beautiful live look outside over san francisco. gorgeous start to your tuesday morning, may 8th, this is "today in the bay." good morning to you. thanks so much for joining us, 5:00 right now, i'm laura garcia-cannon. >> good morning, everybody. i'm jon kelley. and this morning we're following developing news. neighbors in complete shock over the killing of a mother and daughter in their very own home. bob redell live in pleasanton. and bob, the question right now is what are police saying about this tragedy? >> reporter: good morning to you, jon. police are not saying whether this was a murder/suicide or a double murder. they're not ruling anything out. they do tell us that the father and husband is not a suspect. he returned home around 6:00 last night when he found his wife and daughter inside their home here on stacy court both had been shot. his wife was already dead, his daughter still alive, he called 911. she made it to eden medical center where she ended up

passing away. the mom was amy freeman burton, 37 years old, the daughter ansley freeman 13-year-old. she along with her mother and father just moved to this neighborhood a few months ago from missouri. one neighbor describes them as having been a sweet family. reporting live here in pleasanton, "today in the bay." 5:01 this morning, a safety warning about a sexual assault suspect who lures victims with a friendly handshake. police are advising women to be careful along the bike path in livermore. that's where a young man who called himself gabe approached a woman monday. officers say he extended his hand as a greeting, then pulled the woman close and groped her. the woman yelled and ran away. the suspect is still on the loose. police say there have been at least seven sexual assaults along biker jogging paths in that city since 2006. and this morning, an east

bay toddler fighting for her life after being viciously attacked by the family pit bull. christie smith is live in oakland where that 2-year-old is suffering from bites to the face and legs. what a tragic scene there, christie. >> yeah, good morning to you, jon. you know, the latest information that we have is that the little girl suffered some pretty severe wounds but was last listed in stable condition. she was flown here to children's hospital in oakland after the family dog attacked her and bit her in the face. and leg and head according to firefighters on the scene. this was yesterday evening at the family home on the 4,300 block in concord. a 2 1/2-year-old little girl, family members didn't want to talk with nbc bay area on camera, obviously distraught about what was going on about this pit bull attack. and at this point, it's unclear what led to the mauling. >> concern with first and foremost taking care of the

child, receiving emergency care. there's always the potential we'll be investigating whether or not they have any knock. if that was the case, there's potential they could have a case of criminal charges. >> reporter: well, they say so far it doesn't look like it's happened that way. animal control seized the dog right after the attack. and one neighbor who spoke with us says he was quite surprised by all of this because the pit bull was not unattended and did not appear to act aggressively. christie smith, "today in the bay." the city is naming a new pedestrian bridge after a toddler who died on a stretch of train tracks. alexander was struck by an amtrak train in south san jose back in 2005. the 2-year-old was trying to follow his babysitter who was illegally crossing the tracks. zander's crossing is now being constructed near the scene of the accident. it will open this summer.

a new clue bringing some hope this morning for a missing teenager in morgan hill by the name of sierra lamar. "today in the bay's" marla tellez with more on the first break in this case they've had in months. marla, good morning. >> reporter: jon, good morning. that break is a vehicle description. and for those of you who have not heard this yet, sheriff investigators are asking everyone to be on the lookout for a mid 1990s red, four-door jetta with a distinct black hood. it's similar to what you're seeing right here. now, detectives say they do not have a license plate number, but this type of car was spotted near sierra lamar's morgan hill home the morning she disappeared, march 16th, almost two months ago. officials close to the case are calling this new lead significant and sierra's mother, marlene, says it gives her renewed hope. >> it is a lead that everybody can focus on.

you know, before we have to be really careful as far as not jeopardizing the investigation. but the word's out now. >> so how did investigators get this new lead? well, they say surveillance cameras captured a red jetta not only near her home, but where evidence was uncovered. they believe this is more than just a coincidence. back here live at burnett elementary school in morgan hill, this is the meeting point for the weekly searches for sierra, hope continues to hang as you can see on the banner behind me, we love you, we miss you, bring sierra home. and if you have any information for investigators or a tip, you can call 408-808-4500. this morning, a call for action to stop the vigilanolenc an oakland school.

they will hold a news conference at 8:45 this morning at fremont high school. they're concerned about rising crime in the area. so far, this year in oakland, they've had 45 homicides. laura, it proved to be a deadly combination. a volume and alcohol overdose to blame for the death of thomas kinkade, 54-year-old kinkade was found dead in his home near los gatos last month. a coroner's report shows kinkade may have also taken the drug ghb. he battled alcoholism for years and recently had a lapse also suffered from heart disease and hypertension. a key ruling could come today in a hearing on whether ross mirkarimi will be removed from office permanently. a judge is expected to decide whether mayor ed lee can use a video of mirkarimi's wife displaying a bruise on her arm to a neighbor earlier this year. the bruise led to domestic violence charges against mirkarimi and his guilty plea to false imprisonment charges.

the mayor has accused mirkarimi of official misconduct and is making the case to force him out. san mateo county trying to lock up a funding plan for the county jail. breaking ground this year on chemical way in redwood city regardless of state funding. this morning at 9:00, the county board of supervisors will hear a proposal to grant initial $20 million in construction funding for the $150 million facility. this should take about 35 months from the ground breaking for the jail to be up and running. 5:07 right now. this morning, plans to open a walmart grocery store in pleasanton delayed. it's been vacant for a couple of years. but a city council member asked to delay the decision after labor groups questioned walmart's alleged involvement in bribery to expand in mexico. the council will revisit the issue next tuesday. christina loren joining us

and it's starting to feel a lot like summer. >> it is. the dog days of spring is what i'm referring to it as. we have another hot one today and we're going to keep climbing heading into this weekend. today just about as warm as it was yesterday. tomorrow, slightly cooler and then we climb all the way through sunday. wait until i get to that seven-day forecast. in san jose, now, i have heard from many people who do not even suffer from allergies how bad it's been lately because of the high pollen count. and today we've got another high one for you. we can check on these levels any time at nbcbayarea.com/weather. but if you do suffer for allergies or have been recently, try to limit your outdoor activity as much as possible. we have better news for the weekend. 80 degrees inland today, by noon up to 86 degrees by 4:00 p.m., 76 by the bay, and 72 degrees at the coast. what that means is mild conditions by the water. beautiful beach days and a little bit toasty inland.

if you work outside, stay hydrated and seek that shade whenever you can. 5:08. let's check your drive with mike. >> look at the south bay again. showed folks all this construction. now already having a change over on your left. you see the exclamation point. highway 85, just moved that crew, should be clear in the next few minutes. but 280 and 17 down the middle of your screen, one, two lanes at the most with construction on those freeways. the ones circling over on the right, that's tully road, the onramp should be clearing in the next few minutes. crew, no delays reported. so far, by the time you get there leaving your house, it should be reopen for you. the full closure, that is highway 17 southbound as you're heading down toward the summit. and you're going to have traffic diverted over and one lane apiece while the northbound side is closed. southbound side takes both sides of traffic. there's traffic control there and that'll be in place until about 6:00 a.m. expect a bottleneck there, but the volume's light right now.

welcome back, everybody. we give you a nice picturesque and very colorful shot even though the sun's not up over san francisco right there. you can see some orange, blues, greens. a rainbow out there. going to be a nice day of weather, as well. it is 5:13. you know, yahoo's new ceo apologizing over that confusion over his college degree. >> he says he's sorry for the controversy that has distracted employees, not that it exists or why it happened but that it was a distraction. here's the text of the note. provided by the associated press. i want you to know, he says, how deeply i regret how this issue has affected the company and all of you. we've been working very hard to move the company forward, he says, and this has had the opposite effect. for that, i take full responsibility and i want to apologize. now, as soon as this morning, we

could hear something from yahoo's board over what it plans to do about thompson. thompson says the minute the board tells him, he will tell employees as we've reported earlier. fred amaroso leads the investigation into the matter. we presume it's the fundamental question not answered in the apology, and that is how did all of this happen? you may recall yesterday, we were talking about an ultimatum thrown down by daniel loeb that thompson be fired or yahoo face some kind of consequence. he sent a letter demanding all the paperwork associated with thompson's hiring, like his resume, and gave yahoo five working days to provide it. i can without reservation say that jackie deangelis graduated from cornell. she joins us from cnbc. good morning. >> those stats are accurate.

looking at the futures, they're lower today as investors continue to consider the impact of elections over the past weekend. there are still some concerns that the future of budget cuts in greece are in doubt of the country parties forming a new government. the european markets were down, asian markets mixed overnight. there's no major economic data in the u.s., but we are going to get earnings from the likes of directv, wendy's, and disney. the dow falling to 13,008, the nasdaq edging up to 2957. meantime, americans are seeming to pull more plastic out of their wallets again. the fed saying that consumer borrowing surged more than 10% in march. that was led by credit cards, student loans, and new car loans. that's the biggest monthly jump we've seen since 2001. but analysts expressing some reservations about whether this indicates a pick-up in demand or if people are relying more on credit to pay for things in a tough economy. and finally amc entertainment is reportedly in talks to sell all or part of the number two u.s. theater chain.

the new york times says the deal could be worth $1.5 billion and talks have picked up recently after amc dropped plans for an ipo. owning 350 theaters in the u.s. and also has a distribution company called open road films which puts out smaller budget films like "the gray," an action drama starring liam nissom. >> we'll take a look a little later. coming up now, talking about the forecast. getting hot out there. >> too hot for golfing that you're so accustomed to this time of year. especially inland or you could just hit one of those coastal golf courses. a little bit more expensive there, but the weather's going to be fantastic. and a lot of people sent me pictures yesterday jumping in their pool. so finally, your pool is warm enough to get on in there. we're going to have great, great days for hitting the water.

as we head through this week and this upcoming weekend staying nice and hot, no rain in the future, 51 degrees in oakland, 50 degrees in san mateo and 50 in san francisco. what is in our future is a stronger onshore flow tomorrow. one day of relief, especially at the coast with more of the low clouds bringing in cooler weather for tomorrow. today, though, offshore flow yet again. the winds pumping as they warm from land to sea. and temperatures just about as hot if not hotter in some cities today. i think you'll see just about the same at the coast today. but take a look at this. if you can hit the beach, they were jam packed on a monday yesterday. 73 degrees at noon in santa cruz up to 81 degrees. great day to hit the water. you want to stay hydrated inland because take a look at how warm it's going to be. 89 in livermore, 89 in concord. and whenever you have that concrete, that radiates the heat back out into the atmosphere, it gets even hotter. you want to try to seek shade today, work outside and bring that water bottle with you.

84 degrees tomorrow. don't forget those giants back on nbc bay area tomorrow night. thursday into friday, staying nice and warm, up to 88 degrees. the warmest day will be mother's day. if you want to make plans outdoors inland, do it early. however, it also means that conditions will be phenomenal right by the beach for you and mom. check your drive with mike. >> lots to consider. all right. we'll go over here. this is by the water. we're focusing on the road. we have an unspecified road hazard. and usually that means debris eastbound. the reason i'm concerned, yesterday middle of the day we had emergency repair work. i don't know if this is related yet. chp gives us an update. i'll let you know if that will affect the commute. right here, this exclamation point, also a wind advisory issued overnight. it's still there, but i haven't heard any problems here or for the dumbarton bridge. we do have still this

construction zone going on. this is southbound 880 approaching 92. construction blocking one lane, but you see a nice flow and the volume of traffic not a big concern. construction already picking up on 680, 24 eastbound, through lafayette, we still have some construction there. and westbound just got word that a deer has been hit in the area and maybe a couple of lanes affected by that. i'll let you know as we get details there and also reports of a fire. surface streets 99th at mcarthur. no one injured as far as we know, but this will be a problem for local traffic. watch the fire crews there. back to you. >> thank you very much. we can tell you wine makers scrambling to get enough grapes to meet that current demandment wine consumption is on the rise, but the main ingredients in short supply. wine sales rising 6% last year, this year growing even faster. this is also news with -- there's a shortage of new vines. it is considered the oscars for the restaurant industry and

welcome back, everybody. tuesday morning as we give you a live look at the golden gate bridge out there. little bit of fog in the air. it's going to be a little bit of a cool start to the day, but christina loren tells us it's going to crank out that heat quick. it is a new day for the giants, which is a good thing because yesterday certainly was a doozy. the giants lost to the dodgers 9-1 after finding out the pitcher is now suspended for 100 games. major league baseball says he tested positive for the banned substance. his agent says the pitcher took children's cough syrup which contained trace amounts of the substance. he will appeal the suspension, but cannot suit up until that appeal is heard.

so what is clenbuterol meant to alleviate asthma symptoms in horses. it is also known to increase lean muscle mass and reduce fat deposits. it's not approved for humans or food-producing animals. phillies' pitcher cole hammel is out five games for drilling bryce harper on sunday night right there. puts it in his back. he admits, yeah, he intentionally threw at the 19-year-old washington rookie because it's the old-school way to welcome somebody new to the majors. yeah. nice to meet ya, kid. ham hammels will have to pay a fine for his deed. it is going to be another warm day. make sure you dress for the two parts of the day as we do have a cool start. temperatures right now in the 50s. 54 in livermore, 53 in sunnyvale. meanwhile, we have the upper 40s back on the temperature map this

>> reporter: good morning to you, laura. police tell us it was the father who came home from work around 6:00 last night, entered his home here on stacy court in pleasanton, and inside found his wife already dead from a gun shot wound. his 13-year-old daughter also shot but still alive. he's the one who called 911. and an ambulance rushed her to eden medical center where she later died. the mother was amy freeman burton, 37 years old, the daughter ansley freeman. police aren't sure what led up to the shooting. they did interview the father at headquarters they tell us, say he helped them out answering questions. they say he is not a suspect. and by the way they're acting, it does not appear they are looking for a gunman. police won't say whether this was a murder/suicide, but not ruling anything out. we spoke with a neighbor who says this was a sweet family who just moved to the neighborhood a few months ago from missouri. reporting live in pleasanton,

bob redell, "today in the bay." a toddler fighting for her life after being viciously attacked by the family pit bull. we'll give you a live look where the 2-year-old is being treated for her injuries. she was attacked in her family home monday on rose lane in concord. officers say the dog bit that girl on her face and on her legs. a neighbor who did not want to appear on camera said the dog was always on the leash but did not appear to be friendly. another neighbor had this to say. >> this dog was not a problem, was not out unattended at any time i was aware of and i'm sure the rest of the neighborhood would say the same. >> well, the dog is now quarantined, and it is possible that some criminal charges could be filed against the owner if the dog has a known history of being aggressive. "today in the bay's" christie smith is outside the hospital this morning and an update on the little girl's foundation in about one-half hour. it is 5:31 right now.

new information on the victim of a deadly officer-involved shooting in oakland. the man killed during a police chase early sunday is identified as a high school senior alan bluford. police say the 18-year-old and two others ran as officers attempted to make an arrest and bluford pointed a gun at an officer. one officer accidentally shot himself in the foot. bluford was on probation for burglary in san joaquin county. we're getting a look at two of the men suspected of robbing a taxy driver and stuffing him in the trunk of his own cab. police say these men held up that driver at antioch nearly two weeks ago. they then forced that driver into the trunk before driving the car to oakland. the driver was released unharmed about an hour later. he was able to flag down a passing car and then call police. officers found that cab the next morning on 83rd avenue. all three suspects remain on the loose. 5:32, after almost two

months of searching, a new lead is bringing in new hope for the family of sierra lamar. marla tellez live in morgan hill with the first break in the case since the teenager disappeared back in march. the first big break they've had. >> reporter: significant. in fact, that is what santa clara county sheriff investigators are calling this break, laura. they say this is very significant. they are linking a jetta to the disappearance of sierra lamar. they say surveillance cameras captured images of something similar to what you're seeing here, a mid 1990s red jetta, they found this near her home the morning she went missing. they spotted it. this was back in mid march. the car was also spotted in areas where evidence has been found. now, investigators say from the tape they're looking at, they cannot tell if sierra was actually in the car that day, but they have reason to believe this car is suspicious. sierra's mother was relieved to hear progress is being made. >> there's a reason why it was

released to the community today. and it comforts me to know that law enforcement is reaching out because they know the sense of urgency. >> reporter: now, we've also learned officials are looking into whether sierra's case is connected to another one in walnut creek. a 13-year-old girl says she was approached by someone in a similar red car two days before sierra disappears. now, the next volunteer search for sierra is actually scheduled for tomorrow, may 9th. you can show up right here at burnett elementary school in morgan hill. check-in time is from 8:00 a.m. until 1:00 p.m. and you must be at least 18 years old to search. live in morgan hill, marla tellez, "today in the bay." san francisco teachers putting in overtime today out in that picket line. they'll be staging a protest at 5:00 outside san francisco's unified school district. offices on franklin street. the union unhappy over layoffs

and districts' demands to cut $30 million from the salaries and benefits over the next two years. a strike authorization vote will be held later on this week. time is running out for protesters to unoccupy land owned by u.c. berkeley. occupy squatters have been camping on the 10-acre site for about two weeks. they say they're trying to protect it from development. berkeley says it needs the land to begin the research projects and willing to negotiate with those protesters. but so far, the occupiers have ignored deadlines and ultimatums and are refusing to leave. it is 5:35 right now. walking out the door, felt almost perfect out there. ideal, a little crisp, on the way to getting a lot hotter. >> take the clicker, jon, just take it. he's right, but take a look at this. this is the reason it feels so great out there this morning. that natural ac, we've turned it on just a little bit. ing up going to turn it on more so tomorrow. bringing in a fair amount of cloud cover at the coast.

the low clouds, but you can still see alcatraz off in the distance. what we do have out there is not going to last very long. we're going to get a gorgeous and i mean gorgeous sunrise this morning about 30 minutes away from now. you don't have to look outside your front door, we'll show it to you right here. areas of coastal fog this morning. i don't care that is going to make it over the bay bridge. oakland, you'll start out nice and clear. very warm today as that breeze builds. this evening, it should be comfortable to sit outdoors. between 6:00 and 8:00, temperatures will be phenomenal inland. talk about the 70s with a nice cool breeze. but one thing that breeze has led to really high pollen count. people who don't normally, traditionally suffer from allergies are riding into our newsroom all over my facebook page about how bad it is. if you're someone who has been suffering, we have another day of very, very high pollen levels. keep that in mind, try to limit your exposure if you can, keep those windows shut for today if that's your case.

80 degrees at noon, 4:00 p.m., 86 degrees inland, 90s in some cities. and just how much warmer we'll be in this mother's day weekend. let's check your drive with mike. >> highway 4 is where we first see the slowing and it's also one of the worst places you can have anything happen at this time of morning. the disabled car, though, has quickly cleared from lanes because folks knew about that. circling the 64 miles per hour, that disabled vehicle was. the reason i say that is because look at these folks coming out of antioch. this is the first slowing around the bay area. speeds down into the 20s where you see the red to a 30 at the l street sensor, but really the slowdown starts off that antioch bridge. now further south looking at westbound 24, your commute direction off the interchange, a deer was hit earlier, and it was blocking a couple of lanes central lafayette exit. chp just cleared it from the report so they must be clearing the scene there, as well. it is no slowing showing up

>> we're looking over here at walnut creek, 24, all the incidents have cleared coming in. the volumes building a bit, 24 slowing in spots as you're approaching or leaving the maze. the volume's building just a bit there. livermore, things are building up more, 16-minute drive out of the altamont pass slowing into livermore. and yesterday, it was a very, very tough drive right here. livermore, westbound 580, and then south down through pleasanton and sunol. planned for extra time there, but we're seeing a shift. a heavier volume over the last month or so as you're heading into downtown. 17, construction right through campbell, but not any slowing on the southbound side. the concern is here right near the summit, in between the summit, we have one-way traffic

control, over one side of the freeway and one lane in either direction until they have this cleared, just about 6:30 in the morning. no major issues, keep this in mind as you travel through the area. smooth drive all the way up the peninsula. the earlier disabled vehicle and 90 has cleared. no problems to and from the san mateo bridge. that means more folks are hitting the road, good stuff, and that should clear up over the next few. and further north into the city, nice, easy drive from the peninsula or north bay. we'll look at the golden gate bridge and show you that smooth drive. we have the lower clouds and crews heading to the north side. there are still a few cones there and a little roadwork going on that should clear. the sky will also clear. but so far, there's a little fog coming in from the marin side. keep that in mind, guys. back to you. >> we shall, mike. thank you very much. this morning, a dramatic, dangerous rescue. recovering right now after diving into a vat of acid to save a co-worker. the 51-year-old worker was on

hi, everybody, welcome back, and good morning to you. that is a picturesque shot out there of the bay bridge. the orange sky in the background, the waves dancing in the foreground feels very romantic. it is 5:52. well, this morning, csu trustees backing off a policy of giving 10% raises to campus presidents. but, of course, there's a catch. they'll ask campus nonprofit groups now to pick up that tab. the board expected to change its policy during a meeting today. under the new rules, new presidents could still get higher pay than their predecessors shl predecessors, but the amount of the raise would be paid for by auxiliary groups. they say the raise would not take away money earmarked for campuses. if you're a big family with older children, you could have

all kinds of cell phone bills. it may get easier. >> the head of at&t's cell phone business says the company's likely to launch a bucket data plan soon. if you have a cell phone, your spouse has a cell phone, your children have iphones, there's a laptop or two with a mobile data plan, that is a lot of different bills. at&t's ceo tells cnet this morning under this bucket plan, the family would get a set amount of data and you can use it any way you saw fit. right now, if data uses very little data but junior uses too much, your billed for that extra. under the new plan, it wouldn't matter, though no word on when it'll start. one of the big video game titles will be late coming to stores and won't make as much money as it'd hoped. add to that, the company says it's going to cut jobs, though the exact amount is fuzzy. ea has been cutting a number of jobs lately and a bit unclear to us how many are new job cuts. but job cuts either way. and the facebook road show
