good morning, everybody, the time now is 4:30. i'm jon kelley. >> and i'm laura garcia-cannon. let's start out with the forecast with christina loren. >> good morning to you. beautiful weekend. a little warm for some people. and today, actually about 4 degrees warmer on average than where we ended up yesterday. you want to dress for the two parts of the day. cool out there. i'll let you know how hot it's slated to be. first, let's check that drive with mike. >> we do have to give a shout out to the folks on the east bay right around 238, there's some activity on the shoulder. there was an earlier car fire. no injuries, and it's all off to the shoulder. but still a few crew members there. chp as well as a fire truck. watch for that distraction. for the north, a live look past the coliseum. moving very smoothly past high street. you might find another lane blocked heading up towards fifth, but no slowing because of the light volume. i'm tracking a couple of

incidents on 101. >> thank you very much, mike. walnut creek leaders are hoping the force will be with them as they true to lure lucas films to their city. >> the plans for a new production studio in marin county was blocked by neighbors. christie smith live in walnut creek with more on that city's pitch. good morning. >> good morning to you, laura. leaders here in walnut creek think this is the perfect place for lucas films to set up shop. they sent out a three-page letter of all the perks here in walnut creek. and you have to wonder if they included how much they really like george lucas' films. the idea is for a lucas film to build a production studio in walnut creek in the business park. they haven't heard anything back yet, but this comes after lucas film development arm skywalker properties pulled plans to build in rural marin county after decades of fighting for it.

walnut creek mayor bob simmons says walnut creek is perfect because it has an innovative past. >> the human genome was first mapped in walnut creek not too far from where we're standing. >> a number of for lease signs, a lot of medical facilities. the infrastructure is already set up. again, the city doesn't have a specific space in mind and haven't spoken directly to lucas film executives about what they're looking for, but just the possibility of having the force behind the force here is pretty exciting. reporting live in walnut creek, christie smith, "today in the bay." new this morning, an oakland man hospitalized in critical condition after being shot in an apparent robbery overnight. all happened on holly street around 12:30 this morning. police say it appears the man was robbed on the street, but that confrontation continued inside a home.

>> and ended up inside the residence, and we're trying to investigate further. >> police say this man was shot in the chest, both suspects still on the loose. and oakland police also working to identify a man killed in a shootout with police that also left an officer wounded. police say two officers were approaching three people in east oakland about midnight saturday. one of those suspects took off. and one of the officers chased after him and ultimately the two shot at each other. now, the suspect was hit and he died later at the hospital. the officer was shot in the leg, but he's expected to be okay. 4:34. some 30 people are homeless this morning after a fast-moving fire destroyed two apartment buildings in san francisco. the fire in the mission district started in a stairwell sunday morning and within 15 minutes, it went to four alarms. look at the size of that blaze. three firefighters were injured when a staircase actually collapsed. three others hurt fighting that

fire. many people inside the building barely escaped. >> my mom and my brother and all the people in the building, they are safe, and even in the third building, they are safe. and that's the major thing. thank god for that. >> investigators are still working to figure out what sparked the fire. in east san jose, meantime, the fire damaged four units in an apartment complex on shadow dancer drive. the fire started around 2:00 on sunday afternoon. took firefighters about an hour to knock that one down. six people are out of their homes, one firefighter is recovering from an injury. investigators suspect the fire was accidental. gay marriage making national headlines again. vice president joe biden surprising political analysts saying he's announcing he supports gay marriage. does that mean the president might change his stance on gay marriage as well? more on what biden said and the reaction. >> the vice president spoke on "meet the press" today. but many political experts say

today's announcement was no mistake. here's exactly what the vice president said today about gay marriage. >> i'm absolutely comfortable with the fact that men marrying men, women marrying women, and heterosexual are entitled to all the same rights, civil liberties. >> he prefaced his comment by saying the president sets the administration policy. in other words, biden's opinion on gay marriage does not mean the president now supports it, as well. and our political analyst says despite the fact that some say it may have been another biden gaffe. it could be that biden is testing the waters for the president. >> you have to believe that a message was given tonight to those folks in the gay community and those sympathetic to the gay community who are looking for hope. and if nothing else, it sort of emphasizes there's a difference between the two, between obama administration and the republicans and governor romney.

>> the gay marriage debate took center stage back in 2004 when then mayor gavin newsom allowed same-sex marriage couples to get their marriage licenses. it's now at the ninth circuit court of appeals and gay rights supporters are hoping biden's words today are a sign that perhaps if president obama wins a second term it may lead to federal recognition of same-sex marriage. >> it's very exciting and encouraging to hear the vice president of the united states speaking in support of equality, equal respect, dignity, and validation for all of our citizens in terms of marriage equality. this is good news today. >> this issue comes two days before voters in north carolina vote on a constitutional ban on gay marriage. nbc bay area news. 4:37 now. california state university trustees will consider changes to rules on executive salaries this week. among the proposals, removing a 10% cap on salary increases for

new residents and allocating more foundation money as pay for those presidents. critics say the money should be used for student scholarships or instruction. there'll be a closed session meeting in long beach today and tomorrow and then a public session on wednesday morning. it is 4:38 right now. and definitely had a beautiful weekend out there. looks like a good-looking weekend too, christina loren. >> a warm start to the week. and you'll notice, a little bit of fog out there this morning, with a weak onshore flow in place. as of this afternoon, though, offshore flow fully in effect. what that means is storm track way to our north at this point. high pressure able to amplify even more so. and we're talking about peak warmth today. tomorrow a touch cooler, but it's going to be very toasty inland. temperatures in the 90s. places like gilroy and morgan hill. we're starting out really mild this morning. 58 degrees in san jose, 2 degrees away from 60. and 54 degrees in concord.

as of noon today, take a look at where your temperatures are headed. 80 in san jose, and we're going to round out the day with plenty of 90s. so keep that in mind. also, want to keep this in mind. you've probably been sniffling sneezing if you're someone who suffers from allergies. we've got a high pollen count. let's check your drive at 4:39 with mike. >> we'll take you to the two incidents for 101. this is on the peninsula, southbound 101 at university. and unfortunately as sometimes happens in the areas through the hills, we have a deer that was hit by a truck over here southbound side. one lane is blocked, the driver of the truck is all right. we have a crew heading out there and they'll see how the animal is doing. and take the appropriate measures there. no slowing, though. consider the right lane blocked passing through the area. northbound side, no problems, and dumbarton, no overnight construction. we're looking at 101 as well on

the southbound side. an accident there on the shoulder. the slowing center of your screen, see that northbound 280 at 17. there's one lane blocked for construction there and that may be causing all of that slowing. that's extensive for that amount. we'll track that. only one lane blocked there and no slowing. a live look across the bay. the looking at the bay bridge toll plaza, repositioned for a nicer view of the backup that will -- >> it looks picturesque. >> exactly. it does look nice. no one's there yet. >> it's early, it's 12:40 right now. the plan to give san francisco young people a free ride faces a hurdle this week. a pilot program to provide free passes for low-income youth. but the program depends on $5 million in funding from the metropolitan transportation commission. several members of the mtc have expressed skepticism over using regional money for a project that would only benefit san

welcome back, everyone, and a good monday morning to you starting off the workweek. very nice temperatures. lovely live look outside from the south bay this morning. 4:44 right now. yahoo's board of directors facing a daunting deadline later on today. here's the deal, a group of shareholders demanding the board fire yahoo's new ceo by noon. the issue, his resume. thomas has a degree in computer science, a degree thompson now admits he never received. shareholders sending a letter to the board calling it unethical conduct and claims if yahoo does not let him go, they will take legal action.

and there could be some resolution today to a high-stakes fight between two silicon valley giants being oracle and google. a federal jury in san francisco expected to deliver at least a partial verdict in a copyright infringement trial. this is phase one. oracle accusing google of stealing technology from java a programming platform owned by oracle. 4:45, executives from facebook are hitting the road today to convince investors the social networking stock will be a great investment when it goes on sale later this month. before sending the sales force out, mark zuckerburg put a video online last week. the founder and ceo makes the case that access to facebook's 900 million users is really what's up for sale here. >> we all use facebook. we all have a lot of things there. but if it's suddenly our news feed is showing up with all kinds of advertising, you're going to bail.

he needs to tread carefully not to anger users. >> the ipo stock price is expected to be between $28 and $30 a share. could make for a rocky day out on wall street. for that news, we turn it to jackie live at cnbc headquarters. good morning. >> good morning to you, jon. well, the futures are lower this morning as investors are reacting to the election results in france, germany, and greece this weekend. the new leadership or lack of new leadership could throw the austerity measures in doubt which would raise fresh concerns about europe's debt crisis. and here in the u.s., we're going to get one piece of data on consumer credit. also reports later this week on inflation and the trade deficit. we saw stocks dropping on friday on the back of that disappointing jobs report, as well. the dow falling 168 points to 13,038. the nasdaq losing nearly 68 to 2,956. and warren buffett is

playing down concerns about his future at berkshire hathaway after recently announcing he's been diagnosed with prostate cancer. that was a focus of the shareholder meeting this weekend. buffett says it has little affect on his work. he recently considered making a more than $20 billion acquisition but didn't end up happening and he wouldn't name the potential target. finally, more food makers and restaurant chains are jumping on the gluten-free bandwagon. dominos plans to announce plans to sell a gluten free crust. it's still made in ovens with regular pies. anheuser busch rolling out the gluten-free mickalob ultra. and pf chang's adding seven more menu items, as well. >> thank you very much. keeping it gluten-free. >> on a monday morning. >> trying to keep it fat free too. so stay tuned. >> delicious. one thing that was gorgeous

was the weekend's weather. fabulous. >> that was scrumptious over the weekend. more warm weather. put that on your captain crunch this morning. i want to warn everybody who works outside whether you're a postal worker, you're someone who works outside construction wise, you want to make sure you are hydrated today. it's going to be warm out there. and it's kind of a dry heat. we don't have a lot of humidity. you're not going to be sweating as much as if we normally did. drink lots of water today. talking about the 90s. wait until you see the seven-day outlook. looking a lot like summer around the bay area. make sure you're ready for a warm week. high pressure's the reason why it's set up over the great basin. for us, that means offshore winds will pump from land to sea warming as they push out to the pacific ocean. for us today, temperatures about four or five degrees warmer than where we ended up yesterday. if you have the day off, if you have the luxury to hit santa cruz, spectacular out there today. a little bit of cloud cover left

over at that point. but by 4:00 p.m., spectacular sunshine yet again. take a look at some of these highs today, 90s in los gatos. 81 for fremont and san francisco and oakland in the 70s for today. tomorrow, we're talking about the upper 70s in places like san francisco. could hit 80 in oakland tomorrow. by wednesday, we're going to increase your clouds and cool you down a touch. but holding on to that abnormally warm pattern all the way through the upcoming weekend. break out the shades and sunscreen and put the umbrella in the closet. >> unless it's at the beach, right? >> there we go, all the way around. 4:49 right now. the 49ers leaving san francisco, but the city not getting left high and dry. the deal the 9ers have made with city leaders coming up. and a san jose teen is among the best in the nation for her music. >> and you don't want to hear me make music. but we're making good time for 24 despite construction through

there. might be a little fog, but brace yourselves for spectacular weather. christina loren says some areas in the bay area, 90 degrees. sunglass sunglasses, sun block, get it all. >> ac maybe a little too. 4:53 now. san francisco may have lost the 49ers, but winning some consolation prizes. the city struck a deal with the team for $1 million which will go towards its parks department. 49ers can either break the lease or stick around another season in case their new stadium is not ready. candle stick park concession employees will also have the right to similar jobs at the new stadium and both sides will work to host a super bowl. willie mayes celebrating his 81st birthday on sunday and his beloved team. a victory wrapped up in milwaukee. mayes blowing out the candles on his cake there. i don't think they quite got 81 on there. giants up 2-1 in the fourth, two batters later, oh, yeah, the bat's on fire.

giants go up 3-1 here, then now to the ninth inning. giants up 3-2. can they wrap it up? not just yet. the brewers answer tie this game up at three. they're getting a little extra bang for their buck, extra innings, that brings home emmanuel burress. meantime, the a's try to return home with a series win, down 4-0 in the third against the rays. that gives the a's their first run. oh, yeah, kiss that one good-bye. a three-run jack. a's take the lead and never relinquish it. the a's on a roll now, go on to win it 9-5. >> boys of summer. got to love it. what about the traffic? usually start slow about this time. picking up? >> it's getting a little more crowded out there.

there's more cars on the road. you can count them now. but so far, no disturbance as far as the flow for 101. we did have a traffic break, unfortunately that deer was hit and killed on the southbound side of 101 at university avenue. that activity now cleared from the center divide and what remains as far as the car there is over on the shoulder and no lanes blocked. looking at a smooth flow here but then further north. this is a little more common. 280 with reports of a deer here, as well. this is southbound side at 92. no reports on the condition of the deer, but both the vehicle and the deer are parked in the center divide right now and there should be a little slowing as flashing lights arrive. we'll track this for you on the peninsula, but so far no major issues. right here, these crews moving some cones blocking that lane closure and the construction just a little further north. the glow to the lights indicating moisture in the air. we'll track this crew, but so far it's there until you get to the north side. folks heading through towards 5:00.
