and new this morning, police investigating a deadly overnight shooting in east palo alto. bob redell is live at that scene right now with the latest developments going on there. bob. good morning. >> reporter: good morning to you, jon. we just got done speaking with east palo alto police. they are getting ready to clear the scene. the shooting took place on the 2,500 block of gloria way. you see that silver suv right there. on the other side is where a man was shot and killed around 11:44 last night. they're so precise on the time is because they found out about this through shot spotter technology. that's the technology set up here in east palo alto where you've got microphones that are able to triangulate the shots, according to the technology indicated there were nine shots fired, police were on the scene within one minute. they describe a scene of a lot of people out front with a man on the ground, shot several times very hysterical people while the man was somewhat responsive. they took him to sanford hospital where he died about 30

minutes later. they have identified him as tippins jr. around 31 years old, this was his family's home, he lived elsewhere within the city limits and the police sergeant we spoke with this morning knew of him because of visits during his community policing efforts. >> he was actually -- he was actually a pretty good guy. very easy to talk to. just somebody that you -- friendly you could say. >> you surprised this happened to him? >> you know, nothing surprises me anymore in this town. >> police are still trying to find a suspect. we understand it is another man, not clear what led up to this shooting. they do have witnesses they are interviewing downtown. unknown at this time. his twin brother was on the scene not too long ago along with another family member. i asked that family member would you like to talk?

and he said, "talking ends you up dead." reporting live here in east palo alto, "today in the bay." and this morning a man in his 20s is expected to survive after being shot by oakland police. police swarmed the area around 8:00 wednesday night. so far, no word from police on how that shooting started or if the suspect was armed during the confrontation with police. no officers were injured in the shooting and the suspect is recovering at a highland hospital. police have a sketch but they do not have a name and asking for your help in identifying a woman recently found dead in a trash can. an artist sketch, police also releasing a picture of the earring she was wearing at the time. investigators ran her fingerprints through a nationwide data base for missing persons, but no matches. >> we have no way of proving where she came from, where she

died, how long she'd been there. those are very difficult things to answer. >> what they can tell us is that the victim was wearing an old navy shirt and some pajama bottoms. if you have that information which could help solve this crime, you're asked to contact the police department. new details emerging from the bryan stow assault case. during a preliminary hearing, stow's friend described the moments leading up to the beating. he says dodger fans were jeering at them during the game and stow told them quote i hope they code. that's a reference to cardiac arrest. that's when two suspects norwood and sanchez allegedly confronted stow and his friends. but in testimony nearly all of the other prosecution witnesses were not able to positively i.d. the attackers. legal experts say this could affect how a potential trial plays out. >> the lack of a really positive i.d. isn't really a problem at this stage. these guys are almost certainly going to get bound over for

trial. but at trial with a higher standard of proof, the district attorney better have some more solid eyewitness evidence. >> if there is enough evidence that is brought out during the preliminary period, they will stand trial. both men pleaded not guilty for the march 2011 beating. nothing short of a scary moment for a south bay family after a toddler falls out of a second story window but manages to survive. this all happened at this apartment complex near the lawrence expressway and stevens creek boulevard in santa clara this happened about 7:30 last night. the child was alert, happily, when the firefighters arrived. police say that child was immediately taken to a nearby hospital. but so far the extent of the exact injuries not known at this time. 6:05 right now. and we are minutes away from the marketing opening this morning. we're going to be watching to see if traders will keep riding that wave of wednesday's big rally. scott mcgrew to tell us why we

have a san franciscan to thank. >> dow industrials gained a 286 points, up better than 2.33%. nasdaq gained 66, even facebook, yes even facebook gained 3%. much of the rally came after the second in command at the fed, this woman janet yellin said outright the central bank ought to be doing more to help the economy. fed members usually hint at things in language that's really hard to parse, but yellin was explicit in her comments. investors are hoping for another round of easy money, a third round of quantitative easing or qe-3. yellin's boss goes before congress today in a regularly scheduled briefing and this idea of qe-3's going to come up. already dow futures calling for 60 points on the open. >> thank you very much for the update. it'll be interesting to see that

bell and where we go from here. >> meteorologist christina loren telling us -- >> guess who's taking us to lunch, christina. >> sounds good to me. we know, a big baller like jon kelley, it's going to be good. we're going to get delicious sunrise this morning over the bay bridge. beautiful out there as you make your way to work. no thick fog to report at this point. you might find a few ragged patches, but overall, nice and clear as temperatures are mild. and we do have winds preventing that fog from developing. it all works out like this for today, 72 degrees at noon inland rounding out the day at about 80 degrees. warmer than yesterday by 3 to 5 degrees on average. bay side, 67 degree weather as you break for lunch and rounding out the day in the 70s. a little cooler at the coast. but, hey, if you want the 80-degree weather in places like santa cruz, we've got it for you. that's ready to go in my next report. got to get out that front door, hold on for one more minute, mike's here to help you out. >> i want to warn folks, warn

them about debris in the roadway. reported as a road hazard. it's debris westbound 580, folks are serving to get around whatever that is in the roadway. expect a traffic break and causing additional slowing heading over toward 1st street. but west of there, you're okay to the dublin interchange. construction still north right around northbound 680 into san ramon. we're looking at northbound 101 just off of 680 for some slowing kicking off here for san jose, the construction crews still 17 at 280, the middle of your screen not causing a big problem. this is a distraction, 101 at 680. chp had gotten a report of peacock in the center divide. if one bird got out of there, maybe another might be in there maybe some other folks from the crew around. just be careful. listen for this, there you go. that's my peacock. there you go, guysment back to you. >> you should see him flap his

wings, that's really impressive. how about this story? thieves ripping off wire from poles in the east bay leaving people without comcast service this morning. how about a total of 160,000 feet of fiberoptic wire was stolen last week along the road and rollingwood drive in vallejo. the thefts happened in vallejo, but a disclaimer, comcast happens to be our parent company right here at nbc bay area. at a time when budget cuts and tuition hikes are prompting campus protests, we're learning the system has been spending big bucks upgrading the homes of the university presidents. more than $1 million in public and private funds were spent over the last year to renovate 11 university-run homes. administrators say the improvements were necessary so the presidents could host fundraisers. critics say the money spent on renovations could've paid for more than 150 one-year scholarships. well, this story a different vibe.

more than a college degree, a team of graduating seniors carrying on the legacy of their professor. and today they'll be honored in a touching tribute. the engineering students recently won a $90,000 grant to continue their work on their fuel cell design. this design will eventually replace large toxic batteries currently used to store solar and wind energy in poor rural villag villages. carrying on the work of dan strickland, just 27 years old when he was killed in a car crash on interstate 280 back in september. students say strickland had a saying that always inspired them. absolutely and carry on. >> it's just -- just continue with your hard work and it'll take you places. >> very touching and powerful tribute there. today strickland's father will

welcome back, everyone. taking a live look outside. look at that, the sun has arrived in the bay area making way for a beautiful day and lovely temperatures. 6:14. there are new accusations the syrian government is continuing its deadly crackdown on opposition groups. monitors say women and children were killed at one village on wednesday. they say the area had come under heavy bombardment before forces moved in on the ground. the syrian government denying the attacks and is blaming terrorists for the deaths. 6:14. defense secretary leon panetta arrived in afghanistan overnight. he's there to discuss plans to withdraw troops. this is file video from a previous visit to afghanistan. in a meeting with afghanistan's defense minister, panetta also insisted he's keeping pressure on afghanistan. panetta says the u.s. is running out of patience to root out a terrorist network there. but in a meeting with troops, panetta made a joke that the death of an al qaeda leader --

about one earlier this week. >> just took down another leader in al qaeda the other day. the worst job you can get these days is to be a deputy leader in al qaeda. >> 27,000 american troops are scheduled to leave afghanistan by the end of september. defense attorneys for bradley manning will call several u.s. employees to the stand today. the defense is trying to get 10 of the 22 charges against manning dismissed. the 24-year-old is charged with aiding the enemy by leaking of hundreds of classified documents to wikileaks. on to decision 2012, president obama attending one more fundraiser in los angeles this morning before moving his plane over to las vegas. raising $60 million in may for his reelection.

in the meantime, talking the campaign trail about taxes and former president bill clinton's statement that everyone including the rich should continue to get a tax break. >> when you raise the marginal tax rate from 35% to 40%, it means that business will keep less capital and can hire fewer people. it'll kill jobs. >> it's not enough just to continue the bush tax cuts, we're going to tack on another $5 trillion worth of tax cuts. >> well, the military says this is a side story to president obama's flight. the military says two f-16 jets, fighter jets intercepted a small plane during the president's visit to l.a. the single engine cessna breached a restriction and a fighter jet followed that plane until it landed around 5:00 p.m. last night with no incidents. well, we could see history in the making this weekend at the belmont stakes. time to saddle up. >> after having won the kentucky

today. not as gusty as it was yesterday, but i love those live shots, no june gloom to talk about this morning. when the fog does develop, it's going to clear out quickly. good morning, west southwesterly wind at 20 miles per hour. locally getting gusts up to 45 miles per hour. you're now at 20 and fairfield and novato. so what happens is, you've got those winds whipping around, as a result, that pollen is being carried on the breeze. so if you suffer from allergies, the pollen levels have crept back up. they're going to sink throughout this weekend. you can ditch the allergy medication, but breezy conditions today and tomorrow, certainly warranting that medication if you suffer or you want to limit your outdoor activities if you don't want to find yourself sniffling or sneezing. good idea to drive to work with the windows up. we'll check on that drive with mike. we're talking about 80s inland, tomorrow, more of that fog in

the morning and then it'll clear out making way to sunny finish, but temperatures tomorrow, just subtract three degrees from today's highs. almost to the weekend, and we're going to warm you up just in time for that all-important weekend. up to 84 degrees by saturday, temperatures continue to climb as we head through sunday. and the 90s return monday looking toward a hot start to next week. have no fear, though, we'll be here to update you on that. mike's back, thank goodness, let's check that drive at 6:19. >> thank you, christina. nice to be missed. we're looking over here highway 4 just 12 miles per hour lifted at the sensor, and now we have the slowing coming on over here towards pittsburgh and bay point. you see that getting over toward concord, but through concord and walnut creek, that interchange is still moving smoothly. that commute direction all the way over toward the caldecott, highway 13, the freeway, speeds dipping down into the 50s at times, likely more folks heading over toward the maze and the bay bridge toll plaza.

let's get a live look and see how the volume's shaping up. we can still see the tops of those roofs and we see the backup forming on the fast track lanes. metering lights in another two or three minutes. we'll send it back to you guys with the build coming out of the east bay into the city. >> thank you very much. i think you're linked in, right, mike? you could be one of the 6 1/2 million people who had their linkedin passwords stolen. scott mcgrew says it's easy to find out. >> try to log into linkedin, laura, and if you can't, you were one of the victims. they said they've reset the passwords. there will be instructions as to what to do. already people are reporting they're getting fake e-mail from what appears to be linkedin and other websites. now, to make sure you're not falling for the wrong e-mail, there is a fairly simple and easy way to tell the difference. between a real e-mail from linkedin and a fake one. the real e-mail will have no

links in it. nothing to click on. instead, you just follow the printed instruction. let's bring an expert in, the chief technology officer at computer security company voltage security. one of the problems, the bad guys will use this one bit of knowledge to sort of leapfrog their way around your life. >> yeah. indeed, they can extract information from these accounts that can then be used to do password resets or extract other information. but the worst thing is that some people will share passwords between websites in terms of -- it's sort of a pain you've got multiple services going on and use the same password here as there. if it gets broken at a place like linkedin, they can leapfrog over to other websites. particularly a website where you're storing information that has a lot of value. >> or you're spending money on it, as well. is this linkedin's fault?

should they have done a better job? >> yeah, in some sense. there were two things going on. one, they were able to extract this information from linkedin, and the other what linkedin was storing was a password hash. what happens is they stored the passwords that allowed the guesses to be efficient. they were taking the password hashes and guessing a bunch of pass words. if you're on a website of getting passwords or getting passwords that aren't common words, aren't something people can guess. there are a number of techniques and programs that can make pass records more complicated which is going to resist these kind of attempts to get these passwords. >> appreciate you being with us this morning. other news, four square has a new update, recommends places for you. that check-in software that tells you where your friends are now going to guess places to go

6:26, sugary drinks at the center of a growing debate today in washington, d.c. help advocates and medical experts will meet for the first ever soda summit. tracie potts joins us live from washington, d.c. with more. good morning. >> good morning. it's happening in part because 62% of california adults and 31% of california children are considered obese along with similar percentages around the country, obesity, diabetes all side effects. these experts say of drinking too much sugar. we're talking about soft drinks but also fruit drinks that have a lot of sugar in them, even sweetened water, sports and energy drinks. they're going to take a look today, these experts at consumption, obesity stats, how these drinks are marketed and what's public opinion especially after new york decided to ban

good morning, i'm bob redell live on the peninsula where police are trying to find out who shot and killed a 31-year-old man overnight here in east palo alto. we'll take you live to the scene coming up. and a family in south san francisco is demanding answers this morning after their 15-year-old son was shot and killed in an encounter with police.

joins us with the latest. >> reporter: good morning, laura, with shot spotter technology alerted police to the shooting. the technology heard nine shots around quarter to midnight last night and ended up triangulating the location of the shots. that home on gloria way. police say they were here within a minute on the ground beyond that silver suv was a 31-year-old man. he was suffering from several gun shot wounds. he was taken to stanford hospital where he died about 30 minutes later. >> all we heard was -- all we heard were people yelling someone's been shot. and that was about it. we didn't hear anything about this person did it they were driving this type of vehicle, they went this way, even though those questions were asked, they were hysterical. >> reporter: police are interviewing witnesses downtown partly family, partly friends, trying to get a description of

the suspect who is apparently another man. it's not clear what kind of information police are getting on this. it's also not clear what led up to this shooting. police do believe he was hitting this home where one of the members of his family lives. he lives in east palo alto, just not here. and police actually knew him from talks they had with him during neighborhood patrols. they say he was a nice guy, very friendly. when we asked the sergeant if he was surprised that this happened to him, he says nothing in this town surprises him anymore. reporting live here in east palo alto, "today in the bay." this morning, a memorial to a teen who is shot and killed by police in south san francisco. christie smith is live at that scene where the family and friends of that 15-year-old. they're right now crying foul. christie, good morning. >> reporter: good morning to you, jon. we were here late yesterday morning, and there were only two stuffed animals and a note. you can see how things have changed overnight. friends and family keep coming out. derek gaines' aunt tells us she

did everything to protect him. moving him across the bay from oakland thinking that would keep him safer, but the 15-year-old was shot and killed by police. this was tuesday night near a gas station. police said they tried to stop two teenagers because they were engaging in what they call suspicious behavior. but police didn't explain exactly what that behavior was. police say derek gaines ran and pulled out a gun prompting an officer to shoot. now, many who visited the memorial were skeptical about that description of events. but his mother says she thinks he was walking home from mcdonald's. she believes he was profiled and is worried about other teens in the area. >> i'm worried about the status quo in south city, that's what i'm worried about. i don't want to see another kid shot. or labeled. >> she says she doesn't believe he actually had a gun, but police say they did recover his

gun but they didn't say what kind it was or if it was loaded or not. now, south san francisco police and the san mateo county district attorney's office are now investigating the shooting. reporting live in south san francisco, christie smith, "today in the bay." there was a new clue in an effort to identify the victim of a gruesome killing. a sketch of a woman whose body was found inside a garage can last month. they also released a picture of the earrings she was wearing at the time. ran the fingerprint through a nationwide data base for missing persons, but so far, no matches. the victim was wearing they can say an old navy shirt and pajama bottoms. if you have any information which could help solve this crime, you're asked to contact the pleasanton police department. in san jose, voters have made their voices heard. and now lawmakers will speak. city unions are going to court challenging the passage of

measure "b." 70% approved the plan backed by the mayor. mayor chuck reed says he is prepared to spend big money to fight for what he says will be long-term savings for the city. >> this is $1 billion problem. so if we have to spend some money to eliminate the problem to protect the rights of the taxpayers, we will. >> city leaders say measure "b" is an illegal attempt by the city to reduce the value of employees' pension credits. most legal experts we talked to say it'll take years for the issue to be decided in the courts. it is 6:35 right now. supporters of prop 29 say they are not conceding defeat. it's about 65,000 votes short. but more than 1 million absentee ballots need to be counted. this thing could be flipped the other way. some experts predicting the outcome will not likely change. >> all right. i don't think the outcome's likely going to change when it comes to the forecast. >> no.

>> let's check in with christina loren. >> another repeat performance of yesterday, which was phenomenal around here. through the weekend, hotter changes on the way. temperatures soaring, especially in your inland cities, but take a look at this beautiful start. we have a gorgeous, gorgeous clear sky, no the just here in san jose. from the coast all the way to concord this morning complete sunshine already. and it's only 6:36. 50 degrees to start you out in sunnyvale. 48 in novato and 51 degrees in san francisco. this afternoon, winds will play a factor, but they'll decrease throughout the second half of the day. they're very strong right now in fairfield, for example, at 20 miles per hour sustained. keep that in mind as a result of the winds and dry conditions, we have a high pollen count for today, higher than it has been. keep that allergy medicine handy. if you do suffer from allergiea, you want to limit activities. up to 80 degrees at 4:00 p.m. so really comfortable conditions. we warm you up as we head

they're going to start nonstop service between oakland international airport and amsterdam starting tomorrow. well, the low-cost carrier will offer flights between oakland and amsterdam from now until mid-october. as of now, it's just a seasonal service. but airport officials say they hope arco fly will offer flights on a long-term basis soon. airline headquartered in the netherlands. sticking with the friendly skies, a shortage of pilots is having a major airline cutting flights this summer. american airlines, the nation's third largest airline says it's reducing its schedule by 1% because of pilots calling in sick. a union spokesman says pilots may be calling in sick to take care of medical procedures before american raises those help co-payments. i get it. 6:41. coming up, 15 minutes of uninterrupted news. including another scare in the air. fighter jets scramble after a

afghanistan this morning to discuss plans for troop withdrawal. in a meeting with afghanistan's defense minister, panetta also insisted he is keeping pressure on pakistan. the u.s. is running out of patience to root out the terrorist network. that is the group that has claimed responsibility for several attacks on americans including last year's attack against the u.s. embassy. and nato headquarters in kabul. panetta says the group is one of the biggest threats to stability in afghanistan. republicans have found an unlikely ally to fight the extended tax cuts. president obama wants congress to end tax breaks for the rich. mitt romney says that would kill jobs. and former president bill clinton appears to be taking romney's side on this one. the former president says the economy's still too weak right now for lawmakers to extend tax breaks for all americans. if lawmakers do not act, taxes will go up on january 1st. well, the military says two f-16 fighter jets intercepted a

small plane during president obama's visit to l.a. the single engine cessna breached air space restriction. the fighter jet followed the plane until it landed at 5:00 p.m. last night without incident. the family of a man murdered in a bizarre case in canada will meet with officials today. he was arrested in berlin for killing his boyfriend, dismembering that body, and mailing body parts to various locations around canada. investigators say he posted video of the grisly crime and taunted police online. the website that hosted the video of the murder could also face charges. well, a massachusetts teen is heading to prison for killing a man as a result of texting while driving. aaron was sentenced for two years for killing a father of three. investigators say the 17-year-old in high school at the time sent nearly 200 texts

but it's smooth and easy out here. delicious weather according to christina loren and wanting to chomp into it, aren't you? >> we are so lucky to live here in the bay area. it's so beautiful this time of year. and let's take a live look at san jose where it's completely clear. you typically hear the term june gloom, not seeing that june gloom. we haven't had much of it to be specific. now, the first official day of summer, the first full day of summer will be the 21st, the solstice happens on the 20th. we're getting closer and closer as we head throughout the next few days, though, it's going to start to feel like summer time early. 52 degrees, not yet, 51 in san francisco, and 52 degrees to start you out in concord. mainly clear start, fog back tomorrow, today stays nice and sunny, the pollen, though, more of a factor with breezy conditions throughout the afternoon. and then we've got 90s in the forecast. so keep that in mind. high pressure firmly in control as we head throughout the afternoon, this is really going to keep us nice and warm and

sunny, but an area of low pressure situated to our north moving into the pacific northwest creating rain showers in oregon and washington. now that system is still going to play a role in our weather. so we have a tight pressure gradient, those winds coming right through the bay area. and particularly at the coast today, we're expecting pretty high gusts. but 80s today inland, tomorrow, wake up with fog and then a sunny finish for your friday. warming you up by saturday, mid-80s return inland and then the upper 80s by this sunday. so enjoy what we have for you today, 80 in san jose, 78 degrees in santa cruz, and 78 even in gilroy. by tomorrow, little fog, little drizzle in the morning, then we'll hit about 77 degrees, limited sunshine for the first part of the day. we'll keep your temperatures down, but we'll ramp them back up saturday and sunday. and 90s when we return on monday morning. here's mike. >> so is the commute. highway 4, speeds below 20,

throughout somersville getting down into the 30s heading over through concord for 242, and at the bottom of your screen as you're approaching that interchange, speeds coming down below 50 now. typical pattern, but it's coming down towards highway 24. that's going to affect folks in lafayette as that travels through the area, as well. a smoother drive, but still slower, as well. south of here for 580, coming out of the altamont pass, that's livermore heading over toward pleasanton, but speeds into the 50s and 60s as you're approaching that dublin interchange. 680 still not showing any slowdown through sunol so we'll move over to the castro valley y, seeing slowdowns for northbound 238 and 880 coming down toward the bridge. pretty standard pattern over here, but a little bit lighter as far as the volume of traffic through the area. south bay, nice drive, as well. northbound routes, slowing, and a live look at 280 toward 17 shows the volume starting to build at the interchange. they're slowing right near the off ramps. back to you. >> thank you very much. well, as they should,

traders feeling loose and lucky after yesterday's gain on wall street. scott mcgrew with his eye on the market. >> we have a live look at the big board in wall street. the dow industrials are up 128 points. a repeat of yesterday where we saw the dow just rocket up about 200 points. there is lots of expectation that the fed will create more easy money. ben bernanke testifies on capitol hill this morning. we'll be listening carefully to what he says. the head of the nasdaq, meanwhile, you remember him, he's there on the right during the facebook open there, the one with the glasses has publicly apologized for problems in the trading on the morning of the facebook ipo. speaking on our sister network cnbc, the nasdaq ceo says he was deeply embarrassed. nasdaq set aside $40 million to make good on money lost in confusing or unexecuted trades. you remember, we had contests to guess the facebook ipo, you won, i bought you a single share --

>> very interesting. at a time when budget cuts are prompting protesting, the system has been spending big time dollars upgrading homes of the university presidents. more than $1 million in public and private funding were spent over the last year to renovate 11 university-owned homes. they say the improvements were necessary. so the presidents could host fundraise fundraisers. come on. critics say the money spent on renovations could've paid more than 150 one-year scholarships. voters have spoken loud and clear and lawyers will take over as union leaders vow to challenge measure "b." lawyers representing the city's police and firefighters union say they will file suit. appearing in our studios, major chuck reed says he is prepared to spend big money to fight for what he says will be long-term savings for the city.

>> this is a $1 billion problem. if we have to spend money to eliminate the problem to protect the rights of the taxpayers, we will. >> union leaders say measure "b" is an illegal attempt by the city to reduce the pension credits. most experts we talk to say it'll take years for the issue to be decided in the courts. >> and supporters of prop 29 say they are not giving up, they are not conceding defeat. nearly 1 million absentee ballots need to be counted. some experts are predicting based on voting trends the outcome here will not likely change. new details are emerging from the bryan stow assault case. during day four of the preliminary hearing on wednesday, stow's friend and fellow paramedic described the moments leading up to the beating. he said dodger fans were jeering at them during the game and stow told them, "i hope they code." that's a reference to cardiac arrest.

that's when the two suspects marvin norwood and sanchez allegedly confronted stow and his friends. nearly all the other prosecution witnesses were not able to positively identify the attackers. this could affect how a potential trial plays out. >> the lack of a really positive i.d. isn't really a problem at this stage. these guys are almost certainly going to get bound over for trial. but at trial with a higher standard of proof, the defense attorney better have some more solid eyewitness evidence. >> if there is enough evidence brought out during the preliminary hearing, norwood and sanchez will stand trial. both men pleaded not guilty to the march 2011 beating. this morning, a man in his 20s is expected to survive after being shot by oakland police. shooting happened at 105th avenue. no word from police on how that shooting started or if the suspect was armed during the confrontation. it happened at 8:00 on wednesday night. no officers were injured in the

shooting. and the suspect is recovering at highland hospital. family and friends of a south san francisco teenager right now demanding answers this morning after police shoot and kill an eighth grader. christie smith is live at that scene. good morning. >> reporter: good morning to you, jon. you know, this memorial out here at the scene has really grown overnight from just a handful of stuffed animals that were here yesterday to just this. family and friends have gathered here at the spot where south san francisco police shot derek gaines, a 15-year-old. this started tuesday night at 9:00 when, according to police, an officer tried to stop him and a friend at a gas station. police say he and another teen were engaging in what they call suspicious behavior but didn't say exactly what they were doing. police say he ran and when an officer caught up that the teen pulled a gun and the officer fired. police say they did recover his gun but his mother doesn't even believe he had one. and friends are questioning that official version of events. south san francisco police and

the district attorney's office are now investigating. reporting live in south san francisco, christie smith, "today in the bay." police are investigating a deadly overnight shooting in east palo alto. bob redell live at the scene this morning with the latest developments. bob? >> reporter: yes, good morning to you, laura. police here are trying to figure out who shot and killed a 31-year-old man in front of his family's home in the street behind me making him the third person to be murdered in the city this year. police were alerted when shot spotter technology picked up nine gun shots at 11:44 last night, triangulated the location to a house. police arrived within a minute to find him lying in the driveway suffering from several gun shot wounds. he died about 30 minutes later at stanford hospital. investigators are interviewing family and other witnesses at the police station to get a description, if not the identity of the shooter. when we asked a relative if he wanted to talk, his response was, "talking ends you up dead."
