good morning, everyone. it is 4:30, i'm jon kelley. >> and i'm marla tellez. and breaking news on our early morning commute. a big rig has crashed in coopertino spilling 80,000 pounds of concrete on to the roadway. bob redell has just arrived on the scene. if we're not mistaken, this is southbound 280 at 85? >> reporter: yeah, southbound 280, marla to the northbound 85 connector. basically if you're commuting down the peninsula and trying to get to mountain view to work, this will affect your commute. chp telling us it could be two hours before they get this open. what you have right here in front of you is you've got a tractor and two trailers, two

trailers full of dry concrete, a short time ago, the driver was making the turn, he tells chp he felt his rear tractor flip over and the rest is what you ended up with right here. chp not clear what caused this accident, but clearly lost control. this is a solo vehicle accident. the driver standing to the right of the tractor, he's okay. what the fire department is doing right now, they're putting sand down on leaking motor oil, perhaps a little diesel. they've got to do that. and once they do that, the wrecking company can get one of their rigs out here and turn this over. they've already got one rig out, this is definitely a two-rig job. they're waiting for that to show up. things that could be the x factor that could delay this. when they're turning this over, they want to make sure they do not split those in half. they've got to be very careful with that. chp estimating this should be reopening, they're being optimistic they say around 6:30 this morning. again, we're on the southbound

280 to northbound 85 connector ramp. reporting live here, bob redell, "today in the bay." >> thanks. that's going to affect this morning's commute. also happening right now, another traffic mess in the east bay. a big rig crash has shut down several lanes on 880 in oakland. these are live pictures right now of the scene. this is near high street. so 880 near high street, the rig lost control and crashed into the center divider between 50 and 100 gallons of fuel spilled on to the road. you can see crews out there with their brooms working on cleaning this up right now. a lot happening on the roads this morning. mike inouye has more on how these crashes could affect you today. a lot going on. >> yeah, good morning, marla. crews right there sweeping up. there was a fuel spill. estimates about 80 gallons of diesel fuel spilled out there from the tanks. the rig is on its wheels. once they clear the spill, it should be okay. and they're expecting another 15 or 20 minutes, the original estimate.

right now, it's a good distraction. we're going to look at the view from overhead and across the street. and as you see, there are a lot of flashing lights. the taillights approaching high street, the flashing lights, the off ramp is open, you can see cars exiting to the right of the screen. and folks traveling north are distracted, but not slowing much because of the lighter volume. we track that. meanwhile, getting back to san jo wherere we have another issue here. we have a southbound 280. you talked about that with bob. the overturned cement truck. i want to give folks an alternate you can get off on the expressway, take it over to homested, and lawrence, and back to 85, and that should get you past the scene, be uh you see already a disturbance and unusual flow 85 past the area. hey, good morning to you, mike, a good-looking forecast for the first part of the day. but if you are waking up with us

inland, you want to get it done early. we're talking about the 90s, possibly breaking some records right here in the south bay. 54 degrees to start you out, 54 in livermore this morning and 52 in san francisco. so i'll let you know which beach cities are going to get the best weather today and how hot it'll be inland. back to you and the rest of the top stories. >> thank you. it is 4:34, we have an update on a failed jewelry store robbery. a suspect shot inside has died. this robbery attempt took place late wednesday afternoon at the golden treasures jewelry store. four armed men entered, but at some point shots were fired. a suspect who was hit ran outside and then collapsed on to the street. the three others took off. police are not saying who fired the gun, but other jewelry store owners in the area say protection is important more than ever. >> you have a jewelry store -- for me, you're out of your mind.

>> when the price of gold is so high, it's normal. you get whatever you get and easy to convert it. >> police are looking for a get away car, possibly a white 1990s four-door sedan. the man accused of kidnapping and killing sierra lamar expected to answer to charges today. antolin garcia-torres due in court this afternoon to enter his plea. he was arrested last week after investigators say they found dna linking him to the missing 15-year-old. sierra lamar disappeared back on march 16th. she has not been found. in a strange twist, a cell phone conversation could play a crucial royal in the beating case of bryan stow. both accused in the attack outside dodgers stadium last year, they were in court wednesday for a preliminary hearing. prosecutors introducing a recording of a cell phone call between norwood and his mother. >> hey, mom, i got arrested for

that dodger stadium thing. so, yeah. no, i hear you. not much i could say -- >> during that call on a borrowed cell phone from one of the officers, norwood also admitted he was involved to a certain extent in this crime. as for stow, his family says he does not remember this attack. on to decision 2012, mitt romney's campaign is counting the cash today. tickets to a fundraiser at a posh mansion, campaign staffers told the crowd of about 300 it was the most successful fundraiser in california yet, but didn't reveal how much was raised. cameras were not allowed inside. outside, obama supporters held a silent protest. nicole richardson says she is a democrat but supports romney's economic plan. >> i think he has very good business sense. he is fiscally responsible, and

i'm not putting down our current incumbent president. but i just think he has a passion and he loves the country. >> donors say former secretary of state condoleezza rice has endorsed romney. but there was no talk of adding her name to the ticket as v.p. one name being floated for romney's running mate, hp ceo meg whitman. she hosted the fundraiser last night. the two worked together at bain capital and are long-time friends. some suspect a romney/whitman ticket might do well with female voters. other names, florida senator marco rubio, ohio senator rob portman, former minnesota governor tim pawlenty, and new jersey governor chris christie. san jose mayor chuck reed says he won't make a decision on a city resolution to support gay marriage until after that june 5th election. pushing the mayor to join other

big-city mayors around the country in supporting same-sex marriage. now, he says he's not asking mayor reed to go against his personal beliefs but wants reed to do what's right from a legal standpoint. mayor reed questioning the timing. >> i think the timing of this and the connection to the presidential campaigns and local campaigns is unfortunate. >> you cannot treat people as second class citizens when it comes to marriage. and that's what's happening now. it allows the mayor or anyone else to hold on to their religious beliefs, but at the same time, stand up for our constitution and treat everyone the same. >> he wanted to have the full council to consider his proposal next week, but the rules committee and mayor reed have tabled this issue until after the election. the mayor plans to meet with the lgbt leaders after the primaries. well, parents in the south bay are fed up with their school district. they say the schools are failing their children. parents will meet with franklin mckinley school board members tonight to talk about a crisis

at the middle schools. parents say more than half the middle school students finish eighth grade unprepared for high school. the rate is even higher for latino students who make up more than 60% of the district. well, you can expect traffic delays, noise, and a nasty smell this summer as pg & e replaces a 76-year-old gas transmission line. the gas line called line 109 runs west of nelson drive. the city leaders say pg & e has no test records of this line. crews will also dig up parts of line 101 which runs parallel to highway 101. a public meeting about the projects will be held this afternoon at herbert hoover elementary school on east charleston road. the meeting starts at 4:30. good morning to you, it's 4:39, meteorologist christina loren says it's going to get a little warmer today. looking forward to that. >> yeah, possibly breaking records. good morning to you. it's cool out there right now. if you did want to walk the dog,

do anything outdoors that's going to cause you to sweat, for instance, you want to do it early before about noon as temperatures will be climbing into the 80s. about as warm as we were yesterday in the heat of the day at noon. we're at 52, good morning in sunnyvale, and 48 degrees in santa rosa headed toward a good-looking day as high pressure moves over the great basin. driving the winds offshore. and as they pump from land to sea, they warm up along the way. we are talking about a substantial warm-up for today staying just about as hot for tomorrow. 80 degrees at noon inland, about 90 degrees at 4:00 p.m. and that's pretty warm for this time of year. whenever we're talking about records, we're talking about this being the warmest day on this date. so here it is obviously the final day of may and typically we only see highs in the 70s. today we're talking about the 90s. i'll take you through your city-by-city forecast coming up. first, mike's a busy man. good morning. >> yeah, this is one of the

busiest days we have had. usually these are weather-related problems overnight. but right now, the first of our accidents, southbound 280 at northbound 85, this accident, bob redell's live on the scene there. a cement truck has overturned on its side. actually a double trailer and there's a problem, they can't lift that truck. there's a diesel fuel spill, as well. they've shut down the connector. that's southbound heading in through coopertino. maybe 85 into sunnyvale and mountain view. you can pass it, take maybe sunnyvale saratoga through the exit or use lawrence and get over to homested, as well. we'll get a look out there as far as your alternate route. further north, no major problems as far as construction goes throughout san jose or mountain view. oakland, northbound 880 at high street, another accident there. and here we have a live camera. we have some progress here. good progress. they're still looking at maybe

southern california coast at about 8:45 this morning. now the "dragon" detached from the international space station after 2:30. it's equipped with a heat shield designed to withstand reentry. other automated spacecraft that has visited the space station were designed only for one-way trips. the capsule was built by california based space x founded by elon musk who is the co-founder of paypal and tesla motors. the u.s. is trying to crack down on syria after last week's mass killings. they have kicked out several diplomats and frozen assets from one of syria's banks. senator john mccain suggests arming the rebels, the white house says no. >> the best way to resolve this, if at all possible, is not through intensifying the militarization, not providing further arms into what is already a hot conflict.

>> the u.n. wants syria's government to comply with a peace plan, but experts say it's going to take more than diplomacy to stop the violence. not a great way to start a thursday, but more bad news out of europe sending the markets into a tail spin wednesday. for more on that and the rest of the news before the bell, we turn it over to seema mody live at cnbc world headquarters. good morning, seema. >> good morning. u.s. futures are actually slightly higher this morning after yesterday's big selloff as we pointed out, stocks dropping about 1% across the board wiping out tuesday's rally. now the big culprit is europe. bond yields and italy on concerns of mounting debt. that pushed investors to safer markets like u.s. treasuries and asian bonds. european markets are trading higher today. in terms of what the market will react to, we get a ton of economic data out this morning with two reports on the job market as well as numbers on manufacturing and a revised look

at first quarter gdp which may show the economy didn't grow as much this winter as previously anticipated. now taking a look at how the markets ended last night, the dow falling 160 points, it's on track for the worst may since 2010. the nasdaq losing 33 to close at 2,837. foreclosures may make up more than a quarter of all home sales. accounting for 26% of sales in the first quarter of this year. the firm says a spike in short sales may be partly to blame for the increase. those involve sales that go for less than what their owner owes the bank on their mortgage. retailers reporting sales today. total sales are only forecasted to rise around 2% after several big chains including macy's, saks, as well as jc penney reported disappointing results in april. future's slightly higher. back to you.

>> thank you very much. if you're liking the trend mother nature is delivering to us, get ready for some more heat. >> yeah, it's going to be hot today, especially by the coast where we actually had a pretty nice day yesterday. san francisco barely broke into the upper 60s. now, as we head throughout this afternoon, we're talking about the 80s in the city by the bay. 56 degrees to start you out in oakland, now 51 in sunnyvale, and 54 degrees in san jose. and even though we're starting out nice and crisp and cool out there, it will not take long for that sun to warm us up. and we're just about an hour away from your official sunrise. 52 in san francisco, and now we're at 55 degrees in concord. winds will play more of a factor today becoming gusty throughout the second half of your day. and already seeing strong, sustained winds. out of the west-southwest, calm conditions along the peninsula. all works out like this for today. we're going to get a nice sea breeze at the coast and making for comfortable conditions in

places like pacifica and half moon bay, but even san francisco will be warm today with the 80s. and tomorrow, a little bit of stronger onshore flow, and that will bring your temperatures down a touch, mostly at the coast. just about as warm tomorrow as we will be today in your inland city. 88 degrees in san jose. grab that water bottle. 90 degrees in concord, and 90 in livermore. i'm happy to report we do have good air quality. if you did want to open up those windows, feel free to do so, good air quality for the time being. probably reinforcing that good air, monday and tuesday, area of low pressure bringing us light showers up to the north. by wednesday, 82 degrees, starting to level off a little bit. but two hot days to get through. weekend looks good. guys, back to you for now. >> thanks. well, have you seen this video. some people in minnesota got more than they bargained for when they went to their local bar after a truck crashes into it. >> this is crazy. you've got to see this video. lunchtime is the rush hour there

for lunch. watch this, a truck barrels right through that, slams right into the bar. the driver apparently suffered some sort of medical condition, people have no idea anything's coming. unbelievably nobody was killed, however, six people were hurt in this accident. doctors say if it wasn't for a quick-thinking neighbor who jumped in moments after that crash, the injuries would have been a lot more severe. that's just mind blowing that nobody -- >> yeah, seems -- >> -- was more seriously hurt. >> seems almost impossible that no one died under all that. okay. 4:51. still ahead, hoping to lead his team to victory last night. but it wasn't to be. how the freak did against the diamondbacks. >> you've got to be kidding me. and the youngest speller in the spelling bee, unfortunately, out of the competition. wait until you hear the word she tried to spell. >> i would not have even made it. looking at the overturn

all over the roadway. we have bob redell live on the scene. we will talk to him in just a few minutes. but first we want to -- >> let's find out how this will affect your commute. let's get to mike inouye. >> stay on this live picture. the tow truck did arrive. we're looking at the need for at least two tow trucks. 80,000 pounds of cement truck and its load there. about ten gallons of fuel also spilled. we saw the live shot, they were spilling that kitty litter stuff to absorb it. we are looking at no injuries, though, that's the good news. but it closes the off ramp, the connector from southbound 280 to northbound 85. as we continue to watch this crew, i'll explain there is an alternate route for you. foothill expressway a little to the north or back to the maps now. we're showing the connector here south 280 to north 85. if you see the incident, you pass it, go ahead and get off there at at sunnyvale/saratoga.

that's what you know as the area north of 280 and it'll take you over to homestead which takes you over to 85. if you get on the freeway at homestead or fremont, you're clear from that area. now let's get a look over also further north. with the south bay not showing a problem, we'll take you over to oakland. there we go at the high street off ramp. this is actually in the construction zone off the freeway, and chp has notified me all lanes of the freeway are open. a tow truck has arrived. 80 gallons of fuel has cleared here. and we expect this to clear. but no lanes of the freeway are blocked now. the slow lane has cleared, guys, back to you. >> appreciate it. time to take you out to the ball game where tim lincecum had a pretty good night. only gave up one earned run in seven innings, struck out six, the giants' offense didn't have it going. the diamondbacks win this one 4-1. the national spelling bee, yeah, we were talking about this
