good morning to you. thanks so much for joining us. 4:30. i'm laura garcia-cannon. >> i'm jon kelley. we have breaking news to tell you about. richmond police are swarming a neighborhood this morning. that's where christie smith joins us live near the intersection of l street and bay view avenue. she has all of the latest details. what can you tell us? >> reporter: good morning to you. i can tell you that several blocks in each direction are behind crime scene tape this morning. details still coming in right now. waiting to hear from the richmond police. it is believed that there is a man barricaded in an apartment up the hill here. possibly armed. now what neighbors are telling me that this stand-off situation

happened at least five hours ago. they say that more and more keeps coming up. they tell me this is the crescent park apartment. right near 580. it is believed that s.w.a.t. teams are on the way. neighbors tell me that they were actually told to evacuate or stay inside of their apartments because police weren't quite sure what was going to happen next. i asked if anyone had heard any gunfire or anything like that. they tell me for the most part it has been quiet. more and more police coming to the area. we understand that a public information officer from the richmond police department is on the way. and as soon as we hear from that person we will let you know what they had to say. that's latest from here. reporting live in richmond. christie smith, "today in the bay." >> obviously developing story there. we will keep on that this morning. >> absolutely. it is 4:31. first check on weather. meteorologist christina loren to tell us about the hump day forecast. >> hump day looking okay. good morning to you. temperatures are already in the

50s and nice and mild to start. we are headed towards the mid 80s. looks like this will be the warmest day of the week. your full forecast is moments away. let's find out if will are any problems on the road. >> no problems. road crews working hard. eastbound 24. westbound had a couple lanes blocked. it clears up. ooeps bound not showing any slowdown as you head towards the walnut creek interchange. very early. we did have debris. big piece of metal was on highway 4. that got cleared up. routine, says the crew. westbound highway 4 not showing any slowdowns yet either. more construction for 680 south of here. i will show that to you coming up. >> thank you very much. also new this morning, significant changes coming to the south bay with san jose city council now approving a list of groundbreaking measures. >> among them, a cap on payday lenders. protecting low-income families.

as well as tax incentives for developers to bring more people to the downtown area. and a law cracking down object underaged drinking at parties by going after the host. we begin with that story which has its roots in the tragic death of a high school student in 2010. good morning, marla. >> reporter: good morning. it has been almost two years since leyland high school grad sean ranari was killed in a drunk driving accident behind me in south san jose. it is one of those tragic stories of drinking and partying that just turned tragic for him and his teenage friends. robari was passenger. his 16-year-old driver had a blood alcohol level twice the legal limb white he crashed his suv. he died at the scene. the driver made it out alive. a couple of months later, 2010, san jose city councilwoman nancy pyle began pushing for the social host ordinance and now it

is officially on the books. here's what it does. it makes homeowners liable for gatherings of four or more underaged drinkers on their property. regardless of whether the party creates a disturbance, also regardless of whether a homeowner is home at the time or are even aware of the party. until now, homeowners could be fined important having underaged drinkers on their property but only if it causes some sort of a disturbance. so, again, this -- social host law wipes out that loophole. the san jose city council voted unanimously to pass this to see san jose is the largest city in the region to now adopt a social host slot. marla tellez, "today in the bay." city council voted to crack down on payday lenders. members approving a cap on a number of lenders that can set up shot the city. the vote makes the san jose the largest city to limb at this time number of payday lenders. city also is the first to block

lenders from opening close to poor neighborhoods. sponsors say it attracts low-income families. a change could be coming to the skyline as the council approves incentive for residential builders. those incentives include 50% break in construction taxes and 50% reduction in fines in fees that the developers would have to invest in parks. the council also eliminated a requirement for expensive air containers system for firefighters in high-rise buildings. >> today marks two months since sierra lamar vanished from her neighborhood. searchers for the 15-year-old have been ongoing since she failed to show up for school the morning of march 16. the divers have also been searching nearby reservoirs. the sheriff's office originally announcing they found a red jetta believed to be connected to the case. another volunteer search scheduled for this morning at 8:00 a.m., burnett elementary in

morgan hill. still no suspect in the homicide investigation in castro valley this morning in a followup to the story we first reported early yesterday. sheriff's department investigators gathering bags of evidence from the home on omega avenue. a body was found in a home monday night by deputies who are conducting a probation search. the victim has not yet been identified but we do know a woman and her adult son do live inside of that home. a neighbor says that the son had a party there on sunday night while the mother was out of town. the neighbor says there was a fight outside during the early morning hours. 4:36. construction project remains on hold this morning at valley medical center. construction crew excavating for a loading dock dug up 15 pine boxes back in february. now inspectors say 1,500 more bodies are still underground. it dates back to days when it was called county hospital.

a map from 1932 shows the cemetery on the northern part of the property. >> based upon where that is located and the spacing of the boxes, i believe that there are anywhere up to 1,345 boxes that would be in the ground there. >> the site was a graveyard. the cemetery disappeared from county records in 1958. the county has hired an archaeologist. there's last-minimum shuffling as we approach that facebook ipo and we are seeing mixed signals leading up to that big day for the future shareholders. this could be good news. demand for facebook stock so high right now that cnbc reporting the company will sell 85 million more shares at its ipo. this after the social network raised its proposed price to as high as $38 per share. facebook also lost a key

advertiser, general motors says that it is pulling the plowing its $10 million advertising october the sites. gm simply says it is not getting results it expects from facebook ads. >> i think they are keeping their page to like them. we are debating whether you call it pop or not. depends where you live. city council approve ad ballot measure that would impose a fee on businesses to sell sugary drinks. businesses would have to pay one dent per ounce or 12 cents for every can or nearly $3 for each case. the measure is aimed at reducing the con uppings of sugar-sweetened drinks and generating additional revenue. the measure will be on the november ballot. if approved it will take effect in january of 2013. looking to clean up foreclosed homes in its neighborhoods and asking big banks to help foot that bill. city expanded its program tuesday. banks are now required to register homes in the program's database.

won't be able to form a coalition government. now the european and asian markets are lower today. here in the u.s. we are going to get data this morning on how to start and building permits as well as industrial production. this afternoon we get the minutes from last month's fed meeting and also looking at target reporting its earnings before the opening bell. the dow falling 63 points yesterday. 12,632. four-month low. nasdaq losing eight points to 2893. and also watch shares of jcpenney today. they fell more than welfare% in the after hours session. reporting on bigger than expected first quarter loss. customers not happy right now with the chain getting rid of the big sales throughout the year in favor of an every day low price strategy. finally, virgin atlantic letting passengers use their cell phones on certain flights. new york to london for now and 20 other routes later this year. only six people at a time are going to be able to access the plane's satellite system but you will be able to make and receive calls, send texts and access e-mail all for the cost of international roaming charges.

sunnyvale, san jose. might be tough guy. not even need it. by noon temperatures are going to jump into the 60s. all works out like this for today. we are talking about temperatures climbing as high pressure moves into the area. what's going to happen as you head through the next 48 hours, little area of low pressure passes to our north. as a result, it ushers in a strong onshore flow. we are talking about fog, little bit at the coast. even more tomorrow. that marine layer will move all the way inland. breezy and mild for today. little bit of drizzle tomorrow morning. here's your forecast. i wanted to point out we are only going to see that fog bayside and at the coast. mostly clear start here in san jose. east bay. and temperatures will climb to about 65 degrees. in san jose by noon, meanwhile, 70 degrees in livermore at noon. rounding out the day with plenty of mid 80s our temperature map. tomorrow the 70s return. we are going to warm up just a little bit on friday night. those giants take on the a's at 7:15. withdrew want to miss that game. 81 degrees saturday.

occupying transit buses today. they are trying to send a message to make public transit more affordable for low-income communities. organizers say that bus drivers will be honoring the protest. transfers from more than one use up to three hours will be accepted. it is 4:54 now. always on our transportation beat, mike is here to tell us what's happening on the roadway. >> occupying the traffic. >> lockdown. >> you know, traffic center, we are looking at 101 northbound. kind of an odd configuration for construction. blocking the center lane and then skipping one lane over to the left of center lane. lanes one and three have construction reporting north of shoreline. no select despite the bright lights. odd shift going on. probably moving smoothly through the area but sounds unusual. rest of the construction, middle your screen, biggest issue. 280 at 17. we have a number of spots with construction in the zone. but 280 at 17, that construction
