thanks so much for joining us. 5:00 right now, i'm laura garcia-cannon. >> good morning. i'm jon kelley. and this morning, crews mopping up after a five-alarm fire ripped through a complex, blasting flames 100 feet up in the air. bob redell live at that scene where a long list of homes have been reduced to rubble. bob, good morning. >> reporter: good morning, jon. these were homes under construction not occupied yet. and the fire department is still out here and you can see it's been seven hours since this fire started. it's good reason for them to be out here at this time. you can see in the rubble right there there are still flames perking back up. not sure if that's a gas or a hot spot that decided to kindle back up. there are three buildings that are immediately surrounding the destruction here still evacuated. anywhere from 75 to 100 people living elsewhere this morning. it was those two buildings in front of you that were under construction that burned last

night. the heat was intense, so intense, it set off the fire sprinklers and two occupy buildings next door. blew out many windows. this is the fire that caused the intense heat you're looking at captured by cell phone video. those buildings turned into blow torches. points to the sky, flames shooting so high, people able to see it a mile away. fire arrived on the scene a little after 10:00 last night. they called for a fifth alarm, bringing in units from the county and city of san jose. several hundred people who live in this entire complex had the common sense to self-evacuate. firefighters were able to save the buildings finished and unoccupied. there was some damage, but they're still standing. three stories of open-air lumber were too difficult to save. >> oh, man, the flame was taller than the ladders, the firefighter ladders. and i saw the whole house collapse. the whole thing just fell down. crazy. >> fire department is grateful

there wasn't too much wind last night because they said they did have golf ball-sized embers in the air. some went across el camino real. you may recall several years ago when the massive shopping complex was under construction, it caught fire, embers blew downwind setting other apartments on fire. this time around, they knew to anticipate this. they actually had san jose police up with their chopper orbiting downwind to see if any of those embers were causing problems. they also had police out there stomping out those embers. as far as the cause, this is still under investigation. reporting live here in santa clara. bob redell, "today in the bay." this morning, more questions than answers following autopsies on a mother and daughter found dead in their pleasanton home. investigators say preliminary results still have not determined for sure whether it was a murder/suicide. the autopsies did conclude that 37-year-old amy freeman burton and 19-year-old ansley suffered single gun shot wounds to the

head. the results were unclear on whether her mother's wound was self-inflicted. police are still awaiting lab tests. a berkeley high school counselor accused of sexual harassment will have his teaching credentials suspended. a 16-year-old girl said he touched her and made inappropriate comments. as part of a settlement, smith is allowed to keep working on campus, but must leave the door to his office open. the state is stepping in issuing a seven-day suspension of his teaching credentials starting next month. happening now, investigators still at the scene of a deadly police shooting in san francisco. the victim, a man wanted in connection with a north bay homicide. christie smith joins us live at the scene where officers still inside the apartment where the suspect was barricaded. what's the latest, christie? >> reporter: good morning to you, laura. i spoke with san francisco police still on scene this morning. and what they're telling me is all the residents evacuated from

this apartment building last night where the shootout occurred are now being allowed back inside and that officer i spoke with told me that most of them aren't even here yet because they spent the night with red cross or family and friends. this after a person of interest in a killing was shot and killed here by san francisco police. investigators say this man barricaded himself inside his girlfriend's apartment here on poe street. this began when police went to the apartment to try to contact the man and question him about that killing in roner park about 8:45 last night. they say the girlfriend opened the door and he started shooting through walls and windows. officers immediately called for backup, got out of the way, called in s.w.a.t. and san francisco police. the apartment was evacuated and the streets around this with shut down over the next hour or so, police say he fired and made himself a clear threat. >> over the course of the next

hour, the suspect fired multiple shots through walls and floors, buildings had other people in it. at some point in time in the ballpark at 10:00, the suspect set fires within the apartment. >> police said he was a person of interest. again, they wanted to talk with him about the killing of a 66-year-old woman found dead in her home on tuesday. at that time, police said, that her toyota highlander was missing. the relationship between those if any is still unclear. the good news is, though, no one else in this neighborhood was hurt during all of this gunfire. but san francisco police say they are planning an update at 11:00 this morning at the hall of justice. reporting live in san francisco, christie smith, "today in the bay. this morning, two people facing charges for scamming parents on the sidelines of sporting events. accused posing as a sports official to convince people to give him money for coaching sessions. the mother of his children is

also accused of helping manage this scheme and cashing checks. she's the softball coach in santa rosa. about a dozen people say they've lost between $100 and $300 in this scheme. both being charged with grand theft. the south bay woman would not have much to celebrate this coming mother's day after living in her home for two decades, she's about to be evicted. chery is going through a tough time in her life. she tells "today in the bay" she lost her husband after 50 years of marriage and cannot afford to pay off her mortgage. it's difficult to scrape up enough money living off a fixed income. >> we tried to reason with these people. we've been in litigation for two years. and somehow they circumvented the bankruptcy court. and went to superior court. and they decided they were going to kick us out. >> there is some good news. she was able to find a one-bedroom apartment to live

in, but she had to give up her pet dog. voting gets underway today on whether san francisco teachers will go on strike. the 6,000-member union taking the first of two strike authorizations. wants to cut $30 million from salaries and benefits over the next two years. the union instead wants a 2% raise for teachers. the union says san francisco schools are sitting on an $80 million pile of cash. the district says that is not the case. more cuts will be revealed when governor brown reveals his updated proposal next week. a union source tells nbc, our station in sacramento that deeper cuts are actually looming and it could come in the form of layoffs, furloughs, and 8% to 10% pay cuts. the state budget deficit now looks to be more than $10 billion higher than the governor's january estimate. cash and compassion. two things the oakland zoo says it needs to care for its exotic animals. zoo directors say they have plenty of one, but they don't

have the other. right now zoo leaders going for an all out blitz to drum up support for a tax they want on the november ballot. now, works out to about $12 for single-family homes, and $36 for nonresidential properties. if the measure does pass, the zoo could get as much as $5 million per year. palo alto officials have a new plan to balance the city's budget. artists, athletes, and gardeners could pay the price. the city wants to double the rent for community gardens. there's also a plan to raise studio rents at the community center as well as double the fees for lawn bowlers. last night, the city's finance committee called the fee hike steep. city staff will return next week with a revised proposal. >> i've never had the pleasure of partaking, but i'm guessing it's a good day for lawn bowling. christina loren? >> i still need the blown up

with christina loren. for her environmental fortitude. since the 1960s, she's been fighting to preserve wetlands here in the bay area. marla, good morning. >> reporter: good morning to you both. this is lariviere marsh. this is part of the wildlife refuge. hard to get a good look now, it spans the southern part of the bay, but we want to get to the sweeping aerials to give you an idea of what it looks like during the day. from high above, you can see them dancing around in the wetlands. it is a haven for wildlife out here spanning some 40,000 acres. this refuge, though, may not have ever been if it had not been for florence lariviere.

the 88-year-old began fighting to preserve and restore the wetlands near her palo alto home more than 50 years ago. she teamed up with former congressman don edwards and they established the first urban national wildlife refuge in 1972. >> it may sound corny, but it was democracy in action. you work on the things you care about just because they're important to you. the recognition has been a great surprise and very rewarding. >> she's so humble. over the years, she has received all sorts of awards. but today, it is a big one. she is set to be honored with the national wetlands award from the environmental law institute in washington, d.c. so this morning, florence is not in palo alto, not at home in palo alto, she is in our nation's capital today. she tells me she is very excited to receive the award today. today's ceremony set to happen

"today in the bay." new research finds an alarming number of high school graduates are choosing not to attend the state's public universities. from 2007 to 2010, the number of graduates attending uc or cal state universities dropped 20%. that's according to new findings by the public policy institute of california. researchers say the trend developed amid deepening budget problems that dramatically raised tuition and forced schools to turn away qualified students. facebook warning investors it hasn't figured out the mobile business. this is coming late in the process. >> good morning, we're a week and a day from the ipo. we've known and talked about the fact they don't push advertisements to the mobile users and mobile use is growing. this is a major issue for this young company. facebook revised the ipo

paperwork, the stuff you read as you decide to invest. to read, "we do not currently generate any meaningful revenue from the use of facebook mobile products and our ability to do so successfully is unproven. the company continues the road show. it stopped playing that half hour video after complaints from investors who had already seen it. tomorrow, facebook has home-field advantage as it presents to investors in palo alto. here's an example of how problems in europe affect us. cisco systems, san jose's largest private employer says it's having trouble closing sales of all the routers and servers particularly in europe. and jackie is at cnbc headquarters. jackie, cisco sort of popping our tech bubble. good morning. >> good morning to you, scott. yes, the futures are higher at this hour and cisco is the one to watch after the company warned that customers are being cautious with i.t. spending and taking longer to close deals. and like you mentioned, they mentioned europe as a specific area for that.

meantime, we saw stocks falling again yesterday, closing off session lows. one trader calling it the rumor monger olympics yesterday. rumors flying about whether spain may need a bailout. also rumors on greece where it may be denied the next round of bailout money. but it ended up turning out that greece will get its money and spain is only taking over one bank at this point. here in the u.s. today, data on unemployment and trade deficit as well as import prices. we saw the dow fall 97 points to 12,835 yesterday. the nasdaq lost 11 points to 2,934. mother's day spending expecting to bloom this year. the national retail federation saying consumers are expected to spend $18.6 billion on gifts for mom. an average of $152 a person up from 140 last year. about two-thirds of us will buy flowers while some will treat mom to new clothes. and consumers will shell out

those flames were so intense there nearly 100 people who live nearby are still out of their homes. "today in the bay's" bob redell live at that scene where hot spots are still burning we're being told. good morning. >> reporter: good morning to you, jon. yeah, we spoke with santa clara fire who said anywhere from 75 to 100 people are evacuated. firefighters are surrounding the building. they have their water hoses still on the ready aimed at the ruins because every now and then as you've mentioned we've seen a hot pocket flame up. nothing compared to last night. this fire was so large you can see as captured by cell phone video, it could be seen a mile away. that happens when you have three stories of lumber with no sprinkler system. the fire department knew they had a mess on their hands a little after 10:00 last night. the commander called for a fifth alarm. there are about 50 firefighters involved when it was all said and done. the heat was so intense, it set

off fire sprinklers and blew out windows in the surrounding buildings. firefighters succeeded in keeping the occupy buildings from burning down. they're still standing and they will be fix bable. but the -- not these two that were still under construction. >> man, crazy, because they just wasted tons of money on it and now it's gone in a blink of an eye. >> reporter: a big concern were golf ball-sized embers blowing from the scene. fortunately it wasn't too windy last night, but because of lessons learned several years ago, firefighters did have the police chopper up orbiting downwind keeping an eye out for embers. investigators are still looking for the cause. reporting live, "today in the bay." dozens of people left homeless by a four-alarm fire will meet today to plot their next steps. flames destroyed their apartment complex in san francisco's mission district on sunday. four firefighters and two residents were injured and 37 people including seven children were left homeless.

today, a community meeting for the victims will be held at sf friends school on valencia street at 5:00. it is 5:32 right now. this morning, a man fighting for his life and a woman is injured after being shot in vallejo. officers found the two victims wednesday night not too far from the city park on louisiana street. so far, no suspects have been identified. happening now, officers still at the scene of a deadly shooting in san francisco. and residents of an apartment building where the victim was barricaded are now just being let back into the building. live at the scene with with more on this gunfire. >> well, i can tell you that homicide investigators are gone. san francisco police are still on scene sitting in a patrol car outside. they tell me they're keeping this specific apartment off limits, but residents who were evacuated from this apartment building last night are being allowed back in this morning. but so far, we haven't seen any

of them come back in. and an officer told me that most of them left for the night and went with the red cross or a family and friends after a man that police say was wanted for questioning about a killing on tuesday opened fire. this started about 8:45 last night when police came to the apartment here in san francisco to question that man. they say the girlfriend answered the apartment door and he started shooting wildly at them. officers got out of the way, they called for backup, s.w.a.t., san francisco police came to help, the streets were shut down in the area. san francisco police showed up and they say the man kept right on shooting and making himself a real threat. >> over the course of the next hour, the suspect fired multiple shots through walls and floors, building had other people in it. at some point in time, in the ballpark at 10:00, the suspect set fires within the apartment. >> reporter: so san francisco police shot that man. now police came to question him

about the killing of a 66-year-old woman who was found dead in her home on tuesday. at that time, police also said that her toyota suv was missing. still a lot of questions to be answered. san francisco police are telling us they're going to have a press conference to update us at the hall of justice at 11:00 this morning. reporting live in san francisco, christie smith, "today in the bay." a north bay teenager charged with being a motorcycle hitman and lamborghini thief is set to appear in court today. accused of stealing a lamborghini belonging to the celebrity chef guy fieri. police found the car searching for evidence following a shooting. san rafael teenager has been charged as an adult with attempted murder, vehicle theft, and other counts. overruled. this morning, a switch to a tough anti-smoking law in union city. gas stations are now exempt from a law that bans tobacco sales near places that cater to kids.

the city's planning commission wants them included. the city council overruling that decision convinced by gas station owners who said they'd lose business to neighboring cities. protesters will rally in the east bay today to encourage b.a.r.t. to shop around. protesters will rally outside a b.a.r.t. board meeting in oakland today. they're asking b.a.r.t. to get a better deal on its plan to overhaul the fleet of trains. b.a.r.t. wants canadian company bombardier to build 775 new rail cars for $1.5 billion. about 2/3 of the train parts would be made in the united states. the second lowest bidder offered a price of $1.7 billion, but promised that 95% of the parts would be made in the u.s. b.a.r.t. will also give an update on the extension to silicon valley. it is 5:35 right now. meteorologist christina loren is telling us about another beautiful week. >> beautiful, beautiful week. we're so close to the weekend

now. and you can enjoy it comfortably outdoors. inland a little warm side. you can bet all your local beaches will be jam packed saturday and sunday with warm weather on the way. today, temperatures running a little bit above the seasonal averages. 50 to start you out in san francisco and novato. it's a little bit cooler out there to start. one thing that really hasn't changed all that much, your pollen levels. i know a lot of people have been writing into the nbc bay area weather center letting us know about their allergies and how bad it's been this season. the good news is, we are going to see a little bit of relief in this department, tuesday, wednesday, thursday looking much better in terms of our pollen levels. if you can bear through it just a couple more days, we do have good news for you in the future. limit your outdoor activities for today. 79 degrees noon inland. at the bay, 69 degrees, great outdoor lunch weather at the coast and bay side today.

potential buyers. well, this morning, strong reaction from both sides, republicans and democrats. now that president obama's been the very first sitting u.s. president to endorse gay marriage. "today in the bay's" tracie potts is live on capitol hill this morning. and of course, plenty of speculation that this may prove a little risky. >> it could, but it could help him raise more money, especially in california. he's got a fundraiser next month with the gay community in los angeles and organizers say they've already started to see interest pick up there. but in terms of this decision, it comes after two prominent members of his administration, including the vice president came out just a few days ago supporting same-sex marriage, and the president in this interview with abc's robin roberts said he affirms, he wants to go ahead and affirm that same-sex couples should be married. after saying for a long time his views had been evolving. what does this mean politically? well, mitt romney very quickly

came out and said i think the opposite. i think marriage should be only between one man and one woman. analysts are saying he could have trouble with african-americans, working class white families and conservatives and evangelicals who may now coalesce and urge people to vote against him. the u.s. conference of catholic bishops called it deeply saddening. president obama said he still strongly believes that every state should be able to make up their own minds and make their own choice on this. jon? >> i'm sure we'll be hearing a lot about this one, tracie. thank you very much. speaking of the president, he is headed to los angeles to a fundraiser today. many of them hollywood heavy weights. george clooney hosting a party at his home in studio city tonight. organizers could rake in between $12 million and $15 million for the president's reelection campaign. president obama will also be in the bay area later this month for several fundraisers. well, it is a major day for a palo alto woman set to be

honored in washington, d.c. today for her green thumb. well, she has spent the majority of her life helping the wetlands around san francisco's bay. "today in the bay's" marla tellez live in fremont where there's proof of all of her hard work out there. marla, good morning. >> reporter: the proof is in the pudding as they say. good morning, her name is florence lariviere. her marsh and trail out here part of the don edwards san francisco bay national wildlife refuge. we can give you a much better look at this refuge from aerials shot by our chopper. you can see all the wildlife out here. the refuge spans a southern part of the bay and covers some 40,000 acres. now, it came to be in 1972, thanks in large part to florence. i spent some time with her at her palo alto home. she tells me it was back in the 60s when she knew she had to do something about all the development she was seeing along the peninsula.

>> look at all the things we've done to the bay. garbage dumps, airport runways and i read this little notice in the mercury news that said if you're worried about san francisco bay and what's happening to the marshes, come to my office tomorrow at 10:00. >> reporter: and so she went and she ended up working with former congressman don edwards to establish this refuge in 1972. now, she has been environmentally active ever since and she has dozens of awards to prove it. today she gets another one. she is in washington, d.c. she is set to receive the national wetlands award from the environmental law institute. she tells me she is very excited to be there and to receive this award. but at 88 years old, she says she certainly does not expect all the attention. i told her, she deserves it. live in fremont, marla tellez, "today in the bay." a looming deadline could

lead to the closure of 70 state parks unless state lawmakers reach a compromise. who bay area state senators are pitching a plan to keep about 50 of those parks open. the plan would basically reallocate $41 million to cover a $22 million shortfall in all state parks and the recreation budget. the bill would mean simple majorities in the senate and assembly to reach the governor's desk for a signature. plans underway right now to help the state's fish population to stay above water. 60,000 baby salmon will be released into fisheries in half moon bay later on today. state fish and game trying to restock its farms after losing fish to delta water pumps. overall, biologists say more fish will be spawning in the central valley than in recent years. conservation and better ocean conditions also helping with that population growth. 5:46 right now. want to check the temperatures with christina loren. it's been a nice week. >> it has been. and we've got mother's day

sunshine. tomorrow, we warm up into the 90s. isolated 90s in the warmest cities across the bay. one thing we have been dealing with is good air quality in every county across the bay area until now. unfortunately, the north bay, your air quality starting to suffer a little bit. still in the moderate range, but we'll keep watching this with no significant change in the forecast. no rain on the way. our air quality will likely suffer as we head into this weekend. we'll be keeping an eye on that for you. today's highs work out like this. 83 degrees in san jose, 85 in livermore. and temperatures on the mild side right by the water. 72 in san francisco today, 73 in santa cruz. we're talking about the 80s at the beach this weekend. we'll let you know which beaches will be the warmest and also watching your pollen levels, as well. a lot of people suffering from allergies. better news in that department coming up. first 5:48, we want to check your drive with mike. >> and i checked on the golden gate bridge. no flashing lights clear from our shot and no incidents reported. i'll continue to monitor the north bay. we'll jump back to the south bay where we have a lot of clearing going on.

101 here and here, tully and alike. they've all cleared for the overnight construction. no major slowing except for here. look, highway 87 just like the previous couple of days. we see early slowing north of capital expressway. tough commute in general for a lot of spots. we'll continue to follow that. 280 at 17, a crew reported there still, but likely to clear soon because we'll get a live shot out there. i've been monitoring this, as well. we've been looking at 17 as you're coming up toward 280. that's where construction was reported. flashing lights clear about 20 minutes ago and no activity since northbound 280 has also remained clear. although report of a crew blocking one lane. i haven't seen any inactivity coming up toward this interchange. we'll get back out to the maps and show a smooth flow along the peninsula. that crew in the eastbound direction should be moving soon. and it's opposite your commute, not a big deal right now. a smooth drive approaching the bay bridge and only watching this incident here, blocking your left lane northbound 880, back to you.
