teenager's death. i'm sure a rough day emotionally out there. >> reporter: no doubt. good morning. this is the fourth day the school in south san jose is without one of its students. 14-year-old reyes was an eighth grader here. san jose police say soon after he showed up at roosevelt park friday night about 7:00, he was beaten by suspected gang members. according to the san jose mercury news, there were plenty of witnesses but they all scattered once the fight broke out. reyes held on through the weekend but died at the hospital monday afternoon. oak grove school district is taking his death to heart. >> reaching out and supporting our students and our staff in this time. and we'll reach out to the family and provide what support we can. >> roosevelt park is near downtown san jose between julian and santa clara streets.

police say it is known gang territory. anyone with information is asked to contact san jose police. in the meantime, district officials say that grief counselors will be onhand for students, staff, and parents. live in south san jose, "today in the bay." >> 5:02 right now. released after a central valley search for more victims of the so-called speed free killers turned up no additional remains. crews spent two days at a home in lyndon ten miles from a covered well where remains were found earlier this year. the property includes a house once owned by the convicted killer. he killed himself after his partner went public with the location of several sites where bodies and bones were found. this morning, shock and sadness right here in the bay area as the football community mourns the death of an nfl great. they're investigating the death as a insisuicide. the 43-year-old was found wednesday with a gun shot wound to the chest.

a gun was found nearby. the former charger teammate now a high school football coach in dublin, he says no doubt he is grieving and reflecting about one of the greatest line backers ever to play the game. >> i just hope and pray that his boys and his daughter really understand what kind of dad they had. he really didn't care about himself. he cared about everybody else. >> well, police say he did not leave behind notes. but the case is drawing parallels to another nfl suicide. more than a year ago, former defensive back of the bears super bowl championship team. he shot himself in the chest. his last note to his family was asking that his brain be sent to researchers to study possible head trauma from his career in the nfl. >> so sad. 5:03 right now. clock is ticking for the oakland police department. federal judge is giving opd until monday to submit a plan for finishing up its investigation into police

officers' handling of last week's occupy protest. they do not think the investigation will be wrapped up in the 180-daytime limit he set for them. citing conflict of interest issues, they decided to hire a private contract. the police department is not commenting on the latest order. well, this one is a cinco de mayo celebration for a good cause. creating a scholarship to honor a community activist killed last year. tonight's festivities being held at the restaurant in alameda. donations will go towards a scholarship in memory of jesus campos. he was shot and killed by robbers outside of that business last april. tonight's event runs from 5:30 to 7:30. well, a south bay school is trying to replace school equipment used by autistic children. burglars broke into a locked storage shed over the weekend.

15 bikes and tricycles were taken. a pe teacher who made the discovery said the bikes helped raise self-esteem of those kids. >> the bikes are really expensive and whoever bought them, like it's for somebody and they're just going to take it. it's not cool, you know. >> the bicycles were purchased through a grant made available to the piedmont hills. teachers voting to authorize a series of two-day strikes if a new contract cannot be reached. meetings scheduled this week to try to event those walkouts. but negotiations with administration officials have been going on for the past 22 months and the two sides have not been able to reach a deal. a csu strike would be the biggest strike of university employees in u.s. history. more than 24,000 faculty are employed on the state's 23 campuses. 5:05, with the 49ers moving out of the park, san francisco

looking at ways to revitalize the surrounding bay view districts. today, mayor ed lee will make an announcement, he'll also talk about housing programs for the hunters point shipyard and candle stick point. the stadium and surrounding 700-acre area are slated to be replaced by the shipyard project which includes office, retail, and open space. a new after hours show at san francisco's bill graham auditorium not music to anyone's ears. bob redell with the very loud and drastic measures against some homeless people. bob, good morning. >> yeah, good morning to you, jon. homeless people hanging out, sleeping out in front of the auditorium had always been a problem until now. you can see there's no one out here. and there's a reason why for this. this is what the auditorium is now doing. you can see one of the speakers right there. and i'll let you listen in. they've got annoying sounds

pumping out. i don't know what that is. if that's a combination of an alarm and crickets. earlier we heard something -- i don't know how to describe it. a loud screeching sound. they've also been between the hours of 11:00 and 7:00 in the morning, jackhammers, chain saws, anything to agitate people so much they won't loiter out front. management says they are frustrated with people hanging out here especially when they have patrons coming to see their shows. and they said they didn't know what to do especially because apparently there's been more people coming out front here because of a crack down in other parts of the city. so more people are congregating out here. we are going to talk to some people who hang out here in the civic center coming up in a bit. they're probably frustrated, as well, because there's an overhang here. this would be a popular place to hang out in the civic center. there isn't much shelter. we did hear from police and the response is to say that there

are ten more beds they've opened up in the city and we know the city's homelessness directors are trying to outreach to people on the street to try to move into these shelters so they're not hanging out in front of businesses like the bill graham civic auditorium. reporting live here in san francisco, bob redell, "today in the bay." >> thank you very much. going to see some rain today. >> yeah, an active weather pattern after a very quiet pattern so far this week. 50 degrees to start you out this morning. we're at 49 in santa rosa. headed towards the 70s in some cities even with the full deck of clouds all day long because of that nice mild start. overcast conditions as those clouds increase throughout the morning hours. the breeze will also pick up. a few showers on this way this evening. and this weekend, we have a big-time warm-up on the way. temperatures 90 degrees in the warmest cities across the bay. for today, grab that umbrella to the north of the golden gate bridge, we'll be at about 59

this morning. the first quarterly financial report since becoming a public company. good news, the amount of money the company makes grew quickly, but so did its costs. yelp lost nearly $3 million in ten months. they're going to want to see profits at some point. the late private estimates about how many jobs america added last month is tepid at best. an official number this time tomorrow. and jackie says all that worry is weighing on wall street. she's at cnbc world headquarters. good morning, jackie. >> good morning, scott. well, it was weighing on wall street, now the futures have turned a corner and slightly higher this morning. be uh this was after yesterday's mixed session we saw. the markets dropping sharply early on after that report shows that private sector companies added fewer jobs last month than expected. that's made some a little anxious about tomorrow's payroll report from the labor department. the asian and european markets

higher today and we're going to get more data on new filings for unemployment, productivity, and labor costs as well as the report on the nation's services sector. meantime gm and viacom reporting earnings before the open. the gm number came out and looked better than expected. the dow losing 10 points to 13,268 yesterday, the nasdaq edging up to 3,059. and also target today no longer selling amazon kindle once the current stock runs out. like other retailers, target is frustrated and upset as essentially being used as a showroom for amazon. customers looking at the item and then going home and buying them online. and saying it wouldn't just sit back and let that happen. target is going to continue to sell the apple ipad and some of the other ereaders like the nook. back over to you. >> thank you much. >> jon and laura, you can now buy the second coolest vehicle that neil armstrong ever drove.

in san mateo this morning and 48 degrees in santa rosa. one more day until friday and a great-looking weekend shaping up. once we get through the showers today, we are talking about stellar conditions for outdoor activities both saturday and sunday across our beautiful bay area. so the winds will be a factor throughout the next couple of hours. really not that bad just yet. our strongest sustained speed is in fairfield at 14 miles per hour. as we head throughout the day today, those winds will pick up. a lot of instability as an area of low pressure which is going to ride to our north, start to bring in some shower activity. it all works out like this. jet stream going to take that storm to the pacific northwest. for us, some very light showers are expected. mostly to the north of the golden gate bridge. but here in san jose, i think we'll see a little something. our best chance will be between about 8:00 and 10:00 tonight. evening showers by tomorrow morning, just a cloudy start making way to a gorgeous, gorgeous afternoon. stop the clock on your future cast, there's that front draped across the north bay, stop it

again for you at 6:00 p.m. makes its way into the midsection of the bay area. not expecting a whole lot of rain. likely less than 1/4 inch. by 11:00 p.m., what's left of that system is situated over the santa cruz mountains getting ready to move out and 5:00 a.m. tomorrow we meet back here, temperatures look good, we'll have a nice, clear start, mild, as well. 70s today in san jose, 70 for livermore, clearing you out by friday, warming up to 77 degrees on saturday. don't forget, those giants back at it with the marlins. bay game, got that forecast coming up. first let's check your drive with mike. >> we'll start you over in the san francisco area. look at the great highway. typical with gusty winds overnight. sand across the roadways. the great highway is closed between lincoln and locals to the area know they can get through to their house. but others through traffic use sunset. over here, we do have construction. emergency utility repair work going on at broadway. the roadway is still open, expect slowing, and it should be cleared by 7:00.

and the red right here, you know, the doyle drive tear down over the weekend and we have the sensors playing with us right now. let's get a live look at the golden gate bridge and see the volume of traffic. very light. southbound with these headlights and taillights. before the break, they had a road crew moving cones. all lanes are open because we had construction. they're all cleared now, both directions across the bay and across the bay another live look for oakland shows a nice smooth drive, as well. folks making their way north past the coliseum southbound side picking up the volume a bit. and good news all the way down into the south bay. san jose, that commute shows a nice northbound route. 85 at fremont and stevens creek. no slowing, in fact, you better slow because chp's watching. >> thank you very much. this morning, the rumor mill in overdrive now that the athletic director has called for an all-staff meeting this morning. it appears he's been offered the job as big 12 commissioner.

san jose police are looking for the suspects they say beat a 14-year-old boy so badly he died. i'm marla tellez.

thanks so much for joining us, it's 5:30, i'm laura garcia-cannon. >> and i'm jon kelley. searching for suspects this morning in the beating death of an eighth grader. marla tellez live at the middle school where class mates are trying to cope with this terrible, terrible news of that murder. marla, i'm sure a sad day out there. >> reporter: absolutely, jon, good morning. when students, staff, and even parents show up here at the school in san jose they have the option of meeting with grief counselors. they've been dealing with the loss of reyes all week long. the 14-year-old died monday after police say he was badly beaten friday night at a downtown san jose park. the main suspects, they say, are gang members. officials say it happened on a basketball court at roosevelt park. we spoke to a man who arrived minutes after the fight broke out. >> that's pretty sad because we come to play sports and good

things for us. and fighting and trying to beat somebody is pretty sad. really sad. >> reporter: again, san jose police say this is a gang-related -- in fact, roosevelt park where it happened is known gang territory. if anyone happens to know if you happen to know anything about the loss, the death of reyes, you are asked to call san jose police. this is san jose's 13th homicide of 2012. live in south san jose today, i'm marla tellez, today in the bay. the man suspected of brutally killing five people inside a san francisco home is expected back in court this morning. 35-year-old is killed of killing three men and a woman with a blunt object inside a home back in march. he's pleaded not guilty to five counts of murder with special circumstances. police have offered no motive for the killing, but they have said it was a targeted killing.

he will face a judge in san francisco this morning during a preliminary hearing. in a trial of a man accused of beating an elderly south san jose priest. pre-trial motions will be heard in the case of william lynch, the san francisco man accused of beating father gerald linder in 2010. he says the attack was justified because the priest molested him in a camping trip more than 30 years ago. father linder denies those charges. and if lynch is convicted in the attack, he faces four years in jail. this morning, a deadly bacteria strain may be responsible for the death of a young lab research assistant at the san francisco veteran affairs medical center. state and federal investigators say the 25-year-old died of an infection after handling a strain of bacteria that can cause meningitis. the researcher began feeling ill friday at his treasure island home. he died saturday morning at the v.a. hospital. a north bay teenager charged

with being a motorcycle hitman and a lamborghini thief had prior run-ins with police going back months. facing charges of breaking into a vacant mansion in tiburon. according to the marin independent journal, wade had been accused of stealing his mother's car and head-butting a classmate during a dodge ball game at redwood high school. wade is accused of stealing a lamborghini belonging to the celebrity chef guy fieri. they found the car following wade's arrest in mill valley. leaders are calling for peace following may day protests in oakland. you can see shopkeepers dealing with broken windows and vandalism. at 9:15 this morning, the interfaith community group genesis will hold a prayer vigil at the corner of 14th streets and broadway.

more than two dozen people were arrested in the city on tuesday, including one for assaulting a police officer and two for arson. san francisco police say most of the protesters arrested during a wednesday morning raid are from out of town. the proprotesters occupy a building owned by the catholic archdiocese for about 12 hours. 11 of 26 people arrested don't live in san francisco county. four others are from out of state. a san jose card room hoping to add more gambling tables at two of its clubs. san jose's bay 101 filing papers today asking for expanded measures on that november ballot. it wants to increase gambling tables and its clubs by more than 60%. and if it qualifies, it will then need more than 19,000 valid signatures to make it on to the ballot. bay 101 says the move is aimed at cashing in on more of the gambling markets they say is being lost to tribal casinos in the central valley. the auditorium is known for staging big concerts.

but its new after hours show, not music to anyone's ears. the loud and drastic measures against some say the homeless. good morning. >> good morning to you, laura. here's a question for you. could you sleep through this? the people who operate the auditorium are hoping you can't. that's why from 11:00 at night until 7:00 in the morning, they started blasting these annoying sounds through speakers they have set up just on the other side of the lobby front doors. we've heard alarms, screeching sounds, machinery, right now we're listening to static. they've also had birds and crickets. they started doing this recently because they're frustrated with the number of homeless people sleeping out front. this is something going on for years. but apparently the number of people have increased because of crackdowns in other parts of the city. so more people are ending up

here. the idea is that these aanywaying sounds will persuade those people to go somewhere else. >> could you sleep through that? >> no. i could not sleep through that. no. i don't think anybody could. it's coming out the front door, you know. it's noise, it's annoying. had to get away. what is all this noise? >> reporter: but it's hard to tell how effective these sounds have been. yes, this morning, and since we've been here the past hour or so, we have not seen anyone sleeping outside the auditorium as we have in years past, but we also were talking to someone who lives on the street who told us recently police have come by and said you've got to stop sleeping out here. we've even seen some police patrols coming by with the spotlight checking the area. it could be a combination of police enforcement and annoying sounds like this are getting people to stay away. here outside the bill graham civic auditorium center, bob redell, "today in the bay." 5:36 right now. let's check in on the weather

with meteorologist christina loren. going to be a wet day outside? >> remember when all you had to do was bang pots and pans around? things have changed. we've got rain on the way, but you don't need that umbrella if you're waking up with us south of the golden gate bridge until this evening. if you're part of the 9:00 to 5:00 work crowd, you should be a. okay. starting at about 6:00 south of the golden gate bridge. and we're not expecting much if anything. i'd say hold off on washing that car at least until tomorrow. i want to point out giants are back at it today with rain in the forecast. you're going to be headed out for that game, bring your rain gear, we'll likely see showers coming down. not enough to prompt a rain delay, but it is possible. we'll keep watching that for you. winds coming out of the west/southwest. that means the ball will head straight out to left field. as we head throughout the day, 60 degrees at noon, 63 by 4:00 p.m., some showers, making their way at the bay and the coast.

we'll start to see the showers develop. and inland cities, probably holding off until about 5:00, 6:00 tonight. we'll take you through the full forecast. i'll time it out for your doorstep. first, we want to see how you drive is doing at 5:38. >> we're doing how we'd expect. highway 4, to the right of your screen, there's the slowing. red is where it's below 20, typical through antioch and no problems through pittsburgh bay point or even concord in the walnut creek interchange. 24, 580, 880 moving smoothly toward the bay bridge. i want to point out a couple of issues for the nimitz. reports of a disabled vehicle and it's in the narrow part as you're approaching. the tow truck arrives and you may have to have one lane blocked. stay to your left on the broadway exit. and high street, as well, a stall reported there, but a live look outside will show you there's not heavy volume of traffic. just starting to pick up and things bunched up a tad bit. there may have been flashing lights over the last few

be delivering her important endorsement today. and that will be happening in virginia. a key battleground state. also attending this event is the governor of that state bob mcdonnell who is on the short list of possible vice presidential candidates. important again because he is a conservative and helps mitt romney burnish those conservative credentials. yesterday newt gingrich dropped out of the race. gingrich said that romney is, in fact, conservative enough to lead the party into this election. gingrich, though, has launched some sharp edge attack over the past few months. those attacks are being picked but by the obama campaign which is moving ahead in its attacks of romney. president obama starting his first couple of rallies of the official campaign season this weekend in virginia and ohio. laura? >> here we go, brian. thank you so much. this morning, the chinese dissident of that diplomatic

storm says he wants to leave china aboard hillary clinton's plane. guangcheng says he wanted to stay in china but changed his mind hours later over fears for his family's safety. secretary of state clinton happens to be in china for meetings with leaders. confirming this morning that chen is now asking to leave with his wife and family aboard clinton's plane. new this morning, four university students are dead, many wounded, and at least 50 are spending the morning in jail. amateur video shows security forces and proregime gunmen storming a northwestern university in syria overnight trying to break up anti-government protests. activists say forces started firing tear gas and live ammunition into the crowds to try to disperse the students. the rain and gunfire continued for hours ending earlier this

morning. possible hazardous materials in an arizona backyard now slowing the investigation into the shooting deaths of five people. right now investigators testing an unknown liquid found in 55 gallon drums at the home southeast of phoenix. four of those bodies are still inside and outside of that home while officers investigate. the shooter is among the dead and officers say that shooting may be related to domestic violence. well, an online ad featuring ashton kutcher has now been pulled after complaints it is racist. in an ad for pop chips, kutcher was seen here in dark brown make-up portraying a producer looking for love. kutcher says the ad was never intended to offend anybody. conservative group of mothers going after jc penney again. the group 1 million moms upset with jc penney for using this catalog photo that shows a lesbian couple with their arms wrapped around each other and

ocean side with how he's being remembered. good morning. >> good morning. you know, it's interesting, there were a number of people who spent the night here, he didn't just play for san diego, he was san diego, he grew up here, he was ingrained in this community. it's one of the reasons why this huge makeshift memorial is here with flowers, balloons, candles, and random pieces of memorabilia in his honor. an autopsy is scheduled to be performed on the 43-year-old today at the medical examiner's office. now beyond speculation, here's what we know this morning about what happened. his girlfriend returned from the gym yesterday morning and called 911 shortly after 9:30. ocean side police say he was found in a bedroom with a gun shot wound to the chest and a handgun nearby. >> i pray to god, please, take me. take me, leave my son. but it's too late.
