verdict is in on prop 29. that would slap another dollar tax on cigarettes. >> it certainly will. close one after being ahead in early counts. now falling behind by about 60,000 votes. taking a look at the leaders. marla tellez is live in san jose with an update for us. >> reporter: good morning, laura and jon. it looks luke $65 million spent by big tobacco to see proposition defeated almost paid off. lance armstrong's live strong foundation and the american cancer society. now one of the authors of prop 29, former state lawmakers says it is essentially a user fee. if you don't smoke withdrew pay. it would tack on a dollar tax to a pack of cigarettes, bringing the total tax to $1.87. money generated, we are talking close to $800 million a we are,

would have been used to fund cancer and tobacco related research. our very informal opinion poll out here, we are finding mixed reaction. >> hrts the guys that smoke. i don't see that hurting anything. >> that money used in the state i don't think they should pass it. >> that right there is a big concern for opponents that say that there have s no guarantee where the money would go, the money would be funneled into a new agency and not the general fund. last time voters approved a tobacco tax increase was back in 1998. that added on an extra 50 krens per pack. live in san jose, marla tellez, "today in the bay." >> voters deciding the fate of prop 28, state constitutional amendment that would shorten state legislature term limits from 14 to 12 years. a look at the right now. 100% in, that's going to go by.

61% of the voters pushing this one ahead. amendment would only apply to people elected in 2014. and after that, it would be a -- that would be the time spent in the assembly. state senate or combination of both. this year, voter turnout is low with less than 40% of registered voters casting their ballot. >> we knew a lot of people wouldn't come out but the primary is significant in many ways. especially because most of our congressional districts have now shifted. the new district, for example, is now on the coast. it stretches 286 miles from the oregon boarder to golden gate bridge. district 2. it is known as one of the most liberal corridors in the bay area. and the leadership is about to change. because congresswoman lynn woozy is retiring. jared huffman is taking that one with 37% of the votes. daniel rob certain right behind him. top two will be moving ahead to

go head-to-head in november. the ninth district, it includes all of stockton and parts of eastern could traffic -- contra costa county, clungant yok, oakley, brent wood. that means the ninth district got more conservative and happened almost overnight. that's a treat for democratic congressman mcnerney along with ramsey gill. top two vote getters and squaring off come november for the seat in the house of representatives. as important the 15th congressional district, alameda county, most of the old ninth district and part of former -- former tenth district, running as the incumbent elected in 1973 but had is being challenged by democrat eric swalwell. now to a race deciding retirement benefit for government workers. measure b.

voters overwhelmingly approved it. b bob redell joins us with the latest. expecting to hear from mayor chuck reid. >> reporter: yes. we are outside his house in san jose. good morning to you. and the mauer argued that measure b needs to be passed and cut down on the budget deficit in the city to give you perspective about ten years ago the city paid roughly $73 million towards retirement benefits. close to $245 million with the passage of this measure. you can now, of course, cut benefits for future hires and even affect current employees and retirees. chuck reid here, what's next? you got what you wanted. what happens now? >> a lot of implementation steps that have to be done. beginning on tuesday the council will consider the ordinance to modify retirement benefits for new employees to be hired starting july 1. we have to work with the department of treasury to get our employee choice plan approved and through that process, and then there's

ordinances to be adopted. it will take us a year to get this implemented. stay money in the first year of implementation and that's important thing. >> when do you think the city would be end considerably in the black? another year? down the line after that? >> first year of this implementation will save about $25 million and go up every year for probably 40, 50 years. because as new employees come in, their benefits are less expensive than current employees. we are implementing and pieces of it will go in effect immediately and then the employees requirements will change about a year from now. >> reporter: not all employees and unions are happy with this. the police union said they will file. are you worried about an injunction stopping you? >> a lot of the employees are happy about this. they understand the -- employees are going to lose out if we can't fund their benefits. we will make sure we can pay the benefits people earned. we are on strong legal ground.

life threatening injuries. this happened around 9:00 last night in parking lot of the arco gas station on westboro boulevard. investigators say the officer felt threatened and fired a single shot. police say the suspect did have a gun but he did not fire it. >> a man recovering after he was shot by a sheriff's deputy. he was wounded as he drove towards the deputy yesterday afternoon in castro valley. deputies were there attempting to arrest the machine in connection with an attempted murder last month. that suspect was tracked down with the help of a police dog and this morning he remains hospitalized, treated for gunshot wounds and treated for dog bites. >> 6:11 now. find out who else will weigh in on the fate of the former football coach. space shuttle "enterprise" making its trip to its brand-new home today. we will tell you what it has to go threw to finally get there.

detonated their explosives. pretrial hearing will be held today for a u.s. army private bradley manning. he is the intelligence analyst accused of leaking hundreds of classified documents to wikileaks. manning is suspected of leaking video of a 2007 helicopter attack that killed several iraqi civilians. jury selection could wrap up in the trial of penn state football coach sandusky today. nine out of the 12 main members of the jury are already seated and include a penn state senior, retired professor, and a woman who has been a football season ticket holder for three decades. very close-knit football fan friendly type of community out there. three more jurors and four alternates could be picked sometime today. sandusky fight 5g 2 criminal charges for alleged abuse of ten boys over 15 years. testimony could start on monday. 6:15. it may not have gotten into space but will have quite the tour down the hudson. we are talking about the shuttle

basketball court. john madden, form are 49ers, mario. head-to-head at that charity tournament they love to throw bocce in livermore. members of the raiders team will be playing. the event has been held for the past 14 years. it benefits several local charities including the special olympics of northern california. >> very cool. not quite as hard hitting as football. need something do this weekend? how about something for free? you can visit a national park. yosemite and other national parks not charging a single dime for admission this saturday. this is all part of the national get outdoors day created five years ago to encourage more americans to go out and take it all in and experience nature. the deal is not just for california. it holds true at all national parks, memorials and monuments nationwide. positive there is our buddy, the squirrel. >> you remember what smokey the bear said?

yeah. if you are going to be celebrating, partaking, in national park weekend, make sure that you are watching your campground fire and if you are having to barbecue this weekend as well, getting into that time of year, fire season started in the bay area. 6:18 now taking a live look. this is high atop san bruno taking a look over the bay. we have a really good looking day shaping up. lot of sunshine coming in early. that cool air from yesterday will mix out and hit our average high for this time of year before the day is done. that's a great way to start a wednesday out. we are getting closer to that weekend now. and if you did want to hit a national park, you may want go ahead and consider that the higher elevations and the beaches are going to get the best weather this weekend as we will be close to 90 degrees in the warmest cities across the bay as of this sunday, this morning, it is nice and crisp out there. nice and cool. and temperatures are going to climb by noon into the 60s and 70s. running ten degrees warmer than we did yesterday. westerly wind at 9 miles per hour in fairfield. now at ten miles per hour novato. we are going to continuely see the winds pick up as we head

throughout the day today. it will be on the breezy side because we have clockwise flow around high pressure. working again to anti-clockwise. counterclockwise flow of low pressure which will pass to the north today. would are really going to work against each other and right between them. smack dab in the middle, winds pumping through the bay area as a result. windy at times today. tomorrow we will lose the wind. temperatures will increase. 77 for today in san jose. 70 in redwood city. not too shabby in san rafael. 74 degrees. warmup, 80 by tomorrow. on friday, we will get another area of low pressure and pass to our north. usher in a stronger onshore flow. waking up with plenty of clouds and as of friday morning, and cooler day overall as a result. and then the warmup really kicks into high gear. 82 degrees saturday. 88 by sunday. this is metropolitan, san jose and livermore. warmer bay area cities will be in the 90s object sunday. then we will see 90s right here in san jose by monday. remains toasty every day next

facebook. remember back in the first few hours of trading of facebook, problems were nasdaq. that may morning you will recall the opening here went fine. the actual trading of nasdaq shares was delayed for hours. many people that put in buy orders didn't get their shares. so they canceled their orders but didn't even get confirmation of the canceling. this morning, the nasdaq is going to make good on those problems. probably paying out money. it is not clear to whom and how much. if your buy order for facebook says 40 bucks a share didn't go lou you are probably not all that upset. thanks to the nasdaq's technical problems you didn't buy into the worst ipo in history. facebook shares closing at another all-time low on tuesday. facebook has slid more than 30% in the last 2 1/2 weeks. at some point investors will want to hear something from the ceo. if this happened at yeah heahoo

will keep his job. he beat milwaukee democrat mayor in a recall election. tracie potts is live right now to tell us what's next for this politically divided state. good morning. >> reporter: good morning, everyone. at this point this politically divided state decided they p want to hold on to their republican governor. this all stands from him rolling back union rights, collective bargaining rights for state workers. a 5 2% who came out yesterday said that they think walker handled that correctly. trying to save money in terms of what the state is putting out for help and pensions and other benefits and so now he moves on as governor of that state and as -- after beating milwaukee mayor tom barrett. speaking of that, last night at a concession speech, barrett was slapped by one of his own supporters. the supporter said i want to

>> reporter: good morning. tip it is looking like big tobacco prevails on this one. so-called tobacco tax, proposition 29. no doubt about it. would have hurt smokers' cash flow. would have added a dollar tax on every pack. single pack costs $6 or more. tax money would have been used to fund cancer and tobacco related research. people we polled out here this morning are split on this issue. >> i wish it was going to pass so we would have more research done on cancer. >> i don't know how much is actually going to go towards the research. how am i going to know? is there ni proof to say this is how much? this is where it is going to? i mean, i would have voted yes but i don't know. >> reporter: one of the biggest worries about proposition 29 is just had a. who would oversee the generated monday grip opponents saying it would only create an

air force base in just a few minutes. president coming in for a fund-raiser. he's staying four hours before he has gathering the money and heading south to los angeles. more on that coming up in a live report at 6:55 this morning. >> in other news more victims coming forward this morning. claiming they, too, were sexually assaulted by a physician's assistant. san jose police say ali sexually assaulted patients at a weight loss center. five struck times have come forward since he was arrested. occupy protesters running up a huge bill in oakland. city budgeting $750,000 to outsource dozens of occupy related internal affairs investigations. oakland is under court order to complete those investigations quickly. leaders are saying time is running out. current cases as well as future ones will go to law firms and private investigators to try to get that done within six months.

this one is a food truck lover's dream come true. they are calling this food truck park. it is opening up at -- wares in san francisco today. former u-haul parking lot on 11th and harrison, south of market neighborhoods. it is now home to a bunch of food that's out there. unlike the traditional roadside experience, the food park has tables, restrooms, they even have wi-fi hooked up out there. that truck will rotate on a daily basis with lunch and dinner served seven days a week. >> that's going to be a good day for eating outdoors. checking in with meteorologist christina loren. >> are you buying? >> you got it. >> if you are i'm coming along. >> all right. sounds good to me. 50 degrees. 50 in san mateo. 47 in sunnyvale to start out. nice and crisp out there this morning. beautiful sunrise over the bay area. it is clear as a bell basically. little bit of coastal fog starting to develop. we have winds preventing that fog from getting dense and
