did get an update from oakland police on the scene. unfortunately they are telling us that he has died at the hospital. at the same time, neighbors in this area are starting to wake up this morning. they are telling me they are completely surprised by this. that they were up and they say that they didn't hear anything. at least that's what's two women told me this morning. one man said he thought that he heard a few bangs last night. but he said he wasn't overly concerned about it. he didn't think it was gunfire. now major crime section of the oakland police department, they are on their way here to take overing the homicide investigation. there are four evidence markers out here on the street. we are on 40th at lusk near market. police tell me when they arrived overnight they found a man dead -- down in the street. he was taken to highland hospital by ambulance where he died this morning. so far they tell me that they have no witnesses. they don't know if the shooter was in a car or on foot. we have seen them taking pictures this morning and measurements. trying to talk with neighbors and as they wake up this

morning. this comes after a triple shooting in oakland last night. a very busy time for the small oakland police department. i also got an update from an officer here and he tells me that if you are in the area, you will at least want to avoid 40th for the next hour, hour and a half while they complete their investigation. reporting live in oakland, christie smith, "today in the bay." >> meantime over in san francisco, police there investigating a shooting near san francisco state. it all happened just before 9:00 last night. on the corner of plymouth after and fairlawn street in the ocean view neighborhood. officers found the man lying on the sidewalk in a pool of blood. the man was rushed to the hospital. so far police have not released a description of that suspect. >> 6:02. volunteer crews searching for sierra lamar will be joined by camera crews from "america east most wanted" today. today's search will be in the

national spotlight. they will be dealing with rain, it looks like. good morning. >> reporter: that's right, marla. get your umbrellas ready. check christina's forecast before you head over here. it was here the last time i heard from sierra's parents. it was the one-month mark since she disappeared april 16. they expressed most concern about keeping that momentum going. that was one of their biggest concerns. the hope is that the search efforts may be getting a big boost with news from sierra lamar's search team. camera crews from "america's most wanted" will be here in morgan hill filming. this would be the first time crews would be here in person. now it has been more than five weeks and still no major public development in the case. having "america's most wanted" here may give that much needed boost. similar to the spike in attention to the case when 49ers quarterback alex smith and teammates volunteered in the searches twice. there was also a boost with the lar marches announce ad $10,000 reward. thats was a couple of weeks ago.

as for the investigation, the sheriff's office announced oar a week ago the crime lab produced new leads after testing some evidence. they are still not releasing what those leads are. still that hasn't deterred volunteers. neither has wet weather like this. check the forecast. come prepared with rain gear and get here at 8:00 this morning if you want to help out. live in morgan hill this morning, "today in the bay." >> new this morning, a 5-year-old boy in need of a heart transplant is now safe after being kidnapped from a st. louis hospital. officers say that porter stone was found overnight in the chicago area in the company of his father, jeffrey. and paternal grandmother. both are in custody. the grandmother has an east bay address and police thought they could be headed for the bay area. the boy's parents have apparently been involved in a custody dispute. also new today, four people are waking up safe and sound after a late night rescue in south bay waters. two brothers and their two sons, ages 2 and 14, set out on a

fishing trip about 4:00 yesterday afternoon. around 7:00 they decided to head home but their engine died. the boat then got stuck in the mud off highway 2737. alameda county firefighters tried to reach them by boat. then by raft. but the muddy waters forced them more unconventional approach. >> use a small board like some kind of board you can actually lay on. we -- he tied one end and we tied another end and we got the board to our raft, to our boat. and exiting the boat one at a time. >> the family reached dry land about 11:00 last night. no one was hurt. an apartment is now peppered with bullet holes after a drive-by shooting in alameda. police say that people inside a car shot more than a dozen times at a second floor unit on buena vista avenue last night. the bay area news group reporting the shooter drove up though the building and then

called out a tenant's name. when he appeared at that window the shooter started firing. that tenant was not hit and the gunman got away. crackdown is in the works on two fronts in the south bay against payday lenders. tonight san jose's planning commission will consider a proposal to ban payday lenders from setting up shop in low-income neighborhoods. next week, santa clara county's supervisors will decide whether to make their temporary ban on all new payday lending establishments permanent. payday loans can carry annual interest rates as high as 459%. the u.s. supreme court today hearing arguments on arizona's controversial immigration law. that law allows police to check whether immigrants are here legally. arizona claims it did what the federal government wouldn't do. five other states have followed arizona with similar laws. we will have more on today's arguments coming up in a live report from washington. that will take place at 6:45. the rain has started to fall

in certain parts of the bay area. meteorologist christina loren. has that reached san francisco just yet? >> no. in fact, it probably won't reach san francisco until later on. take a look at this beautiful sunrise we are getting over the city by the bay. just spectacular this morning. this is what you get to drive to work under. gorgeous conditions. let's take you to the radar now and show you where we are getting heavy rain. 101 freeney gill sxroy san martin, morgan hill, watch out for slick conditions and showers just starting to develop over the past 15 minutes. we are getting a little bit of moisture through here. but most of the bay area is nice and dry. also want to point out san felipe road very, very slick now. showers have been coming down over the past 15 minutes or so. as we take you to the north, though, as you can see here, mostly dry over the greater bay area. so we are looking pretty good for today. if you go south of the golden gate bridge, best chance for showers. we are getting more activity as we head to the second half of the day. 64 degrees by noon today. inland up to 65. make your way home from work. time-out that system and another one right on its heels later to bring rain just about everywhere

thanks. 6:09. pipeline that blew apart neighborhood will stay innocent ground for now. the city council voting last night to survey residents on this matter before forcing pg&e to remove it. the pipeline has been decommissioned but it still runs under the crestmore neighborhood. some want it out and others say it will be too disruptive as the community struggles. it could take 4 1/2 months. filling the pipe with concrete would take three weeks. >> pipe is not going to be turned back on. let's fill and it be done with it. it is one less intrusion. >> city council members will survey the residents before determining what, if anything, you can do. pg&e says whatever is decided share holders will cover the cost. meanwhile the proposed closure of two schools in that area will be discussed again tonight. parents of students are fighting to save their schools saying the kids had been traumatized

enough. the school district is looking for ways to close an ever widening budget gap. a landmark san francisco restaurant now getting a second chance. sam woh is appealing the closure with the health department. the 100-year-old chinatown restaurant closed its doors last friday after being cited for countless health, fire and safety violations. yesterday's hearing, they were supported by dozens of customers who want that restaurant saved. the inside scoop reporting the owners are working with the health and fire department to try to make changes to reopen the restaurant. sam woh's was famous for a notoriously rude waiter and its weird building. customers have to enter through the kitchen and then they go upstairs to make it to the dining room. >> good. i can finally go check it out maybe. >> maybe you can take me with you. >> perhaps. there are new developments this morning following the discovery of mad cow disease in the central valley. find out which country is halting the u.s. beef imports next.

nice wednesday shaping up. >> we like it smooth on wednesday. thank you very much. san jose students have gotten their class project to raise the city's minimum wage on the november ballot. scott mcgrew says if it passes that means raises all around the city. >> yeah. that's exactly right. good morning. most city based minimum wage laws are only -- affect city workers or city contracts. but this ballot measure created by the sociologist students from san jose state university will affect the entire city of san jose from border to border. raising the minimum wage to $10. now, it used to be a -- economists used to think raising labor costs hurt businesses. it seems like common sense. but exhauhausexhaustisve shows raise money. >> when you have a minimum wage increase what happens is the workers stay longer than they otherwise would. and that means the that the cost to the firm with the turnover

hvrnlgts welcome back. it is 6:24. immigration takes center stage in the u.s. supreme court today. tracie potts is live in washington with more on the challenge to arizona's controversial approach. good morning. >> reporter: marla, good morning. the law they enacted two years ago that said that if immigrants are stopped on the street and can't prove their legal status, they can be detained. is that constitutional? that will now be in the hands of

the justices here at the u.s. supreme court. there has been a big debate over whether or not this profiling. arizona says that they are trying to crack down on the illegal immigration because the federal government won't. it is costing them millions of dollars. this is sure to be a political hot potato this year because president obama's administration jumped in and filed suit against arizona and the president had hoped for comprehensive reform. and it did not happen in the first term. at least not so far. political issue here on the hill as well. a hearing yesterday. republicans boycotted that hearing. calling this political side show. now if the court upholds this law, democrats say that they have a backup plan, a bill this would prevent states from enacting laws like this. >> okay. we will keep an eye on that. thank you very much. 6:25 now. we check in with meteorologist christina loren to find out -- i think we will get rain in certain areas. >> we are going to get some rain. in fact, we already have some

here. we have seen them looking at fences and they looked at the back tire of the truck there. trying to piece together what happened here. really taking a close look at the crime scene. there are four evidence markers in the middle of the street. also a shoo-in the street, we can see now it is daylight here at 40th. overnight police say that they got a call before 4:00 a.m. of a man down in the street but a sarge entells me sergeant tells me they have few witnesses. detectives are out here trying to talk to the witnesses that may have happened. neighbors told me they were surprised because they didn't hear anything, gunfire or any arguing. i got an update from an officer on scene and tells me that you will want to avoid the area for at least another hour while they con their investigation. roaring live in oakland, christie smith, "today in the bay." san francisco police are investigating a shooting near san francisco state. it happened just before 9:00

a note and demanded money and told everyone to drop to the ground saying he would blow things up. the police say the suspect held a knife to the throat of a pregnant woman after she told him she was pregnant and thanks to appeals from a crisis negotiator, the bank robber let the woman go. he's now in custody. everyone else is okay. charges could be dropped for the american soldier in the crosshairs of the biggest leak of secret government files in u.s. history. a military judge ruling today on whether to dismiss all charges against army private first class bradley manning. his defense team accusing the prosecution of being too slow to share information. prosecutors say that gathering documents from various agencies takes time. manning, of course, accused of leaking thousands of sensitive materials to the anti-secrecy site wikileaks. good morning. 6:35. meteorologist christina loren called it. depending where you are waking up with us today, it is raining

san francisco not getting hit just yet with rain. but christina loren says it is on its way. already falling in the south bay. your time is 6:41. >> new this morning, london investigators now say there is a chance that a british girl who vanished during the 2007 family vacation in portugal may, in fact, still be alive. madeleine mccann disappeared from a condo and resort while her parents dined nearby. she was just days away at that point from her 4th birthday. british police just releasing this new image of what she would actually look like today. that would be weeks before her 9th birthday. they say that they do have some new evidence and reason to be believe the girl could still be alive. portuguese police closing that case back in 2008 after various alleged sightings of the girl turned ed up nothing. the next story will make you smile. usually when a cow ends up at a drive-thru it is probably because it is on the menu but that's not the case here in colorado. check out this picture.

intersection of lusk and 40th streets after a man was found shot. christie smith joins us live from oakland with the latest. good morning. >> reporter: good morning. right now three homicide investigators from the oakland police department are walking the neighborhood, looking for witnesses, potential witnesses after man was shot in the street. and near a truck there. the one with the flat tire in the crime scene. here at 40th and lusk. a sergeant tells me they got a call of man that was shot taken to high land hospital where he died. because it was overnight police say that they just don't have a lot of witnesses, lot of details now. they don't know if the shooter was on foot or in a car. they are advising people to avoid the area on 40th eastbound for another 30 to 45 minutes. while they con their investigation. reporting live in oakland, christie smith, "today in the bay." >> in san francisco, police there are investigating a shooting near san francisco.

this happened just before 9:00 last night at plymouth avenue and farallones streets in the city's oceanview neighborhood. officers found the man lying on the sidewalk in a pool of blood. the man was rushed to the hospital. so far police have not released a description of the suspect. that local search for sierra lamar now drawing big-time national attention this morning. p volunteers are will be searching today and their crews will get an up close and personal spotlight from some camera crews. good morning. >> reporter: good morning. camera crews from "america's most wanted," our first volunteers just got here minutes ago at the search center and said they got the call the crews will be here around 8:00 this morning along with everyone else. perhaps getting much needed boost, the parents have been talking about. the crews are expected to get here in about an hour. the program has already featured the case twice this month already. but this will be the first time we have the cameras here in

earth day. one north bay city wants to clear the air by making it tougher to find a place to light up. san rafael leaders will meet tonight to talk about new anti-smoking proposals. they want to ban cigarette use in multiunit housing complexes. smoking would also be restricted at atm lines, bus stops, and outdoor dining areas. on the peninsula, classic bags get in the -- plastic bags get in the crosshairs. leader talking about a countywide ban. environmental impact study being done after the plastic bag industry filed legal challenges over san francisco's failure to do such a study. san mateo says the eir should be finished this summer. meantime, a hearing to get public input will be held tonight starting at 6:00 at the mountain view city hall. dogs could soon run free in park at one south bay city. lead verse a proposal that would allow dogs to be unleashed. the program will set designated

times of the day. the first in the series of public meetings will be held at lewis van meter elementary school. that begins tonight at 6:00. cal pot growers now want the same protection as farmers. but the legit malagriculture operation they are saying that not so fast. proposition d extends right to farm protections to protect marijuana growers. but farmers in lake county says pot operations should not be counted as agricultural. the measure will appear in this year's june 5 primary ballots. meantime, mendocino county looking to be one step ahead of the feds when it comes to the federal crackdown on medical marijuana. the da telling growers to tag their plants with sheriff issued zip ties indicating that they are sanctioned to grow operations or sanked to be growing operations. opponents are not convinced and do not like having to pay for the ties. and agree to inspections from the sheriff's department.
