an update on the park beating. very tragic. good morning, marla. >> reporter: good morning. 14-year-old reyes was an eighth grader right here at the intermediate in south san jose. students and staff have been dealing with the loss of him all week long. san jose police say it was soon after reyes showed up at roosevelt park friday night that he was beaten by suspected gang members. according to the san jose mercury news, there were plenty of witnesses, but they all scattered once the fight broke out on a basketball court. reyes held on through the weekend, but died at the hospital monday afternoon. detectives are trying to determine how many people were involved in the fight. they say this is a tough investigation for many reasons. >> it weighs heavily on those detectives. some of those have children, some of their children are teenagers. a lot of people in the community have, you know, 14-year-olds. and the police department, we take that very seriously. >> roosevelt park is near downtown san jose between

julienne and santa clara streets. police say it is a known gang hangout. again, reyes was an eighth grader, which means he would've graduated from bernal intermediate at the end of the school year. marla tellez, "today in the bay." the man charged with murdering five people inside a san francisco home due back in court this morning. accused of killing three men and a woman with a sharp-edged weapon inside a home on house street back in march. he pleaded not guilty to five counts of murder with special circumstances. police have offered no motive for the killings, but they have said it was a targeted killing. he will face a judge in san francisco this morning during a preliminary hearing. we're following breaking news this morning as we're getting word of a large police presence. you see it there in petaluma. our chopper live over the scene. some kind of activity underway at the location where our chopper is there. you can see how many officers are on the street and they're

actually quite spread out. it's interesting. we believe this is along mcdowell boulevard. we are told by a clerk at a nearby best western, there have been shots fired. it appears to be closed off right now. several vans there, a lot of police armed heavy activity there. looks like they're joining forces right there having some kind of huddle or meeting as the chopper adjusts its shot a little bit. we're going to keep our crew there and bring you the latest information as it becomes available to us this morning. but breaking news we're covering in petaluma. a hit-and-run crash causes a lot of damage overnight. take a look at what happened at simpson soul food. yeah, a car slammed right into the corner. the driver ran away before police and firefighters managed to arrive at the scene. a lot of charges, but not a lot of locals in that occupy protest arresting in san francisco. the group took over a building on turk street for about 12

hours. police say 11 of the 26 people arrested do not live in san francisco county. four others are from out of state. now the clock is ticking for the oakland police department. a federal judge giving opd until monday to submit a plan for finishing up its investigation into police officers' handling of last year's occupy protest. the judge didn't think they'll have it wrapped up in the 180-day time limit set for them. citing conflict of interest issues, opd deciding to hire a private contractor. the police department is not commenting on the latest order. 6:04. released this morning after a central valley search for more victims of the so-called speed free killers turned up no additional remains. crews spent two days at a home in lyndon. property includes a house once

owned by convicted killer. he killed himself after his partner went public with the locations of several sites where they claim they dumped bodies of murder victims. a south bay school trying to replace stolen equipment used by autistic kids which play an important role in development. they broke into a locked storage shed at san jose's piedmont high school over the weekend. a total of 15 bikes and tricycles worth $1,500 was taken. a pe teacher says the bikes helped raise self-esteem for those with disabilities. students were shocked and disappointed somebody would actually rip the school off. >> the bikes were really expensive and whoever bought them is like for somebody and like they're going to take it. it's not cool, you know. >> no, it is not. the bikes and trikes were purchased through a grant.

csu strike could be coming this fall. the teachers voted to authorize a series of two-day strikes. meetings are scheduled this week to try to prevent the walkouts, but negotiations with administration officials have been ongoing for nearly two years. a strike would be the largest strike the university employees in u.s. history. more than 24,000 faculty are employed on the state's 23 campuses. yes, it is a place known for being loud, but usually it's the rock band there making noise at san francisco's bill graham civic auditorium. now that building is just blasting out loud sounds trying to keep the homeless from sleeping nearby. bob redell with more on the overnight show. >> not a show everyone's coming out for you can see outside the auditorium, there isn't anybody sleeping out here, which is unusual. over the years you've come by here and see people sleeping here overnight. it's a problem that has grown recently because of crackdowns in other parts of the city.

a problem so much that the management of the auditorium seeing more people deciding to do this. take a listen. you can see the speaker next to the trash can. what it's been doing between 11:00 and 7:00 overnight is blasting annoying sounds. i think that was static. right now i hear birds chirping which actually isn't that annoying. but we've also heard alarms, loud machinery, screeching sounds, another, planet entertainment started doing this recently. they didn't know what else to do to get these people from sleeping out front. and it's been a nuisance for people who come here to listen to real music. but they're hoping that by doing this they can at least get people to stay away from the front doors and find somewhere else to sleep. >> it's all over the place. i mean, once you get used to it,

you're just like, okay. when are they going to shut this thing off? when are they going to fix it? >> reporter: it's hard to tell if people have stopped sleeping out front because of the annoying sounds they're blasting out through the speakers in the lobby or also because of recent police crackdown. we were talking to one person who sleeps out in the civic center and he says in the past week police have come by saying please do not sleep out here. you're not allowed to sleep out here anymore. we saw a patrol car coming by to see who was not out here. reporting live here in san francisco, bob redell, "today in the bay." >> thank you very much. time to check that forecast with meteorologist christina loren. rain coming our way. >> yeah, we do have changes on the way. good morning to you. made it to friday eve. and a great-looking forecast for the weekend if you can make it through these showers. 48 in sunnyvale, 50 in livermore. clouds will increase as we head throughout the day as well as that breeze. a few showers by this evening. and then we've got a

nice-looking warm-up ahead for the weekend. temperatures back in the 80s. great beach weather on sunday. i'll get to that in my seven-day forecast. grab that umbrella if you're waking up to the north of us. by the bay, 59 degrees at noon, up to 60 at 4:00 p.m. making your way home from work, waiting for those showers inland, before we hit about 6 to 10 tonight, that's what we're expecting. now, mike's been following that breaking news, as well. he has an update on how that could impact your drive up in petaluma. >> this is just off of 101. choppers over the scene and this is affecting mcdowell boulevard south of washington street. and the washington street off ramp is closed because of this activity near two shopping centers and there's also an elementary school nearby. we're checking on that, as well. locals avoid washington street at mcdowell. actually between washington street and merridian.

as well as the car fire going on for the tri-valley area. the off ramp has now reopened after an earlier car fire. and no slowing for 580, but slowing coming out of the altamont pass and expected for livermore. and that's a standard build. but we're watching it carefully. those two areas had tough rides, as well. we continue to follow breaking news coming into our newsroom. and if you plan on driving to oakland later today, the northbound onramp on 42nd avenue will be closed tonight at 9:00 until 5:00 a.m. tomorrow. two other lanes leading from the overpass to san leandro street will also be shut down due to construction crews working on a seismic retro fit project. lanes will reopen just in time for the morning commute on friday at 5:00 a.m. the art of creating jobs will be on the agenda this morning in the silicon valley where some big-time power players will be in attendance. former president bill clinton and former secretary of state

western clerk that they had heard shots fired in that area. we're trying to confirm any injuries or people potentially taken to the hospital or who was actually involved with police agencies could be involved in it. but the street completely closed down there as we continue to see s.w.a.t. teams huddling there on the ground. this is live from petaluma this morning. any other information that comes into us, we, of course, will bring it to you. it is 6:14 right now. four players linked to the new orleans saints illegal bounty program are appealing their suspensions. nfl announced the suspension wednesday morning following lengthy investigation. the suspensions range from an entire season to three games. the players are accused of offering up and taking money for injuring opponents. appeals will probably be fruitless because the nfl commissioner's office hands out the suspensions and handles the appeals. a lot of questions following

the nfl player's suicide. he shot himself inside his ocean side home wednesday morning. that is the report. "today in the bay's" steven luke joining us live from ocean side with more on how sayo is being remembered by all. good morning. >> reporter: jon, pillar is right. good morning. it is overwhelming in front of junior seau's home in ocean side. we're getting our first good look at this makeshift memorial which has grown overnight. a number of individuals spent the night here watching the glow of the candles, the flowers being placed here, cards, random pieces of memorabilia to honor the legacy of a home-grown hero who is no longer here. >> but i pray to god, please, take me. take me, leave my son. but it's too late. >> reporter: that raw emotion from junior seau's mom moments

after she saw his dead body for the first time. an autopsy scheduled to be performed on the 43-year-old by the medical examiner's office. seau's girlfriend returned home yesterday morning and called 911 a little after 9:30. police here say the former football star was found in a bedroom with a gun shot wound to his chest, a handgun was found nearby, but no suicide note was left. also, immediately after the news broke, many members of the community, hundreds at one point started flocking to the ocean front home where the makeshift memorial remained. there are many questions surrounding seau's death including perhaps what years and decades of pounding in the nfl may have done to his body and mind. >> over the last several years, there have been a number of well-publicized cases in retired athletes who have committed suicide. and there is some concern over whether those issues may be related to changes that occur in the brain.

>> reporter: junior seau grew up in this community, went to high school a few miles from here. and when he was drafted -- >> well, sounds like we have lost that signal. that is a report -- junior seau reportedly committed suicide. we'll get more on that. 6:17 right now. rain coming through the bay area. when is it going to hit? >> looks like it depends on where you're waking up with us. it's a big bay area. 49 degrees in napa, 49 in fairfield this morning, and 51 degrees in concord. we do have rain on the way. but you don't need to tote that umbrella with you if you're waking up with us to the south of the golden gate bridge. north of the golden gate bridge, that's another story. i'll time out this system as we speak. 53 degrees in livermore. system moving into the pacific northwest. really bringing some ample rain to places like oregon and washington for us we're going to see the tail end sneak through. and we're not expecting a lot in terms of our rainfall

degrees sunday, beach weather, 78 degrees, places like santa cruz. let's check your drive at 6:19 with mike. >> watch highway 17, going to be crowded. we're looking over here, already crowded, but highway 4, we know that's the case, speeds down below 20, in towards 10 miles per hour as you're heading toward somersville and a little slowing, as well, for bay point. that's the note there. concord, walnut interchange, not a major issue. 580 starting to build, volumes building through livermore and in towards first and the interchange. a 20-minute drive through pleasanton and dublin. consider the speeds into the 40 even though we're registering a few 50s. smoothly toward the castro valley y., moving to the southbound with the northbound speeds showing your commute incident-free, and the flow is moving nicely throughout the peninsula. a very nice drive. the golden gate bridge, let's

show you that. this is basically where christina talks about north of here, the rain hits earlier in the a.m. and the p.m. below here, but we're showing a nice smooth flow and a clear drive right now, guys. back to you. >> thank you very much, mike. 6:20. european authorities angry this morning at google. they say google misled them about who did what and when. scott mcgrew, case looks straightforward. >> yeah, using laurae inine ini words, laura. google said, we're sorry, one engineer put a couple of lines of code into our google mapping cars we didn't know about it, total mistake. and european countries largely forgave the company and dropped the case. but as we reported last week, google said in the own internal documents that a number of people knew what the cars were doing. that revelation has european governments feeling very misled this morning. san francisco's yelp turned in the first quarterly financial report since becoming a public

company. good news, the amount of money the company made grew quickly, but so did its costs. meaning yelp lost nearly $10 million in three months. now, investors are going to be patient while yelp grows, but eventually they're going to want to see some profits. the latest private estimate of how many jobs america added last month is tepid at best. labor department gives us an official number this time tomorrow. and jon and laura, you know, you can buy the second coolest vehicle that neil armstrong ever drove. it's a corvette given to him by houston car dealer after he returned from the moon, and it's for sale on ebay. current bids put it around $250,000. here's a close-up of it. you say to yourself, mr. armstrong, you don't take care of your cars. the truth is, neil turned it back over -- i call him neil, driving a year, and then another nasa employee bought it and he's putting it up for sale, but this is definitely neil armstrong's

this is at mcdowell near washington. bob, are you there? >> i am. >> what can you tell us. what did you hear? >> it was in the neighborhood behind the hotel about 4:05 this morning, there were some loud bangs. and then we heard some gun shots after that, obviously, we came ala alarmed. and, i'm going outside, there was -- i was told there was a homeland security operation going on and they had served a search warrant. and to kind of remain inside at that time. >> were you able to tell those were federal agents out there? >> that's what we were told. but it's been really the whole neighborhood's been on lockdown. we really don't know a whole lot at this point. we just know it was some kind of operation and we know that a search warrant was served and the neighborhood behind us. there wasn't a whole lot of activity here at the hotel, you know, just kind of some walk through activity. but they basically said for the guest safety, keep everybody in

their rooms. and until they gave us the all clear, which we got about 20, 30 minutes ago. they said, you know, everything's fine, the guests can leave, go to breakfast, that kind of thing. it sounds like everything's pretty much wound down at this point. >> what about police presence and agent presence right now? are you still noticing a lot out there? >> yeah, like i said, looks like people are pulling out now. at one point there was s.w.a.t. on-site. s.w.a.t. teams from various jurisdictions and, you know, there was quite a bit of activity going on back on the streets behind us. at this point, everything looks like it's pretty much kind of wound down for the moment. >> now, what about -- are there any reports of -- did you hear any ambulances come to the scene or any rescue helicopters? >> yeah, we did -- the helicopter landed in front of the hotel this morning and evacuate someone, we don't know who. we don't know if it was an agent or one of the alleged perpetrators. but it, the helicopter did

it is right in back of this area. it's a residential area as well reported seeing homeland security officers come into the best western telling them to keep all the patrons inside the hotel inside for quite some time. they've since been released and told they can come and go. he also reported seeing a life flight helicopter land in the area and take one person away. we do not know how many people were injured. who, in fact, who is involved or the extent of those injuries, but heavy police presence this morning at mcdowell closed near washington this morning as we continue to -- we have a crew on the way to the scene. we'll continue to bring you live updates as we get more information this morning. a san jose eighth grader is dead this morning. and police blaming gang warfare. marla tellez is live in san jose with the latest on this brutal beating in a popular park. gooed morning. >> reporter: jon, good morning. reyes was beaten friday. he died monday.

now, he was an eighth grader right here at bernal intermediate school in south san jose. he wasn't beaten here, san jose police say it all happened at roosevelt park near downtown san jose, again, on friday. they say this is a popular spot for gang members. and they do believe the attack is gang-related. now detectives say a fight broke out on the basketball court and that's when reyes was beaten up. the school district president says the loss is tough for everyone. >> any time that you have a young person who is killed in this kind of manner, it's just a real tragedy for the whole community, and our condolences go out to the family and friends of this young man. >> reporter: now, school officials say that grief counselors are onhand all week long here at bernal intermediate for students, staff, and even parents. in the meantime, detectives are really just trying to determine how many people were involved in that fight. if you know anything about the

beating of reyes on friday, you're asked to call san jose police. live in san jose, marla tellez, "today in the bay." the man suspected of brutally killing five people inside a france home expected back in court this morning. the 35-year-old killed of killing three men and one woman with a blunt object inside a home on house street back in march. he has since pleaded not guilty to five counts of murder with special circumstances. police have offered no motive for the killings but have said it was a targeted killing. he will face a judge in san francisco this morning during a preliminary hearing. police will hold a community hearing to address the fears and concerns of residents in the wake of sierra lamar's disappearance. dozens of volunteers continue to search for the missing teen last seen march 16th. the klaas kids foundation is leading the effort and planning to search areas that may have been missed in previous searches. the reward in the case has been

increased to $25,000. and sierra's mother says it is important to keep the search effort going. the city will also host a community wide self-defense class at the high school tonight at 6:00. the trial of a man accused of beating an elderly south bay priest gets underway today. pretrial motions will be heard in the case of 44-year-old william lynch, the san francisco man accused of beating father gerald linder at a retirement home back in 2010. lynch claims the attack was justified because the priest molested him during a camping trip in santa cruz more than 30 years ago. father linder denying all of those charges. now if lynch is convicted in this attack, he faces four years in jail. this morning, a deadly bacteria strain may be responsible for the death of a young laboratory research assistant at the san francisco veterans affair medical center. state and federal health investigators say the 25-year-old died of infection after handling a strain of bacteria that can cause

meningitis. the research began feeling ill reportedly on friday at his treasure island home. he died saturday morning at the v.a. hospital. a north bay teenager charged with being a motorcycle hit man and a lamborghini thief had prior run-ins with police dating back months. the kid's been doing a lot of things here reportedly. 15-year-old max wade facing charges of breaking in a mansion for hosting a drinking a party for dozens of teens. wade had also been accused of stealing his mother's car and head-butting a classmate during a dodge ball game at redwood school. wade is accused of stealing a lamborghini, as well, belonging to the celebrity chef guy fieri. police found the car while searching for evidence following wade's arrest for shooting at a cup sitting in a pickup truck in mill valley. faith leaders are calling for peace following the violence in mill valley. vandalism and destruction along city streets.

at 9:15, the interfaith community group genesis will hold a prayer vigil at the corner of 14th street and broadway. one of the intersections that saw the most damage. more than two dozen people were arrested in the city on tuesday, including one for assaulting a police officer and two for arson. 6:36 right now. let's get a check on the weather with christina loren. a little rain before a beautiful weekend, huh? >> beautiful weekend. picture perfect. our third in a row. so that's the good news. mother nature timing things out in accordance with your plans. as we head throughout the day, we'll see a really comfortable day temperaturewise. it's not too cold even with showers on the way. rain cool there up in the north bay before about noon, that's it. as we head throughout the day today, this front will slide to the south. it'll fall apart. showers in sonoma county, but we do have reports of people having to use their windshield wipers because of drizzle. keep that in mind. the giants back at it today, at&t park, a day game, 12:45, 57 degrees, you want your rain gear with you. it will be breezy and we are

expecting showers. we're not expecting rain delays. but possibly we're going to keep our eye on that for you to bring you any updates on my facebook page. 50 degrees at noon, 59 degrees at the coast, 63 4:00 p.m. inland. when i get to that forecast, i'll show you how nice it's going to be in your city come this weekend. first, though, still following that breaking news for you. mike, how is that impacting traffic? >> already showing what -- in fact there might be that weather you're talking about. the drizzle in the north bay and slowing here and also the accident -- sorry, the police activity off of the freeway. washington street, the off ramp is closed there, so this is going to cause slowing as you pass the scene, as well. you can use lakeville as an alternate, also coronado drive. and remember in the area, locals mcdell boulevard is also closed between maria and washington, as well. that's passing by mcneil where laura reports the first shots being heard. a smooth drive south of there coming through novato and into the san rafael.

we continue to follow breaking news out of petaluma this morning. our chopper over the scene captures these pictures of heavy police presence in that area. three special agents with the homeland security investigations were injured while executing high-risk federal warrants relating to an ongoing criminal investigation. the special agents were transported to a local hospital for treatment we're told of non-life threatening injuries.

high-risk warrants. >> bob redell with an update. bob? >> reporter: good morning, 15 minutes out from the scene. good morning, laura and jon. this happened a couple of hours ago between 4:00 and 5:00 this morning when i.c.e. agents with the homeland security department, department of homeland security were trying to present this what they call high-risk federal warrant at a home that located behind the best western on south mcdowell and petaluma. witnesses report that at some point during this operation they heard gunfire or the sounds of what they described as explosions. as a result, three of these agents have been taken to the hospital, one by chopper, two by ground. we now understand their injuries are non-life threatening, serious enough they have to be treated, but they are going to survive. one suspect is in custody, and from what we're gathering, at least one person on the ground. as i understand, the situation is now secure. yes, a lot of police, a lot of law enforcement out there.

marla tellez live with an update on what's nothing short of a brutal beating, marla, good morning. >> reporter: jon, good morning. 14-year-old reyes would've graduated from bernal intermediate school in south san jose at the end of this school year. san jose police say he was beaten by suspected gang members friday night at roosevelt park. it is near downtown san jose. and as jon mentioned, it is a known hangout for gang members. according to the news, there were plenty of witnesses, but they all scattered once the fight broke out. reyes held on through the weekend, but died at the hospital on monday. detectives are trying to determine how many people were involved in the fight. they say this is a tough investigation for many reasons. >> some of them have children, some of their children are teenagers, a lot of people in the community have, you know, 14-year-olds, and the police department we take that very seriously. >> reporter: again, the suspects who beat reyes are still on the run. so if you know anything, you're

asked to call san jose police. when students, staff, and even parents show up here to bernal intermediate, they have the option of meeting with grief counselors onhand all week long. live in san jose this morning, marla tellez, "today in the bay." 6:53. new this morning, hit-and-run crash causes a lot of damage to an oakland restaurant overnight. take a look at what happened at foothill and congress. car slamming right into the corner of the building. driver reportedly ran away before police and firefighters arrived at the scene. a tragic scene in southern california. there was also shock and sadness right here in the bay area as the football community mourns the death of nfl legend junior seau. police say they're investigating the death as a suicide. the 43-year-old found in his home in ocean side on wednesday with a gun shot to the chest. a gun was found nearby.

seau's former teammate is now a high school football coach in dublin. and he says he is grieving and reflecting now about one of the greatest linebackers ever to play the game. >> i just hope and pray that his, you know, his boys and his daughter really understand what kind of dad they had. i mean, he really didn't care about himself, he cared about everybody else. >> and police say seau did not leave a note behind. but the case is drawing parallels to another nfl suicide more than a year ago. former defensive back who played for the chicago bears world championship, he shot himself in the chest. and he asked that his brain be sent to researchers to study possible head trauma from his nfl career. homeowners in palo alto will be getting a break on their gas bills. they can expect 20% reduction or about $15 less a month. the savings is a result of a change in the way city purchases natural gas supplies. some council members say the new

prices may be just short-term due to uncertainty of future markets. a san jose card room hoping to add more gambling tables to the two clubs. san jose -- the bay 101 filing papers today asking for an expanded measure on the november ballot. it wants to increase gambling tables at its clubs by more than 60%. and if it qualifies, it will then need more than 19 thourk,0 signatures to make it on the ballot. the move is aimed on cashing in on more of the gambling market they say is being lost on the central valley. rob davis has a brand new job this morning. the mercury news reporting davis joining hillard heinz, a corporate investigation firm headquartered in chicago. davis will be managing director of its west coast operations based right here in san jose. davis retired from the san jose police department back in 2010

after 30 years on the force. sticker shock at the supermarket. it may cost you more to buy your cut of red meat. some cuts of beef have gone up more than 30%. several factors are contributing to the sky-rocketing prices including increase fuel and feed costs. a last-ditch effort to stop a ban is leaving a bad taste in some lawmakers' mouths. it's the duck liver that is sometimes -- i guess they force feed those ducks up to three times a day during the last month of their lives. the law banning it in california goes into effect july 1st. a group of 100 chefs spearheaded by san francisco's golden gate restaurant association signed a petition opposing the law. in response, darrell steinberg says he will not allow the issue to preoccupy the legislature which she says has higher priorities. california could be the next state to ban companies from

asking job applicants social media passwords. they approved a bill to make them off limits to employers. maryland has a similar ban in place. they follow national reports of employering requiring applicants and employees from handing over passwords. one of the most anticipated movies of the year opening across the country and here in the bay area with a midnight screening.
