name of this complex that caught fire this morning is the coyote creek condos on warfield way about a mile from 101 and tully. live pictures coming to you from our chopper high above to give you a bird's eye view of the damage. fire officials telling me the fire began in the underground garage just before 3:00 a.m. it spread to a four plex damaging two units, eight people inside, four were taken to the hospital, three with critical injuries. now, san jose police officer confirms to us one woman was pronounced dead onscene. a fire captain says the fire quickly turned from one to three alarms. >> the officer established that we had a rescue need so we ordered more resources, went to a second alarm then a third alarm and we also had more ambulances, a total of six ambulances arriving onscene.

and it was because of the fire department we didn't have a bunch of fatalities. >> reporter: the fire captain gave me the latest information a few minutes ago and tells me that arson investigators have arrived on scene, though he says there's no reason to believe that this was intentionally set. again, this started all in the underground garage, spread quickly to the four plex above damaging two units. now, fire engines are being released as we speak, but the fire captain tells me that you can expect fire crews to be out here for the next couple of hours. live in san jose this morning, i'm marla tellez, "today in the bay." on now to our other big story this morning, may day demonstrations being held across the bay area all day. >> we have team coverage. christie smith live in berkeley at one of many hospitals where nurses will picket. but first, bob redell where a strike has forced the cancellation of ferry service. bob? >> reporter: yes, the district decided to cancel this morning's

ferry service, golden gate ferry service in anticipation of the picketing that has just started up here at the san francisco ferry terminal. if you are trying to get from the north bay to the city by boat, you will have to make other plans. you can take the bridge, you can take the bus, those services are not being affected, and they will only be affected for the morning service. we'll start up again in the afternoon. you can see the picketers here in support of the union that represents the ferry workers, the bridge workers, and the bus drivers, and they're also going to be picketing at the terminal in sausalito, and protesting labor negotiations with the district going on over a year now. they don't think the management has been negotiating good faith. at issue are rising health care costs, wages, and pensions for new hires. now, the labor coalition representing the bridge, bus, and ferry workers say they've made over $2 million annual in concessions so far. the bridge district, say, hey, we've been negotiating good faith, as well, and our offer is fair and equitable and in line

with other contracts. both sides are supposed to start negotiating again sometime this weekend. ferry service will start up again at 2:15 this afternoon and again in sausalito at 1:55. as i mentioned, bridge and bus service is normal. so if you normally take the ferry, you can drive across the golden gate, try out the new doyle drive. you might have also heard that some occupy protesters are going to be trying to shut down the golden gate bridge. it's understanding, they have canceled that plan for today. reporting live here at the ferry terminal in san francisco, bob redell, "today in the bay." they will be cleaning up a mess in san francisco's mission district after mass vandals went on a rampage. protesters smashed windows, spray painted -- they shattered windows on valencia. about 100 people marching up mission are responsible for the damage.

>> i saw them just litter this place with egg bombs. they came up with -- well, we're missing one of our signs, which did most of the damage to this aston martin. they shattered everything they saw. one guy had a crowbar. >> vandals also damaged several cars. also part of today's may day events that will include pickets outside bay area hospitals where thousands of nurses will protest over contract negotiations. christie smith is live at oakland summit hospital with more on how this will exactly affect all the patients there. christie, good morning. >> reporter: good morning to you, jon. as they've done many times before, nurses are expected here basically any time now at the medical center in oakland. they'll bring their signs and then actually start picketing at 7:00 this morning. as you said, this is part of a contract dispute between the nurses and the sutter health system, a one-day strike that could involve up to 4,500 nurses at hospitals and places like

vallejo, antioch, berkeley. a summit spokesperson says as soon as they got word of this strike, they hired replacement nurses to keep the hospital running. though, some electives are being rescheduled. the union says two big sticking points are sick pay and potential cuts to benefits. it's the third strike in seven months. >> nurses never want to strike. this is -- this is a measure of last resort. and sutter health has put over 100 concessions on the negotiating table. and most of these concessions go to the heart of nurses being able to provide safe care. >> reporter: the summit here in oakland released a statement saying in part they certainly respect their nurses, but they're disappointed that a strike could not be avoided. they wanted to stress that they have nearly 500 replacement nurses ready to come in and take care of patients. reporting live in oakland, christie smith, "today in the

from san francisco looking pretty good today. it's going to be a little bit cool, right? at the coast with that coolant situated right over the city. 50 degrees now, struggling to break out of the 50s before noon. but you're still slated to hit the mid-60s in the city. we're talking about the upper 70s yet again in the south bay with a lot of sunshine coming in right after the bat. patchy fog right at the coast, little drizzle, as well. as we head throughout the day, we're talking about the 70s inland, upper 60s right by the water and then we've got the showers on the way thursday into friday. if you live north of the golden gate bridge, you've got a better chance of seeing the showers than we do here in the south bay. but still looking pretty good for a little bit of rain right here in the bay area later this week. noon today, 71 degrees inland, 75 degrees, touch cooler 72 degrees, cooler in places like oakland at 3:00 p.m. and coastal cities just reaching the mid-60s. all right. this is that time when the drive starts to heat up and we do have a couple of problem spots to point out, first through antioch, multi-vehicle crash here.

this is actually highway 4 past summersville road. and we know at least three vehicles are involved. you want to give yourself extra time, delays stacking up as we speak. stay to the right as the crash is on the left lane. let's take a live look at 880 where we don't have problems through the area. traffic here looking good in both directions. might be that time to hop on 880 as you can see here right past the coliseum, traffic looking good. both ways on a traffic tuesday. back to you, guys. here's a warning, christina. freeway closures will be in affect this week affecting those early birds getting on the road before 5:00 in the morning. caltrans shutting down 101 between marsh and willow roads so the crews can start demolishing the old ringwood avenue overcrossing. all northbound lanes will be closed in the area from 1:00 to 4:00 in the morning tomorrow. the number one and number two lanes in both directions will be closed tomorrow and thursday between 11:00 at night through 5:00 in the morning.

welcome back, everyone. it's 6:13 right now. the search for a missing teenager sierra lamar headed back to the water ways. the santa clara county sheriff's dive team is going to use sonar scanners again to check out several areas in south san jose. parkway lakes will be first checked and then on to anderson, coyote, and guadalupe reservoirs. there have also been five arrests indirectly related to the case. all are related to sex offender violations, not the actual disappearance of sierra lamar. this morning, a teenager accused of killing a high school football standout answering to charges in courts. 18-year-old abraham haid accused of stabbing to death this man, 18-year-old osana futi. he was at a house party in fremont on saturday night and

involved in an argument that ultimately led to the stabbing. now friends say he was just trying to get his life back together after a string of personal tragedies including the death of an uncle and the killing of his best friend. 6:14, concord city leaders want to put an end to copper wire theft. thieves have already cost the city more than $400,000 in repairs and additional security. tonight, the city council says it'll ask for the public's help in stopping the growing problem. thieves stole 25,000 feet from copper wire from six parks and one tennis court last year. a task force taking the first look at florida's stand your ground law today. trayvon martin's killing by george zimmerman forcing lawmakers to re-examine that law. it allows residents to legally use deadly force when they feel threatened. a 17-person task force will hear public testimony and then make recommendations to florida's governor and state legislature. today is the one-year anniversary of the capture and killing of osama bin laden.

there's still plenty of fallout about whether president obama made the right call. at the time, mitt romney called the decision ill-timed and ill-considered. now he says he wouldn't have blinked. without naming romney, president obama is challenging romney to explain. >> even jimmy carter would've given that order. >> if there are others who have said one thing and now suggest they'd do something else, then i'd go ahead and let them explain it. >> the obama team is taking heat for referencing bin laden's death in a campaign ad. they say it's a perfect example of strong leadership under pressure. romney's camp calls it a cheap political ploy. more than 100 people dead this morning in india after a ferry boat just capsizes. some 300 passengers were dumped right into a river when the boat flipped over and broke into pieces during a storm near bangladesh. 100 people have been rescued from the waters, but at least 100 more are still missing. rescue crews are searching right

now for survivors. there reportedly were no lifeboats or life jackets onboard. >> back here in the bay area. one of the bay area's first pot clubs have closed. the berkeley patients group was shut down for being too close to two schools. that's a violation of state and city laws. the pot club had been at its location for 13 years before the schools. the clinic has not found a new location. in an effort to try to crack down on crime, berkeley police teaming up and ramping up patrols on telegraph avenue. both the berkeley police department and university police will be out in telegraph's business district, people's park, and the surrounding areas. they'll also be on foot and they'll be patrolling on bikes six days a week mostly in the afternoons and in the evenings. once the color center of berkeley live telegraph avenue has fallen victim to crime and homelessness. residents held a brainstorming session to discuss ideas for

curbing the problem and revitalizing that area. authorities say they started the two-man patrols yesterday to address those concerns. starting today, you can buy some raisers tickets and help oakland public schools at the same time. the team is donating 10% of the sales price for all new season tickets. tickets will have to be paid in full between now and june 30th. they're giving back to the community, namely schools. >> enjoying baseball right now. >> exactly, as you should. giants doing their thing. 6:17 right now. let's check in with christina loren. >> yeah, they're back at home tonight, 7:15, taking on the marlins, should be nice ball weather out there. could see the winds come into play. right now, let's talk about what's happening out there. as we speak, a beautiful, beautiful look here embarcadero. we do have some ripples out there on the water courtesy of some winds which will pick up throughout the day today. but that cruise ship just docked. all those people getting ready

to enjoy some gorgeous weather here in the city. 50 in novato, 51 in concord. throughout this afternoon, we do have subtle changes. no real stark differences from yesterday. but you will notice a little bit more cloud cover this morning and that breeze will be a little bit stronger this afternoon. a short wave trough come through here, high pressure's moving back in quickly. the two work against each other, we have a pressure gradient that tightens up as a result and the winds pumping through the bay area as a result. but onshore winds bringing in that cool air from the pacific at least for the first part of the day. tomorrow, more cloud cover, a touch cooler. i want to show you what we're expecting in terms of your wind for today. stop the future clock at noon today as you can see, we'll start to get a little bit gustier right at the marin county coastline. we stop it again for you at 6:00 p.m., starting to really see the pinks, reds, and oranges come in. you look at the key, pretty strong winds coming in at the coastline. it'll be a little bit gusty here in san jose. you want to keep that in mind. winds picking up for the second half of the day. we have rain in the forecast.

bay area weather center. you can break out the short sleeves for today, but you'll need the umbrella later this week. we'll sort out your full forecast. and taking a beautiful live look outside for this tuesday, may 1st. this is "today in the bay." good morning, everybody. thank you for joining us, it's 6:30, i'm jon kelley. >> developing this morning, it is may day and labor unions are taking part in labor protests. right now that means no ferry service. bob redell is live to tell us more. we can hear the protesters out there, are we having trouble with bob's shot? >> reporter: there we go. sorry about that. the noise here, the picketers have started protesting outside of the ferry terminal golden gate ferry terminal. these are some workers representing the union that represents the ferry workers,

the bridge workers, and the bus drivers, and they're protesting labor negotiations. now the district knew that this was going to happen. so as a result, they did shut down ferry service for this morning's commute. so ferry service is shut down. if you have to get to the city, you of course have the golden gate bridge and the golden gate bridge bus service as your alternatives. they're suspending labor negotiations with the district for the past year. the workers are, of course, saying the district has not been issuing in good faith. they're trying to put the rising health care costs on them. they say that's wrong. wages and pensions for new hires are also at issue. the labor coalition representing these bridge, bus, and ferry workers say they've made over $2 million in annual concessions. the bridge district says they too have been negotiating in good faith and their offer is fair and equitable and in line with other contracts. both sides supposed to be getting together to negotiate again this weekend. so again, ferry service has shut

down for this morning, will start up again. as i mentioned, the bridge and bus service is normal, so you can still take the bridge, doyle drive as we all are well aware has been reopened. that happened yesterday morning. and there was the possibility the occupy oakland protesters were going to shut down the bridge, that plan has been canceled. reporting live here at the ferry terminal in san francisco, bob redell, "today in the bay." also this morning in san francisco, store owners and police dealing with a trail of destruction after a group of mass protesters went on a rampage down valencia street. windows broken, paint splattered over the police station. there are also stores that suffered broken windows out there, paint and eggs were thrown at many businesses set up. police were out in riot gear looking for vandals, but the damage was already done. one person reported arrested.

6:32. nurses for some of the bay area's busiest hospitals also heading to the picket lines this morning. more than 4,000 registered nurses at ten northern california hospitals operated by sutter health are expected to walk off their jobs as a part of a one-day strike. it's the third strike the nurse's union has waged against sutter in seven months. the major issue is sick pay and reductions in employee benefits. occupy oakland will also be a driving force during may day protests. those protests will start at 8:30 this morning and they will end around 3:30 this afternoon with a march from the b.a.r.t. station down to city hall where a rally is scheduled for 6:00 tonight. and also calling for a daytime work stoppage at the port of oakland. we'll of course have live continuing coverage throughout the entire day today on-air and online at nbcbayarea.com. stay with us throughout the

"today in the bay's" marla tellez live in san jose with the latest update. good morning. >> reporter: jon, good morning. i just spoke to a few people who escaped those flames here at the coyote creek condos on warfield way near 101. as you can imagine, they are pretty shook up. they live in the four-plex right next to the four-plex that caught fire. they say they saw the flames about 3:00 this morning. they called 911, they got out, now they haven't been allowed back inside yet, but they say they are certain their condo was damaged by smoke and water. now the worst is confirmed by a san jose police officer. he tells us one woman died on scene. she was rescued by firefighters who tried reviving her, but to

no avail. fire officials tell us seven to eight people were home at the time the four plex caught fire, four taken to the hospital, three with critical injuries. they say it all started in the underground garage. >> it was because of the fire department we didn't have a bunch of fatalities. awesome job by those guys. stressful situation, fire started in the garage and extended into the residence. >> reporter: now, the fire went from one to three alarms in about 20 minutes. crews knocked it down within an hour, they worked quickly. 2 of the 4 units suffered significant damage. arson investigators are out here surveying the property looking for a cause this morning. we're live in south san jose, marla tellez, "today in the bay." 6:35, this morning a key decision is due in the case of ross mirkarimi. a judge issued a tentative

ruling against the mayor's attempts to get mobile phone records from his former campaign manager. the mayor wants phone records as evidence that mirkarimi tried to dissuade witnesses in his domestic violence case. mirkarimi pleaded guilty to a misdemeanor charge stemming from the new year's day argument that left his wife's arm bruised. he's fighting official misconduct charges and the potential loss of his job. the judge's ruling is expected at a 9:30 hearing. it is 6:36 right now. we have a lot to get to as far as the weather and traffic. and we've got one lady to do it all, ms. christina loren. good morning. >> good morning and one great team behind me to help. we've got a good-looking day, mike needed the day off, he'll be back tomorrow. live look over alcatraz, we do have ripples here on the bay courtesy of some winds. it's a little choppy out on the bay. a nice day today, 52 in san jose, 51 in sunnyvale, we're going to get a lot of sunshine today. and then we'll get more of that filtered sunshine by about 3:00 p.m. those high cirrus clouds moving

well, we can tell you the fire's out at a condominium complex in san jose. unfortunately, one person was killed in that blaze. "today in the bay's" marla tellez live at the scene with the information. good morning. >> reporter: jon, good morning. the scene out here is just finally starting to clear, but fire officials tell me that wee can expect dozens of firefighters and crews to remain onscene for the next couple of hours. you can see the entrance is still blocked off by a san jose police officer. this is the coyote creek apartments near 101 and tully. here's the latest, the fire started in the garage beneath and behind the four-plex. it quickly spread to the residence. at one point, the flames shooting through the roof of that four-plex. in all, two units were damaged. now, a fire captain tells us three people are critically injured. a san jose police officer tells

us one woman died. >> so we've lost somebody this morning? >> that's correct. one, looks like an asian female in her 30s was evacuated from the apartment while the firefighters were attempting to extinguish the fire. and she was pronounced deceased. >> reporter: now the sergeant believes that woman died from smoke inhalation. we are waiting to confirm that with san jose fire. now right now arson investigators are onscene looking for a cause at this point. it is just still too early to determine a cause. now i should also say the call came in before 3:00. firefighters were able to knock it down within the hour. the fire captain on scene tells me they did notice the units were equipped with smoke detectors, so he's not sure if they worked properly this morning. we're live in south san jose this morning, "today in the bay." more than a dozen people

hurt after a large fire at a half way house in watsonville. fire broke out monday night. flames spread so fast, several of the residents had to jump from the second-story windows. 11 of the people living there had to be taken to local hospitals to be treated for various injuries and smoke inhalati inhalation. and how about this? delta going through extreme measures to try and cut down on fuel costs. the airline buying this refinery near philadelphia from conocophillips. the goal is to try to lower their fuel bill. it's the biggest expense costing more than $300 million a year. the refinery will continue to rep fine gasoline as well as jet fuel. it's going to be a really nice day out there, finally feels like spring, and it's sticking around for a while. >> yeah, it's going to be nice for the fine refineries today. gorgeous day shaping up. a gorgeous looking day today. tomorrow, want to put that antenna up for you. we've got showers thursday into friday. what does that mean? hold off on washing your car. what does that mean?

hold off on watering the plants that day. but just that day. thursday into friday. and we're expecting those showers elsewhere, we're going to get a little bit of action up north. maybe a little bit more rain, maybe measuring 1/4 inch, but not expecting anything more than 1/10 in the north bay in the mid to end section of the week. 52 degrees in sunnyvale to start you out. nice mild start to the morning, beautiful sunrise shaping up over the city over the bay. we had a weak disturbance pass through. this is going to keep that onshore flow in place. so for today, mostly cloudy start, clouds hugging the coastline. that'll be the case. and as a result, temperatures will be much warmer inland versus what we're expecting at some of your coastal cities. for example, i'm forecasting 65 degrees in pacifica, versus 78 in san jose. blustery later on as the winds start to increase. and then tomorrow, we're going to drop off your temperatures just a touch. we bring in the showers, stop the clock on the future cast at 9:00 p.m. thursday. there it is, enough to get your plants nice and wet and then

maybe just maybe enough for a car wash up in the north bay. you'll probably still need to wash it yourself on friday. but hey, you don't want to go out of your way before then. 75 degrees in san jose, 71 in fremont, or else the showers will muck it up even more so. 71 in livermore. throughout the next couple of days, we are going to keep the low 70s in place for tomorrow, but we're down to the 60s on thursday. warming you back up as we head into the weekend. and the good news is, we'll stay nice and quiet for the weekend. another spring-like weekend for great outdoor activities here in the bay area. switching gears now, let's get to your drive. couple of serious things to point out. we told you about this earlier, debris's all over the highway, i-80 westbound at fitzgerald drive. reportedly a big rig passing through there lost its load, there's a massive cleanup effort taking place. you want to give yourself extra time as delays are stacking up and they're growing as we speak. meanwhile, another issue to tell you about, jammed traffic on 880

really moving slow from grand avenue up to the toll plaza where the metering lights are on this morning. and that's actually backed up more so than usual. keep that in mind, give yourself extra time. back to you for now. >> thank you very much. we continue following developing news this morning. may day demonstrations being held throughout the bay area all day. >> we have team coverage, christie smith is live in oakland at one of many hospitals where nurses will picket. but first, bob redell on the san francisco water front where a strike has forced the cancellation of ferry service. bob? >> reporter: yes, good morning to you laura and jon, the golden gate bridge district knew that picketers would be out here at ferry terminal here in san francisco and the terminal in sausali sausalito. they did cancel ferry service for this morning, will resume later this afternoon. something to keep in mind if you commute from marin to the city over the water. these are supporters of the labor union and the labor union workers themselves. ferry workers protesting labor

contract negotiations that have been going on for over a year now. and both sides have clearly not come through an agreement yet. they are supposed to go back to the table some time this week. but three big issues are rising health care costs, pensions for new hires and, of course, wages. so right now what they are doing is the day of action also coinciding with may day. they are picketing in front of the terminal. and ferry service shut down will resume earlier this -- later this afternoon. 1:55 at sausalito. the bridge is still open and so is bus services. that's your alternate route. and there were also reports that the occupy protesters were going to shut down the golden gate bridge, they have canceled that plan. we are live in san francisco, bob redell, "today in the bay." quite a different scene on the eve of these protests about 100 people chanting we are

occupy in san francisco's mission district. smashing windows and spraying paint. they also threw eggs at about a dozen businesses around 18th and valencia streets that's night. they also broke windows at the police station. witnesses say about 100 people marching in the streets are responsible for all this damage. >> i saw them just litter this place with egg bombs, came up with -- well, we're missing one of our signs that did most of this damage. they started shattering everything they saw. one guy had a crowbar. >> and vandals also damaged several cars. thousands of nurses are gearing up to hit the picket lines this morning for a one-day strike. at issue there, sick pay and benefits. christie smith live at oakland summit hospital with more on how this will affect patients. good morning. >> reporter: good morning to you, laura. as they've done before, the nurses are starting to show up early. they've got their picket signs down. they won't officially start until 7:00 this morning.

this is a one-day strike for the california nurses association and the third strike in just seven months against this sutter health system. about 4,500 nurses are expected to walk off the job over a contract dispute. nurses say sick pay and a reduction in benefits are just part of the problem, but summit says that it's disappointed that this strike couldn't be avoided. i spoke one one icu nurse a little while ago. he said he doesn't want to, but he has to hit the streets because this is so important to him. the nine hospitals affected throughout the bay area will have replacement nurses to care for patients. they were hired with a contract, though, for five days which means that the nurses who go on strike won't be allowed back on the job until sunday. reporting live in oakland, christie smith, "today in the bay." occupy oakland will also be a driving force during may day protests. the protests will start at 8:30 this morning ending up at about

3:30 this afternoon with a march from the fruitvale b.a.r.t. station where a rally is scheduled for 6:00 this evening. shoremen have called for a daytime work stoppage. the oakland police department handling of occupy protests just one of the criticisms in a new report from independent monitors. the report concluded the department is still far from reaching court-ordered reforms and that could mean it is a step closer to coming under federal control. oakland agreed to sweeping reforms back in 2003 after the fallout from a police corruption case. and protesters will also be out in force in support of janitors this morning. a group of protesters will rally near westfield shopping mall on san francisco's market street set at 11:00 this morning. janitors and retail workers at the mall were engaged in an ongoing labor dispute. and they'll be picketing at fifth and market. low-wage earners could be in for a raise in san jose. city council will consider an initiative today to increase the

minimum wage from $8 to $10. it has several options on the table including enacting it directly or leaving it up to voters in september. it was started by a sociology class and quickly gained community support. alcohol crackdown, city leaders in walnut creek are set to consider a controversial new ordinance giving the city more control over places that serve alcohol. they will hold a hearing tonight to discuss the controversial law. now if passed, older bars may be required to have security and adhere to alcohol cut-off times. right now, those bars are exempt from the 2004 law that set rules for bars and restaurants. bar owners have threatened a lawsuit if that ordinance is passed. the hearing starts tonight at 7:00. it is 6:55 right now. the "today" show is next and ann curry shows us exactly what they're working on this morning. >> jon and laura, good morning, coming up here on a tuesday morning on "today," new security concerns on the one-year anniversary of the killing of osama bin laden. this morning, we'll get an
