there were so few people out at the time of the shooting, more than an hour ago, that they just don't have a lot to go on in terms of evidence. so it is -- unclear that they say if the shooter was on foot or in a car. that this comes after a triple shooting just last night. and oakland's police chief telling public safety committee that despite various crime prevention strategies, robberies, homicides, and

burglaries are up. about 21% this year. and he's looking at a number of ways to try to bolster the department including getting outside help. they are down about 150 officers from just two years ago. 911 response time now about 17 minutes. they are saying it is about 10 minutes longer than other cities this side. but now what you want to do is avoid the area. they are telling me that the eastbound direction of 40th will be closed probably for another three hours. reporting live in oakland, christie smith, "today in the bay." police are trying to track down the person that pulled the trigger shooting a man in the head near san francisco. it happened just before 9:00 last night on the corner of plymouth avenue and fairlawn street in the city's ocean view neighborhood. officers found the man lying in the sidewalk in a pool of blood. so far police have not released a description of the suspect. search for sierra lamar will soon be in the national

spotlight. we are hearing volunteer view crews will be joined by camera crews. >> reporter: first of all, good morning, jon. there's always hope at these weekly searches and maybe a little built more today. this morning, as we hear from the see air lamar search team that "america's most wanted" film crews will be here this morning to film these search efforts that start at 8:00 this morning. this would be the first time we have film crews here from the program in person. although, "america northeast wanted" already featured the sierra lamar case a couple of times this month. as mark klaas of klaas kids foundation told us before, the biggest obstacle as weeks go by without major public development in the case, it is keeping the momentum going. the hope is that "america's most wanted" cameras here in person would give the search another big boost. in addition to a couple of other highlights like 49ers quarterback alex smith and his teammates volunteering in two searches. more than 3,000 volunteers. it has been more than five weeks

since the 15-year-old disappeared. and over a week ago it was the sheriff's office that made an announcement that the crime lab does have some new leads after testing evidence. so investigators have not released the details on that just yet. anyone who wants to come here the search for this weekly wednesday morning starts at 8:00 here at burnett elementary. be sure to bring your rain gear out here. it just started sprinkling minutes ago. live in morgan hill this morn g morning. a first hand account what happened to the yacht that crashed. a survivor writes on the website latitude 38.com and very deta detailed writing about the crash that killed five crew members. he says, quote, i have seen large waves before but this is unlike anything i have ever seen outside big wave surf videos. he goes on to write, a single thought races through my head -- this is going to be bad. he adds the best way to describe the water in the zone is like a

washing machine filled with boulders. very pleasant start to the wednesday morning. would you agree? >> it is nice. feels good. >> right. meteorologist christina loren. >> we have showers just like steph new pointed out coming down in some parts of the bay area. if you live south of the golden gate bridge, you are fair game for those showers throughout the day. we are not expecting a whole lot of moisture. ing in fact, probably not even going to measure any precipitation. south bay, until maybe later tonight until 5:00 p.m. we could see a spot write shower or two make its way up from the south as we are seeing right now. as you can see, showers kind of falling apart as they make their way over the santa cruz mountains. we have a little bit of action here on 101 south san jose between morgan hill. you want to keep that in mind and travel cautiously. the good news is that we don't have that thick fog out there. that will keep things nice for the first part of the day. we are starting out mild. temperatures in the upper 50s and low 60s. easily hitting the mid 60s by noon inland and then we will round out the day with 7 ons at 3:00 m.m. as you make your way

home from work, 4:00, cooling you back down to 65. inland 62 by the bay. we will be at 61 degrees at the coast. we have more rain on the way for tomorrow morning. right in the heart of your morning drive. time out the next system and we will talk about how much rain you might just get overnight south bay. >> look at highway 40. start with construction eastbound closure has reopened just a minute ago. in the same few minutes we have the westbound commute direction dipping down below 20 where you see red approaching l street to all the way over. typical area and typical pattern there for a wednesday. we are looking at the closure. eastbound 40th street. police investigation after an overnight shooting. a person has died as a result of that situation. it is closed. you can use macarthur out of the area. that's another block south. that issue for 40th street. as we are getting a wider shot, approach to the bridge, not an issue for the freeways. earlier disabled truck cleared

from the lower deck of the bay brigitte self. live look shows you the golden gate bridge which is just fine now. clear view and no problems out of the north bay all the way down through the tunnel. reminder, of course, signs lit up round the bay area. closes friday starting at 8:00 p.m. avoid 101 on the approach towards the golden gate bridge all weekend if you can. you can walk. everybody else will be sitting in their cars. >> good advice, mike. thank you very much. there has been a change of plans for the nation's largest wireless providers. verizon now reconsidering placing a cell tower next to evergreen elementary school in san jose. it is now asking the city for more time to study other potential sites. the request could also delay a public meaning scheduled for next month on verizon's prj. some neighbors and parents are concerned over health and safety issues of these cell towers. one north bay city wants to clear the air by making it tougher to find a place to light up. san rafael leaders will meet tonight to talk about new anti-smoking proposals.
