in just a few hours, pleasant hill will be getting its own in and out burger a few miles away from another very controversial potential location. i'm christie smith, i'll explain coming up. no food, no water for seven days. the man is found alive this week after crashing his truck. why it took searchers so long to find him. plus, unlimited no more. the move verizon is creating buzz for data users. and a live look outside. that is the golden gate bridge. a little bit of fog in the air. not a lot of traffic. but it is good news. thursday, may 17th, this is "today in the bay."

a few more minutes. the taillights heading south from the curves down to lincoln avenue. pretty dark over there and pretty light flow of traffic. no slowing, novato past the bridge down to the golden gate bridge. back to you. >> thank you very much, mike. time now to satiate that appetite. this one is a first for central contra costa county. >> in and out burgers, it's wetting your appetite, but not for some. they're opening their doors in pleasant hill after losing a food fight with neighboring walnut creek. christie smith live in pleasant hill with more on the much anticipated opening. good morning. >> reporter: good morning to you, laura and jon. you know, it's so new that you can't even smell the burgers yet. but that familiar look is here brand new and ready to go as you said, the first in and out burger here on contra costa boulevard. the first in this part of the county opens up a little later this morning. but just the idea of opening up an in and out in this general area didn't come without a

fight. in and out had planned to open a second location on north main street right along the pleasant hill border of walnut creek. but a lot of residents were upset, they complained. not that they didn't love the burger and fries, but they were concerned about all the cars tied to the burger chain's popularity, potential noise and potential trash impacting their neighborhood. now, it's unclear where that stance in the company's decision in terms of trying to move forward with that right off of 680. but this one is good to go. it's got 98 seats, a drive through lane and jobs about 50 newburgher associates hired starting at 10:50, an hour, opens up later this morning, will be open up sunday through thursday and 1:30 a.m. friday and saturday. reporting live in pleasant hill, christie smith, "today in the bay." new this morning, police in martinez asking for your help trying to identify a suspect vandal this morning. take a look at this surveillance

photo. police believe this man is connected to a vandalism spree that happened back on may 6th. police say graffiti sprayed on several businesses there, and if you recognize this person, you're asked to please call martinez police. well, the vice principal at a south bay high school is facing felony charges for sexually ail salting a teenage girl. a 32-year-old assistant principal of activities at leyland high accused of having unlawful sexual contact with a minor who is a student. the alleged incident happened last september. he was charged yesterday with two felonies and one misdemeanor. he has been placed on paid administrative leave. 4:34. san jose police say it is a miracle a man is alive after missing for seven days with no food and no water. more than a week ago, michael sanchez junior lost control of his ford pickup on highway 101. a witness says he saw the truck go down an embankment and crash into a field. the same witness reported seeing

sanchez get out of the car and walk away. but the chp found no sign of him. seven days later, san jose police returned to the scene hoping to collect more evidence and they found sanchez still alive. >> he actually was out there for seven days and found alive. so i know that the investigators were elated to know that they actually found someone that they essentially rescued. >> detectives have not talked to him yet. they hope to interview him later today. also this morning, a sophisticated pot ring now dismantled after a federal bust in the east bay, more than 20 under arrest today. some facing life in prison if convicted. now, a tip led to federal agents to a home in discovery bay where several people allegedly grew marijuana for money. also targeted, a business called growers choice hydroponics. they confiscated weapons.

the man accused of bludge bludgeoning a man to death, tried to restrain the 23-year-old dewitt to transport him to the hospital wednesday morning. the sheriff department says dewitt swung at the deputy and hit him in the mouth. dewitt whose family says he is mentally ill is accused of beating a 67-year-old berkeley hills homeowner to death with a ceramic pot back in february. 4:36. a man infected with tuberculosis is in jail for refusing to take his medication. health officials say 34-year-old armando rodriguez has t.b. which can be spread through the air. in this photo presented by the d.a.'s office, rodriguez seen wearing a protective mask. prosecutors say he was arrested for refusing to take that medication missing doctors appointments, and endangering public health. he faces two misdemeanor charges. well, questions and concerns unearthed along with bodies at a

san jose construction site. and a new push to have all those coffins removed. it's a story we first broke right here on nbc bay area. santa clara county planning to file a petition asking the court to remove 100 of the coffins found at valley medical center. county leaders say the bodies may have been buried in the 1930s and were likely people whose families could not afford proper burials. construction on the new parking center is now on hold at the medical center while that investigation continues. and this morning, fed up grocery workers across the bay area delivering a very strong message to their employers. starting at 7:00, they'll be getting on buses and heading to 24 grocery stores. the workers employed by lucky, rowley's, and safe way say they're demanding a contract that provides good jobs and affordable health care. at 4:00 this afternoon, the buses will converge. this is in downtown san jose for a mass rally. well, an unusual sight today

some point on your morning commute, especially over the course of the next two hours. cool and cloudy conditions. breezy at times for today and a much warmer weekend shaping up. your day part forecast works out like this. hour-by-hour detail, vividly displays the clouds hanging through noon, 70 degrees at noon inland. so as you make your way home from work inland, you're going to get peaks of sunshine. talking about cloudy conditions just about all day long. hey, that keeps things nice and cool for all you outdoor enthusiasts. if you're hopping on a bike getting in your car, mike knows what could slow you down. >> we watch out for those, but just fine, christina. highway 17, a disabled tractor-trailer, the truck is what we were watching at the interchange with highway 9 just reported as a completely cleared from the system and no problems through los gatos. for highway 17, though, a little blip around highway 5. i'll track that as well as the rest of the south bay. we're looking at 17 and 880

around the 280 interchange. slowing shows up there, but construction in various spots and that's probably why we see that going on. 85 and 280, more construction, as well as 101 heading out of mountain view. from shore up to embarcadero, we have construction on both sides of the freeway for the bay shore stretch there. and should be a smooth drive despite that construction zone. dumbarton bridge, eastbound construction for one lane. and remember, memorial day weekend, that bridge is completely closed. that's the same weekend we have our celebration for the golden gate. san mateo bridge is just fine, but getting on to southbound 101, westbound 92 has construction there on the ramp as well as the milbray onramp. road crews are busy at work as you get to work, but no other issues for the peninsula. >> thank you very much, mike. it's 4:40 right now. unlimited data plans about to become a thing of the past for verizon customers. verizon scrapping unlimited data plans for customers when they move to the higher speed 4g

hey, welcome back, everyone. and good thursday morning to you. taking a live look outside, overlooking san francisco, transamerica pyramid there. cooler temperatures across the bay. we'll check in with christina coming up. 4:45. decision 2012, president obama taking a break from the campaign trail today as republicans close ranks behind mitt romney. the presumed gop nominee continues to criticize president obama's track record with the economy. romney also picked up an endorsement from herman cain this week. cain now urging tea party skeptics to unite behind the presumptive nominee. >> governor romney gets it right on the big issues. president obama gets it wrong on all of the big issues. >> we really cannot afford trillions of dollars of new federal spending. >> meantime, president obama prodding congress to raise that debt ceiling. he says lawmakers need to put aside politics and try and get some work done.

but in an election year, we know neither side is willing to compromise. well, the final stage in the john edwards campaign finance trial, closing arguments getting underway in a few hours from now. prosecutors will start followed by the defense will follow then the government getting a final rebuttal. the judge expects to read lengthy instructions to the jury in the afternoon. and jury deliberations are planned to start up on friday. we're just a day away from facebook's big ipo. the company sets the share price later today. in the meantime, the markets are hoping to break a losing streak. for more on that and the rest of the news before the bell, we turn to seema mody. good morning. >> good morning to you. just as you pointed out. futures are trading higher after stocks failed to hold on to gains early wednesday. worries about greece offsetting positive economic data on factory output and housing. the markets were spooked by

reports that the european central bank was pulling support from several greek banks. japan's economy grew more than expected this winter. europe right now is trading in negative territory. we'll also get data today on new filings for unemployment that will surely be a market mover. in terms of stocks i've been watching today, walmart reports earnings before the open. the dow falling 33 points to 12,598. the nasdaq, the tech heavy index losing 19 to 2,874. the number of foreclosure filings fell in april to the lowest monthly since september 2007. the numbers could rise. florida and 26 other states that require sign off on foreclosure documents are starting to work through huge backlogs of paperwork. also, the countdown is on to the

most anticipated ipo in recent memory. facebook will price shares after the closing bell on wall street today with an expected range between $34 and $38 a share. the "wall street journal" says for facebook to be the biggest ipo ever, shares would have to price at $41 or more. that would raise about $19.85 billion topping visa's offering in 2008 which raised $19.6 billion. so, guys, again, facebook ipo continues to be the elephant in the room. >> it sure does. we will see if people will like it. thank you very much. >> and speaking of facebook. high-end businesses now bringing more services to the peninsula hoping to cash in on facebook. employees who will have a lot more cash to burn. one of those services is a private jet membership. of course you've got to have that. surf air announcing palo alto as a new base of operations. that'll happen today. the company is a members only
