hearing right now. can you hear now, christie? >> reporter: yeah, i hear three people. >> go ahead, take it away, christie. >> reporter: yeah, good morning. well, what's in the last two minutes or so, there was a pickup truck that was sitting right here where these three gentlemen were standing. someone got in it, turned it on, and drove it away. and they backed up this amtrak train. we believe it is a capital corridor train. now i took a quick look inside and i didn't see any passengers inside it. but what's been going on here this morning basically is that we've had a lot of investigators from union pacific and a couple of other agencies looking at a pickup truck that to the amtrak train clip. i spoke with one gentleman here this morning and he thinks what happened is perhaps the vehicle, there were several of them here, people just moved them out of the way. maybe they were parked a little bit too close to the train

tracks. so, again, within the last couple of minutes, someone got in and just moved that truck to the other side. i spoke with the berkeley fire department, and they're telling me there were no injuries at all. we have seen some crews here from union pacific checking the tracks out and that sort of thing. but for the most part, the train has just been sitting still since we got here this morning. i haven't seen any passengers off the train. one gentleman did tell me that this was a capital corridor train and that they're just looking at the tracks right now and trying to get everything back up and running. i do have calls into amtrak this morning. haven't heard back yet. but the good news, no one was hurt, and at least for now, they have that truck that was sitting right here. it's been moved to the other side. so that's what we have from here. we're at 3rd in berkeley. back to you guys in san jose. >> christie, thank you very much for that update. that could affect the morning commute as well as a situation at a b.a.r.t. station in san francisco.

that closed it for a short time. we want to check the morning commute right now with mike on how both of these are going to impact our morning. >> christie showed that the pickup truck had been pulled off the tracks. that's good news, that's progress, but train 518 is still sitting there on the tracks and i'm just checking the capital corridor service right now for trains 521, 522 and only registering 6:00, maybe 6:05 for their departure. it's 6:02 right now, i think that'll be updated soon. so far that train not moving. stopped right now between berkeley and richmond as that day gets started. now, no word on the status of the train coming into or out of richmond. we haven't heard of any delays. if you get to the richmond station, that might be your best bet getting out of the area or into the area you can transfer there. tell folks to transfer at the richmond transfer station before the b.a.r.t. line. that that's the end of the line. you should be able to get back into the area and you have to take the b.a.r.t. system for the rest of your trip through the bay area. that's one option for you.

now, also on the b.a.r.t. lines, the 24th station like laura talked about was closed for a period of time due to police activity that has reopened, 24th at mission has reopened and no delays for the b.a.r.t. system. 16th was your alternate. 16th and mission that station is fine, as well, guys. we'll track the rest of your commute coming up. 6:03, and new this morning, less than half an hour away from the opening bell on wall street and a big buzz this morning, heading into the day is jpmorgan chase's announcement it lost $2 billion in only a few weeks. scott mcgrew live in our newsroom really flabb ebergastf. >> this has been washington's concern all along. and the irony is what jpmorgan chase did will actually be against the rules, but not until later this summer. you want more irony? the head of jpmorgan chase was the leading critic against this rule nicknamed the volcker rule that would've saved his bank billions. what seems to have happened is that a banker in london made

bets that the economy would get better, those bets called hedges are supposed to help banks protect against their investments in going bad. he was wrong. these are the same sort of bets called derivatives that brought down the financial system back in 2008. after the financial crash, washington set in place certain rules like the volcker rule that prevent banks from making certain investments with your money to prevent this from happening again. now, the head of jpmorgan chase admits this morning he has egg on his face. i do want to point out one thing, jpmorgan chase owns chase bank, your neighborhood bank on the street corner there. your money is absolutely unaffected. your money, they lost their money for now. this company makes billions of dollars per quarter, jon, so, in a weird way can kind of afford to lose $2 billion in two weeks. it's been unhappy about it, but it will not affect your money in any way. >> not good business all the way around. thank you very much for that update. this morning, uc berkeley's

research farm in albany where occupy protesters have been living since last month now sealed off. police allowing them to leave the site, but not enter. however, protesters on san pablo avenue are being allowed to pass food and water over the fence to those inside. the land being used for plant research, and occupy protesters want the university to turn it over for part of its community for farming. 6:05. today, oakland mayor jean quan among others will rally in support of programs. days before the governor releases that revised budget. deeper cuts are reportedly looming and they could come in the form of layoffs, furloughs, and pay cuts. right now the state deficit is about $10 billion, which is higher than the governor's estimate back in january. today's rally will be held at noon at laney college. there are new details at the devastating fire in the town home complex. the builder telling "today in

the bay," he believes the five alarm blaze was an accident does not add up. bob redell live in santa clara where some people are still out of their homes. bob, good morning. >> reporter: yeah, good morning to you, jon. the plan was to release some of the residents back in the two buildings that were damaged. you've got the construction site burned down, two buildings that suffered damage. the plan was to let those people back in their homes yesterday. but they found some new damage in there, the fire department, they're not going to let them go in there until they're able to fix that. as for the investigation, this fire at this town home construction site was so large that santa clara fire has had to call in the county's arson task force to help figure out the cause. we don't know if they have already, but we do know they want to speak with witnesses who saw someone pumping a liquid on to the site a few hours before it caught fire around 10:00 on wednesday night. and here's something else that raises questions, the builder of these town homes, they tell us

friday morning. what are you tracking right now? >> still tracking the activity through berkeley on the tracks. first, let's get the overview of the roadway. a smooth drive on the eastshore freeway, and caldecott tunnel through oakland and berkeley. but, yeah, we're busy watching this accident where christie smith is live updating that scene. but so far, i've been checking the capital corridor service and although berkeley has no updates as far as the progress for their train that is still on the tracks 3rd and camelia, train 521 has left the richmond area. if you take b.a.r.t. over to the richmond transfer station, you should be okay getting on the capital corridor lines from that point and heading eastbound if that is your route. a small brush fire reported just off the castro valley y, not really afrifecting the flow of traffic. and out of the altamont pass, as well. a traditional build, you guys coming out of the altamont pass and in through livermore. back to you. thank you very much.

6:09 right now. b.a.r.t. is on track to replace much of its fleet with next generation rail cars. canadian-based firm lombardier will fill the order. protesters say they don't use enough american workers and supplies. executives with the company say a majority of the train parts will be american made and all of the cars will be assembled here. well, laura, tonight the search for sierra lamar going from local to national. the case will be featured on "america's most wanted." just last month, a camera crew following volunteers as they searched for the missing 15-year-old. they also interviewed her parents for the show. santa clara sheriff deputies say the girl was likely abducted near a morgan hill bus stop back on march 16th. a teenage it had girl now facing attempted murder charges for allegedly setting her boyfriend's bed on fire while he was sleeping.

they did with a former toxic site. it is 6:15 right now. pleasanton teachers have agreed to a new contract that could save the district more than $2 million. the contract could result in four furlough days for teachers and counselors if the state cuts more funding for the 2012, 2013 school year. it could mean increased teacher pupil ratios at the middle school and the high school levels. >> great weekend for riding a bike and we are hours away from the seventh annual amgen tour of california. the lead bicycle race kicking off sunday in santa rosa before heading to san francisco and to santa cruz county. stage three starting on tuesday in san jose before a winding through contra costa county and finishing in livermore. racers will ultimately make their way through parts of central california before finishing up all the way down in l.a. on may 20th. raiders' receiver darius hayward bay will go to court on may 31st. chp arrested him around 2:00 in the morning on april 7th.

isolated 90 or two in places like gilroy, but overall, tomorrow, looking much warmer. we're starting out nice and mild, high pressure's keeping things on the mild side to start. we don't have any of that marine layer to point out at this moment in time. hazy conditions. but i don't think we're going to see the marine layer penetrate across the bay this morning. it's very, very thin and what's left is moving out quickly. we're talking about little bit of coastal fog. little bit warmer in the coastal cities tomorrow. but we're talking about a big-time warm-up in your inland cities. the microclimates making things a little difficult. it's that time of year. if you want to take mom to the beach on sunday, we'll cool down by about 5 degrees from saturday's highs. pacifica, 73 degrees, nice light breeze, keeping things comfortable. half-moon bay, 74 degrees come mother's day. and the warmest beach city will be santa cruz at 5 to 10 miles per hour, 77 degrees on mother's day. that's a great way to celebrate mom, take her to the water.

at&t and oregon state university. well, this morning, michelle's husband and the president obama was taking a tour of western states leaving l.a. to talk about the economy. "today in the bay's" tracie potts is live on capitol hill this morning. this is controversy this week, but yesterday the president spending the past few days shaking some hands and raking in cash while his opponent has been busy apologizing, correct? >> exactly. let's start with the president because he was there in california down in l.a. last night. big fundraiser at george clooney's house. did you hear about this one? $40,000, plenty of people hanging out outside trying to get a glimpse of him. it was the biggest single fundraiser ever. democrats say the money's been pouring in since president obama announced he's supporting same-sex marriages. vice president biden has apologized for jumping the gun or as he put it, announcing his own support of a few days earlier.

meantime, republicans say they're going to use this as a key difference in the fall between the president and mitt romney. mitt romney's dealing with something else as it comes to same-sex and gay couples. he is actually being accused of being a prep school bully in the "washington post," an article says when he was in high school, he pulled a student out of his dorm. he and friends surrounded him, pinned him down and cut his hair. romney says i don't remember anything like that, but i did a lot of stupid things when i was in high school. and if i hurt anyone, i apologized. brand new this morning from that student's family, the victim telling nbc that the portrayal of the student is factually incorrect and agreed he would be used to further a political agenda. jon? >> thank you very much for the report. and president obama back in california may 23rd right here in the bay area. he's planning to attend three fundraisers all in one day. redwood city, palo alto, and aberton, a price tag of $35,800

you made it to friday morning, it's may 11th, this is "today in the bay." good morning, thank you very much for joining us, i'm jon kelley. >> and i'm laura garcia-cannon. we continue to follow breaking news where investigators are at the scene of an amtrak train accident in berkeley. the train hit a truck parked on the track. christie smith joins us live at the scene she's been gathering information all morning. what do you know now, christie? >> reporter: i just spoke with an amtrak police officer and he says what happened here this morning is that a worker at a steel plant were on 3rd and camelia parked his pickup too close or on the back end of the train track. that was here when we arrived this morning. but since then, they've been able to get the train off the tracks. the train involved is being

moved forward. what they did a couple of minutes ago is they brought in another train and moved the passengers who have been stuck here since about 4:45 on to another train so they could carry on. this is a capital corridor train that was going from oakland to sacramento this morning. what happened just a couple of minutes ago they're telling me is that the engineer on the train that was stuck basically said that he was fired. he called for backup and they brought in a second engineer, a second train to carry on this morning and get those passengers moving. so you can see at this point the train is gone. they gave the all clear to the tracks, maybe ten minutes ago. i asked if this was common practice with people parking their cars here and they told me that unfortunately sometimes it is. no one was in that pickup truck at the time. but when we first arrived, there were maybe three of them lined up right here and then three more right over there. so they say that's an infraction.

obviously you don't want to do that. they've been talking with some of the steel workers out here reminding them not to leave their trucks, their cars, their vehicles so close to the tracks. reporting live in berkeley, christie smith, "today in the bay." new details on that raging fire at a townhouse complex in santa clara. investigators at this point sorting through eyewitness accounts over what may have started the fire. bob redell is live in santa clara is live at that scene been there the last two days. bob, what are you hearing now? >> reporter: well, good morning to you, jon. first the issue of residents that are still evacuated. the plan was the two buildings that were damaged, they're the ones in the background there to let them back in yesterday, but the fire department found some damage in there, things that need to be fixed. they're holding off. it's to be determined when they'll be let back in. as for the investigation, this fire at the town home construction site was so large that santa clara county has called in the arson task force to find out the cause. they do want to speak with witnesses who saw someone

back before cameras talking about the b.a.r.t. officer convicted of killing their son. grant's mother, wanda johnson will hold a news conference to denounce the court hearing this week appealing his conviction. oscar grant was unarmed when he shot and killed him at the b.a.r.t. station. he was convicted of involuntary manslaughter nearly two years ago and served 11 months of a two-year sentence. this one is a story we first brought to you last night as breaking news about a man shot by san francisco police. investigators identifying that man as dennis hughes. police believe he beat his mother to death on tuesday in their home and that they shared then fled in her highlander and hold up in his girlfriend's apartment in knob hill. when police confronted him, he started shooting at them. investigators found the missing highlander in the surrounding area. and tonight, hundreds of families will take it into their own hands to try to crack down on prostitution. at 6:00, a rally will be held at

17th avenue and international boulevard to draw attention to the growing prostitution problem there. that is in the san antonio and east lake neighborhoods. jean quan and police chief howard jordan planning to speak. organizers want a strategy to try to fight prostitution, including community police partnerships and more targeting of johns and pimps. some progress has been made. we can tell you more than 20 security cameras are now installed along international boulevard. scott mcgrew has been reporting all morning long about the $2 billion -- $2 billion loss at chase bank. getting a quick look at how the markets are reacting so far. they're down a little bit. kind of fluctuated. let's check in with scott, though. did you think it would be more at this point? okay. we'll just take a look at the big board right now. and we'll keep our eye on it this morning. but down about 64 points so far.

6:45. new homes and new hope. today the city in san jose will celebrate the opening of an unusual affordable housing project. the twist is, it was built on what used to be toxic land. "today in the bay's" marla tellez live at the site in san jose. good morning. >> reporter: good morning. it is hard to believe this property out here used to be toxic. you can get a look for yourself. it is nicely landscaped.

this is the family apartments. the complex is right off monterey highway just down from communication hill. now today it is the official grand opening, but i can tell you at least some of the apartments are already filled. i spoke to one man who told me he moved in about a month and a half ago. he says he and his neighbors are enjoying the home. the complex includes 92 homes, four stories, it is affordable sto housing. for families who make up to $57,000 a year. the project has been in the works for a couple of years. now here's a little bit of the background. this two-acre lot used to house an auto wrecking yard. now that business left behind a mess of spilled oils and high levels of lead. so the state department of toxic substances control stepped in and gave the city of san jose about $500,000 grant to clean up the site. so talk about a complete makeover. now, i placed a call this morning to officials to find out if there are any vacancies left.

in livermore. even some of your metropolitan cities ending up in the mid-90s. a little bit of fog this morning, mostly at the coast. we're not picking much of that up. looking really comfortable. couple of the beach cities really, really nice. san francisco at the marina, 67 degrees at noon on sunday, that means 73 degrees at 4:00 p.m., beautiful conditions there. if you wanted to take mom to santa cruz, here, as well, even warmer, 72 degrees at noon with full-on sunshine by 4:00 p.m., warming you up close to 80 degrees. mother's day looks good. in fact, very similar to what we're expecting today. tomorrow is that day you want to seek shade and stay indoors if you can't take the heat. 84 degrees in fremont, and 76 degrees for today. in santa cruz, here's that three-day forecast. you can see 93 degrees on saturday, 88, dropping back down to the upper 80s for mother's day. we've got a little bit of that coastal fog and drizzle monday into tuesday with onshore flow back in the mix but offshore flow resumes wednesday into thursday and as a result your

minutes, the amtrak train that clipped a pickup truck took off that way in the direction that it was headed all along. what happened is that a second amtrak train came and picked up the passengers and carried them on towards sacramento. this is a capital corridor train running from oakland to sacramento. and an amtrak rep tells me this morning that the pickup truck was parked too close to the tracks and actually the back end of it was on the tracks. he said it belonged to a steel plant worker here in berkeley. about 4:45 this morning, he says, the train came along and hit the back of that truck. the workers showed up a short time later with keys and actually moved it. got it right off the tracks, they checked the trucks out to make sure nothing was wrong. now, i just maybe a little while ago finally saw a train, an amtrak train moving in the opposite direction and for the first time this morning, we're starting to hear movement. we're starting to hear trains go

by. as a matter of fact, we see one right now and it's going at a good speed, what looks like the normal speed. the one that came here a little while ago was going very slowly because crews are still here checking out the tracks making sure that everything is okay. of course, this is an infraction. you don't want to park your truck so close to the tracks. and when we got here, there were maybe six cars or trucks very close here and an officer told me that is an infraction, they were reminding the workers here not to do that. in fact, one investigator said and i'm putting it nicely what he said is it wasn't the smartest thing he'd ever seen. reporting live in berkeley, christie smith, "today in the bay." the builder of a santa clara townhouse complex partially destroyed in the five-alarm fire said an accidental cause doesn't add up. bob redell live at the scene with the latest on this investigation that right now has really got some people out of their homes for a second straight day. bob, not a great morning for those folks. >> reporter: no, it isn't.

good morning. especially considering they were supposed to be in yesterday. santa clara fire investigators are not commenting on the cause yet. the fire department is still out here. they're actually here to preserve the scene until investigators tell them otherwise. and this fire was so big and so significant because it destroyed so much that they've actually called in the county's arson task force to help them figure out what caused this to burn wednesday night. we don't know if they have already, but we do know they want to speak with witnesses who saw someone pumping a liquid on to this construction site a few hours before it caught fire, 10:00 wednesday night. and here's something else raising questions. the builder of these town homes, shea homes tell us there was no electricity on this site yet. >> we were still at the framing stage, really, and that no one was on-site for three to almost four hours, it's -- it's odd. >> reporter: this was a five-alarm fire, the flames were

shooting so high. we understand, some people were able to see them from a mile away. back here out on the scene. you've got the construction site in the background. a couple buildings -- construction site in the foreground, couple buildings in the background that suffered damage. the plan was to let the people who lived in those buildings go in yesterday, but apparently there still need to be repairs. it's to be determined when they're going to go back in their home. anywhere from 10 to 12 units. reporting live here in santa clara, bob redell, "today in the bay." 6:54, a teenager facing attempted murder charges this morning for allegedly setting a boyfriend's bed on fire while he slept. police say 18-year-old jacqueline rivera slipped into his redwood city home and used an accelerant to start that mattress on fire. the fire was quickly extinguished, but not before the 21-year-old man suffered minor burns on his hands and arms. officers say the girl started the fire because she thought her boyfriend was cheating on her. tonight the search for sierra lamar going from local to

national. that case will be featured on "america's most wanted." last month, a camera crew following volunteers as they search for the missing 15-year-old and interviewed her parents. sheriff deputies say the girl was likely abducted near a morgan hill bus stop back on march 16th. tonight the nbc bay area investigative unit continues to follow your money. this time, more than $1 million tax dollars spent to study erectile dysfunction and the accurate reporting of a person's sexual history. asking why you paid for it. >> the first sentence of the description reads, improving self-reports about high-risk sexual behavior. >> right. >> that says to me they're trying to get people to more accurately report their high-risk sexual behavior. >> yes, that's exactly what it says. >> reporter: as part of the federal stimulus program, taxpayers spent $1.2 million to fund that study. the money went to the university
