then the president was off to the fox theater in redwood city where he was met by protesters, but supporters, they paid $250 to $7,500 to get a seat inside in that audience. mr. obama taking to the stage to make his case for another term in the white house. >> a crisis this deep didn't happen overnight. and it's not going to be solved overnight. so we've got more work to do. we know that. and that's why this year's so important. >> and today, more big money and another big event. this time it is a breakfast at the fairmont where each plate is going for around $36,000. once again, that one gets underway starting at 8:30 a.m. 5:01, also having breakfast in the bay area. prominent republican congressman paul ryan. now that was originally set to

be happen at gap headquarters in san francisco. but the chronicle reporting the event has been moved to a secret location to avoid protesters. a group of retirees say they plan to protest outside gap offices anyway. they are taking ryan to task for his path to prosperity budget plan which emphasizes tax and spending cuts. ryan has been floated as the possible vice presidential candidate for mitt romney. protesters in wood side as the motorcade housing john boehner came to town. he stopped by last night for a fundraiser at a private home. tickets for the event topped more than $35,000 each. now back to the south bay and the search for sierra lamar. the man accused of kidnapping and killing the missing morgan hill teenager set to make his first court appearance. "today in the bay's" christie smith is live with the challenge facing the d.a. at this point. good morning, christie. >> reporter: that's right. in just a few hours, antolin

garcia-torres will make his first court appearance. what's going to happen is he'll hear the formal charges read against him. and prosecutors say they believe there's definitely enough evidence to send him to prison. the 21-year-old is being held without bail after his arrest late monday. the santa clara county sheriff detectives had gathered direct and circumstantial evidence showing he killed 15-year-old sierra lamar on march 16th. the d.a. says details of the exact charges will become clearer today as more facts are laid out in court. now, we also spoke with one legal analyst who says this case may be tough to prove without a body. first, here's what's expected. >> going to file the charges tomorrow at 1:30, and they'll become public then and the judge will read the charges to the defendant and we'll also release a statement of probable cause at that time. and it'll provide the reason and

the basis for the charge or charges that we file. >> the defendant may say he dropped sierra lamar off after the kidnapping and he has no idea what happened to her after that. that's why this forensic evidence is key. >> so steven clark says if the dna evidence inside that red jetta that investigators say belonged to garcia-torres shows proof of trauma, then prosecutors will have a much stronger case in the absence of a body. he could also decide to go after the death penalty or drop those murder charges, at least until he gets more evidence. reporting live in san jose, christie smith, "today in the bay." meantime, the special dive team will search for any trace of sierra lamar. the sheriff's department says the team is using advance sonar equipment to search the waters south of lamar's hometown of morgan hill. the sheriff's department says the search will also expand to other south bay water ways throughout the week.

a safeway clerk able to return to work after defending a pregnant woman. after he broke up a domestic dispute at a store near monterey. young says he hit a customer he says was beating a pregnant woman near the meat counter back in late april. safeway has decided to give young his job back plus all back pay and benefits. 5:05, more furlough days and less pay. those are the terms by gilroy teachers. the contract includes 10 unpaid furlough days next year for teachers in the gilroy unified school district. that would mean a 5% pay cut. the furloughs are described as temporary pay, hinges on the november election. if it passes, the furlough days would be restored and teachers have until may 30th to vote on that contract. 5:05 right now. and looks like you may have to have a new plan to get to work if you take light rail or the bus in the district. shutting down several key routes

for an 11-day stretch starting on may 25th. buses will run in place of trains between ocean beach and vannize avenue. it'll make tracks smoother and more reliable. other lines impacted. the 22-fillmore, and the n-owl routes. good morning to you. getting so close to that weekend now, and we are going to see really nice weather over the course of the weekend. but between now and saturday, we've got showers on the way to the bay area and cooler weather today. 51 degrees to start you out in san mateo, good morning. holding on to the upper 50s here in the south bay and san jose and we have upper 50s right now in novato, as well. heading toward a day running ten degrees cooler than yesterday. breezy to windy conditions will sustain. tomorrow, showers on the way and sierra snow. we're going to see a very cold

jose. talking about a very presidential type person coming in. okay, the president. coming to breakfast in downtown san jose. likely causing a big stir for downtown san jose. there's a bus there, and we are looking at no other traffic flow through the area. but i'm sure that's special permission. we're looking over to the peninsula for slowing through menlo park, no issues for 101 now. there is a report of a small brush fire just off of 580 west of the castro valley y. and that may be an issue. we're tracking that, so far no big issues reported and no updates from chp. that's good news. we don't want to hear about anything bigger, guys back to you. we're all proud to call the bay area home. but one south bay city has something extra to brag about. kiplinger's finance ranks sunnyvale number seven on the list of ten greatest cities to raise your kids. the report cites the low crime rate and high academic

fairmont at 8:30. i believe you're looking at when he arrived here last night. his motorcade pulling up to the hotel after a night of high-end fund raising. it was a dinner in atherton at a private home, $36,000 a plate there. about 60 people attended that event if you do the math on that one. he pulled in close to $2.2 million from that dinner alone. now, again, the president will be waking up here at the fairmont hotel in downtown san jose for a private fund raising breakfast. about 20 people are expected. again, do the math there, $36,000 times 20, if i'm not incorrect, i think that's about $723,000 that the president will pull in for his campaign. now, from here, he's going to be heading to moffett field where he is expected to take off about 10:00 this morning. he is bound for iowa to push his plan for job growth. now, when all is said and done, the president will have been in the bay area for just 16 hours. talk about a whirlwind. live in san jose, marla tellez,

"today in the bay." hikers soon getting the chance to reach the summit of an iconic landmark. metal cables being put up on the steep shoulder of the half dome peak. that work there expected to be completed by friday. not everybody will be allowed to reach that summit. a limited number of permits will be handed out each year. each day there. the 17-mile trail has very high elevations and is extremely dangerous when wet. at least five people have died there since 2006. it is 5:14 right now. the project to build a new synthetic soccer field at golden gate park could soon get a green light. a final report will be given to the park commission today. if it's approved, the department would vote on whether to construct the playing fields and the new light system. the supporters say the project will fix the problem of having to play on potholes and muddy grounds. activists are concerned about the impact, however, on wildlife and the neighborhood. hewlett-packard employees wondering this morning if

they're among the unlucky. some workers could be informed as soon as today that they are losing their jobs. >> that's right. hp, jon, has broken down some of the numbers for us. saying 9,000 workers will leave the company by the end of the year. and notifications for those 9,000 would start "shortly." the total number is much bigger. 27,000 jobs gone through early retirement and layoffs by 2014. this will be hp's biggest reduction in force ever. and it's had doosies. other news, hp says it was disappointed by results from autonomy, a company they bought for $10 billion less than a year ago and it actually dismissed autonomy's former ceo. and whitman took a shot at the new french president too. she says every leader in europe is concerned over the election of hollande.

facebook -- both the house and senate are talking about congressional hearings to look into the company's botched ipo. not necessarily calling mark zuckerberg to testify, more likely officials from the nasdaq and underwriters like morgan stanley. yahoo, meanwhile, has made a web browser. seema mody with that. good morning. >> good morning. that's right. yahoo wants to turn the web world on its axis. they have launched its own web browser axis that lets browsers get access without leaving the page. it only works on apple mobile devices like the ipad and iphone, although you can get it as a plug in on your pc. taking a look at the markets, step back for a second. futures are trading higher at this point after stocks staged a late-day turn around. the dow had been down as much as 191 points on news that european leaders were calling for greece

and you're so close to it now, you can taste it, i bet. you can see the tippy top of the transamerica pyramid. and that is courtesy of some winds overnight clearing our coastline starting out nice and clear. we're going to see the opposite that we typically see this time of year. start out with the full deck of clouds, clear out throughout the day. we're going to see the clouds really increase toward about noon into 5:00 p.m. as an area of low pressure is slated to bring us some showers moving onshore. but today you can leave the umbrella at home. 57 in santa rosa. as we head through tomorrow, system of low pressure dives to the south. this is going to move in very quickly. and for us, we're expecting significant rainfall. places in the east bay in particular. if you live on the north end of the east bay, you pick up 1/10, 1/4 inch of rain. we stop the clock at 11:00 p.m., starting to get those clouds really thickening up along the peninsula. stop that clock again.

7:00 a.m. tomorrow morning, a little bit of shower activity along the santa cruz mountains and gets more active toward the second half of you day, between noon and 5:00, we get light showers and by 3:00 on saturday, completely clear conditions. so today's highs are going to be much cooler than where we ended up yesterday as that areas moves onshore, ushering in cooler weather. by tomorrow, holding on to the 60s. that's it, even in san jose and livermore, 67 degrees, you'll need that winter wardrobe, but just for one day. climbing back into the 70s. sunshine as we head into this weekend, and monday, memorial day, 79 degrees. great weather for all those outdoor activities that you typically think of when it comes to memorial day. barbecues, hitting the boat, you'll be able to do it. let's check your drive with mike. look on to the south bay with the earlier issue, here santa clara, homestead. that is completely cleared from the reports and the roadway, and apparently all the lights are working, as well as the signals,

chance to choose where their child goes to school. >> early in the race, but right now, well, had a slight edge in most major polls this month. but not enough to break what is considered a statistical tie. 5:33. and now to the south bay and the search for sierra lamar. this morning, investigators will resume the search for the missing teenager's body. prosecutors prepare to make their case against the man suspected in her disappearance. "today in the bay's" christie smith joins us live from san jose. good morning. >> reporter: good morning to you. antolin garcia-torres has been held without bail since his arrest late monday. what will happen today, he'll head to court and the judge will read the formal charges against him that prosecutors believe that they have enough strong evidence to send him to prison. but the exact charges will be filed today. now, on tuesday, the day after his arrest at a morgan hill safeway, the santa clara county

sheriff says detectives gathered direct and circumstantial evidence, enough to prove he killed 15-year-old sierra lamar. she disappeared on her way to school on march 16th after she disappeared, her cell phone and a bag of clothes were found and investigators say that bag had garcia-torres' dna. even with all that, one legal analyst says it may be hard to prove without a body. >> that's where the defense is going to attack this case. they're going to say, you haven't proved that this defendant committed murder. even if there's evidence of a kidnapping. >> now, he says if the dna evidence inside the red jetta that investigators say belong to garcia-torres shows proof of trauma, well, then prosecutors have a stronger case even without a body. the d.a. could do a couple of things. could decide to go after the death penalty or even drop that murder charge, at least until he gets more evidence. live in san jose, christie

smith, "today in the bay." a passenger on a united flight from new jersey to southern california was arrested overnight after that flight landed in l.a. police were called to the plane after a passenger caused a disturbance last night. they have not really said much else about this incident. so far, no word yet on any charges. at this point, it does not appear anybody was hurt during that incident. 5:35. a ban on opening racing in san francisco will be lifted today. the coast guard halted the competition after five sailors were killed during a race. the agency has set offshore racing council to put new rules in place. the five who died were not wearing safety harnesses. one of the new rules may be required to have safety tethers. the vallejo police department ending a lawsuit. he will receive more than $4 million in a settlement for a confrontation which left him with a broken neck.

back in june 2007, two officers entered his apartment after receiving a complaint from his girlfriend. during a confrontation, he was tased two times. he suffered a neck injury and partial paralysis. police say he did resist arrest but federal courts called the police tactics improper. 5:36 right now. a key deadline extended in the case against barry bonds. prosecutors have 45 days to respond to bonds appeal of his obstruction of justice conviction. the delay likely pushing back oral arguments until october or november. a decision by a three-judge panel likely won't happen until late 2013 at the earliest. bonds was convicted of being evasive when testifying to a grand jury back in 2003. at the time, the grand jury was investigating the role of illegal steroids in major league baseball. pot dispensaries will be a thing of the past. the owner in novato announcing

the medical marijuana dispensary will close next month. this comes weeks after the green tiger collective shut its doors. both pot clubs were targeted last month by federal prosecutors who filed paperwork to seize those properties. if the green door closes mid june as planned, marin will only have one remaining dispensary. state parks facing closure could be saved. funding collected through various programs including from license plate fees would help keep those gates open. and nonprofit groups and volunteers would help manage the parks. the senate will wait for a vote on a similar measure. more than 70 parks are slated to be closed right around the corner on july 1st. 5:37 right now. we have good news to report, the weekend coming in to focus. christina loren is here to tell what it'll look like. good morning.good morning to you.

welcome back, everyone. like a painted photograph out there. it's a live look out across the bay this morning. gorgeous sunrise, 5:43. >> this morning, our buddy uncle sam tightening the rules on the prepaid cards you use instead of debit or credit cards. tracie potts is live on capitol hill this morning with a look at efforts to make them more consumer friendly. good morning, tracie. >> good morning. and to make sure that consumers know what they're getting into, 7 million people are using these cards. we spend $82 billion -- that's just this year, on prepaid credit cards. that is expected to double in two years. so lots of money, lots of people using them, not a lot of protections. they are not protected like credit cards, debit cards, even

gift cards. no federal government regulations on these cards. so they're reloadable, you put your money on them, some people putting their paychecks on them. but that money is not guaranteed if they're stolen, lost, or even if the bank goes out of business. the consumer financial protection agency. let's take another look at that. and not only do they want to hear from the industry, but they want to hear from you. check out consumerfinance.gov to find out more about these cards. the fees can be lower than checking accounts, but your money may be at risk. >> okay. tracie potts, in washington, d.c., thank you very much. >> 5:44. new this morning, a u.s. drone strike kills nearly a dozen suspected militants in pakistan. pakistani intelligence says a drone fired two missiles killing ten people. this is the second such attack in the region in the past 24 hours. the pakistani government has been demanding an end to all

drone strikes. also new this morning, a pakistani official and various witnesses tell nbc news that u.s. drone strike hit a village mosque in northwest pakistan. at least ten people reportedly dead. witnesses say that drone fired two missiles at the mosque during morning prayers. a separate report says locals and militants were inside at the time of the strike. in maine, six people now injured as firefighters work to contain a fire burning on a nuclear-powered submarine. the fire's been burning since about 5:45 last night at the naval shipyard. all those injured have been treated and released. the reactor aboard the subwas not reacting at the time of the fire and is not affected. no weapons were onboard. we're learning new york police are questioning a new jersey man in connection with the 6-year-old boy who vanished more than 30 years ago. police picked a new jersey man up last night. they say he worked and lived in his soho neighborhood at the

time of the boy's disappearance and has made statements implicating himself in the boy's disappearance. police say they plan to provide further details later this morning. doing something special for those who sacrificed so much. members of the u.s. military will begin the duty of honoring america's fallen soldiers today. it's a memorial day tradition that goes way back to 1948. soldiers from the third u.s. infantry regimeregiment. that's more than 220,000 grave sites. the old guard soldiers will stay through the weekend to make sure a flag remains at each and every grave. 5:46 right now. harvard alumni attending their 50th class reunion getting an unexpected update from one of their class mates. kisinski graduated back in 1962 and is serving a life sentence for going on a deadly bombing

spree. and the directory handed out during the reunion, he listed his occupation as prisoner, and under awards he listed eight life sentences. one harvard professor called the entry chilling. >> that's ridiculous. well, new zealand wants to make its country tobacco free. in the nation of over 4 million people, about 20% of the adults there smoke. an attempt to wipe out smoking altogether by 2025, the country will raise the tobacco tax 40% over the next four years bringing the cost of one pack of cigarettes to about $15. beginning in july, retailers will have to start hiding tobacco products behind the counter instead of having them displayed outside in the open. a proposal to hike the prices to $75 a pack was rejected. >> wow. a campaign by tobacco companies aimed at snuffing out support in california seemed to be working. a new poll finds 53% of voters support proposition 29, which would impose a $1 tax increase on cigarettes.

that's down from 67% back in march. before the opposition began its flood of tv and radio ads. if passed, the tax would raise hundreds of millions of dollars for cancer research and smoking reduction programs. the tobacco industry calls it a flawed measure that will send research dollars out of state. right now, a brief warning to be very aware of intersections this memorial day weekend. just watching out for drivers running those red lights. a study by the national coalition for safe roads finding more than 2 million drivers in 18 states ran a red light over the memorial day weekend last year. the report also finding the number of drivers running reds was more than 24% higher than on an average nonholiday weekend. >> everybody's got somewhere to go. just got to slow it down. a lot of folks heading out of town early. >> yeah, but no need to do so. we're going to get great weather in the bay area. a lot of people coming in to town for that reason alone. also, we've got a little

celebration happening through this sunday. just a minor celebration. 75 years for the golden gate bridge. nbc bay area proud to be the broadcast home. we are going to have so many wonderful elements for you right here on nbc bay area on sunday. so stay tuned for that. 50 degrees in san francisco, 57 in novato. nice and mild this morning up in santa rosa in the mid to upper 50s. as we head throughout this afternoon, temperatures won't climb that much more from where we're starting out. maybe an additional 10 to 15 degrees. an area of low pressure on the way. going to bring us rain through tomorrow. but right now, winds are rather strong in places like santa rosa and fairfield. low pressure moves in. as we head through tonight, the storm track dives to the south. so for us, we're going to see the system for the most part, the kor pass through our north. and bringing us light showers. it all works out like this, stop the future cast tonight at 9:00, mostly cloudy conditions at that point, we stop again at 7:00

a.m. friday. we meet back here tomorrow, maybe some light drizzle to start you out. but the bulk of the moisture doesn't arrive until the second half of the day. looks like 1:00 p.m., getting pretty good shower activity from antioch down south to livermore and right here in san jose. but it's not going to put a damper on your holiday weekend plans. we stop that clock again at 3:00 a.m. saturday. nice clear conditions. so temperatures will rebound nicely. th they're going to be cool for today but we'll warm up saturday through sunday. tomorrow, you might need to keep that winter wardrobe handy. 73 degrees in the valley, tomorrow, light showers for the second half of the day. 71 degrees on memorial day. >> we'll take you to the south bay where we have a construction crew 880, both directions, no slowing there. we do, however, have slowing northbound 101 just north of 680. and likely to see that cropping up for highway 87 coming into downtown. if you're coming into downtown san jose, a note for you,

basically watch the area right around the fairmont. president obama's in town, and there's a breakfast going on and a closure in the immediate area right around. so watch first, san fernando, san carlos, and the plaza itself, between the hotel and tech museum. the freeways are moving smoothly and santa clara street does not look like it's affected. we're seeing slow downs now, big slow downs coming into livermore, a 16-minute drive and a nice easy drive through pleasanton and toward that dublin interchange. pretty typical pattern for a thursday over there. no major issues coming over toward the bay bridge toll plaza and the maze right here, the 50s coming over toward caldecott tunnel. that's a good flow of traffic here and coming into the city via interstate 80 and going over to 101. shows you a smooth drive, traffic flowing nicely, but just south of this shot, reports of some debris, there may be a lane or two, at least with a pause in traffic flow, but very light

commute corridor. that's great. the second worst commutes in the bay area is the routes, the same drivers take in the morning highway 4 westbound from hillcrest avenue. >> got that going for you. >> which is nice. hey, the president took a break from his visit in the bay area last night to make a phone call to elan musk. >> this is the latest video we have into the newsroom. it's a bit hard to make out that is a speck, it's the dragon capsule in orbit. you can see it there. kind of make out the two solar panels to either side. this is by astronauts looking down from the international space station. i was texting with one engineer who says this is about 2 1/2 kilometers, about 1 1/2. the capsule will pull away for a while, and then it will come in for an attempted docking tomorrow. meanwhile, back on earth,
