this will be righted. that story coming up. and we're looking at the flow, which has stopped, i'll give you your alternates to get through the area, including folks heading to the apple campus today. and san ramon police this morning looking for three suspects after a botched jewelry store robbery turns fatal. who fired the fatal shot? i'm christie smith with the latest on the investigation coming up. and it's history in the making this morning when the space x dragon capsule splashes down in the pacific. and it's going to be a hot one. temperatures in the 80s today. but, hey, just bring bottle of water with you. we've got a cool down on the way as of tomorrow. your full forecast is moments away. live look right now at 880, traffic moving along pretty good in oakland, mike will have the morning commute in just a moment on this thursday, may 31st, "today in the bay."
6:01 am
. good morning, thanks for being with us, it's 6:01, i'm marla tellez. >> good morning, everybody, i'm jon kelley. we start off with breaking news in the south bay. a stretch of freeway known for, yeah, nasty commutes got a little bit nastier out there. crews busy clearing up a crash where tens of thousands of pounds of cement has just spilled all over the place. bob redell is live in cupertino with an update on how this cleanup is going. how's it looking out there, bob? >> well, jon, the best case scenario is have the southbound 280 connector and northbound 85 open by 8:00. light right now, they're estimating another two hours to have this open. unfortunately, that is going to be into the morning commute. the cement has not actually spilled yet. what you've got is you've got a tractor that was hauling two trailers full of dry cement that overturned here. you can see in the foreground to
6:02 am
the left. the towing company got that righted, now they've got to get the other one beyond that and the tractor itself right side up. the good news so far, there was concern when they were righting these that one of the trailers might split open and pour wet cement all over the roadway. that did not happen. they're hoping it will not happen with the second trailer. clearly that would add time to the cleanup effort. you can see the driver, he's okay. he's been out here all morning long. he's obviously not happy with the situation here. he told us that he was leaving cupertino, a cement plant here in cupertino early this morning when he was coming around the bend on his way to santa rosa when this happened. >> i was coming to the ramp at 25 miles per hour, then i come to here -- i never heard anything, just slowly tip over. >> reporter: he believes that his load shifted that some of
6:03 am
the cement in his back trailer shifted when he was making a turn and that caused it to tip over. chp tells us they will be looking into whether he might have been going too fast. again, southbound 280 connector ramp to northbound 85 shut down, the new estimate now is 8:00. so perhaps around two hours from now, you're going to need to know how to get around this. that's why we have mike inouye to help us out. >> thanks for that update. and our fingers are crossed for that second cement hauler to hold intact. we're looking at the counter commute, southbound 280 to northbound 85. countercommute but still 8:00, this could present a problem for the bulk of the south bay commute to be kicking in at that time. your alternates are moving smoothly, foothill expressway to the north, you can take that north to homestead and a quick move back over to 85, 85 north will rejoin you with the flow of traffic. if you continue south past the incident, you notice the closure, still have the sunnyvale/saratoga interchange
6:04 am
open, and you can head up past the accident or fremont through the area. a live look out there shows you how things are shaping up. and we're looking at a different scene. this is oakland through the area past high street where the big rig has just cleared. this was our earlier sig alert, which is all lanes of 880 cleared past the scene. high street has reopened. there may be a closure for the off ramp -- no, cars have gone by. this is in the construction zone between 880 and high street. as they moved that rig and trailer from the earlier sig alert. we're now tracking just the cupertino closure at 85. it is 6:04. the man accused of kidnapping and killing 15-year-old sierra lamar will return to a san jose courtroom today. 21-year-old antolin garcia-torres is expected to enter a plea. he was arrested ten days ago after dna testing allegedly linked him to the missing morgan hill girl. volunteer search parties are still trying to track down sierra whose body has still not
6:05 am
been found. she was last seen the morning of march 16th heading to school. pleasanton investigators working very hard but having no luck at all identifying the body of a woman found inside of a trash can. the woman has dark hair, wearing blue nail polish, an old navy t-shirt and pajama pants, but her fingerprints have not revealed any clues about her identity. the body was found on dublin canyon road last week. police hoping to create a sketch of this woman over the next few days to get the public's help in identifying her. well, also in the east bay, police are looking for suspects in a violent jewelry store robbery attempt that left one man dead and three others on the run. christie smith live in san ramon where police have a possible description of the get away car. christie, good morning. good morning to you. yeah, you know, and we heard from the store owner's daughter and she said her family certainly wouldn't stand around and be victimized. so when four armed men stormed into the jewelry store
6:06 am
yesterday, well, one of them was shot and the other three went scrambling to try and get away so this morning san ramon police are still looking for them. the robbery attempt was bold. it was broad daylight. they stormed into the golden treasures store here on san ramon valley boulevard. but the attempts fell apart quickly when one of them was shot, ran into the street looking for help. he was taken to the hospital and later died. police didn't say exactly who fired that shot. a worker or the owner, but they did say no customers were inside at the time. another business owner said these type of stores with gold and silver coins and jewelry are attractive to people with the wrong intentions. >> when the price of gold is so high, it's normal. you get whatever you get and then convert it. you stop at the next jewelry store and you can sell them there cash for gold. it's a big target. >> reporter: now san ramon police are reviewing surveillance tape from around
6:07 am
the area. and they're still looking for that get away car. possibly a white four door sedan from the 1990s. reporting live in san ramon. christie smith, "today in the bay." nasa and people at california's space x are counting down to splash down for the "dragon" capsule. now shifts will pick it up off the coast of baja california and take it to los angeles. the capsule took supplies to the international space station. space x is contracted to make 12 more trips through 2016. meantime, the faa is clearing the virgin galactic spaceship for test flights. "spaceship 2" has a permit for flights beyond the atmosphere. virgin galactic is owned in part by billionaire richard branson's group. they have already taken deposits
6:08 am
from more than 500 people for rides which cost $200,000 apiece. >> wow. i tried to get one on the layaway plan and branson did not accept. >> nothing? >> no, i won't be going. 6:08 this morning. let's check to find out if we're going to have warm areas out in space today. >> walmart has layaway. you need to get some new haynes, a new tank top, something to cool off in later on today. they can hook you up. we're looking really good. you saw from the picture, blue skies for the most part, little bit of low cloud cover, but not much, and it will not last long. good morning to you, 50 here in san jose, and we're headed towards a really warm afternoon, one of the warmest afternoons we have had in almost six months. so make sure you're ready for that. north bay, central bay, east bay, everywhere across the bay area, we have good air quality today, but take a look at where your temperatures are headed. upper 50s as of 8:00 a.m. and the inland cities and bay side will clear the quickest.
6:09 am
at the coast, you might have to see more cloud cover until about 9:00. but 80 degrees, comfortable by noon, rounding out the day at 88 right here in san jose. your full forecast is coming up in a few moments. but right now, back to you guys. >> okay. 6:09. the movement to get marijuana legalized in california appears to be going up in smoke. a new poll from usc and the "l.a. times" shows just 46% support legalizing it for recreational use. prop 19 lost by a similar margin in 2010. strangely, california even appears to be lagging behind the rest of the country. a gallup poll showed 50% of americans support legalization. and today u.c. berkeley heading to court trying to crack down on protesters occupying farmland. the regents will state their case starting at 9:30 this morning. they're hoping for an injunction and a restraining order against a group of activists known as
6:10 am
occupy the farm. now if the regents are successful, each protester could face up to six months in jail. protesters, well, they've been camping out there on and off at the farmland since earth day in april. activists say they want some of that land preserved as a community garden. the university says the land is used for research by the college of natural resources. well, some parents in the south bay are fed up with their school district. they say the schools are failing their children. they're going to meet with franklin mckinley school board members tonight to talk about what they call a crisis at the district's middle schools. parents say more than half of middle school students finish eighth grade unprepared for high school. the rate is even higher for latino students who make up more than 60% of the district. it is 6:10 right now. coming up, rebels issue a deadline following more killings in syria. find out what they want done by noon tomorrow. that's coming up. and new polls show the
6:11 am
president and mitt romney neck and neck in three key states. plus, facebook shares take another nose dive. we'll take a look at that stock and what mark zuckerberg may want to do about it coming up. and for all your latest news, weather, and traffic, come find us on facebook at nbc bay area. back in minutes.
6:13 am
welcome back, everybody, on this thursday morning. i want to give you a heads up as you head out the door to work. in cupertino, a cement hauler overturned but it has now been uplifted after a crash on the connector from southbound 280 and northbound 85. we've been told this may not be cleared up until at least 8:00 this morning. so this should be jamming up some traffic today during rush hour. mike inouye will be along to give you all the details in a few minutes.
6:14 am
the time now 6:13. now on to decision 2012, three new nbc polls showing president obama and mitt romney are deadlocked in three key battleground states. they are tied at 44% apiece in iowa and colorado, obama gets support from 46% of voters. romney gets 45%, and in nevada, the president is at 48%, romney is at 46%. now romney's campaign will keep him in california today for several more fundraisers. >> that's right. tickets to a fundraiser at a mansion last night went for between $2,500 and $50,000. campaign staffers telling the crowd of about 300 it was the most successful fundraiser in california so far. no cameras were allowed inside. that's why we're showing the outside. and outside we can tell you, people gathered to voice their support. nicole richardson is a democrat but supports romney's economic plan.
6:15 am
>> i think he has very good business sense. he is fiscally responsible, and i'm not putting down our current incumbent president. but i just think he has a passion and he loves the country. >> condoleezza rice did formally endorse romney at this event. syrian rebels are giving the government 24 hours to comply with the u.n.'s peace plan. the discovery of 13 bodies in east syria and a weekend massacre that killed more than 100. >> knows only one word which is shoot. and as long as that is the approach of this regime, then we understand and must understand that no plan, no peace plan is going to work. >> the united nations says 9,000 syrians have been killed in government clashes in the last 15 months. well, an oakland raiders player known for big plays on the defense will be on the defensive darius hayward bay will be arraigned in court a few

hours from now facing dui charges after driving erratically on the bay bridge back in april. the chp says bay failed several sobriety tests after being pulled over. if found guilty, he could face six months in jail. there are just three games today on major league baseball's schedule. and neither bay area team is playing. tim lincecum still trying to get out of a funk with the giants. timmy only gave up one earned run and struck out six, but the giants' offense was lacking last night. the diamondbacks win 4-1. the giants are back at it tomorrow night. they host the cubs and you can see the game right here on nbc bay area. coverage starts at 7:00. 9:16. the national spelling bee's youngest competitor is out of the running. >> so sad. 6-year-old lori ann madison misspelled her word yesterday in the preliminary round and well, this one was tough.
6:17 am
how about ingluvies, that's right, that cold-hearted judge pointed out the word starts with an "i." ingluvies. >> that is incorrect. >> yeah, that's rough. and then the judge was so cold-blooded. look at her sad face. the judge said, yeah, it starts with an "i," not an "e," young lady. but the judges have the answers right in front of them. >> look at her. she was staring at the judges like, did i hear you correctly? >> am i really done? >> poor thing. >> she'll be back. >> 6 years old. impressive. >> christina loren. nice forecast today. >> she doesn't even realize it, but she's doing great things for blonds all over. one day, girl. one day you'll see what you've done. we've got a great-looking day shaping up. as you can see, that sun is blazing over san jose already. only 6:19, we typically have a fair amount of may gray, or
6:18 am
tomorrow we'll call it june gloom, but not the case today. and offshore flow is going to bring your temperatures up. now let's go ahead and show you what we did have in terms of fog formation this morning already quickly thinning out and burning off. and you can see here, ripples out on the water indicative of to winds. a little choppy on the bay with winds picking up. 49 degrees in napa this morning, 56 in oakland, and 51 degrees in san francisco. so you get a five-degree increase as you head over the bay bridge this morning. throughout the afternoon, your temperatures will be about five degrees warmer in oakland than what we're expecting in san francisco. i'm forecasting 80s. breezy conditions, winds picking up throughout the second half of the day in particular. as we head throughout today, high pressure sets up over the great basin. we are going to see offshore flow. and as it kicks into high gear for the second half of the day, the gustier the winds get, the warmer we will get inland. a nice breeze at the coast, that'll keep your temperatures in the upper 60s and low 70s today in pacifica and half moon
6:19 am
bay. san francisco, 79 degrees, 85 in los gatos, and 85 and warm up in wine country. throughout tomorrow, a touch cooler, not much inland. we'll be just about as warm. some cities might be warmer with a nice mild start to your friday. final day of the week, you made it to thursday, friday eve, as we head through this weekend, temperatures are going to be perfect for outdoor activities. and a lot of kids are starting to get off for summer. if you want to get them outdoors, you'll be able to do so saturday and sunday. sunday will be downright perfect inland, 78 degrees with a little bit of fog in the morning. 6:19, mike is a busy man, any updates on 280? >> we do. first of all, what we're talking about is southbound 280 to northbound 85. we do have that closure. the connector ramp is closed. a live look shows you in the last few minutes, the big rig has been righted. so all three of these components have been righted without any further incident. what you saw a few minutes ago,
6:20 am
this blue inflatable that helped ease it down. that was pretty spectacular. i'll try to get that video cut and sent to the web, as well. that still has the connector closed. going to get you back for your alternates. back to the maps, looking at that closure, simple one, to get off of 280 at foothill expressway and get over towards homestead. homestead will take you back to northbound 85 and that is good. if you travel south of there, you'll use sunnyvale, saratoga, travel north and homestead, as well. but that could take you into some of the traffic as folks head over toward the apple campus, as well. we'll watch that and send it back to you. >> thanks a lot, mike. appreciate that. the dragon capsule set to splash off the coast of california just about 2 1/2 hours from right now. scott mcgrew joining us now. and the question is, where does the "dragon" go from there? >> that's a good question. space x says the "dragon's"
6:21 am
going to go on display, my suspicion is the smithsonian. when "dragon" does come back, it will be the first unmanned cargo capsule to come back from the international space station ever. they normally let them burn up in the atmosphere, but future "dragons" will be reused, so they're going to protect it with a heat shield. now, where's mark zuckerberg? let's turn to him. he's on his honeymoon. last we heard in italy. some investors would like to hear from the newlywed. as facebook shares continue to sink. employees too would probably benefit. we talked in the past about how a company's stock price becomes a major distraction to workers. and look at this distraction, it's a big one. the stock fell enormously. zuckerberg himself actually dropped off the list of the world's 40 richest people as facebook shares fell another 2.25% on wednesday. i can see we've got something out of order. this is the star dust probe.
6:22 am
this is probably my fault we got it out of order. and we're going to go back and talk about this heat shield. this is the star dust probe protected by the same material as the "dragon" and it's also invented in nasa. this is the fastest object ever to enter the atmosphere, faster even than the apollo astronauts when the heat shield held. i've said before and there are statistics to back it up. in the race for tech, san francisco's winning, the "wall street journal" ran the numbers, says san francisco's growing its tech industry much faster than san jose. south bay still has far more tech workers, 211,000 people work in tech in the south bay compared to 94,000 in the city. but san francisco's accelerating, getting 10% in tech jobs last year, south bay 3%. a lot of the credit has to go to ed lee, obviously, but facebook had something to do with that, as well. the u.s. government considers
6:23 am
everything palo alto south to be the san jose market, everything menlo park north to be san francisco. so when facebook moved from palo alto to menlo park it actually skewed the numbers northward. >> fine line. location, location, location. thank you, scott. 6:23. coming up, you've got to see this video. lunch at the bar turns into a close call. >> crazy. >> look at that for all these customers. find out what led to this crash next. [ male announcer ] stop & go traffic.

6:26 am
good morning, everybody. take a look at this. at a minnesota bar. oh, just a pickup truck smashes right through the wall there. police say the driver of this pickup suffered some sort of medical condition and lost control. the mind-blowing part, nobody was killed, unfortunately six people were hurt and they've been hospitalized. well, tough teen licensing laws are working and saving lives. tracie potts joins us live from washington with efforts to take these restrictions even further. good morning. >> reporter: good morning. the insurance industry says if we make teens wait a little bit longer and get more experience before they get behind the wheel, at least for long periods of time, we could save 500 lives a year and prevent 9,500 accidents. now here's how that breaks down in california. what they want to do is toughen up graduated licensing. you know, your permit and then your intermediate license and then finally your full licensing. that permit you can get in
6:27 am
california at 15 1/2, they want to move that up to 16. the insurance institute for highway safety in the new report also says that teens should have 65 practice hours before getting a full license. in california right now, it's only 50. and they want to move the full licensing age up a year, as well from 16 to 17. night driving is an issue in california. teens can drive until 11:00 p.m., they want to roll that back until 8:00 p.m. doing all of this, the insurance industry says will drop collision claims in california by 13% and prevent 25% of fatal crashes. marla? >> teens not going to like this, but if it's saving lives, hard to fight that. >> yeah. 6:27 right now. still to come on "today in the bay." the man accused of killing sierra lamar expected back in court. we'll let you know what the next steps in this process are. and a cement truck causing a major traffic headache right now in the south bay. efforts ton xt ivea lior rept. next in a live report.
6:30 am
progress in the effort to reopen a major commute thoroughfare here in the south bay, i'm bob redell. we'll take you to the southbound 280 to northbound 85 connector ramp coming up. and with that closure in the south bay affecting folks heading into the heart of silicon valley, i'll have your reroutes and the affect on the traffic flow so far. and this morning, san ramon police are looking for three suspects that got away after a botched jewelry store robbery that turned fatal. i'm christie smith with the latest on the investigation coming up. and get ready for a summer-like day. the last day of may could be record breaking temperatures ending up in the 90s. your full forecast is moments away. and with those temperatures rising and rising, it's a live look outside at san francisco. going to be a hot one on this thursday, may 31st, "today in the bay."
6:31 am
good thursday morning, everybody, thank you very much for joining us, the time now is 6:31, i'm jon kelley. >> and i'm marla tellez in for laura garcia-cannon. crews are busy clearing a crash involving a cement hauler in a major freeway interchange. "today in the bay's" bob redell live with an update for us. bob, any progress out there? >> reporter: big time progress. here on the southbound 280 to northbound 85 connector ramp. you have the tractor and the two trailers. they have just been righted. this was the images we captured about 15 minutes ago. the wrecking company out here, just righted the second trailer using air bags along with the tractor that pulls it. right now what they're trying to do is to attach those vehicle parts to a rig, wrecker so it can be towed out of here. the estimate right now is that it'll probably take an hour to get all the vehicles out of here
6:32 am
and the roadway cleaned up. so you're looking at 7:30, possibly even as late as 7:45 before this connector ramp is reopened. that's good news because last report we were hearing it could be as late as 8:00. now you're looking at maybe just another hour, 1 hour, 15 minutes. it was a solo accident. the driver telling us he was coming around this bend, says he was going around 25 miles an hour when he believes the load shifted. he has two trailers full of dry cement when he believes the load in his back trailer shifted causing the entire rig to turn over on its side landing in the middle of the road part way off the road and crushing the guardrail. he got out okay, he is fine. the chp will be looking into, however, whether he might have been going too fast. again, the southbound 280 connector ramp to northbound 85 is shut downright now behind your vantage point. i can see traffic on southbound 280, there's hardly any. it's not affecting the commute
6:33 am
right now. but in an hour from now, that could be a different story. so mike inouye, what do you suggest as the alternate? >> bob, first of all, great live observation on the traffic flow. that's exactly the same thing we're seeing on the sensors. reaffirming what bob was saying, southbound 280 to northbound 85. folks heading into cupertino and traveling north into sunnyvale or mountain view, that'll affect you. the alternate, well, the easy one right now, get off one exit early. head over toward foothill expressway, then take homestead a little to the east back to 85. that's the one over to the left. if you pass by the incident and you want to take your chances to see if it's open and it won't be open until at least 7:30, you'll continue south past the incident and over toward sunn sunnyvale. back to highway 85, in toward cupertino, the surface street businesses and also the apple campus, a lot of surface street traffic expected there, as well.
6:34 am
the south bay moving smoothly, 101 over on your right showing the slowdown as well as northbound 87. again, bob's expecting another hour from what chp tells him that reopens, and that could be an issue, although this closure is countercommute. >> thank you very much, gentlemen. well, the man accused of kidnapping and killing 15-year-old sierra lamar back in a san jose courtroom today. antolin garcia-torres expected to enter his plea. arrested last week after dna evidence allegedly linked him to the missing morgan hill girl. search parties are still trying to track down any signs of sierra whose body has still not been found. she was last seen the morning of march 16th heading to school. well, this morning, one man is dead and three others on the run after a jewelry store robbery went wrong. christie smith is live in san ramon where tepolice are tryingo track down this team of robbers. >> reporter: that's right.
6:35 am
san ramon police are looking for three men that got away. reviewing surveillance tape of this strip mall after four armed men burst into the jewelry store. one of them was shot and later died, possibly shot by the store owner or an employee of golden treasures here on san ramon valley boulevard. it was really bold. four of the gunmen ran inside in broad daylight around 4:30 in the afternoon. but the robbery attempt fell apart quickly when one of the suspects was shot, ran outside looking for help during the evening commute, he was taken to the hospital where he later died. police didn't say exactly who fired that shot only that no customers were inside. store owner's daughter said she only had time to come down and see that her family was okay, but she says they're not likely to standby and be victimized. >> they're strong people. they're not going to let somebody hurt them or anybody around them. >> reporter: the other store owners in this strip mall say they've been robbed before too
6:36 am
and that gold n treasures store which carries gold and silver coins and watches and jewelry may have been hit in the past, as well. investigators think that the suspects got away with in a white four-door 1990s style sedan. reporting live in san ramon, christie smith, "today in the bay." >> thank you. 6:36 right now. time to check in with christina loren. unofficially the start of the weekend. looks like officially it's going to be nice. >> it is going to be nice. you just have to get through today and then tomorrow we get to enjoy friday and beautiful weather over the course of the weekend. this is it when it comes to cloud cover. we have very little hugging the coastline, some ragged patches situated over half moon bay and pacifica. and temperatures are comfortable. 66 degrees to start you out in oakland. we'll be at 72 degrees bay side at noon today if you break for lunch, rounding out the day in the upper 70s and low 80s. even san francisco getting pretty warm at the coast, not too bad. 68 degrees at noon 74 degrees at
6:37 am
4:00 p.m. 90 degrees inland, it's going to be a toasty afternoon. but we aren't going to hold on to these temperatures for long. we've got a cooldown on the way and rain in the forecast. talking about that coming up, right now, back to you. >> thanks, christina. 6:37. one lawmaker gets fired up. what caused him to lose his cool. >> easy big fella. and the space x capsule ready to splash down two hours from right now. and we'll tell you where it's going to splash down coming up. and for the latest news, traffic, and weather, and some very good conversation, come talk to us -- find us on facebook. search nbc bay area. stay with us, we'll be back in just a minute.
6:40 am
welcome back on a thursday morning. right now we give you a look live at san jose in the beautiful state of california. going to get real nice outside with temperatures rising. christina loren will tell you all about that coming up. it is 6:40 right now. in the great state of illinois, we all know that is the land of lincoln, as in abraham lincoln, the president who arguably delivered the most memorable speech in history. >> total power in one person's hands, not the american way! >> whoa. wow.
6:41 am
>> -- figure out how -- >> okay, he's a little bit upset. this is illinois state representative mike voss. he was mad a bill was sent to the floor to vote before lawmakers had a chance to read it. >> mad? >> the session adjourned before a vote, which means the debate will resume. is he still going on? >> what i love is the dude in the back looks like he's asleep. not even noticing. >> everyone in the background. no one's really -- >> mike, why don't you just take a drink of cool water and go lay down in the corner. he's still going. i think he might still be screaming right now. 6:41, coming up, 15 minutes of uninterrupted news including a live update on the cleanup on a major south bay freeway.
