chuck reed would limit retirement benefits for future hires and would force them to pay half the cost of the pension. current employees could keep the pensions they've already earned. but they would have to make a choice. either choose a more affordable plan for the rest of their years on the job or pay an additional 16% of their salary to continue with existing benefits. unions representing city workers say the measure is illegal and unfair. the fine over measure b has raised over $1 million, supporters have raised $740,000, opponents have pulled in $525,000 in money and services. well, today is the primary election statewide, the polls opening up in a few hours from now. and if you haven't turned in your absentee ballots yet, you can do it without stepping out of your car. there's a list of new drive-thru ballot dropoff locations open from 7:00 this morning until 8:00 tonight. and here's a little run down of those locations. the dropoff at the mccarthy

ranch marketplace. morgan hill is at the vta park and ride on main avenue. in palo alto at the mayfield soccer complex, san jose at the eastridge mall, and saratoga at the westville mall parking lot. you can also read more about all the candidates and all the issues on our website nbcbayarea.com. 5:02. new this morning, a neighborhood no longer on lockdown after a suspect surrenders to police. the suspect surrendered to police at about 3:00 this morning after barricading himself inside a house on high street for about seven hours. now, initially, the suspect had held a man, woman, and a child hostage, but all three released safely before midnight. oakland police tell us the suspect spent most of the night inside the home pacing with a gun and a cell phone. police say the suspect is one of three men who fired on police on

sheriff deputies then led them on a car chase near 41st avenue and international boulevard last night. two of those suspects are now in jail, the other still on the loose. there are new developments in the search for morgan hill teen sierra lamar. sheriff investigators calling off the water search in the reservoir. dive teams searching that reservoir extensively after the mother of the suspect antolin garcia-torres told investigators her son was fishing there the same day that sierra disappeared. now, investigators say this is not the end of the search for sierra. >> it was a less scheduled kind of planned search. it doesn't mean the searches are going to stop. they're going to be more target focused based on tips and leads. >> they know what they're doing. they know what they found and not found. so i have confidence in what they're doing. >> right now, garcia-torres is in jail facing charges of kidnapping and murdering sierra. he's due back in court next month.

police in the east bay are investigating a burglary that could close the door to a summer program that could keep kids off the streets and out of trouble. christie smith live in oakland where thieves stole a number of items from a popular boxing club. good morning. >> reporter: good morning to you, laura. yeah, looks like this happened over the weekend, but it was just discovered yesterday. and it's really starting to settle in. looks like thieves jumped the fence here and broke a window to get inside of the east oakland boxing association. they took a lot of things. they took laptops, they took boxing equipment, even water bottles that were made up for children to use as part of a fundraiser. this was discovered monday afternoon. the association has provided free after school and summer programs for kids for years. this is more than boxing skills, though. it's job skills, it's gardening, really a home away from home for a lot of the youth in the area. a few months ago, they were in danger of closing because of funding, but they raised money

to keep on going and now this. >> when you walk in here and you just have the respect and the kids are supportive of each other, the older kids are working with the younger kids. it's just a very unique place. and it's really a shame that somebody had to come in and disrupt that. >> now, they've already got a summer program lined up that's starting june 25th. and at least 100 kids are signed on. they're certainly looking for donations. the thieves took about ten laptops, tv, dvd player, jump ropes, nintendo wii, and a number of other items. meantime, the group is holding a fundraiser june 12th at the jazz club here in oakland. reporting live in oakland, christie smith, "today in the bay." >> one man's trash is another man's treasure. the city says it will no longer throw away items confiscated during sweeps of homeless camps.

this coming after complaints and a reminder of a long-forgotten city policy. now people's possessions will be tagged and stored for 90 days. the city is shifting money to this fund to fund this inventory program. a major milestone today at san francisco general hospital. the final steel beam will be placed in the new hospital at 10:30 this morning in a topping off ceremony. the new facility being built using earthquake resistant designs. the hospital says during an earthquake the base isolator technology lets the building slide actually 30 inches in either direction. kind of rolling along there. >> got to go with it. >> the hospital is expected to be completed in 2015. well, you may have noticed a little bit of a break. a small break, that is, at the gas pump. gas prices are falling nationwide. "today in the bay's" bob redell with what's behind this recent steady decline. bob, good news out there, huh? >> reporter: yeah, good morning to you, jon. nationwide, the prices have fallen so much that this country

is almost back to where it was eight months ago. the declines here on the west coast have not been as dramatic, but one analyst, at least, thinks we could start seeing some better declines soon. prices here in the bay area are already down from just a week ago. here are the overnight numbers from aaa and san jose around $4.22 a gallon, that's a drop of seven cents from the past week. oakland's also at $4.22, and san francisco as expected is a little bit higher, $4.30. >> i'm an old-timer and i remember when they were quite low and i remember when they got quite high. and i remember when we were waiting in line to try to get gas. so it's good to be able to get gas. boy, it does affect your budget today. it sure would be nice to get a break. >> reporter: not clear how much more of a break we're going to get, though, depends in part on the price of oil. one analyst tells the l.a.

times, that's why we've seen the drop in the price of gas. a barrel has now sunk to the low to mid-80s. oil's down because of pressures on the u.s. and chinese economies. there is signs that growth in both could be slowing. bob redell, "today in the bay." >> i wish the gas prices were lower, but we'll keep our fingers crossed. >> what about the temperatures? higher, lower? >> well, we'll swing them in the opposite direction of yesterday's highs. temperatures are climbing today. as you can see right now, we have a little bit of shower activity lingering from the system that came through yesterday. but those showers are going to impact us for the first part of the morning, and that's it, we're going to get a nice day. temperatures on the mild side, warm by tomorrow, and the winds are picking up as the winds pull out. watch out over the open water bridges this morning. we don't have any accidents to report on your local bridges, we'll take a look at your drive.

carriage gates at westminster palace where she is enjoyi inin lunch. she joined the queen for a service of thanksgiving at st. paul's cathedral. during that service, prayers were offered up for prince philip who is in the hospital recovering from a bladder infection. he's not able to attend any of the queen's diamond jubilee celebration. but after the service, the royals as we mentioned having lunch in the medieval hall before a carriage procession back to buckingham palace. such royalty. now once there, the royals will actually greet well wishers from the balcony. from regal to politics, now to decision 2012. polls open in just a few hours from right now. and there's a new game changer which could alter california's political landscape. marla tellez with a look at this unique election coming up. marla, good morning. >> reporter: good morning. it is unique because we're using a whole new system when it comes to state offices, you can forget

about majority rules. this new system is called the top two primary. this means the two candidates with the most votes will face off in november even if one gains an outright majority today. now, this also means your ballot includes all candidates of all parties for state legislative house and u.s. senate office so you can expect a longer list of candidates. also new for the first time in california independent voters can vote in the june primary. now, when it comes to the issue statewide, prop 29 is a big one. it's $1 tax on a pack of cigarettes. that would help fund cancer research. a political analyst we spoke to said independents could be a game changer for this specific proposition. >> i tend to think a lot of the independents in this state would've voted for it and they're not, again, they're not acclimated to voting in these cycles. it's going to be really close.

did six months ago while only 20% say they're spending more. investors have questioned how facebook will be able to generate revenue from the more than 900 million users, especially on the mobile platform. and think you've seen the end of airline fees? come on, they're never going to let go of those again. the "new york times" says reports now that some u.s. carriers are considering a $25 charge at the gate for carry-on bags that exceed the posted size limit. you know who you are carrying on those big giant bags. alaska airlines is already quietly doing that. passengers from lugging oversized bags on to planes, cutting space from cramped overhead bins. they started impose those fees back in 2008. and futures this morning are looking that little bit choppy. a choppy session on monday. the dow extending the losing streak and continued worries that the economy has hit a soft patch. and if it's tuesday, it must

this point. we're expecting those low clouds to hug the coastline. slight warming from yesterday's highs. high pressure is slowly but surely inching its way closer and closer to the coastline. but it's working against an area of low pressure yesterday that brought us the showers. we will see breezy conditions and tight pressure gradient with the two systems working against each other. and tomorrow high pressure really takes control of the forecast. and that'll bring your temperatures up from the 70s today into the 80s. got a good-looking forecast as we head throughout the remainder of the week. nice and dry and sunny. everything that you think about when it comes to spring. and then once we head into this weekend, getting closer to our summertime averages, warmer weather yet again saturday and sunday is your beach day if you wanted to hit the beach. let's get to your drive this morning. starting at the bay bridge toll plaza, we actually just received word in our newsroom of serious crash southbound 880 north of the scales and hayward.

contenders include a nonprofit executive from danville, a surfing rabbi, and a former marine. you can vote for any of them regardless of how you registered. the top two finishers advance to november regardless of party. now, keeping kids safe, the goal of a proposed law in san jose. today city leaders taking a final vote on a tough new social host ordinance. this one's been inspired by the tragic death of a south bay teen and a drunk driving accident that happened two years ago. reshawn was killed in the crash. police say the driver had been drinking. and under a new law if there's underdrinking in a home, that homeowner is now liable for anything that happens. 5:33, a little less pain at the pump this morning, filling up that gas tank is going to cost you a little less nationwide, prices are slipping. bob redell finding ate the pumps this morning. live in san jose with a look at

the numbers for us. good morning, bob. >> yeah, good morning to you, laura. if only the west coast was fairing as well as the rest of the country. if you look at the gas prices nationwide, they're almost as low as they were about eight months ago. we're not seeing that kind of low numbers here at the pump, but we're definitely seeing declines. if you were looking at the price of gas today and compare it to a week ago, we're down on average 6 to 7 cents per gallon on average. san jose, oakland, $4.22 a gallon. seven days ago, you were looking at $4.37, $4.30, and a week later we're seeing about a penny drop per day. >> what are you going to do about it? right? i've got better things to worry about. >> like? >> i can't walk in here and be like, well, i think you should lower this price to, you know, $3 or maybe $1 when i got my license.

i've got better things to worry about. it'll drop. oil is just trading for less than $90 a barrel two weeks ago? >> reporter: actually, lower than that. it's in the low to mid-80s today. and oil seemed like it was going to get stuck at the $100 plus, but because of pressures on the u.s. and chinese economies, the price of oil has dropped, where it goes from here, not quite clear. but one analyst telling the l.a. times that they believe that the slowing economies here and overseas and china is what's putting pressure -- downward pressure on the price of oil. reporting live here in san jose, bob redell, "today in the bay." >> good news as we approach the summer driving season. >> 5:35 right now. christina loren, not really summer weather right now. >> no, but that's appropriate because it is still spring afterall. but we are close to summer. and you can see, clear conditions as i promised yesterday. take a look at how clear this shot is.

you can see well beyond the golden gate bridge here. beautiful start this morning. we are expecting a little bit of fog to start to settle in, especially right at the coast between the hours of about 8:00 and 10:00. otherwise, a sunny finish today, temperatures nice and mild in places like san mateo, in the 50s in san jose. but we do have 40s on your temperature map, 45 degrees is cool enough for a heavy coat up in santa rosa this morning. but your inland cities will be in the upper 60s by noon today. rounding out the day in this low 70s. we've got a really good-looking day weather wise ahead. it's starting to get quite a bit more active. switching gears now with a stalling. 680 southbound after the i-80 intersection there, and no delays just yet because it is an 18-wheeler, this will be a lengthy process to get it cleared. give yourself a little extra time and travel cautiously. otherwise, here's the bay bridge toll plaza.

80 southbound north of the scales in hayward, that is clear. updated all morning. back to you guys. >> thank you so much, christina. an east bay program designed to keep kids off the streets suffered a serious blow. thieves broke into the popular boxing club and cleaned up thousands of dollars in valuables. the community's scrambling to keep the doors at the club open. good morning. >> reporter: good morning to you. oakland police are expected back out here a little later this morning to finish up their investigation. so much was stolen. over the weekend, it looks like someone jumped the fence here and broke a window to get into the east oakland boxing association. they took everything from tvs to dvd players, laptops, desk top computers on down to water bottles that the children were trying to use as part of a fundraiser. the club has provided after school programs and summer programs for 25 years. as the director says that someone took ten laptops the

kids actually use every day. tv, dvd player, even a nintendo wii, even trashed the art supply room they have here. they took jump ropes, boxing equipment. one student told us this is a great alternative for people in this neighborhood. >> it's just like a lot of things you could get into oakland. there's games, there's drugs, there's alcohol, there's so much things you could get into here. and here it keeps you from doing that. it takes your time. >> reporter: they also do gardening and nutrition programs. they work on job skills. the center has been in danger of closing down recently. but they were able to get the funds to keep on going. what's happening next, though, is that on june 25th, they have about 100 students already lined up to try and start the summer program so they're asking for the community's help and then on june 12th, they have a musical fundraiser planned at yoshi's

that has rocked a college campus to its core. and today the penn state assistant football coach accused of sexually abusing young boys will finally go to trial. brian mooar live in pennsylvania this morning where a group of jurors will soon take on that case. good morning. >> reporter: good morning, laura. well, jerry sandusky and his defense attorney are here, the prosecution is here, a judge from out of town is here to hear the case. all that's missing now is the jury. and jury selection is just now getting underway finding a fair and impartial jury is going to be one of many challenges that jerry sandusky's defense is going to face in this case. they have a couple of hundred jurors from here in center county that they're going to try to go through. but one thing you have to remember is that this is essentially like a bedroom community. a suburb of penn state. people if not professionally connected with the university, certainly having personal ties. this will be a difficult trial,

long trial, perhaps as long as three, four weeks. but it's going to be tough for the victims themselves who in a way here will be on trial. >> it's really sad if you report to the police and your case moves forward, you also need to be concerned about whether or not your particular story, some of the most humiliating things you've ever endured will be open to discussion at dinner tables and on the internet across the country. >> this is a scandal that has tarnished the penn state football reputation and legend. but it's also been very costly for the university in terms of money. so far, the university in legal and other fees has had to pay out roughly $10 million and counting. live in pennsylvania, laura, back to you. well, a key decision coming today in california's same-sex marriage ban. a federal court issuing the decision on whether to review a three-judge panel's ruling that

significant rain chances in the next 15 days. i'm looking as far out as i possibly can. that's what we're watching for you right now. taking a live look at your doppler radar this morning. whatever showers are trying to move onshore, they're falling apart before they do so on the open waters. winds becoming more of a factor as that system pulls out. we get what we call a very tight pressure gradient, and that is why winds are sustained at 14 miles per hour in ferry field, 10 miles per hour in novato. if you are getting ready to hit the road, it is still slick in spots because we picked up almost 1/2 inch of rain in some of your east bay cities out there. take it easy. 49 in sunnyvale and 51 degrees in san mateo. but what you will notice as you make your way out that front door. and take a look at the sun coming up, beautiful clear air out there, it's going to be a really nice afternoon with temperatures making their way into the low 70s. taking a look at what we're expecting for tomorrow. high pressure really moves in.

as it does so, our temperatures will jump from about 5 to 10 degrees, upper 70s and low 80s in your inland cities. today, though, we're talking about the low 70s and upper 60s even in places like oakland and san francisco. so actually pretty comfortable considering we've barely broke into the low 60s yesterday. by tomorrow, 78 degrees, then thursday, the 80s return. we'll get a few more clouds on friday. and an area of low pressure will start to dig south. we might actually see a little bit of drizzle up in the north bay, but that chance is only about 10%. we will update you each and every day. all right. switching gears now, let's get to your drive this morning. expect delays. we've got a disabled vehicle that's actually taking up the right-hand lane. this is 680 southbound just after the i-80 direction where it's already an area prone to delays. give yourself an extra ten minutes. that ought to do it. we do know there's a crew on the way. a live look at the golden gate bridge and show you it's clear as a bell out here and no delays getting into the city of san
