today the ethics commission expected to decide some very important rules and regulations of an upcoming hearing at san francisco sheriff ross mirkarimi tries to keep his job. i'm christie smith with that story coming up. a police shooting turns deadly in vallejo. and then life after baseball, barry bonds opens up about his plans for the future and his ongoing legal battle. it's the former giants superstar like you've never seen him before. a live look outside from san francisco, the bay bridge all illuminated in the night's air. it is tuesday, may 29th, "today in the bay."

good morning to one and all. the time now is 4:31 on the nose, i'm jon kelley. >> and i'm marla tellez. we hope you enjoyed your memorial day. let's get to the forecast on this tuesday. meteorologist christina loren, how's it looking? >> looking pretty good. good morning to you. temperatures this morning are cool to start. we haven't been this cold for two weeks at this time. 46 in gilroy to start you out and we're in the low 40s in novato and napa, headed toward the upper 70s and low 80s. and today marks the first of a heat wave in the bay area. first, mike's back, any developments on that dumbarton bridge? >> we do have news for you. i'm going to hold that off for jon. we'll let him handle the big news. right now, we're looking over at westbound 580. i want to point out a stall. there's a stall at westbound 2580 coming past fruitvale.

you might want to see a little slowing, might see flashing lights there. reports of some construction, that might be why we see the slower sensors up 23rd into downtown. down to one lane, from what i understand. light traffic past the coliseum, but closer to downtown, as i said, everyone's funneling over to that right lane. prepare for that until about 5:00. well, that ross mirkarimi saga is continuing this morning. >> the ethics commission is expected to make key decisions in the case involving the suspended san francisco sheriff. christie smith is live for us. good morning. >> reporter: good morning to you, marla. you know, ross mirkarimi has faced the ethics commission before. but today he's expected to learn more about how this whole hearing process will work and what the rules are as he fights to keep his job as san francisco sheriff. mayor ed lee suspended him in march after he was convicted of misdemeanor false imprisonment

tied to an argument new year's eve day with his wife. her arm was bruised in that incident and the neighbor that taped her tearfully recalling it. he's facing permanent removal from his job. the five-member ethics commission has to decide a number of things, including what type of testimony to allow, live testimony or written and how long this hearing might last. attorneys for both the city and mirkarimi are expected to have a very long list of witnesses. mirkarimi has been out and about at events and appearances trying to save his job. and the ethics commission will eventually decide and make recommendations to the board of supervisors about what to do. it would take 9 out of 11 supervisors to agree to remove him from office. a decision, though, isn't expected until july or august. reporting live in san francisco, christie smith, "today in the bay." >> thanks. 4:33 now. this morning, the scandal involving former alameda county

supervisor nadya lockyer -- county supervisors are set to announce the final decision june 5th and then swear in their choice june 12th. lockyer resigned on april 20th after reports surfaced about drug abuse and an affair with a drug addict. she is married to bill lockyer, the state treasurer. a suspect is dead, police investigating the second officer-involved shooting in days. police shot and killed 41-year-old antonin barrett after a car and foot chase. officers say he reached for something in his waistband and they fired. turns out that was a metal business card holder he was reaching for. loved ones say the suspect was a good father who worked for 15 years as a supervisor at a napa winery. >> when you're talking about fractions of seconds, there's not a lot of time to assess. they have to react or put

themselves or others at harm by not reacting. >> nobody's perfect. he had a dui and that's why he ran because he didn't want to go back. >> as his mother said, he did have a criminal record including five felony convictions and was currently on probation. last thursday night, police shot and killed another man after he allegedly threatened them with what turned out to be a bb gun. firefighters found more than 200 marijuana plants inside a home near 25th and foothill boulevard. much of the crop burned in the fire. no one was home at the time, and there are no rorpts of injuries. >> and this is just the worst possible news for a family on memorial day. a 21-year-old soldier from selinas has been killed in afghanistan. specialist hernandez died in the kandahar province from an ied explosion. he was assigned to the fourth battalion at ft. lewis,

washington. hernandez was flown back to the u.s. yesterday. this picture was taken of the flag draped over his casket as it arrived at dover air force base in delaware. hernandez graduated back in 2008. 4:36, time is running out in santa clara county if you want to vote by mail. today is the deadline to request a ballot for the june 5th primary. you can request a ballot at sccvote.org. after today, you have to go in person to the registrar's office. the registrar says only a fraction of the 500,000 ballots sent out this year have been returned. well, facebook is looking to clear another hurdle in its campus expansion plan. tonight leaders will go over the environmental impact report. the social networking giant says it needs the space to eventually double its current 3,600 employee workforce. the meeting will be held at 7:00 tonight at the menlo park city hall. nancy pelosi being

recognized for her 25 years in congress today. she headlines a special commonwealth luncheon at san francisco's fairmont hotel. pelosi was elected the first woman speaker of the house back in 2006, making her at the time politically the most powerful woman in washington. she touts her best day on the job as the day the affordable health care act passed back in 2009. today's event honoring pelosi starts at noon. good news for commuters, that dumbarton bridge is back in business and our traffic guy mike inouye says he drove over it today looking good. it reopened at 3:00 this morning, two hours ahead of schedule. the bay area's southernmost bridge had been closed since friday night for retro fitting. crews had been installing steel. the $60 million retro fit project expected to be completed some time next year. talk about dedication.

he got up earlier than usual to report that. >> warrior. >> yep. christina loren, going to be a warm-up. >> yeah, we've got a big-time warm-up on the way. temperatures are cool to start. you probably needle a jacket or a light sweater as you make your way out that front door. 45 up in santa rosa. and temperatures are going to be on the cool side at least until about 10:00 or 11:00, the sun will breakthrough earlier than it did yesterday. and as a result, we will warm up quicker than we did yesterday. 48 degrees in sunnyvale, that's pretty cold as we've had temperatures in the mid-50s every single morning for the past two weeks. high pressure really starts to build in. and for us, that's a warming pattern. we're going to see those winds pushing offshore before the day is done. and as a result, temperatures are going to climb. it works out like this for today. 67 degrees at noon inland, 79 degrees at 4:00 p.m. that's when our highs are coming in this time of year. cooler at the coast and bay side. little drizzle, cloud cover at the coast.

i don't think it's going to penetrate all the way inland as it did yesterday. we'll keep on top of that. he's on top of that drive. let's check on that with mike. >> i got out on the road earlier and got to the office on time, consequently. a correction, we have the onramp at park boulevard. that's what is affected by this accident. park boulevard onramp to eastbound 580. so you know, it's noncommute direction, and 4:39, not much of a commute through the area. but keep that in mind. also at the bottom of the screen have the construction i told you about restricting traffic flow down to one lane from 23rd up toward the embarcadero exit. that will be an issue as you see on the speed sensors. a lot of lights, flashing lights, and a little lane flow because of the constriction there. we have that clearing up at 5:00. no problems, but that'll start slowing after 5:00. the san mateo bridge moves

smoothly, as well. there's the dumbo moving smoothly. a nice flow of traffic. 101 southbound, you see slowing on the sensors there, i'll track that for the next few minutes and i'll tap the computer to make sure those clear up. 101 across the golden gate bridge, a smooth drive. the crews starting to get things ready for the morning commute. we had quite a celebration, finally getting over that, we're back to work again on tuesday for the regular traffic flow for this traffic tuesday. we'll track it, but so far, no problems from the north bay. >> thank you very much. and picking up where mr. inouye left off, more congestion on freeway onramps starting tomorrow. new metering lights will be activated on southbound 280 from menker to 11th street. it's the first of hundreds of ramp lights that will go live over the bay area over the next few years. aimed with helping with traffic delays on local freeways. hopefully that'll smooth things out. >> let's hope so. 4:40, still ahead, he is slim, trim, and confident.

good morning. >> very good morning to you. chinese media reports electronics maker fox con has begun production on the apple television set dubbed itv. the company was preparing for the device but then denied everything a few days later. analysts are divided over when apple could launch itv with some saying as early as january, while others say, hey, not until 2014. it will include voice recognition and face time calling features. in terms of the market right now, futures are trading higher, they appear to be taking the latest news out of europe in stride after spain unveils more detail about the bailout of one of the country's largest banks and greece injecting more cash into the troubled system. european markets are trading higher. it's a big week for economic data today. reports on home prices, consumer

confidence. later this week, we get pending home sales and revised outlook on first quarter gdp, auto, and retail sales and to top it all off, we have friday's job report. in terms of how the markets closed last friday, the dow fell 74 points to close at 12,454. although it did snap a three-week losing streak. the nasdaq slipping one point to close at 2,837. >> it has had three days off. thank you, seema. >> 4:48 right now, seems like a chilly start out there, but ramping up the heat. >> yeah, we're really ramping up the heat, up to 90 degrees in less than 48 hours. good morning to you. we've got a really nice day today. we're going to be on the cool side to start. but temperatures this afternoon warming by about 3 to 5 degrees from yesterday's highs and yesterday was was just spectacular inland. 50 degrees in livermore to start you out. a chilly start prompting a jacket or sweater for the first part of the day in the north

bay. once that sun comes out, temperatures are going to start to warm very quickly. so we've got a really good-looking day today. and if you have not had a chance to hit the beach, well, come thursday and friday, you're going to get some phenomenal conditions to do just that. and a lot of kids are starting to get out for summertime. that's the good news. the wind out of the southwest at 14 miles per hour in ferry field. meanwhile, calm conditions along the peninsula. that wind is helping to keep that fog from settling in right at the surface. and visibilities are pretty good for the time being. after that sun comes up, we'll be able to let you know where the fog is the thickest. i think we're going to start out with nearly as much cloud cover as we had yesterday morning. three to five degrees warmer, mid-80s return tomorrow, and then we're talking about the 90s as we head through thursday and pretty close to 90 degrees on friday. today works out like this. in fact, by about 10:00, expecting mostly clear conditions in san jose.

the only camera to capture bonds as he talked about everything. and the amazing thing, he stood outside the giants' clubhouse and answered questions from reporters for about 30 minutes. that rarely happened during his playing days. the all-time home run leader says he does not have any regrets in what happened in the steroids case. the judge has given prosecutors until mid july to respond to bonds' conviction appeal. it could be next year before we hear a decision. >> i don't know what you call justification -- i went through the system, i think what they gave me, that's the penalty they gave me. i'm in an appeal over that. >> how this affects his ability to get into the hall of fame on the first ballot next year is something bonds says he has not thought about much. now bonds says he would like to return to the giants in a coaching role. >> it would be interesting.

up, twins score, a's cannot answer, pushing their losing streak to six straight. that hurt. meantime, manny ramirez will not make a debut as planned this week. ramirez was supposed to be on that roster by wednesday. when he comes off that 50-game suspension for violating baseball's drug policy. it's unclear why the team decided to keep him off the roster for longer. so that dumbarton bridge back open for business on this tuesday morning. let's check the commute with mike inouye. >> from the dumbo to the dumbo. that has cleared. also to the south bay. we had some issues here, southbound 101 did show slowing southbound of 880. basically what's going on is more cars are hitting the roads. so our averages are kind of moving around. i'll track that but no incidents there. this is the incident. capital expressway, the onramp to 680, there is an accident, but it has been moved to the shoulder in the last couple of
