jon kelley. and new this morning, yeah, the jobs front, a bleak one. the monthly federal jobs report is out and it does not look good. business and tech reporter scott mcgrew is here has all the numbers released on a downer friday. >> it is really a downer friday. good morning to you. we were expecting maybe 130,000 jobs added in the month of may to the u.s. labor force. take a look at the numbers. it's 69,000. the unemployment rate ticks up .1% to 8.2%. but i often tell you ignore the unemployment rate it is so variable. it's the 69,000 jobs that are just breathtaking. also the u.s. department of labor downwardly revised. some of the numbers we have gotten in the past, as well. so this is terrifically bad news to the u.s. economy. we will continue to follow this all day. dow futures calling for 170 points to be lost right off the open. we're going to go ahead at 6:30 and put the dow number in the

corner of your television screen, as well. but again, marla, this has a big political implication but implications for all of us. yes, the bay area has a better number than that, but we've got to look nationally at the big picture. and it's a terrible picture. >> oh, okay. thank you, scott. well, it is 6:02 now. an update to a story we've been following all morning long in the south bay. two separate fires at a san jose high school. bob redell is live at evergreen valley high with the new details for us. bob, good morning. >> reporter: good morning to you, marla. and thank goodness for smoke and fire alarms or this one particular fire could've done some serious damage to the building behind me. if you look into the corner, you can see where that wall was scorched. that's the side of the library here at evergreen valley high school here in south san jose. that's one of two fires, the fire department believes that it was intentionally set because it did happen overnight and because it was not the only one. there was the second one right over here in that dumpster here out front of this gate. fortunately, the fire alarm

alerted the fire department, it was a little bit after 2:30 this morning. san jose firefighters were able to extinguish both fairly fast. the dumpster fire was far enough away it didn't threaten any structures, but the other fire, a pile of wood debris left up against the side -- outside of the library did scorch the walls as i mentioned. but the fire department tells us that was superficial damage and only sent a light amount of smoke on the inside. >> and the fires do appear suspicious. our arson investigator is on scene now and investigating the fire. as of now we have a cause that's undetermined. >> there are also surveillance cameras here at this high school. we know the arson investigator will be taking a look at that video footage to see if it shows anything. if it shows a suspect or suspects for that matter. as far as suspects, they don't have any idea yet, at least they're not telling us of who might have done this. and as far as school is concerned, it's not going to affect classes because the last day of school for the summer was last week. reporting live here in south san jose, bob redell, "today in the

bay." a developing story now in san francisco where police are trying to track down a woman accused of stabbing a man nearly to death overnight. officers found a man in his 30s on ellis street just before 1:00 this morning with stab wounds in his upper body. he is now in the hospital clinging to life. officers say the attack happened after an argument between the man and a female suspect. so far, officers have not been able to find her. friends and family of sierra lamar planning another gathering tonight, trying to hold on to hope that the missing morgan hill teen will be found alive. the man charged with lamar's killing, 21-year-old garcia-torres appeared in court but did not enter a plea. they say dna found inside his vw jetta matches sierra's. still, legal sexpert say this will be a very difficult case to prove. >> absence of the body, it's the absence of a crime scene, the absence of a murder weapon.

so there's a lot of things that the prosecution has to put together in this case to get a murder conviction. so it is a challenge. >> sierra lamar was last seen back on march 16th in morgan hill. tonight's rally is set for 7:00 p.m. in washington high in fremont where sierra once attended school. two of bryan stow's friends on the witness stand at the preliminary hearing of the men accused of beating stow. prosecutors say lhe was attacke from behind in march of last year. stow's doctors not expected to testify during the hearing. prosecutors and defense reached an agreement that stow's injuries be read into the record. now, it says stow suffered a fractured skull and traumatic brain injuries and he will require daily medical assistance for the rest of his life. well, 6:05, sitting on the sidewalk could become a crime in another bay area city, berkeley's mayor is proposing a law similar to the controversial

sit/lie ordinance in san francisco. live in berkeley with details of the proposal and how it's been working across the bay so far. christie, good morning. >> reporter: good morning to you, marla. you know, right now, it looks pretty clear here, but berkeley's mayor says he's inspired by what he sometimes sees up here on telegraph avenue. young people sitting on the streets with their dogs asking people for spare change creating an obstacle course for people who want to walk on by. mayor tom bates says he wants to ban sitting on sidewalks in front of businesses. new video this morning where it's easy to find people sitting or sleeping. bates says he knows this type of move might cause concern among some berkeley voters. according to the contra costa times, the city already has an ordinance against lying on sidewalks at least until 10:00 p.m. problem is, according to bates, you ask people to move and they just sit up. this would go ahead and close that loophole. now, san francisco voters approved a sit/lie ordinance in

2010, but a report in sf weekly says it might not be doing what it's supposed to. most of last year's citation went to the same 19 people over and over again. the berkeley ordinance would have tickets starting at about $50 and going up for repeat offenses. bates says he would like to see this on the november ballot. reporting live in berkeley, christie smith, "today in the bay." >> thank you. 6:07 right now. we'll check back in with christina loren to find out about some very high temperatures still coming our way. >> yeah, it's going to be really interesting today because we're going to be cooler at the coast and bay side. just a touch cooler, but warmer inland. where we're starting out nice and mild. that's the biggest difference between yesterday and today. we still have that cloud cover yesterday, this morning, though, we're not waking up with the 40s. we're waking up with the mid-50s, even the 60s in some cities. 54 degrees right now in san mateo and those winds are going to pick up throughout this afternoon, particularly right by the coast. you can see that here, you look to the key where you start to

get those reds. that's very gusty winds through the second half of your day into the evening hours. keep that in mind. inland today, at noon, you'll already be at 80 degrees. 90 at 4:00 p.m. cooler bay side and at the coast with that cloud cover until about 9:00, 10:00, but then it'll clear quickly, breezy conditions, rain in your seven-day forecast. that's in my next report. let's check your drive first with mike. >> we'll check the south bay where we do see slowing northbound 101, 680, and northbound 880 approaching that same highway. pretty standard pattern for this portion of the south bay around now. but we're looking at also northbound 101. car reported as being flipped over and landing on its wheel. turns out no, it didn't flip, but it slipped off the roadway into a fence. no one was injured, but this is a distraction, no lanes are blocked, though. southbound 680, there's an accident there, and no lanes are blocked here either. activity off to the shoulder and no slowing through sunol and that debris westbound 580 right around spring town, no additional slowing, but they have not yet cleared it

according to the chp report. should be cleared in a couple of minutes. a 17-minute drive out of the altamont pass. back to you. >> thanks a lot, mike. the wife of san francisco suspended sheriff ross mirkarimi says his family is a victim of a political witch hunt and now ileana lopez is considering suing the city for the just released video of the center of her husband's domestic abuse case. >> this happened yesterday, i'm going to use these just in case he wants to take theo away from me because he did -- he said that that he's very powerful and he can -- he can do it. >> that is the extremely emotional video of lopez telling her neighbor her husband ross mirkarimi bruised her arm during an argument new year's eve. this is at the center of an official misconduct probe before the city's ethics commission that could cost mirkarimi his job. lopez says the decision to release that video is just tearing her family apart. lopez is back in her native

venezuela with her young son theo to escape the media glare surrounding the case. as for her husband, he tells us, "the release of the video is the latest heavy-handed tactic to ruin me with absolutely no regard for my family's well-being." well, it is closing time for two controversial oakland businesses. a judge has ordered the economy in and the national lodge to shut down by july 31st. the city has been fighting to close the motels for months calling them havens for prostitution and child prostitution. the owners have also been ordered to pay $45,000 each in fines. marla, leaders from several bay area cities gathered this morning to discuss the impact of california's high-speed rail project. the peninsula city's consortium consists of five cities that have joined together to monitor construction of the project that's between san francisco and san jose. this morning, that group will discuss plans to upgrade caltrain and electrify the

6:13. well, george zimmerman's defense team and prosecutors trying to convict him of murder will be on the same side in court today. a coalition of media groups is asking a judge to release witness names and statements made by zimmerman by police. both sides argue that witnesses will be harassed if their names are made public. they also claim that some of zimmerman's statements are inconsistent. zimmerman is charged with second-degree murder for shooting unarmed florida teenager trayvon martin. this morning, opposition to the syrian government claiming there have been more mass killings. they claim government officials rounded up and killed 12 men at a factory. it's been a week since 108 people died in a massacre. leon panetta weighing in right now on this crisis in syria calling for more action from the international community to remove assad from office. panetta, well, he stopped short of calling on the u.s. military to take action. >> this is an intolerable

situation. we cannot be satisfied with what's going on. and the international community has got to take further steps to make sure that assad steps down. >> and since the 14 months the uprising began, up to 13,000 have died, many of them civilians. just this past week, a hundred people including many children died in the city of houla. mitt romney will attend more fundraisers in southern california today. the presidential candidate headed south after thursday's surprise stop at the solyndra plant in fremont to knock president obama. romney is scheduled to speak in newport beach this evening. and romney picked up an endorsement from nancy reagan. mrs. reagan releasing this statement thursday night saying "mitt and ann romney joined me at my home this afternoon for some lemonade and cookies and i

offered my firm endorsement for his campaign as president." she added ronnie would've liked governor romney's business background and his strong principles. and i have to say i do too. i look forward to seeing him elected president in november. the giants welcome the cubs to at&t park tonight. the giants are coming off a series against the diamondbacks in which they took two of three games. the cubs are coming off a sweep of the padres. before that, the series they had lost 12 straight games. now, you can catch tonight's game, guess where? right here on nbc bay area. coverage starts at 7:00 this evening. >> and i'm going to take a wild guess that one person that may be watching that game sitting right next to me here. big-time giants fan, christina loren. nice night for baseball? >> it is. it's going to be nicer to view from your home. we've got some air-conditioning. so that's the good news. you don't even have to change that channel, just keep it right here on nbc bay area. all that action starts at 7:00. and we do it right here on nbc

bay area. so make sure you tune in for that. taking a live look starting here, transamerica pyramid as you can see we do have a fair amount of cloud cover out there. that will play a factor in today's forecast. as we head throughout the afternoon hours, your temperatures will climb into the 70s bay side and at the coast. so we're talking about maybe a three or four degree difference than yesterday. but take a look at san jose where we're starting out very close to 60 degrees, complete sunshine already. that means we are going to get very warm as we head throughout this afternoon. good morning to you. 54 degrees in oakland, 54 in san mateo, 56 in sunnyvale, and 53 degrees in santa cruz. so air quality is good, you can open up those windows if you don't have an air-conditioner in your car or home. this afternoon, temperatures are going to tumble. and that's only at the coast. three or four degrees, high pressure bringing in the triple digits, though, to gilroy and fairfield. and then throughout this weekend, more of an onshore flow, more fog hugging that coastline. that natural coolant coming in

from the pacific. going to bring your temperatures down. back to the seasonal averages and then we get some rain as we head through the beginning of next week. but just wanted to point out how hot it's going to be. 85 in santa rosa, and that giants game, 67 degrees to start with a light wind out of the west at 10 to 15 miles per hour. seven-day outlook tells the story. we cool off and we bring in those showers as we kick off next week. let's see how that drive is kicking off on friday with mike. >> a slower kick for friday. kind of like a slow mo replay. looking over here, though, no major slowing. this accident southbound 680. see the volume of traffic. as we're looking here the southbound side, not a whole lot of cars. a lot more sunlight. the low clouds that christina talked about, and the fog over in san francisco. a bright easy drive heading over the hill. now the reason i talked about that shot again back to the maps because of the concern before you get to that shot of all the activity, including three chp cruises and tow truck on the

scene. a big distraction for folks heading out of pleasanton. that's why we have a nice drive for 580, about 19 minutes out of the altamont pass to the dublin interchange and a great flow of traffic there. easy drive toward the maze construction getting away i from the bridge on the east shore freeway and a look at oakland 880 just to show you the volume. not a big deal northbound past the coliseum. starting to build, guys. back to you. >> thank you so much. >> here's the multibillion dollar question. can anybody? i mean anybody find any kind of good news about facebook? >> i guess the stock did pop a little thursday? >> yeah, that's some good news. their headquarters didn't burn down. that's a positive, right? but you're absolutely right. the problems keep coming for facebook. last night the social network actually went offline for a time. some users say for more than an hour. facebook issued a statement this morning saying all things are back to normal. and as you mentioned, facebook shares were up about 5% on thursday. if they go up again today, facebook will no longer have the worst two-week performance for a

big ipo in the last 15 years. it'll be the second worst. another company has delayed its ipo, formula one racing was starting to sell stock, but just not going to do it yet citing the rocky markets and the poor economy. now, part of f1's decision might be facebook, it's mostly the economy. particularly in europe where it's most popular. here in america, the dow ended its worst month in years down more than 6% in may. and the latest job figures which we've been reporting to you are so spectacularly bad, one begins to wonder if the fed will have to get involved again with the third round of cash infusions, quantitative easings or qe-3 for short. dow futures down about 167 points, money absolutely racing into government bonds because that's where it's more safe. it's too bad you just signed that mortgage because of this bond activity, those mortgage rates are bound to go lower.

a live look over san francisco. that is the tower, the clouds out there starting to blow out, getting crystal clear, but you can see the clouds coming into the shot. christina loren going to tell you another nice day. mike inouye will talk about your traffic flow at 6:24. governor jerry brown and state lawmakers are taking a 5% pay cut. the same pay cut the governor proposed two weeks ago for rank and file state workers. the pay reduction will kick in december 3rd. the decision by the citizens compensation commission will save the state more than $650,000 a year. some lawmakers are angry about this decision saying it comes on top of an 18% cut taken from lawmakers' pay three years ago. okay, a dismal unemployment report might suggest otherwise, but a brand new survey reveals there are, in fact, jobs out there. tracie potts is live in washington, d.c. right now to tell us which positions employers are having a hard time filling. tracie, good morning. >> it is interesting, isn't it

that as millions of americans are looking for jobs, thousands of employers are saying we've got them and can't find people to fill them. a brand new survey from the manpower group, a staffing agency, they asked 1300 employers are you having trouble finding people to fill these jobs? and almost half, 49% of them said we sure are. we can't find the right people for the right job. they said that either they have a lack of applicants or the applicants don't have the right experience. sometimes they want too much money. the top ten hardest jobs to fill include skilled trades, engineers, i.t. staff, sales reps, accounting, and finance. and then drivers, mechanics, nurses, machinists, and teachers, many of whom have lost their jobs in california and other parts of the country in the last several years. now, some of these employers say they're going out for colleges and universities, participating and teaming up with them to train people for these open jobs that they can't seem to fill.

>> okay, tracie potts, thank you very much from washington, d.c. just about 6:26 now. let's check the forecast. christina loren, another nice day in store for us. >> yeah, it's going to be hot. but if you wanted to get outdoors and do anything that's going to cause you to maybe sweat, you want to do it early because by this afternoon, we are going to have oppressive heat. triple digits in the warmest cities across the bay. inland for your metropolitan cities, works out like this, 80 by noon, 90 in the heat of the day. bay side, hitting about 74 degrees at 4:00 p.m., and 65 at the coast. we cool off as we head through the weekend. we'll take you through that forecast coming up. first, i want to check your drive with mike. we talked about distraction and now we see the flowing for the sensors. the accident activity off the shoulder, but three chp crews and the tow crew likely a big distraction for folks. less of a distraction at lawrence, the accident still there off the freeway and slowing, but now showing up south of 101, that's unusual.

i'm christie smith telling you what's behind this move coming up. and we're going to cool you off just a touch bay side and at the coast today. meanwhile, hotter conditions inland, triple digits on your forecast. cooling down for the weekend. i'll take you through the seven-day of forecast. >> and your tri-valley commute starting to kick in as far as tit goes. right now, a live look outside at a fogged in golden gate bridge. and allow us to be the first to congratulate you for making it to friday, june 1st, "today in the bay." right now, we are following breaking news out of livermore where more than 4,000 people right now are stuck without power. >> yeah, the outage started about 5:00 this morning, the utility expects to have power fully restored by 8:00 for another 90 minutes or so. and new this morning, the latest unemployment numbers, they are out, and we can tell you they are not good. the unemployment rate rising to 8.2%. experts predicted it would stay

steady at about 8.1%. but more surprising than those numbers, employers created just 69,000 jobs over the last month. that is far fewer than economists had predicted. the market's expected to take a dive on this news. we are watching the live look at the new york stock exchange ticker. we'll continue to check this out right now. right now it's down about 114. we'll have our eye on this all day long and keep you informed. well, 6:31 now. in san jose, investigators believe two separate fires on one high school campus overnight were no accident. bob redell is live at the school with the latest developments for us. bob, good morning. >> yeah, good morning to you, marla. they believe these are suspicious for two reasons. one, because they happen overnight. and two, there were two fires. one was right here on this dumpster here. this one was put out fairly fast and it wasn't much of a threat because you can see it's far away from the building. the other one that's much more serious, you can see the scorching up against the wall. that's the side of the library. and there was a pile of wood

debris that was set fire. that was the more serious fire. but thank goodness for a fire and smoke detector because the alarm alerted the fire department just after 2:30 this morning. they were able to get out here and put it out fairly fast. they say the damage to the library is superficial, just confined to the outside. even though it started getting up to the roof, they were able to get it out okay. it didn't do much damage inside. no flame, just light smoke. and it's not going to affect classes because school is out for summer. they went out, had their last day of school last week. as far as the investigation, there is surveillance footage. they're going to be taking a look at that from the cameras that are installed at the school to see if that shows anyone or anything that happened around 2:30 in the morning. reporting live, bob redell, "today in the bay." a developing story this morning from san francisco where police are trying to track down a woman accused of stabbing a man overnight and nearly killing him. officers found a man in his 30s on ellis street just before 1:00

this morning with stab wounds in his upper body. he is now at the hospital and he is clinging to life. officers say the attack happened after an argument between that man and the female suspect. so far, officers have not been able to find her. a hit-and-run suspect who bolted from the bay area and then fled to india after the crime is due in court today. sunnyvale police arrested 25-year-old singh at sfo this week. they say he fled to india one day after the crash in march in which he allegedly ran over 28-year-old jennifer flores with his car killing her. flores was the mother of a 6-month-old and an 8-year-old boy. it is 6:33 right now. his family calling it a miracle. the condition of a san jose man who survived for a week on the side of a freeway is improving this morning. the sister of 25-year-old michael sanchez telling the mercury news her brother is awake and is becoming more alert. he still can't talk at this

point, but he is able to communicate by blinking his eyes. sanchez reportedly crashed his truck on 101 near the off ramp earlier this month. police found him seven days after the accident. he was unconscious at that point. about 50 feet from where the truck crashed. 6:34. a mother who claimed her son was abused by a redwood city schoolteacher is now suing for more than $1 million. special needs teacher alexia bogdis is named in this suit. accused of kicking a 5-year-old autistic boy and withholding food and water from him. she is due back in court at the end of the month. well, another bay area city is taking steps to sweep its streets of the homeless. berkeley's mayor wants to follow in the footsteps of san francisco's sit/lie ordinance. live with more on this proposal and how it's working for san

francisco, christie, good morning. >> reporter: good morning to you. that's right, berkeley's mayor is behind this. and he knows right out of the gate this may cause concern among berkeley voters. but he says he was motivated by what he saw here on telegraph avenue. we're not seeing it specifically this morning, but he says sometimes he sees young people, a lot of them, sitting around on the sidewalk in front of stores asking people for spare change. people have a hard time getting by. mayor tom bates says it's not civil and that berkeley residents have stopped him and said, hey, can't you do something to fix this according to the contra costa times? we shot new video on shaddock avenue. san francisco has had a sit/lie ordinance. but report in "sf weekly" recently shows it's not all that effective. most citations seem to keep going to the same 19 repeat offenders. now berkeley already has an ordinance in place against laying on the sidewalk from 7:00

a.m. to 10:00 p.m. but what bates says is what people do is they just sit up. this would add teeth to that and close that loophole. fines would be about $50 and get higher for repeat offenses. bates says he wants this on the november ballot. reporting live in berkeley, christie smith, "today in the bay." thank you, christie. 6:36 right now. let's get into the weekend. let's talk about that forecast. some good weather. i always love talking about fridays and christina's here to tell us about it. >> it's one of those weekends where you can get outdoors. all those things you can associate with summer time weather, barbecues, boating, you can do it all comfortably. taking a live look at san jose to start. and your temperatures are already climbing. we had bypass the coolest point of the day. 59 degrees in livermore, 57 degrees to start. in san jose and meanwhile san francisco we do have some fog developing, not too thick just yet. it'll likely become thicker as we head through the next couple of hours. i want to point out the marine layer is offshore throughout the day today.

stop that clock at 4:00 p.m., completely clear conditions, and that is the warmest time of the day. so if you do need to turn that ac on, it'll likely be between the hours of 4:00 and 6:00. and in san jose last night at 10:00 p.m., it was 75 degrees at 10:00 p.m. that's an indication of how comfortable it's going to be in your outdoor plans tonight. 80 degrees at noon and 90 degrees at 4:00 p.m. in san jose, that san jose, livermore, i'm forecasting 100 degrees just right in your area. so we'll talk about that coming up. first, let's talk to mike about your drive. >> well, we talked about that power outage in livermore, that might be an issue for city streets and signals. not a problem as far as the commute goes and 580 itself. we do have the issue, though, for folks cutting through isabel. that's an advantage for you this morning. passing the scene of the accident which is causing quite a bit of slowing now just south of castlewood, south of sunol boulevard. through pleasanton because of this activity on the shoulder and possibly blocking the slow

through tomorrow, 77 degrees at the bay, 63 at the coast. and showers late sunday into monday. i think showers over the greater bay area. all that activity, though, should clear out by monday night leaving us with a nice, great air quality on tuesday as we wake up. 76 degrees as we wake up, and wednesday and thursday, sun comes up in full force, warm you back up and it looks seasonal finally as we head through next week. mike, how are we looking? >> no, no, it's a little heavier. a lot heavier in many spots. first note, you talked about the beach weather so highway 17 going to get crowded probably from this early this afternoon heading back down and back again this evening. right now, though, we have a lot of slowing northbound 101 from 680 all the way to that earlier accident we've been tracking here at lawrence expressway. still have crews on scene addressing this car that went off the roadway into the fencing. no lanes were blocked, they blocked the slow lane. look at this big backup towards lawrence expressway 101. you can use el camino as your

alternate on surface streets. we're looking also southbound 680 as you're coming down past sunol boulevard. all the way to 580 now because of this accident. a car went off the roadway and a trailer there. no injuries, but big injury to the commute, slow from 580 through livermore, we'll end with this shot as i give you the note. cutting through on isabel, you'll get on 680 south of all the backup. back to you. >> thanks so much. 6:51. well, the market is already reacting to the grim jobless numbers that just came out over an hour ago. this is a live feed from the new york stock exchange showing the dow down 163 points right now. let's get more on the numbers from, of course, our business and tech guru scott mcgrew. >> good morning to you, marla. the numbers we just got absolutely shocked by were the unemployment numbers adding 69,000 jobs to the american economy in the month of may. that raises the unemployment rate to 8.2%. this is a huge disappointment. in fact, we wouldn't be surprised to see the dow at some

point turn around because perhaps the fed needs to get involved with quantitative easing. that is adding more money into the american economy. all right. we've got that and we'll continue to track that throughout the day. but we're not going to forget the fact that it's friday, ra o right? i've got in my hand an iphone and a bracket that the iphone goes in. and take a look at what this combines to make. it is something called the optrix. and this can go on top of your helmet, on your body, or in your car and it turns your iphone into essentially a go pro, and you don't have to buy the go pro. here's an example of what to do with it. out of the nuremberg ring in germany. and then you can add all kinds of telemetry data to it, as well. as you can see, the motorcycle on the ring there going around the track with all the information about g-force, et cetera. because iphones can do so many different things, you can add

that data to your video and it comes out pretty cool. again, dow industrials down 169 points. we'll continue to monitor it throughout the day. >> can never forget gadget friday, though. thank you, scott. san francisco police are searching for a female suspect wanted in an overnight stabbing. officers responded to a call near ellison jones about 1:00 a.m. and found a man stabbed in the upper body. he was rushed to the hospital with life threatening injuries. she left the scene and police are looking for her for questioning. friends and family of sierra lamar gathering again tonight holding on to hope the morgan hill teen will be found alive. her accused killer, 21-year-old antolin garcia-torres appeared in court yesterday but did not enter a plea. he was arrested 11 days ago after investigators allegedly linked him to sierra through dna found inside his vw jetta. sierra because last seen on march 16th before heading off to her school's bus stop. the gathering is set tonight for

7:00 p.m. at washington high in fremont. that is where sierra once attended school. well, a hit-and-run suspect who bolted from the bay area and fled to india after the crime is due in court today. sunnyvale police arrested 25-year-old singh at sfo this week. they say he fled to india one day after the crash in march in which he allegedly ran over 28-year-old jennifer flores with his car killing her. flores is the mother of a 6-month-old and 8-year-old boy. and the condition of a san jose man who survived for a week off the side of the freeway is improving this morning. the sister of 25-year-old michael sanchez telling the mercury news her brother is awake and becoming more alert. now, he still can't talk, but is communicating through blinking. sanchez reportedly crashed his truck on 101 near the off ramp earlier this month. police found him seven days after the accident.

he was unconscious about 50 feet away from his truck crashed. nothing short of an emotional day coming up for a bay area fire department. two san francisco firefighters being honored tomorrow almost one year after they died fighting a house fire in diamond heights. anthony valerio and vincent perez were killed by a flashover. their firefighter family has a new garden at station 26 to honor them. they will open the door to the public starting tomorrow for a dedication and a barbecue. firefighters say a year later, yes, emotions still raw. >> they worked with him often. it could have been their day. the layers are very -- it's the ground zero. it really is the emotional ground zero for line of duty deaths. >> it was members of the diamond heights business community that paid for that garden installation. the dedication ceremony starts at 10:30 tomorrow morning. well, two of bryan stow's friends will take the stand today in the preliminary hearing

for the two men accused of beating him. sanchez and norwood are facing assault and mayhem charges. thursday, three women who say they saw the attack on stow spoke out in a southern california courtroom. the witnesses say they were heading to their cars after the game when the atmosphere in the parking lot turned violent. >> the gentleman in the blue shorts with the white shirt punched brian. i heard brian hit the pavement. it sounded like a -- a thud like someone's head was smashing against the pavement on the parking lot. >> they were out of breath. one of them had his jersey in his hands. and they were saying drive, drive, drive. >> despite their graphic testimony, none of the witnesses were able to positively identify norwood and sanchez as the attackers. 6:56 now. well, san francisco's controversial sit and lie law could be headed across the bay.

berkeley's mayor wants a similar measure for his city. today in the bay's christie smith live in berkeley now with more on this proposal. christie, good morning. >> good morning to you, marla. you know, mayor bates says this idea was inspired by what sometimes goes on here along telegraph avenue. and that is a patchwork of young people with dogs sitting around asking for change in front of store fronts. we're not really seeing that going on this morning. but this measure would ban sitting on sidewalks. we shot video this morning where it's pretty easy to find people sleeping or sitting around. san francisco tried to deal with the street behavior in 2010 when voters approved a sit/lie ordinance there. but one report in sf weekly shows it may not be working out as planned with most citations last year going to the exact same 19 repeat offenders. tom bates says he knows some voters in berkeley may take issue with this whole thing, but he says that he would like to see this on the november ballot so he would avoid a showdown

with the city council. christie smith, "today in the bay." let's get the latest on the two-alarm fire that happened a few hours ago. bob redell live at that scene since 4:30 this morning. what's the latest you can tell us? >> well, the fire department has left. good morning to you, jon. the fire department does believe that someone was trying to burn down the library here at evergreen valley high school in south san jose. and if it weren't for smoke and fire detector, they might have succeeded. this fire's suspicious, not only because it happened overnight, but because it wasn't the only fire. there was a second one that was set right here in a nearby dumpster. the dumpster fire did not threaten any structures. a fire alarm that alerted the fire department a little after 2:30 this morning. the fire up against a library started in a pile of wood debris, ended up getting the roof overhang. it did not affect the inside of the library. as far as the investigation is concerned, there are surveillance cameras here, they
