president obama will be touching down very soon for another whirlwind fund-raising trip out here. good morning. >> reporter: good morning to you. yeah. blink and you might miss this trip altogether. president obama is expected to land at sfo just before noon today. heading to downtown is an plan and then leave the bay area before 4:00 this afternoon. now you may recall he was just in the bay area less than two weeks ago. this time, again, president bam here for a fund-raiser. re-election bid. the big fund-raiser will be at the juliette morgan ballroom in the merchants ex-change building where nearly 300 supporters will pay about $5,000 each for a lunch with the president. estimates are that this quick trip to the bay area will grab about $1.5 million towards demonstrators they plan to be there, too. some upset they say the president is once again with the 1%. others upset with potential plans for drilling by big oil. and on the other side, according

to the chronicle a giant legend willie mays is going to be on hand. governor jerry brown, san francisco mayor ed lee, all expected to be there before the president heads to l.a. later today for an lgbt leadership gal. >> thank you very much, christie. 5:02. too close to call right now. proposition 29, cigarette tax hike measure, slight lindh after being slightly ahead hours ago. i want to take a look at 100% of the precincts reporting. 51% against it and 49% in favor. that's a close one. it has been a controversial one as well. i want to check in with marla tellez with an update. good morning. >> reporter: good morning. just a couple of months ago a statewide poll suggested proposition 29 would pass with two-thirds approval as you said down to the wire trailing by a slight margin this morning. so-called tobacco tax would tax

on an extra dollar on every pack of cigarettes. bringing the total tax on a single back to $1.87. the tax would generate an estimated $735 million a year and that money would fund cancer and tobacco related research. former state lawmaker don perata was inspired to help write prop 29 when he learned cancer resear researchers need cash. >> this is a user fee. if you don't smoke you don't pay it. >> reporter: opponents worry about a lack of accountability as the money would be funneled into a new agency. >> directed to another special uncontrollable group that no one has guidance over. >> reporter: big tobacco has outspent proper phone epts big time, about 60 million have been dropped to defeat it compared to the $18 million raised by supporters and supporters include lance armstrong and his live strong foundation. and new york city mayor michael

bloomberg. he gave a single $500,000 donation. now the last time voters approved a tobacco tax increase is back in 1998. that tack order an extra 50 cents a pack. 5:0437 this year voter turnout is low with less than 40% of registered voters casting their balance zblots the primary is still significant in many ways. especially because most of our congressional districts shifted here. had is how it breaks down. the second district now out on the coast. it stretches 286 miles all the way from the oregon boarder to golden gate bridge. this one known as one of the most liberal corridors in the bay area. as leadership is about to change there, that's because congresswom congresswoman woosley is retiring. jerrod huffman is in front. daniel roberts checking in second. we will keep in mind the top two in the primary still. the ninth district includes all of stockton and parts of

eastern contra costa county. the ninth district is more conservative, almost overnight. theoretically that would be a threat for democratic congressman jerry mcnerney. they will square off in november for that seat in the house of representatives. >> for the 15th congressional district, now includes alameda county. most of the old ninth district and part of the former tenth district. pete starks is running as the incumbent there. he's first elected -- since 1973. he is being challenged by eric swalwell. this one is checking in. stark taking over swalwell. those two will move forward and go head-to-head in november. >> now, certainly a closely watched race in the south bay measure b where voters overwhelmingly approved the measure to cut retirement benefits for city workers. bob redell live in san jose with

the latest as we look at the numbers. 70% to 30%. bob, what do you know? >> reporter: good morning to you. outside the house of the mans who champion pd, chuck reid who will be speaking with us live within the hour with his reaction. the fact that san jose one of the largest cities in the state passed this pension reform measure means that it is quite possible other cities in the state, even in the country, could eventually be following suit. the mayor has argued that the city needs to cut the pensions it pays to its workers to rein in its workers. paid $73 million towards employers' retirement. measure b will allow the city to pass on more of that cost. now in the future hires but also to current employees and retirees. with the savings the mayor said that the city will be able to reopen libraries and community centers and hire back police and

firefighters who had been laid off because of budget cuts. >> huge undertaking. it is a great win for me. it is a great erwin for the people of san jose. >> i hope he is pleased he destroyed a lot of city workers' livelihood and -- there was another way to do all of this. >> the union representing san jose police officers already said it will file a lawsuit against the implementation of measure b. their argument being that this contract, this was a pension contract, that was never meant to be broken. live reaction from the mayor within the hour. reporting live here in san jose, bob redell. it appears like san jose, that city's proposition b will be approved and approved overwhelmingly. the measure puts new city employees into 401(k) programs and limb at this time top salaries workers can use to calculate pensions.

san diego's pension cost at $231 million this year. which makes up about 20% of that city's general fund. > ask. voters have a tough choice to make. raise fire taxes or downsize the fire department. here's the latest numbers on that one. 44% to 56%. it would impose a $197 each we are. the tax would last about ten years and preserves existing fire fighting services and would possibly add additional paramedic services. the district is nearly $4 million in the red. if the partial tax does not pass, it may have no lay off half of the for fighting force and possibly shut down three of six fire stations, including downtown brentwood, bethel island. >> we have had grass fires out behind our house.

and response time has been great. but i do worry if i doesn't pass all that will change. >> i think it is going to be a hard rain check for the politicians and the public. and it is not going to be what everybody wants but we have to start cutting back. >> if measure s is approved, the partial tax would start on july 1 and end june of 20223. our election coverage, of course, continues on the bottom of your screen throughout the morning. that's where you are going to see the latest election results. 5:09 now. other news, police shoot a man at a south san francisco gas station sending him to the hospital with life-threatening injuries. this happened around 9:00 last night in on parking lot of the arco gas station. investigators say that the officer felt threatened and then fired a single shot. police say the suspect did have a gun but did not fire it.

meantime, another man recovering this morning after being shot by an alameda county sheriff's deputy, he was wounded as he drove towards the deputy yesterday afternoon in castro valley. deputies say they were attempting to arrest the man in connection with an attempted murder last month. after being shot, the man was finally tracked down with the help of a police dog. and this morning that suspect is hospitalized, being treated for a gunshot wound and dog bite. >> 5:10. more victims coming forward claiming they were sexually assaulted by a physician's assistant. they say he sexually assaulted female passengers at weight loss center on north white road. more than five victims have come forward since he was arrested. pg&e in damage control again. 200 trouble spots where gas pipelines could be severely corroded. obtaining a letter sent to the california public utility commission. director gibson tells of 180

>> one of which is thes in nasd fault. back in the first few hours of trading the problems were the mass dakota's. remember on that may morning, the opening went fine. the actual trading of nasdaq shares, though, were delayed for hours and many people who put in buy orders didn't get shares. they canceled their orders but couldn't get confirmation on the cancellation. this morning, the nasdaq will make good on those problems. paying out money. it is not clear how much and to whom. if your buy order for facebook says 40 bucks a share didn't go through you are probably not all that upset. thanks to the technical problems you didn't buy into the worst ipo in history. facebook shares closed at another all-time lotus. now, facebook shares slid more than 30% in the last 2 1/2 weeks. at some point investors is are going to want to hear something from the ceo. if this happened at yahoo or hp and, frankly, it has, over a

good wednesday morning. thank you very much for joining us. the time now is 5:30 on the nose. i'm jon kelley. >> i'm laura garcia-cannon. we begin with decision 2012 this morning. results are still pouring in. key races in this year's california primary election. this morning we have team coverage. marla tellez takes a look at the battle over new cigarette tax that's still too close to call. but we begin with bob redell live in san jose with a look at san jose's fight with pension costs. good morning, bob. >> reporter: yeah, good morning to you, laura. that measure, measure b passed yesterday overwhelmingly with 70% of voters here in san jose giving it the thumbs up. we are outside mayor chuck reid's house where he will be speaking with us within the half hour. the man who championed that measure and certainly went to bed last night knowing he was victorious in getting that pension reform measure passed. he will be waking up this morning to another fight. union representing san jose

police officers has already said it will be filing a lawsuit against the implementation of the new law arguing that it is in violation of a contract made between the city and employees. the mayor argued the city needs to cut the pensions to better pay to workes to rein in the budget. the city paid $73 million towards employee retirement. today it is around $245 million. measure b will allow the city to pass on more of that costs not only to future hires but current employees and retirees. >> be able to restore some of the positions that we have, fire positions we have, libraries, community centers. we turned a corner and the voters have said okay, enough is enough of cutting. >> reporter: the fact that san jose, one of the largest cities in the state, passed the pension reform could have repercussions elsewhere. quite possible that other cities in california, even for possibly throughout the country, might look at this and say wow, this

is something we can pass to rein in the costs. again, reporting live here in san jose, bob redell, today in the bay. >> statewide voters deciding the fate of prop 28. that's a constitutional amendment to reduce the term limit for state legislature from 14 years down to 12 years. the amendment would only apply to people elected in 2014 and after that. it applies to the time spent in the assembly the state senate or combination of both. tight race but still too close to call this morning. still no final word on a plan to hike state taxes on tobacco products. i want to take a look at numbers themselves right now. 51% voting against california's state prop 29. 49% in favor of it. marla tellez live in san jose with a look at the ongoing billion opt count. good morning. >> reporter: good morning. we are certainly getting a mixed reaction out here from people in regard to the so-called tobacco tax proposition 29 would add on

a dollar tax on to every pack of secrets. this money, estimated $735 million a year would fund cancer and tobacco related research. this morning, some people are disappointed by the results. others even nonsmokers are glad to see it losing. >> i don't think it is necessary. it is not going to stop people from buying cigarettes, i don't think, necessarily. even if it -- i mean, they are already expensive enough as it is, right? what's an extra dollar going to do? >> i wish it was going to pass so we have more research done on prop 29. >> in 2006, voters narrowly defeated a similar proposition, prop 86. would have imposed an additional tax of $2.60 per pack. no doubt about it, big tobacco companies are thrilled to see these latest results after all they you spent prop 29. supporters by about 40 million

job. they must release calls from mirkarimi and his wife. the mayor wants to use the calls in his official misconduct case against mirkarimi. mirkarimi pleading guilty to false imprisonment a after admitting he bruised his wife's arm after an argument. >> running up a huge bill for oakland. $750,000 budgeted to outsource dozens of occupy related internal affairs investigations because it just can't meet the time constraints that the court ordered. the cases as well as some future ones will go to law firms and private investigators. oakland must complete an investigation within six months. >> another california city right now on the brink of bankruptcy. late last night stockton city council members giving the city manager the power to file for chapter nine bankruptcy protection. that's by the end of the month.

if officials fail to strike a deal with the city creditors. it depleted the general fund, dough faulted on bank bonds and cut essential services. if stockton does file for bankruptcy it would be the nation's largest city to do it. >> the fight over same-sex marriage will now head to the supreme court. this comes after san francisco's ninth circuit court of appeals refused to reconsider a ruling which struck down prop 8. back in february a three-judge panel overturned the voter approved measure which defined marriage between a man and woman. the high court is expected to decide whether to take the case this fall. a decision could be handed down by next summer. 5:36 now. check back in with meteorologist christina loren. let's find out what's happening now outside. >> this is what's happening out there. you don't even have to look outside. take a look at this beautiful sunrise over the greater bay area. you are going to get really mice weather to start. which will correspond with the really good looking drive. we have very good conditions. very little fog.

against former penn state coach jerry sandusky could soon be wrapped up. nine people wrestling selected in the first day. most have ties to penn staupt university. during questioning tuesday nearly half of the jury pooled said they have been or have family employed by the university. sandusky faces dozens of criminal counts of abusing ten boys during a 15-year period. testimony is expected to begin monday. the heat is on jpmorgan chase in front of the senate banking committee today. questioning regulators about the more than $2 billion loss in stock trades that just went sour. the comptroller of the currenty will be in the hearing today and will investigate whether jp morgan's will have to compensate for monster losses. jamie dime longo before congress to talk about it next week. 5:41. back to decision 2012. this morning, bay area taking the spotlight on the national political stage.
