new this morning, a standoff that shut down streets and had neighborhoods on edge through the night is now over. also new this morning, big changes for today's primary election. good morning, i'm marla tellez live in san jose. i'll have a look at those changes coming up. and the trial for jerry sandusky gets underway this morning. why lawyers say they may not be able to seat a jury right away. and a live look from london this morning. that royal car holding the queen celebrating her diamond jubilee celebration. it's tuesday, june 5th, this is "today in the bay."

what a way to start out a day. >> that's how she arrives to work every day. it's 4:31 right now, i'm jon kelley. >> i'm laura garcia-cannon. let's see if we need that bonnet this morning. how about an umbrella, christina? >> if you're waking up with us in the north bay, you better be safer than sorry. we do have a little bit of shower activity. nothing prompting me to activate the radar. it's cool out there, but the chance for some drizzle certainly possible as we head throughout the next few hours. by mid-morning, that sun will start to breakthrough those clouds and we've got a really good-looking day shaping up. even warmer through the week. we'll take it through the full forecast in a few moments, but we gave mike the day off. couple things to point out this morning, starting with an early morning fender bender as you approach el camino real, travel

cautious through there. everything is running nice and smooth. otherwise, we have a stall to tell you about, highway 24 westbound as you're getting into the central lafayette area. that has a crew on the way. no delays around that, and the good news is, early morning construction on 880 wrapped early. we'll keep you updated on your weather and traffic. for now, back to you and top stories. >> overnight police standoff in oakland. and this one wraps up peacefully. a story we brought to you last night at 11:00, the suspect surrendering early this morning after barricading himself inside a home on high street. police say the man fired at a sheriff deputy and briefly led police on a chase near 41st avenue and international. police say, yes, they had to be cautious. >> he did shoot at the deputies this evening. he is in the home with another male adult. we have established communication with him, we are in the process of having that

communication and dialogue with the suspect. >> initially the suspect held a man, woman, and child hostage, but they were all released during the night. the second suspect has also been detained. a third is still on the loose. and now for decision 2012. today is election day. voters across the bay area will soon head to the polls, but there are a few changes this time around which could affect who is elected. "today in the bay's" marla tellez with an update on what is at stake. good morning, marla. >> reporter: laura, good morning, we're at the register of voters. this is one of the locations around town you can drop off your ballot if you went ahead and filled it out as i did last night. there's a 24-hour drop box, you need to get it in before 8:00 tonight. this primary could be one of the more confusing in state history because of a couple of key changes. we're using what is called a top two system. this means the two candidates with the most votes will face off in november even if one

gains an outright majority today. the november runoff may pit two candidates from the same political party against each other. to be clear, the top two process does not apply to the presidential nominations. now, also new for the first time in california, independent voters can vote in this june primary. and voters can support any candidate regardless of affiliation. >> independent suddenly, i guess, feel they won the lottery on this because they're relevant in a race they haven't been in a long time. >> now, experts are predicting a low voter turnout. somewhere around 40%. now this tends to skew more conservative as republicans are more apt to vote than liberals. so independent voters could really make a difference in today's election. now the polls open at 7:00 this morning and close at 8:00 tonight. live in san jose, marla tellez, "today in the bay."

>> and the question this morning is whether independent voters will impact on the prop 29. now millions were spent on ads by both sides on this issue. you probably saw those all over television. one political analyst says he doesn't think independent voters will affect that decision very much. >> i tend to think a lot of the independents in this state would've voted for it. it's going to be really close. >> more than 30 high-profile state and national organizations have come out against prop 29. at least a dozen of those groups have historical and in many cases financial ties to big tobacco. supporters raising nearly $13 million for the top donation coming from the american cancer society. 4:35 right now. the fate of gay marriage in california takes another legal step today. announcing whether it'll review a three-judge panel's ruling that overturned prop 8's ban on same-sex marriage.

if the court agrees to review the ruling, a larger panel would be assembled. a new review ruling could take several months to more than a year and will likely end up before the u.s. supreme court. in san francisco, city leaders hope to curb foreclosures with a new ballot initiative. the measure proposed for the november ballot would force banks to pay a tax when they repossess a property. under current city law, banks are exempt from paying the tax. it applies when these are transferred. the initiative must be approved before going up for a vote in november. jury selection begins this morning in the former penn state assistant coach jerry sandusky. sandusky accused of sexually abusing ten boys over several years. he denies those charges. some of his alleged victims expecting to testify during his trial. >> if you report to the police and your case moves forward, you

need to be concerned about whether or not your particular story the most humiliating things you've ever endured will be open for discussion on dinner tables and the internet across the country. >> lawyers right now concerned about whether the impartial jury can be assembled in the close knit community there. some of the jurors may be summoned from other areas and a judge has been called in from a neighboring county. new information this morning, the sexual assault case against giants third baseman sandoval accused of assaulting a 21-year-old woman on friday morning. now, we know he met that woman at a bar in santa cruz. now the two went with a small group of people to sea scape resort, and that's where the alleged assault occurred. sandoval's attorney calling the encounter with the woman a quote consensual personal sexual relationship. sheriff investigators have

given up on searching the u.s. reservoir. dive teams were back in the water yesterday after the mother of the suspect antolin garcia-torres told investigators her son was fishing there the same day sierra disappeared. investigators say this is not the end in the search for sierra. >> it was a less scheduled kind of planned search. doesn't mean the searches are going to stop. just from here on now they're going to be more target focused based on tips and leads. >> they know what they're doing. they know what they found and not found and so i have confidence in what they're doing. >> meantime, the case against garcia-torres moves forward. he's accused of kidnapping and murdering sierra lamar. garcia-torres has not entered a plea and is scheduled to appear in court next month. it is 4:38 right now. a burglary in east oakland leaving a community like it's been sucker punched. thieves breaking into the east boxing association some time over the weekend. they stole two desk top

computers, ten laptops, two printers, wi-fi equipment and all kind of music equipment. just a few months ago, the boxing program was in danger of closing down. this burglary, definitely another setback. >> when you walk in here and you have the respect and the kids are supportive of each other, the older kids working with the younger kids. i mean, it's a very unique place. and it's really a shame that somebody had to come in and disrupt that. >> and to try to help out the cause, the boxing association holding a fundraiser at yoshi's on june 12th. 100 kids already signed up for the summer program. >> i'm sure a lot of people step up to help. >> indeed. let's check that forecast with christina loren. a little taste of winter. >> a little taste of winter is correct. we might see a little bit of shower activity this morning. although, nothing to report. just cool temperatures this morning. but you know how the weather works around here in the bay

area. you get that additional moisture coming through with these systems. hence high pressure moves in and you get that thick fog right up the surface. this morning, i don't think the fog is going to be that much of a factor, but it will be tomorrow and particularly on thursday morning. so keep that in mind. but this morning is cool out there, it's crisp. good air quality and we're headed toward a day with 70-degree weather. so warmer day overall than what we saw yesterday. coastal fog this morning, slight warming throughout today, 70s on the way, and major warming, and i'm talking about big numbers as we head toward the week's end into this weekend. here's your day part forecast for today. 58 degrees at noon inland, 61 degrees at 4:00 p.m. temperatures on the mild side as we head throughout this afternoon. so you want to bring a coat for the early part of the day, but you'll be able to peel it off by noon today. all right, let's switch gears and take a look at your drive this morning. we gave mike the day off. still a traffic tuesday and one fender bender to report in the south bay. 85 northbound as you approach el

president obama heading back to the bay area this time for a little quick lunch tomorrow in san francisco. air force one scheduled to touch down at sfo tomorrow at 11:40 a.m. and depart for l.a. four hours after that. mr. obama scheduled to attend a luncheon at the morgan ballroom in the financial district. a lunch and a picture with the president will cost you $7,500. president obama raising several million dollars for his campaign visit to san jose less than two weeks ago. a political race coming to a head today and people all over the country keeping their eyes on this one. scott walker fighting right now to keep his job in the face of a recall election happening today. facing backlash. he's facing milwaukee mayor democrat tom barrett. and political analysts say this is a decision to watch closely.

>> what we're seeing in wisconsin is what we're seeing nationally. certainly a rough start to the week on wall street. for a check of the markets, we turn to bertha coombs. good morning, bertha. >> hey, good morning. yeah, the futures are pointed to a lower start again this morning. we had a choppy session on monday. the dow extended the losing streak to four straight days on continued worries that the u.s. economy has hit a soft patch. and if it's tuesday, we must be worried about something in europe. the debt crisis in focus today as finance ministers from the world's seven largest economies and the g-7 are holding an emergency conference call on the issue. reports say the biggest worry right now is there could be a run on the banks in spain. we saw something similar already in greece. and european markets are mixed at this hour. asia was higher overnight. this morning we're going to get

data on the u.s. services. the dow will start the day at 12,101, the nasdaq did manage to close higher by 12. and starbucks is breaking bread. buying bay bread. you know it well. the chain owns a bakery in san francisco, starbucks is snapping them up for about $100 million. the biggest move outside of coffee. the company will be rolling out pastries, muffins, and other foods in their own stores and expand the store into a chain. it also puts it in direct competition with panera bread. and disney's cutting back on the number of junk food ads on tv and radio shows aimed at children. bob eiger will be making that announcement with michelle obama. disney which owns abc, espn, and the disney channel.

the program stops short of impacting its advertising. a lot of folks worried about kids and the junk food. got to keep it -- >> obesity, diabetes, as well. all time high. thank you very much, bertha. well, the last we checked the calendar, yeah, it does say june. but mother nature bringing baaing to the sierra. kids dig it. locals say they're prepared for the elements. but the out of towners say the snowy conditions created more than a chill. >> i just flew in from new jersey this morning. and so it's 80 degrees there right now. this wasn't exactly what i was expecting in california. >> i was expecting to have to travel to a job interview via the oregon trail. >> like i said, little guy. he's out there in shorts. national weather advisory is in effect overnight, and that's when things should start to gradually improve. >> not like it's the donner party out there. but it is amazing in june. >> snow angels. >> it was cold.

>> it was very, very startling change for many people. they did not expect that rain yesterday and then the cold blast settled in. you probably had to use your heater after using the ac over the weekend. we're going to continue to swing your temperatures around, but mostly in the upward direction as we head throughout this week. taking a live look at your doppler radar. your attention north of santa rosa. we actually have a little bit of shower activity. starting to fall apart just before it makes its way onshore. we are fair game for a few light showers, especially up in the north bay. but by about 9:00, 10:00, mid-morning, we'll eliminate that chance and your temperatures will warm nicely before the day is done. it's going to take one day, though, for that cool air to mix out and for us to get to our seasonal averages. couple upper 40s. a jacket up in the north bay. high pressure's moving in quickly for today. going to start to make for warmer conditions, especially inland, but we'll have a fair amount of cloud cover hugging the coastline and the bay throughout the day today. so not quite warm just yet. we're going to call it mild and

get even warmer as we head through tomorrow. 63 in san francisco, 0 in san rafael, 67 for fremont, and 71 degrees right here in san jose whereas our average is closer to about 79 degrees. tomorrow, right back to our average, then thursday into friday, holding on to warm, sunny conditions. saturday into sunday, we really start to warm you up, 85 degrees by sunday. if you're starting to think about the beach, looks like your warmest beach city will be santa cruz. your drive information coming up. mike has the day off, and it's traffic tuesday. back to you guys. >> thank you, christina. it is election tuesday, but there's also a royal vibe in the air. thousands lining the streets in front of buckingham palace checking out the diamond jubilee procession. >> yeah, a live picture from london this morning. the queen is on her way now to lunch at the palace of westminster before making her way back to buckingham palace this afternoon.

>> look at the crowd. you can hear them. they love their queen. they cheered last night as she walked on stage at the jubilee concert. what a lineup they have there. elton john, paul mccartney, they headlined the show, attended by more than 10,000 people. >> oh, okay. >> i don't know what they were saying, but it was funny. as it comes and goes, many arrive to pitch their tents to hopefully get a good spot to see today's procession. many camped outs in the same spot last year for the royal wedding. they had so much fun they wanted to relive all the pageantry over again. >> i dig the crown. >> yeah. everybody's a queen today. but you know, many of the queen's subjects are sending the well wishes to her husband prince phillip. the duke was admitted to the hospital for a bladder infection. he's going to be 91 on sunday. and a royal spokesperson says the prince will actually be

taking a live look outside. beautiful bay bridge out there. looks kind of dark and ominous a little bit. >> i like it. >> yeah, you like dark and ominous? >> yeah, that's how i live. >> now we know. 4:55. well, it's no joke, nothing but a joke for the last couple of weeks for the oakland a's. one win over 11 games. last night, though, they turn things around. a 12-1 victory against texas. how about this kid? rookie jared parker, the kid had a no-hitter through seven innings, strikes out six. then top of the eighth, breaks up the no-hitter, but hey, parker still strong. eight shutout innings, and the rookie getting a standing "o" out there feeling good. a's go on to take this one and break out of that funk. meantime the giants going for a sweep against the cubs, bases loaded for buster posey. but they score -- they get the out there, the cubs get it, but
