so much for joining us, 5:59 i'm laura garcia-cannon. >> and i'm jon kelley, and a couple of hours from now, the santa clara sheriff's department will tell us more about the arrest of this man, garcia-torres being charged with murder and kidnapping in connection with to sierra lamar's disappearance. >> bob redell live outside the santa clara county jail. investigators arrested garcia-torres. we begin with bob redell with the latest on the investigation. bob? >> yeah. good morning, we're outside the main jail here in the downtown san jose. where the suspect is in jail facing charges of kidnapping and murdering 15-year-old sierra lamar. the sheriff has promised more information at that news conference that jon mentioned which was scheduled for 8:00 this morning, a couple of hours from now. law enforcement arrested garcia-torres around 6:00 last night at a safeway in morgan hill where he works. they brought him to the

sheriff's office for an interview, and as you can see they escorted him out for a ride over to booking at the jail. the sheriff tells us he is the registered owner of the red vw jetta seen around sierra's home around that morning of march 16th around the time that she disappeared. investigators did have him under surveillance prior to his arrest, and they do have a lot of physical evidence they tell us that connects him to her disappearance. >> public safety is our main concern. we don't want anyone else hurt. we don't want any more girls taken. >> reporter: there's not much information they're telling us about the suspect except for the fact that he is 21 years old and it is our understanding he is a resident of san martin. the sheriff has told the lamar family about this arrest and clearly it's difficult for them and they do intend to attend this news conference later this morning. the sheriff's department does not know where sierra lamar's body is. so they're asking the public not to give up on that volunteer

search effort. they'll be taking place again tomorrow, down south in morgan hill, and that, of course, is where my colleague marla tellez is outside that safeway. good morning to you marla. >> bob, good morning. this is the safeway where the arrest happened last night about 5:30. now, i spoke to an employee inside. he tells me he knows garcia-torres. when i asked him what sort of a guy he is and if he's surprised by this latest arrest, he tells me no comment. in the meantime, i've been speaking to people as they make their way inside to get their reaction. they tell me they are shocked and saddened. one woman had not heard about this latest news until i told her a minute ago. here's her reaction. >> oh, my gosh. i am glad they found somebody to give the family closure, but it's still -- it's heartwrenching, and to have it so close to my home because i'm not that far away. i'm extremely shocked.

ill thought there was a chance that she was still alive. >> my nephew went to school with her. so i really hope they find her alive. but i'm really glad they got somebody. >> reporter: that last gentleman there holding on hope. the sheriff office, again, presuming sierra lamar is no longer alive. but urging the community to help bring her home. since her march 16th disappearance, there have been weekly volunteer searches that start at burnett elementary. that's not far from where we are this morning. those searches typically happen on wednesday mornings. it's unclear if a volunteer search will happen tomorrow. live in morgan hill, marla tellez, "today in the bay." and our legal expert steven clark has been working with us on this case. he says a lot remains unknown, but garcia-torres could face the death penalty. clark talking about the challenges of a case if a body is not found. >> there are prosecutions without bodies. and i think that's why they will

there. just a beautiful sunrise over the city by the bay, but what you will notice is we do have a pretty thick marine layer and it's pushed all the way inland. dealing with more cloud cover than we did, it'll clear. about an hour, maybe two hours earlier right at the coast. more sunshine courtesy of a building breeze. winds are going to pick up today. and your temperatures will be comfortable, but it's going to be a little blustery later on this afternoon, especially through the east bay hills. a little fog at the coast this morning. we do have low clouds moving inland, breezy to gusty conditions later on this afternoon. you'll be at 70 inland as you break for lunch, 69 bay side and 68 degrees at the coast. so really comfortable conditions today and tomorrow and then things change, your seven-day in my next report. first, let's check your drive with mike. >> the slow down starting for the south bay right on schedule for a traffic tuesday. circling 101 north of 680 and 87 which they just changed the sensor readings, but we had slow driving for about 15 minutes.

we have the volume increasing heading into downtown just in the last few minutes, and also northbound 101 at montague expressway. an accident although all cars off to the shoulder. this could cue speeds down to the 50s just around -- just north of the airport there. we continue up 101 and we're looking at the southbound side now. southbound 101 at willow road, another issue there, an accident first started with a stalled vehicle, yukon hit by another car. this is a slow lane southbound 101 around willow road that will be an issue and definitely a distraction, as well. as we get a live look at the bay bridge, we know there's a fog advisory that had been issued by chp overnight, but now low clouds hanging out there has the cash lanes are backing up, the metering lights should be turning on in about five or ten minutes. and we're looking at another issue over on the city side. we'll see if things clear from the golden gate bridge or if i get more details. >> okay, mike. we'll look forward to that. new this morning, a news

conference now just hours away on the future of the golden state warriors. the owner of reds java house on piers 30 through 32 says warriors' top brass are planning on building on that front property and his restaurant will be able to stay. crews started setting up tents for a 10:00 a.m. news conference for city leaders and the warriors. also new this morning, the commercial era of space travel is officially underway. overnight a commercial supply ship owned by the company space x rocketed away. space x was founded by billionaire elan musk. if all goes well, it will dock on friday. >> still a lot ahead on that one. well, new questions this morning about the abuse of power by berkeley's police chief. a report released by the berke my police department shows chief michael meehan sent four sergeants to track his son's

stolen iphone in january. they worked two hours of overtime at taxpayers' expense. no report was ever filed with the department. the iphone was never found. now earlier this year, chief meehan apologized for sending a sergeant to a reporter's home demanding changes in a newspaper article. that led to an audit of the police department's media policies. this morning, the oakland unified school district is now a target of a federal probe. a federal grand jury will investigate the force. it's unclear what federal investigators will be looking for. but district officials expect it will be twofold. the first concern allegations that the former police chief used racial slurs against another officer. the second deals with a deadly officer-involved shooting outside of a school dance. in that case, police shot and killed a man after he allegedly tried to stab an officer with a screwdriver. no word yet on when that probe

explaining what led investigators to garcia-torres and why the investigation right now is far from over. >> and we were looking for anyone who had seen where that car was. we still want more information. if there's any witnesses. >> well, smith will speak again at a press conference coming up at 8:00. sierra lamar's family expected to be there, as well. and we'll, of course, have more live reports on this developing story coming up a little bit later on. well, this arrest coming off weeks of investigation. and the fact the suspect has already been charged with murder is extremely significant. here's the investigative unit with more on that. >> sources have been telling us for several days the sheriff investigators already close to making an arrest, close to closing in on the man they believed responsible for the disappearance of sierra lamar. sheriff department confirming last night that in morgan hill they arrested antolin garcia-torres, a 21-year-old male from morgan hill after spending several days in a 24/7

surveillance on the man. he also have a known address in san martin. lamar disappeared on march 16th on her way to school. the searches were not able to find the missing teen. the big break came last week when police took possession of that red volkswagen jetta. the car was seen on surveillance in the neighborhood around the time lamar disappeared. now a reliable source told us last week there was a dna match between the red car and sierra lamar's clothing. last night, 21-year-old antolin garcia-torres was taken into custody. and this is significant. he is charged with one count of murder and one count of kidnapping. this is the first time since lamar disappeared that the sheriff's department confirming that sierra is not alive. a charge of murder clearly says investigators and the district attorney this morning believe sierra lamar is dead. in the newsroom, i'm nbc bay area's tony kovaleski. >> continuing coverage all morning long for you on that.

it's 6:13 right now. in other news, bogus bar codes led to the arrest of a silicon county executive. 47-year-old thomas leganbach is accused of stealing lego blocks by sticking fake bar codes over the real ones. the s.a.p. executive seen in surveillance video swapping those bar codes to pay hundreds of dollars less than the original price. in san carlos, a search of his $2 million home uncovered hundreds of lego sets. he also used an ebay account to sell legos for $30,000. he did not respond to our request for comment. the men accused of beating bryan stow and leaving him with severe brain damage appear in court. today a judge hearing evidence to decide if there's enough to bring sanchez and norwood to trial. the hearing coming a little more than a year after stow was attacked in the parking lot after the opening day game

against the giants. sanchez and norwood both charged with battery and other felony counts. stow undergoing rehabilitation at the central valley recovery facility. a scandal involving former alameda county supervisor takes a new turn. a list of eight applicants vying to replace her will be whittled down to three this afternoon. the three finalists will face public interviews in june. lockyer resigned on april 20th after reports of drug use and an affair with a method addict. she is married to bill lockyer. today's meeting kicks off at 2:00 in oakland. well, san jose may be on the brink of following in san francisco's minimum wage footsteps. today the city council could vote to increase it from $8 an hour up to $10. by comparison, the national minimum wage is $7.25. only a handful of cities actually nationwide have their own rates, san francisco is one

garcia-torres, the man charged with murder and kidnapping in connection with sierra lamar's disappearance. we have team coverage this morning, christie smith is live in morgan hill. she talked to torres' sister just moments ago. live outside the jail where torres is being held. and marla tellez live outside the morgan hill safeway where investigators arrested him. but we begin with christie smith and what she just learned from the suspect's sister. christie? >> reporter: yeah, good morning to you, laura. i just got off the phone with a woman who says that she is antolin garcia-torres' sister. she says that she is in complete shock this morning. i asked her how the family found out about this arrest. and she says that they found out by watching the news just like everyone else and since then the phone has been ringing off the hook and they've been trying to make sense of what's been happening. i asked her if she was aware of the sierra lamar case, had been following it, if there were in

ties between her and her brother or anything. and she said she didn't know. she said she knew that the girl was missing but she specifically has no ties to her, did not know her. she says that she hasn't been able to talk with her brother since his arrest and that the family is now looking for an attorney for him. but she thinks that what's going to come out is in her opinion that this is all a big mistake. she says that he's been looking for work and in the past had worked in construction and done electrical work that he has two small children and is expecting another. i asked about that jetta earlier police were looking for a red jetta with a black hood. she said at one point she believes her brother did have a jetta, she didn't recall the specifics about it and couldn't say whether it was tied to this case or not. but, again, she says that the family is in complete shock. but she said they're trying to pull it together and they will be there when he appears in court. that's the latest from here reporting live in morgan hill,

garcia-torres. in the meantime, we spoke to a woman right here last night who saw the arrest happen. >> about 5:30, i was at work and we saw a bunch of cops. pretty scary. i worked right here and we're here until 11:30 sometimes. >> reporter: and here is another look at the 21-year-old suspect. and as the news of his arrest starts to spread within this community today, there is a whole lot of heart ache. >> very young girls, and because of the incidents, i've had a close eye on them. they don't get to go, walk to or from school, we are always with them. and you know, because of this we're very, very vigilant and i'm really sad and i'm really sad for the family. >> reporter: well, not far from this safeway is burnett elementary. that has served as a search post for sierra lamar. volunteers meeting there each wednesday to head out on foot searching those surrounding areas. her family also started a website to keep the community

updated. that website is findsierralamar.com. i checked it this morning, it has not been updated yet with the latest news of this arrest of garcia-torres. the last entry was made by sierra's father. he was marking the two months since his daughter disappeared. that two-month mark was may 16th, just six days ago. now, my colleague bob redell is live outside the santa clara county sheriff's department in san jose with where torres is currently behind bars today. good morning, bob. >> reporter: good morning to you, marla. in jail where garcia-torres is being held without bail. his first scheduled court appearance not until thursday at noon. he faces charges of the kidnapping and murder of 15-year-old sierra lamar. after his arrest around 6:00 last night, the safeway works in morgan hill, he was taken to the sheriff's office here in san jose for an interview, and you can see he was escorted out to take a ride across the street

accused of stealing legos but sticking fake bar codes over the real ones. swapping those bar codes out to pay hundreds of dollars less than the original price. in san carlos, the search of his $2 million home uncovering hundreds of unopened lego sets. >> it does appear it was something that was fun. that was he got some sort of enjoyment out of it. there was some sort of work involved. >> what's not fun is going to court. he also used an ebay account to sell more than 2,100 lego sets for about $30,000. he did not respond to our request for comment. 6:42. a plane crash in southern california leaves an entire neighborhood without power. federal aviation administration spokesperson says the pilot reported engine problems around 8:00 last night, three miles from a small public airport. the plane hit three power poles before slamming into the ground. the pilot was taken to the hospital with minor injuries and no one on the ground was hurt. about 2,000 homes in the

6:45 this morning. a south bay family's worst fears now realized. as the search for sierra lamar officially becomes a murder investigation. this is video of 21-year-old antolin garcia-torres being held right now at the santa clara county jail on suspicion of

kidnapping and killing the morgan hill teenager. so far, the santa clara county sheriff's department staying pretty tight-lipped about the investigation. >> we believe we have probable cause to believe that he committed the kidnapping and murder of sierra lamar. >> it's unclear if garcia-torres knew lamar prior to her disappearance. sheriff department and lamar's family will speak publicly this morning at 8:00 and we'll stream that live on nbcbayarea.com. new to tell you about this morning, a news conference on the future home of the golden state warriors. the san francisco city leaders and team owners expected to make an announcement about plans to move that team across the bay. part of that deal includes building a brand new arena on the water front property on piers 30 and 32. and that's where crews are starting to set up tents. for right now, the team telling us the news conference scheduled for 10:00 a.m. want to check in with meteorologist christina loren

580 and a live look shows you the metering lights are on at the bay bridge toll plaza. they are still moving, showing movement in the fast track lanes. back to you. >> thank you very much, mike. we continue to follow developing news this morning about the arrest in the sierra lamar case. >> that is right. 21-year-old garcia torres was picked up at a morgan hill safeway. >> we have team coverage for you this morning. christie smith live in morgan hill where she talked to garcia-torres' sister just moments ago. bob redell outside the county jail. marla tellez live outside the morgan hill safeway where investigators arrested garcia-torres. but we'll begin with christie smith and what she learned from the suspect's sister. good morning. >> reporter: good morning to you, yeah. i talked to a woman by phone who says she's his sister. she says she's in complete shock this morning. i asked how she found out about the arrest. and she says she found out on the news just like everyone else. and that the last time she saw

her brother was about a week ago at a family barbecue and that antolin garcia-torres seemed just fine. she says she knew that sierra lamar was missing because of news reports. she said she didn't know her personally. she says the family has not spoken to him since the arrest and are now looking for an attorney. she says that her brother was looking for work and had a background in construction. that he has two small children and was expecting a third. i asked about that red jetta that police have been looking for tied to the case, and she says she thinks at one point her brother might have had a jetta, but she doesn't remember much about it, anything like the color, of course, might be tied to this case or not. in her opinion, she thinks this is all a big mistake. she was on her way to work this morning but sounded really rattled when i spoke with her by phone. that's the story from here my colleague bob redell picked up the story from san jose outside

of the jail. bob? >> reporter: good morning to you, christie, he's being held without bail facing charges of kidnapping and murder of 15-year-old sierra lamar. his first court appearance, we understand, is not until thursday at noon. the sheriff has promised us more information about his arrest during a news conference that is scheduled to take place just over an hour from now at 8:00. law enforcement arrested him around 6:00 last night at that safeway in morgan hill where he works. they brought him to the sheriff's office here in san jose for an interview and as you can see, they escorted him out front for a ride over here to the jail for booking. the sheriff tells us he is the registered owner of that red vw jetta seen around sierra's home the morning of march 16th around the time she disappeared. investigators did have him under surveillance prior to his arrest. and they tell us they do have a lot of physical evidence that connects him to her disappearance. >> public safety's our main concern. we don't want anyone else hurt.

we don't want any more little girls taken. >> the sheriff has been in contact with the family of sierra lamar. they are expected at that news conference this morning. they still do not know where her body is. again, they are treating this now as a murder. they do not want this public to give up in the search for her. reporting live here in san jose, bob redell, "today in the bay." and our team coverage continues with more on the actual arrest of antolin garcia-torres. he's the suspect we've been talking about in the investigation of sierra lamar. he was taken into custody outside of the safeway super market on tennant in morgan hill. live in the south bay with details on that arrest and now what the community is saying. good morning. >> reporter: laura, good morning, garcia-torres as you mentioned was taken into custody right in front of this safeway on tennant avenue. one witness tells us it all happened so quickly.

it was just a swarm of sheriff deputies as you can imagine. well, this morning as the news of his arrest spreads, the community is reacting with heartbreak, but still some hope. one man says his nephew went to school with sierra. >> i'm glad they finally caught somebody, but i really hope they find her alive more than anything else. >> i'm extremely shocked. i thought there was a chance that she was still alive, just not in morgan hill. >> reporter: now, again, the sheriff's office is presuming sierra lamar is no longer alive, but still urging the community to help bring her home. since her march 16th disappearance, there had been weekly volunteer searches that started in nearby burnett elementary. those typically happen on wednesday. tomorrow, of course, being wednesday, it's still unclear if a volunteer search will still happen tomorrow. now, here at the safeway, i have spoken to several employees this morning, now they are being told not to speak to the media, though one employee did confirm that he knows the suspect

unified school district is now the target of a federal probe. the oakland school police department tells the district a federal grand jury will investigate the force. district officials expect the focus will be twofold. the first concerns allegations that the former police chief used racial slurs against another officer. the second deals with the deadly officer-involved shooting outside of a school dance. in that case, police shot and killed a man after he allegedly stabbed an officer with a screwdriver. no word yet on when the probe will begin or how long it'll last. and this morning, the men accused of beating bryan stow will appear in court. today a judge hearing evidence to decide if there's enough to bring sanchez and norwood to trial. this hearing coming a little more than a year after stow was attacked in the dodgers stadium parking lot after the opening day game against the giants. sanchez and norwood both charged with battery and other felony counts. stow right now continues undergoing rehabilitation at a central valley recovery
