this morning what she has to say, and ask you to weigh in on our website. also this morning an olympic hopeful is in the headlines for her very personal quest. she's 29 years old. she's a hurdler. her name is lolo jones. he says she has committed herself to remaining a virgin until she gets married. coming up live, she says it is harder to do that than training for the london games. let us now begin with the breaking news this morning. a new jersey man being questioned about the 33-year-old disappearance of etan patz. we've got jonathan dietz, an investigative correspondent for wnbc. what's the story? >> the police went to camden, new jersey yesterday and arrested the gentleman, pedro hernandez, brought him in for questioning. he has not been charged. he claims he dragged the boy into a store, luring him in using candy, took out a knife, later killed the child and disposed of the body. that is the claim. the problem is there's no

corroboration to this account at this time. it's 33 years later. tomorrow is the anniversary of his disappearance. so there are a lot of questions. is this guy telling the truth? police have to take it seriously because he worked and lived in that neighborhood, and he's making these claims. but they have no corroboration at this time. but they are working around the clock with the manhattan d.a.'s office to try to figure out is this the killer. >> he's been tied to the case in the past. in the past, we have had claims before. so are police taking this seriously, or are they concerned that this may be another false lead? >> you're hearing it from both sides. you're hearing there are some who just think this guy's a little nutty. why would he step forward now and make these admissions? it seems very strange. it seems very odd. at the same time because of the location and the specific claims he's making, they're treating this very seriously. >> and he's making the claim that etan has been killed. so is there any information that has been gleaned to far about where his remains might be

found? >> that's one of the problems. the second point is, he says he killed him. well, where's the body, then? it sounds like it was disposed of in garbage bags. unclear, again. if any of this is true, they've had false claims, false admissions before in this very case. so they're treading carefully. but they're treading full steam ahead to try to see if this is the -- the suspect. remember, we had just a few weeks ago the fbi searched a basement of a different worker to see if a body was buried there. it was based on some leads and some information. that appears to have gotten nowhere. the gentleman in that case denied it vehemently. in this case there are some admissions. >> this case, we should say, has been one of the most notorious, one of the most important in new york city history. >> it's heart wrenching. here was a child, his first day going to school. just vanishes. you know, he's the first child to be put on milk cartons and really raise awareness about missing children, exploited

children. and the question has haunted the city, what happened to this little boy? and the police and the district attorney working around the clock trying to get that answer. where is he? what happened to him? >> jonathan dietz, i guess we'll find out whether this, in fact, is a major break in the case. >> question, by the way, that's haunted the parents as well who still live down in that neighborhood. thanks. a check of the rest of the morning's top stories. natalie is standing by at the news desk with that. >> good morning, everyone. a fire on a nuclear powered submarine has injured at least seven people. but shipyard officials say the sub's reactor was not threatened by the blaze. the forward compartment of the "u.s.s. miami" caught fire while it was docked in maine for maintenance. cause not known. pakistani officials say a suspected u.s. drone killed ten alleged militants near the afghan border. this just a day after a pakistani doctor who was lauded by the cia as the man who helped lead the u.s. to osama bin laden's hideout was jailed.

the doctor was convicted of treason and sentenced to 33 years in prison. a decision that has american officials outraged. the french citizen who allegedly caused a us airways flight to be diverted with an f-15 escort will not face charges due to lack of evidence. the woman reportedly passed a note to flight attendants in mid-air saying she had a surgically implanted device, causing the crew then to treat the claim as an emergency, landing the paris to charlotte flight in bangor, maine. the 41-year-old is now being returned to france. a terrifying crash caught on tape in russia. dashboard camera mounted on an suv caught this whole thing on tape as an oncoming truck driver rounded that sharp curve too quickly and flipped over sliding into that car head on. the driver who posted the video says both he and the truck driver were fortunately just fine. no injuries there. elton john has canceled his upcoming performances in las vegas through the weekend citing a serious respiratory infection.

analysts had concerns about facebook's earnings prospects. information that could affect the stock while the average investor was left in the cold. it may be the most watched initial public stock offering or ipo in years, but it's now being called one of the worst-handled ipos. >> if you could tailor a way to have an ipo crash, this would have been it. >> reporter: first, an embarrassing nasdaq technical glitch that delayed the ipo. then the stock's performance. opening at $38, popping to $45, and then plunging to $31. closing yesterday at $32. all the while, mass confusion as many investors were unable to confirm trades, buy or sell the stock. now allegations from journalists and investors that morgan stanley, the ipo's lead bank, may have informed only its most valuable clients that it had a negative view of facebook's growth prospects. and the investor lawsuits have begun. >> the bottom line here is, the

process that occurred here stunk. it stunk bad. and anyone who bought in the ipo is furious, feels like they've been cheated. >> reporter: morgan stanley insists it followed the same procedures for the facebook offering that it follows for all ipos. while facebook says the suits are without merit and will defend ourselves vigorously. now massachusetts has subpoenaed morgan stanley's internal documents, all of it, further undermining faith in wall street. >> wall street still hasn't figured out that they have to rewin the confidence and faith of the public. and everything like this episode of the facebook ipo sets that back, makes it harder, and really begins to rouse suspicion and anger in a time when it cannot be afforded by the industry. >> reporter: cnbc's bob pisani has covered wall street for 15 years. >> the sad thing is it doesn't matter who you want to blame, nasdaq, morgan stanley. it's another black eye for wall street and another disappointment for the average investor. >> all of this comes on the

heels of the 2008 financial crisis and the bailout, then a couple of weeks ago, jpmorgan announcing a multibillion-dollar trading loss. now, the senate banking committee is looking at the facebook ipo as congress considers tougher regulations on the financial sector. matt? >> tom costello, thank you very much. henry blodgett is a former wall street analyst who was permanently banned from the securities industry after settling fraud allegations with the s.e.c. savannah guthrie is "today's" legal correspondent. good morning to both of you. i'm sure you don't love being introduced that way, but you were banned after you were accused of giving assessments of stocks that did not jibe with the public assessment that merrill lynch was giving people. so you may be perfectly suited to discuss what happened here. what do you think happened? >> unfortunately, yes, it's horrible to hear that. but i think really what's going on hear is it's actually a big flashback to what happened then. what i got in trouble for was an industry system where analysts

worked very closely with bankers on ipos, very involved after the dotcom crash. everybody said that's outrageous. so the rules are different. here i think morgan stanley is defending itself by saying we followed the rules. but the rules here are grossly unfair. and that's obvious to anybody. >> the analyst for the banks handling the ipo, according to reports, cut their estimates for the facebook stock during the road show, and just so that people who don't hear these terms that often, that means while they were out generating excitement for this public offering of stock, they actually cut their estimates about how that company was going to do. you say in all your years in the business, you've never seen that happen. >> 20 years. it's unheard of. and nobody i've talked to has ever heard of anything like this. really what it is is the company saying, whoa. our business suddenly slowed down. >> the company, facebook. >> exactly. >> saying to these analysts. >> to the analysts, and then the analysts verbally disseminate this information to big clients. >> let me ask you a question. if the people at facebook went

to the analysts and said that, is that unfair, or is it illegal? >> the rules, as morgan stanley is saying them now, is that before an ipo, you are allowed to communicate like that. and in fact, you're supposed to be required to communicate like that. but again, stepping back from it, the idea that big institutions were whispered information that is very material. >> right. >> the company's business is slowing down, that little investors didn't get. it's grossly unfair. the rules have to change. >> savannah, the question that everybody's going to ask now, is this a case of broken trust or broken laws? there are already three lawsuits that have been filed. class action lawyers are circling around this like crazy. congress will get involved. where do you see legally this going? >> this is a section of the securities laws, it's exactly what it's supposed to prevent. the securities laws are supposed to make this even playing field so that the little guy gets the same information as the big guy. they are suing under a provision of the security laws that is extremely favorable to plaintiffs. if they can prove that there's a material misstatement or an omission of fact in that

registration statement that was put out to the public, they can recover potentially even without showing that the company intentionally did anything. >> and i mentioned congress getting involved. can they just -- can they do more than make it uncomfortable for these big banks? do they have legal teeth here? >> well, they can subpoena witnesses. they can subpoena documents. they can certainly regulate. there's a potential of an s.e.c. enforcement action. and you mentioned the class action lawyers. they want to certify this as a class which means the stakes are very high financially. >> henry, one of the reasons people got so excited about this, they like investing in products that they use. and 900 million registered users of facebook, a lot of those people said this is a great idea. but the lesson going forward, should those small investors just take away from this, it's an insider's game? >> yes. we get this lesson over and over and over again. and i think this rule will now be changed. and it will be fixed, and then there will be 40 other ones that you don't know about that favor the big institutions. individuals absolutely should be

in the stock market. it's important long term. but there are ways to do it such as buying index funds where you're not trying to compete against professionals who have much better information that are just much smarter. trying to go heads up, very difficult. >> that's an unlevel playing field. henry, thank you very much. savannah, thanks to you as well. it's now 15 after the hour. here's ann. >> matt, thanks. the director of the secret service has made his first public comments since last month's scandal involving agents and prostitutes in colombia calling it an isolated incident, but some lawmakers around buying it. nbc's justice correspondent pete williams has more on this. pete, good morning. >> good morning. senators from both parties were skrept cal of the director's claim that his agency does not have a cultural problem. his first public comments about the scandal came as a senate committee revealed new details of past incidents. >> reporter: president obama's secret service detail will be on the job as usual with him today in california. but back in washington, the agency's director is defending

his roughly 7,000 employees. very few, he says, have ever been accused of the kind of misconduct that launched a scandal in colombia last month. director mark sullivan said it was an isolated incident, one that did not jeopardize security. >> between the alcohol and i don't know the environment, these -- these individuals did some really dumb things. >> reporter: but a senate committee disclosed wednesday that the agents in cartagena actually went out in small groups, not all together, to several different nightclubs. they all brought women back to their own hotel rooms registered in their own names, all indicating, some senators said, that the agents considered their behavior acceptable. >> it suggests to me that these agents felt that they did not need to conceal their activity. and they weren't worried about being caught. >> reporter: and the committee revealed its secret service

records contain three complaints of inappropriate relationships with foreign nationals since 2007. also in washington, d.c., a uniformed secret service officer was fired after he solicited an undercover police woman posing as a prostitute. and at the salt lake city olympics in 2002, at least three agents who were there to help provide security left shortly after they were caught partying and drinking with underage girls. but director sullivan insisted there's no widely held view for agents on travel, anything goes. the notion that this type of behavior is condoned or authorized is just absurd. >> reporter: and sullivan said 60% of his employees responded to a survey last year by saying they would report unethical behavior. a figure that struck several committee members as low. >> i guess that's my concern. when you hear the story of what's done on the road stays on the road, my guess is within the service, there's a pretty high level of esprit de corps, possibly even a code of silence.

>> the secret service said it did investigate another claim of agent misbehavior last year in el salvador. but after interviewing people there, found no evidence of any misconduct. ann? >> pete williams this morning, thanks. it is now 7:18. once again here's matt. thank you. there is yet another new case of a rare flesh-eating bacteria in georgia. this time a 67-year-old grandfather who's actually being treated at the same hospital in augusta where a young college student has been fighting for her life. nbc's thanh truong is there. good morning to you. >> reporter: matt, good morning to you. the recent cases of flesh-eating bacteria that have captured so many people's attention all strangely originated here in georgia. three patients are being treated at this hospital. aimee copeland's is perhaps the most well known and now her father sharing intimate details about her struggle to survive. aimee copeland has been fighting potentially deadly flesh-eating bacteria for almost a month, being able to sit up is considered progress.

>> she's had a lot of trauma to her body. but to be asking to get up is pretty amazing. >> reporter: a big step after aimee had to endure multiple amputations, losing her hands, left leg and right foot to the aggressive infection. aimee's dad says the decision to amputate was heartbreaking. >> blood vessels in her hands and foot and extremities were destroyed. her life was saved. so if i were given a choice between losing a limb and saving my life, i would opt to save the life. >> reporter: the 24-year-old college student became infected after falling off a zip line and cutting her leg. aimee is unable to talk, so her family relies on other ways to communicate. >> she can mouth words. and we're becoming very adept at lip reading. we can almost anticipate a little what she wants before she asks. but i think a lot of that goes with being a parent. >> reporter: aimee is one of three patients at the hospital being treated for necrotizing fascitis. 67-year-old paul bales was

recently admitted and is scheduled to have a leg amputated. the grandfather from central georgia contracted the bacteria after falling and cutting himself. georgia landscaper bobby vaughn is in good condition after doctors removed several pounds of infected flesh. and a few hours away in south carolina, lana kuykendall remains in critical condition. the flesh-eating bacteria attacked her just days after she gave birth to twins. although there are multiple cases of the infection in georgia and other states across the country, doctors say it is not an outbreak but rather a random occurrence. >> in a short period of time, and that's just kind of random. >> reporter: for aimee copeland's family, they're turning to a higher power for help. >> people say you use god as a crutch. we're not using god as a crutch. we're using god as a stretcher because he's carrying us through this. >> reporter: aimee is still in critical condition at this hospital. despite all her struggles, her dad says she's still cracking jokes. a testament to her strength and her humor, matt.

it is 7:26. good morning, everybody, i'm jon kelley. the morgan hill man accused of kidnapping and killing sierra lamar making his first court appearance this afternoon. he will be arraigned on murder and kidnapping charges in santa clara county superior court. prosecutors believe they've gathered evidence showing garcia-torres killed sierra lamar. garcia-torres was arrested this past monday at a san martin safeway where he worked. sierra's family at this point hoping he will cooperate with investigators. >> you can't get out of this now. you're going to be locked up forever. so at least give the family something, you know, we just want to know where she is. >> volunteers will continue

a baby put in a washing machine as part of a dangerous game of peekaboo. we'll talk to the boy's mother and meet that baby in just a moment. but first, nbc's mara schiavocampo is outside the laundromat where it all happened. >> reporter: that baby is okay, but that very upsetting video watched by millions online has many people wondering, what parent would ever play a game like that with their child? well, it turns out it wasn't the baby's parents. camden police have now identified the boy's mother, and she says she found out about the whole thing just like the rest of the country, when she saw that surveillance video. the surveillance video sent shock waves across the country. it showed a man placing what people presumed was his son inside a washing machine at a camden laundromat. a woman presumed to be the baby's mother looked on. but within seconds, the apparent game of peekaboo went horribly wrong. the baby trapped inside as the

machine started running. the adults unable to open the door. the helpless baby tossing about. his tiny feet seen spinning inside the machine as the woman ran for help. >> the mom and the dad called me. >> reporter: laundromat employee ing is seen on the tape coming to the parents' aid. like most people, he assumed the man and woman were the boy's parents, and he demonstrated to nbc station wcau how he saved the little boy. shutting off the circuit breakers amid the panic. a minute and a half after being locked inside, ing pulled the crying baby out, handing it to the relieved man who acted like the boy's father. >> and then he said, "thank you" to me. and then he say, "sorry, mom, sorry, mom, sorry, mom." >> reporter: but it turns out the people on the tape are not the baby's parents. >> i never knew about none of this. i found out on the news. >> reporter: sakia david is the mother of 1-year-old saimeir.

she says she's a single mother and had to work so left her baby with a baby-sitter. the woman seen here on the surveillance tape. >> that's his father's girlfriend. >> reporter: david says the baby-sitter told her that saimeir fell down the steps and was checked out at the hospital. a story that david believed until she saw the video on the local news. >> that's what i said, that's her and that's my baby. that's all i said. but she just said it wasn't her. so i took it like all right, then it might not be here. so when the cops came this morning to my house and told me to come outside, i was, like, oh. that was my baby. >> reporter: thankfully, her baby is fine. david says she still can't identify the man in the video. the camden prosecutor's office tells nbc news the investigation is closed, and the individuals involved have not been charged with any crime. legal experts say although shocking, the video also shows no crime was committed. >> in this case, there is no way to show that there was any criminal intent on the part of these two people. they were stupid, but they

weren't criminal. >> reporter: late wednesday night, wcau spoke over the phone to the woman who says she's on the surveillance tape. she says she didn't realize her friend had put saimeir in the washer until it was too late. >> i seen it and i panicked, like i didn't know what to do. he thought he was playing peekaboo. he didn't do it intentionally. and i told him, you don't play like that, and now i guess he understands that. >> reporter: now, prosecutors say another reason they're not moving forward with the case is because little saimeir did not suffer any major injuries from this incident, but they are referring all this information to the department of youth and family services. ann? >> mara schiavocampo, thank you very much. sakia david is with us along with her son, saimeir bush. good morning. >> good morning. >> you first saw this videotape on midnight tuesday. when you recognized your child was being put into that washing machine, what was your reaction? >> i was, like, i know that ain't my child.

his ritual was always the same. he finds his spot, sets up his tripod, focuses his camera, and then does something, well, a bit out of the ordinary. he strips down to nothing more than a pink tutu. >> i feel like i'm giving everything i have for these images. ♪ >> reporter: his pictures have been described as magical, from subway platforms to public beaches, parking lots to amusement parks. bob lets his imagination soar. his inspiration, his wife, linda. they've been happily married for 24 years. >> i started using this project to just get away from things and to start expressing myself. and it's turned into this journey. >> reporter: bob's unlikely journey began in 2003 when linda was diagnosed with an aggressive form of breast cancer. as she faced grueling rounds of

radiation and chemotherapy, the tutu project became an outlet for them both, a way to laugh through the tears. >> it made her happy to see that i was doing something. she loves seeing me work. >> he just forgets about things and becomes this guy in a pink tutu. which is very funny. >> reporter: but just three years after linda's initial diagnosis, her cancer came back. this time it had spread to her liver. her doctors say it isn't curable. each day is a battle. >> i have a very strong reality of what can happen. i mean, i can go and get my blood test tomorrow, and it can be not good. >> reporter: with bobby her side, linda undergoes cancer treatments every three weeks. it's become a routine part of their lives. >> hi. how are you? this is new, actually. >> reporter: he often brings his pictures along to show other patients in hopes of raising a smile and inspiring them to find their inner ballerina. >> this is the fastest my treatment ever went by.

>> i immediately felt like, okay. i can do this. >> reporter: an unlikely inspiration, bob's tutu has taken on incredible meaning in the fight against breast cancer. he's created a nonprofit organization to help raise awareness and money for patients in need. just recently, his ballerina website, the tutu project, has gone viral. his pictures now touching countless people across the globe, many writing him simply to say thank you. >> your images made me smile, laugh and cry all at the same time. your pictures reminded me of my mom. life is good. maybe even better after cancer. you just want more of it. >> reporter: with each camera click, bob's heartwarming mission continues from the grand canyon to times square in new york city. he says his wife's strength gives him the courage he needs to place dress-up and give back, just a man in his pink tutu. it truly is a love stare.

involved with this program? >> after hearing all the alarming statistics, 70% of african-american and hispanic kids don't know how to swim. it's only natural for me to be part of this program. it's an absolutely fantastic way to get kids educated and involved and the parents as well. >> what got you into swimming? >> i was diagnosed with scoliosis when i was about 7 years old. my doctor recommended swimming, and that's kind of how i got into it. i ended up starting this year-round program, loved it, and never looked back. >> what are the goals of the swim today program, then? >> the goals of swim today program is really to educate, just to provide resources and education and educate parents and kids about being safe around the water. you know, with those statistics, you really have to pay attention to what your kids are doing and be educated on the proper safety skills around the water. >> or like the lifeguards here at the pool, so we're watching. >> we're watching right now. >> give us pointers for parents, then.

what are the safety tips? >> very first safety tip is to really learn to swim. your kids, they don't naturally pick up that habit. it's not something that comes naturally. you've got to get those basic safety skills. find a learn to swim program. if you go to swimtoday.org, you'll actually be able to find some local swim pools around your area. next safety tip is to be -- follow the pool rules. you see those signs that say don't run on the pool deck. you can fall, slip, you never know what can happen. >> never swim alone. that goes without saying. >> especially have parents nearby. you've got to be at arm's length. you never know what's going to happen at just the blink of an eye. make sure your parents are close by. >> i know you have a little 5-month-old son who's over there off to the side. that's actually, you know, an age where a lot of people start saying, is this the time to start exposing them and getting them into the water? >> we actually recommend that kids start to swim right when they're potty trained. it's important that they get acclimated to the water.

as far as learning to swim, really the best time is right when they're potty trained. >> and in terms of -- as we tell these kids, you're going to give them a couple instructions to help them start swimming. what are some basics that parents can work on in terms of skills with their kids? >> we'll have the kids show us. come on, kids. come over here. >> come over here, kids. come over to marissa. >> so we're going to show the audience a couple of quick water safety skills. one easy one is to learn how to tread water. can you guys tread water for me? can you guys tread? they're kicking right here. just treading water. >> see if i can stand up. >> in the deep end, you want to make sure they can stay calm and tread water. another is to just float on your back. it's a great way to stay relaxed and stay calm until help can come to you. so if they can learn how to float, it's really great. >> we have this young man doing it right here. >> of course, the main focus of our swim today campaign is to be able to swim from one end to the other. so if these kids can go ahead and show us -- can you guys show
