barrett after a foot chase. turns out what he was reaching for was actually a metal business card holder. loved ones say the suspect was a good father who worked for 15 years as a supervisor at a napa winery. >> when you're talking about fractions of seconds, there's not a lot of time to assess. they have to react or put themselves or others in harm by not reacting. >> nobody's perfect. he had a dui and that's why he ran, he didn't want to go back. >> well, as she pointed out, barrett did have a criminal record. last thursday night police shot and killed another man after he threatened them with what turned out to be a bb gun. ross mirkarimi will get key details about how the official misconduct case will be argued. "today in the bay's" christie smith is live with the next

steps in this ongoing process. good morning. >> reporter: good morning to you, jon. the purpose of this hearing doesn't sound that important on the surface. where things go from here sets up the rules and regulations and future hearings before the ethics commission as suspended san francisco sheriff ross mirkarimi continues the fight to keep his job. he pled guilty in march after an incident with his wife on new year's eve that left her arm bruised. san francisco mayor ed lee suspended him without pay on misconduct charges. but he does have a right to a hearing. today he's expected to learn how the process will work and what type of testimony will be allowed. attorneys for both mirkarimi and the city are expected to have a very long list of witnesses. and the ethics commission what they do is they make recommendations to the board of supervisors. 9 out of 11 of those supervisors would have to agree for mirkarimi to be removed from his

post as sheriff. but a final decision isn't expected until july or august. reporting live in san francisco, christie smith, "today in the bay." 5:03. facebook is looking to clear another hurdle in its campus expansion plan. tonight menlo park leaders will review the environmental impact reports. the social networking giant says it needs the space to eventually double its current workforce of 3,600. the meeting will be held at 7:00 tonight at the menlo park city hall. an elementary school principal accused of drunk driving and accused of hit-and-run due in court today. paul revere elementary school, accused of hitting two cars south of the golden gate bridge on may 12th and then taking off. also made headlines last year when her parents petitioned to oust her over her strict policies at the elementary school. well, tourists finding new opposition out on the peninsula. in san mateo, measure t would

require car rental businesses to impose a 2% tax, measure x would impose a 8% tax on parking. local businesses say the measures on the june ballot will discourage travelers from staying on the peninsula. it would generate money they badly need to close that budget gap. it is still spring, but fire crews across the bay area are getting ready for what could turn out to be a hot summer. cal fire announced the official start of the wildfire season monday. the agency says conditions are dangerous this year because of an unusually dry winter. hillsides are quickly turning brown, making vegetation more flammable than ever. >> and i'm nervous about the type of fires, how big they're going to get this year, and the lack of firefighters on the fire ground. and it's going to compromise the safety of all the people as well

as the firefighters. >> a sensible space of at least 100 feet around the property. the hillsides are so brown. >> absolutely, and we start heading toward summer and the temperatures rise, the fires can get even worse. let's check in with christina loren telling us about a crispy start, but looks like it's going to get toasty out there. >> it is. thursday looking like the warmest day, 90 degrees, even right here in san jose. 52 to start you out in san mateo, meanwhile, low 40s, i think we'll drop off into the upper 30s before all is said and done in novato this morning. and we have a windchill factor in addition to that cold air. we've got some wind out there. keep that in mind. you'll probably need that jacket in san francisco, as well. but the good news is with that wind, it's keeping that fog from settling in right to the surface. so your visibilities are actually pretty good. all the way up the peninsula this morning if you're leaving headed toward san francisco. high pressure moves in, builds in quickly today and tomorrow.

this is going to keep our atmosphere nice and clear, the sky nice and sunny, but 3 to 5 degrees warmer today, 10 degrees warmer through wednesday. all works like this for today. 67 degrees at noon inland. you can peel off your first layer. as you make your way home from work, 79 degrees, downright perfect. i'll let you know when you might have to kick on that ac. which cities might get close to the triple digits in my next report. here's mike. >> good morning, folks. a lot of traffic coming back for that memorial weekend and traffic tuesday. getting on to the freeway at park boulevard, you do have that disabled vehicle still blocking lanes. but chp going to make quick work of it. should be cleared in the next few seconds from the way the report's looking right now. we don't have any problem on the traffic flow itself. and even northbound 880 where i had the slowing show up on the sensors, circling it, approaching 23rd, restricting down to one lane, but expected

to clear right about now, they may have done that because the speed sensors are clearing. a few more taillights heading northbound, no problems in either direction heading down toward the san mateo and the dumbarton bridge, yes, the dumbarton bridge, reopened just about 3:00 this morning, so a couple of hours earlier than the earlier estimate. that's good news, westbound commute direction, no delays. in fact, i drove it. it's fine. >> it's still standing. thank you, mike. 5:07, a sacramento family recovering today after their plane crashed in the idaho wilderness. the plane went down late saturday night with a man, his wife, and daughter onboard. they called 911 and remarkably the call went through. several hours later, the family was airlifted to safety. >> i have to believe there was some divine intervention in there too to get a cell phone call out that really shouldn't have made it. >> it is unclear what caused the cessna to crash. all three family members

there. lots of lights. feels like a rock 'n' roll vibe. christina filling you on a spectacular week ahead. unfortunately, some frightening news for fish lovers. radioactive contamination detected in blue fin tuna 6,000 miles from japan. tuna samples tested positive for increased levels of radioactive. ten times higher than the amount measured in tuna off the california coast. it is still far below what is considered unsafe to eat. the tuna sea and waters contaminated by the fukushima power plant disaster last year. well, after months of bad news about the home prices, the nation's housing market may be finally ready to turn a corner. >> some areas increasing so quickly in value, this has not happened throughout america. but, in fact, the data show when you average out the 20 biggest housing markets across the

united states, home prices have fallen steadily since the economic crisis of 2008. this may be turning around finally. case shiler, which is the biggest and most respected measurement will release new data later this morning. economists expect will show glimmers of a general turn around. china, defending itself this morning over accusations it's been dumping cheap solar technology on the american markets. the u.s. has added new tariffs to solar cells being built in china claiming china subsidized its solar industry and that's unfair. china counters this morning by saying that five u.s. states, including california subsidize their own solar factories. now the concern here is trade wars can get very expensive very quickly. the u.s. could respond by increasing taxes and tariffs on, say, chinese-built steel used for the bay bridge. let's check on the markets before the bell after a long weekend. seema mody at cnbc world headquarters. good morning.

>> good morning to you. the justice department is reportedly investigating whether bp lied to congress in 2010 just about how much oil was leaking from the deep water horizon well in the gulf of mexico. now the "wall street journal" says a probe could lead to more charges against current and former employees. investigators are also looking at whether engineers working on sealing the well tried to withhold data about the true size of the spill. in terms of the markets, the futures are trading higher as investors get back from the long holiday weekend. investors taking the news out of europe in stride. more details on the bailout of one of the largest banks and greece injecting more cash into the troubled banking system. asia closed higher, europe also trading in positive territory. in terms of data coming out, it's a big week. we get reports on home prices and consumer confidence today. later this week, we get pending home sales, a revised look at first quarter gdp. auto and retail sales.

and to top it all off, friday's jobs report. lef the dow fell 74 to close at 12,454. although it did snap a three-week losing streak, the nasdaq closing at 2,837. companies all over the world say they're having trouble finding skilled workers. a new report by staffing firm manpower says too few people applying for jobs. the most indemand jobs trade and technical workers, sales reps, teachers, and nurses. back to you. >> thank you, seema. shares in the norwegian company opera have soared on speculation that facebook will buy the company. we talked in the past about how facebook needs to figure out mobile. no confirmation from either company this morning. and jon and marla, you remember eduardo savron, he's a good guy in the fictional movie "the

social network." he tells a brazilian magazine he has no hard feelings against mark zuckerberg. it's estimated he's worth about $3 billion. i think that does ease the way a bit. >> it takes away the pain. >> it feels all right. thanks a lot, scott. christina loren talking about a warm-up. >> yeah, we've got really good-looking weather. not just today, but deeper into the week. temperatures are going to be downright perfect right by the water. get ready for that. this morning, a little on the cool side. you'll need a jacket. 48 degrees in sunnyvale, and san mateo to san francisco and vice versa because we do have thick low clouds out there. but the marine layer doesn't look like it's going to penetrate all the way inland this morning. a nice clear start in san jose, oakland, concord, and livermore. temperatures are going to be just about perfect. and then the heat is on.

wednesday into thursday getting really warm air over the bay area. it all works out like this, though. winds are going to play a bit of a factor. right now, they are coming off the pacific, right out of the west as we head through tonight and tomorrow, they'll start to shift more offshore. and we do have a little disturbance as we head through the overnight hours. tomorrow morning, we might be waking up with a little bit of cloud cover. not expecting much. high pressure firmly in control of your forecast for today. and then tomorrow, we are going to see those mid-80s return a 10-degree climb. 73 in redwood city and about 68 degrees in san francisco. by tomorrow, temperatures are going to climb up to 85 degrees and then if you work outdoors, you really want to pay attention to the forecast as we head through thursday. and particularly friday. close to 90 degrees, certainly warm enough to where you want to be drinking lots and lots of water and seeking shade, probably about every 2 or 3 hours because it will be warm as

we head through friday. warm enough for heat exhaustion. just keep that in mind. as we head through the weekend, going to cool you off. area of low pressure will bring in that onshore flow. let's check your drive at 5:17. here's mike. >> first we'll look at the traffic flowing, westbound capital expressway. the onramp to 680 does have traffic flowing here, but a flat bed tow truck has arrived on scene. still no reports of lanes blocked. that's better news. nice easy drive for 680 and the rest of the south bay freeways moving nicely. northbound 101 had some slowing, that has also cleared. these sensors continue to adjust, 237 as more cars hit the road. 101 and 280 not a problem, holding with that tradition. 84, the dumbarton bridge, that reopened earlier and a smooth drive right now. all things cleared there, as well as the san mateo bridge. 92 moves smoothly in the westbound commute direction. castro valley y no problems for 580 and 238. 580 through oakland, the earlier issue, to east 580, that has cleared as well as this road

high-tech crime in china. zuckerberg and chan as you recall visited china back in marchment. up in northern canada a flight lands safely, but it's what happened on the ground which is also making headlines. an engine on an air canada jet bound for tokyo on monday shut down shortly after takeoff as the plane circled back for emergency landing, several metal pieces started to rain down below. people pumping gas were shocked when the fragments crashed through their car's windshield. >> i saw some pieces made of metal. it was so hot. you couldn't even touch it. >> yeah, just really, really strange. not something i expected to happen today having airplane debris falling on my windshield. >> he suffered some serious damage. yeah, luckily, no one was hurt. investigators have not confirmed the metal pieces came from the jet. as for the passengers, they were given a free overnight hotel stay before taking off on another flight. >> you have like a year's supply

today for suspended sheriff ross mirkari mirkarimi. back before the ethics commission to learn how the official misconduct case against him will actually play out. "today in the bay's" christie smith is live with the details of this hearing. good morning, christie. >> reporter: good morning to you, jon. what's happening today doesn't sound that important on the surface, but it really establishes the direction of this hearing as suspended sheriff ross mirkarimi continues his long fight to keep his job. will there be live testimony or just written testimony? and exactly how long will this hearing take? attorneys for the city and mirkarimi are expected to have a long list of witnesses. san francisco mayor ed lee suspended him without pay from his job as sheriff in march after he pleaded guilty to misdemeanor false imprisonment after an argument with his wife on new year's eve. she ended up with a bruise on her arm. the mayor believes he's unfit to be sheriff, but mirkarimi disagrees and has been out and about at events and trying to

work hard to get his side of the story of events out to the public to try and save his job. now the hearing is before the ethics commission which then makes recommendations to the board of supervisors. what they do is decide whether or not to remove him from office or to reinstate him to his job. 9 out of 11 of those supervisors must agree. a final decision on all this isn't expected until july or august. reporting live in san francisco, christie smith, "today in the bay." 5:31, this morning, more efforts to move past a scandal involving nadya lockyer. a group of five finalists vying to replace her will be interviewed this afternoon. county supervisors are set to announce a final decision june 5th and swear in their choice june 12th. lockyer resigned after reports surfaced about drug use and an affair with a drug addict. she's married to bill lockyer.

the discovery of a possible marijuana grow house. firefighters finding more than 200 marijuana plants in a home near 25th and foothill boulevard. much of the crop burned in that fire. nobody was home at the time and so far there are no reports of injuries. well, it is the worst possible news for a family on memorial day. a 21-year-old soldier from selinas has been killed in afghanistan. the department of defense says specialist hernandez died saturday in the kandahar province from an improvised explosive device. hernandez' body arriving yesterday at dover air force base in delaware. hernandez graduated from everett alvarez high school in selinas back in 2008 and joined the military soon after. 5:32. time is running out in santa clara county if you want to vote by mail. today is the deadline to request a ballot for the june 5th primary. you can request a ballot online at sccvote.org.

after today, you'll have to go in person to the registrar's office. the registrar says only a fraction of the 500,000 ballots sent out this year have been returned. 5:33 right now, south bay commuters can expect to see more congestion on freeway onramps that will start tomorrow. new metering lights activated on southbound 280 near 11th street in downtown san jose. caltrans says it is the first of hundreds of ramp lights that will go live over the bay area in the next few years. and this is of course aimed at helping the traffic delays on local freeways. well, good news, one less headache for south bay commuters headed back to work today after the holiday weekend. the dumbarton bridge is open for business this morning. bob redell is live on the bridge with more on the earthquake safety upgrades completed a couple hours ago. bob, did you notice a difference? >> reporter: well, we're going to approach the mid span. i'll give you a sense once we're

up there whether there's any difference on the roadway as far as the smoothness. i don't expect there will be. but the bridge did open not on time, actually ahead of schedule. opened at 3:00 this morning when caltrans shut down the bridge at 10:00 friday night. they said it wouldn't be until 5:00 this morning. here we are approaching the mid span. the mid span is where all the -- most of the work was done. there were two significant things that happened. on the western end of the mid span, workers replaced a 30-year-old expansion joint. they put a new one in. this new one will allow the bridge to move 18 inches either way if there is an earthquake. they also raised the bridge 5 inches. they used hydraulic jacks to raise the section of the bridge 5 inches so that over the next several months, workers can install seismic bearings. now, we are told that there might be another closure of the dumbarton bridge some time down the road.

probably going to look at another weekend closure they're going to have to replace the expansion joints on the eastern end of the mid span, which is actually what we're passing over right now. but as far as today is concerned, the dumbarton bridge actually opened up ahead of schedule. and if you can see out here, there is traffic, but it's at the limit. there's nothing in terms of congestion. thank goodness we have mike inouye to tell us what the rest of the commute's looking like in the bay area. good morning, mike. >> yeah, i traveled that same road bob did, experienced the same thing. we have cool technology taking us a live shot in a van over a bridge, but let me clarify, we might have missed a couple of words. there may be another closure later on. but we don't know when that will be, and we'll be well warned when that is the case. right now, the bridge is flowing smoothly, all lanes are open in both directions, no problems for highway 84. to the south, 237, a great alternate for you, and now it's your morning commute and nothing showing up right now. northbound slowdowns haven't

kicked in just yet, although we're seeing blips from time to time. southbound 280, tomorrow getting the onramps with the metering lights right through this zone. service streets backing up, but the freeway might have a smoother flow. 680 getting on there to the southbound direction at capitol expressway. the onramp still open, but a flat bed tow truck has not arrived. we still have that accident over on the shoulder and may have one lane blocked as that does arrive on scene. and a live look to oakland. a smooth drive right now. no problems northbound with those taillights southbound with the headlights, they are starting to pick up the volume through the area. and christina, the camera is holding pretty steady, but meteorologist christina loren, any big deals for the wind this morning? >> well, take a look at another camera, mike. doesn't take a meteorologist to tell you this camera has a bit of a shake to it. and you will find gusty conditions. but that wind is certainly helping us this morning. it's preventing that fog from settling to the surface and reducing our visibility. this morning we have a sustained

good tuesday morning. welcome back, everybody, hope your day is starting spectacular. this is a live look from san francisco at alcatraz. kind of mysterious. kind of mystery. kind of spooky. enough of that stuff, it's 5:40. new this morning, at least ten people are dead after another earthquake hits northern italy. the 5.8 magnitude quake hit just after 9:00 in the morning local time in the same area where a 6.0 quake hit earlier this month. it was centered about 25 miles northwest of the city of bologna. several people still buried under rubble. the homes and at least one

historic building has collapsed. annan visiting the capital of damascus trying to revise the cease-fire plan he brokered. annan plans to push them to take bold steps to resolve that crisis. the u.n. security council condemning syria for shellings that left more than 100 people dead, many of them children that were dead in the city. and syrian government denies any involvement in these murders. and a chaotic scene outside an upscale shopping mall. at least 19 people all foreign nationals were killed in that large fire. among the dead, 13 children. 17 people including four children were wounded. at this point, it is not immediately clear what caused the fire. but it is believed the blaze broke out at a child care area inside of a mall. well, there's a celebration of sorts for mitt romney after texas has its primary today.

he should have enough delegates to become the republican nominee for president. "today in the bay's" tracie potts is live with the latest from that campaign trail. good morning. >> hey, jon, good morning, it's not the official nod from the party yet, but it's as close as you get if you're mitt romney, he should get the last 58 delegates he needs to have 1,144 to win the nomination. romney yesterday looking forward to today said it would be a big day, looking forward to the news. he's actually going to be in battleground colorado. also seeing president obama recently. then he's going to vegas, las vegas to campaign with donald trump. he's doing a fundraiser there and taking some heat because trump has recently just in the last week reiterated these concerns about president obama's birth certificate and whether or not he was really born in hawaii. romney says, look, some people don't agree with me, and support

me, i don't agree with everyone who supports me. but i need their support to get that -- as he put it 50.1% to win this presidency. meantime, the president spent his day yesterday with veterans at arlington cemetery and the vietnam war memorial. that, jon, is also going to be a key voting block for both of these candidates, vets make up 13% of voters in this country. >> that is a big number. tracie potts, thank you very much. the heat is on. it's coming. christina loren talking about a warm-up. >> best intro ever. good morning. we've got a good-looking day today. today we're calling it warm. you might be using the word hot. hot, hot, hot as we head through wednesday and thursday. the natural coolant coming in off the pacific at 5:43. that's what's going to keep our temperatures at bay today. keep them from soaring into the 90s. we're going to lose that coolant as we head through wednesday and thursday. and as a result, your temperatures, oh, they are going to skyrocket. we've got a really warm mid and

end of the week to look forward. but winds are a bit of a factor. keep that in mind if you drive a high-profile vehicle. the winds are keeping the fog from settling to the surface in san francisco. but you might find thick patches through half moon bay this morning where we have calm conditions. as we head throughout this afternoon, your temperatures are going to jump from the 40s and 50s into the upper 70s and 80s. and i want to point this out. earlier the potential for novato to dip into the 30s. hasn't happened in over three weeks this morning, now at 39 degrees. that's definitely cold enough for a jacket this morning. might want to grab that on the way out the front door. probably need that jacket by the coast, at least until about 10:00, 11:00. high pressure's moving in quickly. today, looking pretty good by tomorrow we're going to tack on an additional 10 degrees from today's highs which are already expected to be three to five degrees warmer than yesterday. once the offshore winds start to develop, that's when things get interesting around here.

after baseball. comcast sports net bay area was the only camera to capture bonds as he talked about everything. and the amazing thing here is he stood outside the giants' clubhouse and answered questions from reporters for about 30 minutes. and that rarely happens during his playing days. the all-time home run leader says he does not have any regrets over what happened in the steroids case. a judge has given prosecutors until mid-july to respond to bonds' conviction appeal. it could be next year before we hear a decision. >> i don't know what you call justification out of it, but that's what i am and i went through the system and that's the penalty they gave me, i'm in an appeal right now over that. >> well, how this affects his ability to get into the hall of fame on the first ballot next year is something bonds says he hasn't thought about much. he says he would like to return to the giants in a coaching

well, doesn't she look good for being 75 years old? and two days. the golden gate bridge, the traffic moving along just fine. mike says the traffic volume is starting to pick up on this tuesday. it is 5:52. well, an auction in beverly hills has elvis fans buzzing. i guess you could say one of the items is to die for. the crypt where elvis presley was first laid to rest will be one of the items on that block for auction. if you recall, elvis died way back in 1977. and following his funeral at graceland, his body was temporarily entombed in the crypt of a private mausoleum in memphis. after about two months, both his body and that of his mother were moved to a permanent site at graceland. it's a good excuse to show old elvis highlights. at graceland, the auction house will auction it off during a two-day sale on june 23rd and

24th. the opening bid if you want it, $100,000. >> i bet it goes quick. 5:52. the stock market back to work after a long holiday weekend. scott mcgrew joins us. scott, it needed the break. >> it really did. it's been a long slow slide. dow is down 6% this month alone. now, there are a couple of good things going into today's trading. european leaders had until monday to get greece billions more euros to keep it afloat. and they did. and we expect a new housing report to show home prices are slowing their fall. that took a while. the slump started in 2008. the dow 30 will start this morning at 12,454 after another lousy day friday. nasdaq, mostly unchanged to some degree propped up by apple. apple accounts for about 12% of that index. yahoo over the long weekend killed its live stand project. this was a take on the popular flip board. one of the ways that yahoo was going to get involved in tablets. the irony is this was a pretty

p.m. so warming up nicely under abundant sunshine. bay side at the coast, a little bit on the cool side, warm later, but by thursday, temperatures in the 80s, even in san francisco. stick around, your seven-day is on the way. first, let's get you out that front door if you're leaving right now, hold up, one minute, here's mike. >> or a few seconds, at least for 92. that's the issue. sounds like there's a big rig going on there between 280 and highway 35 just off of the freeways along highway 92 itself. and maybe having some brake problems. that might have one lane blocked. chp is going to let us know as they have arrived on scene and hopefully we'll know specifics on any lane closures. but traffic flow as far as i know on 92 is moving past the scene and 280 for sure, no problems there along the peninsula. we'll get a look at the other issue for 242 involving a big rig. this is southbound 242 just past concord avenue. and there is, indeed, that big rig i told you about, the update, lane three is blocking one of your right lanes heading
