we did hear from one witness here at the scene. he told me that there was a fight outside of the karaoke bar before the shooting. so a lot to be determined as to what happened with the motive might be. we're still waiting for the public information officer for the san jose police department. "today in the bay." >> and this isn't the first time this year that karaoke night has turned into chaos in san jose. back in january, one person was shot, two others were stabbed outside the creekside bar and grill. all three victims survived. doesn't appear the january shooting is linked to the shooting this morning on center road. happening now live wires are down in san jose after a car hit a power pole in san jose happening at silver creek road just off of 101. we know one woman is now in the hospital with major trauma as a result of that crash. we have a crew on the way to the scene, we'll, of course, bring you updated throughout the morning as it could also affect the morning commute. this morning, concord police

are recommending a teenager be charged with vehicular manslaughter for a crash that killed a father and his 9-year-old daughter. bob redell live in concord with where the case goes now. bob, good morning. >> good morning to you, marla. ultimately up in the contra costa county district attorney on whether to charge this 17-year-old driver who police say killed a father and his 9-year-old daughter as they were riding their bicycles down the sidewalk on long tree boulevard on easter weekend. you could have probably seen in the background there, workers are still fixing the damage done to this building after the teen's cadillac escalade ran into it. he was speeding when his suv jumped the curb, hit the man and his 9-year-old daughter. his 12-year-old daughter was also hurt but survived. one factor the d.a. will take into consideration was this teen distracted when this accident happened. in other words, was he texting or talking on his cell phone?

and if he is going to be charged, will he be as an adult or juvenile? it could take the d.a. a while to announce his decision because as the police have pointed out to us, there is a lot of evidence to consider. the teenager driver is out of jail. we've also since learned this cadillac escalade was linked to a drug and weapons citation of a juvenile. this was a week before the crash. whether that juvenile was the same 17-year-old driver, police will not say. reporting live here in concord, bob redell, "today in the bay." a cyclist who struck and killed a 92-year-old woman is expressing remorse this morning. jean smith was crossing arlington boulevard and a cyclist came around a curve, saw her too late. douglas herring says he couldn't stop in time. smith died from her injuries. the cyclist says he feels horrible about what happened. the family says they have no hard feelings. >> we have sympathy for him too. >> you have sympathy for him?

>> oh, i would hate to live with that and i know he was hurt too. >> his family and friends say they would rather celebrate the life of a woman with 20 grandchildren and 28 great grandchildren and someone who lived each day to its fullest. there is still no word if herring will face charges. wrong place at the wrong time. this morning, an east bay woman is recovering after being hit by a stray bullet. police say two groups were arguing thursday night near sycamore drive in mandarin way when gunfire broke out. a woman standing nearby was hit by a bullet. police say she was not involved. she is expected to be okay. the suspects are still on the loose. the wife of embattled sheriff ross mirkarimi is fighting back accusing ed lee of misconduct after releasing what she calls private video. nbc bay area obtained court papers filed thursday by ileana lopez' attorney. this we will show you shortly is the video in question. i believe we're showing the wrong video.

there you go. you'll see it. this is shortly after that new year's eve confrontation with her husband. the video was released to the public last week. in the filing, the attorney claims the video has gone viral. because of its prevalence online. she says lopez's privacy has been shattered. we reached out to the mayor's office and he has yet to respond. a cal swim coach will be able to hold her clinic at a country club after all. she had planned to speak to the swim team at the club where she grew up. the cal coach recently went public about being a victim of sexual abuse years ago. this week, the president of the country club canceled her talk over concerns about the recent publicity. >> i want to do some things to reconnect with the community and they're not letting me and that's when i was trying to explain it to her and get the words out and that's when i broke down. >> now, people at the country club reacted quickly. and last night the club's president reversed the decision

and apologized to her. 5:04, tomorrow's graduation at contra costa county high school will be overshadowed by controversy. 51 students have been suspended for what they insist was a series of harmless pranks at the high school last week. the principal calls it vandalism. the stunts included painting messages around campus in washable red paint, tagging windows and tieing a lamb to a light pole. the suspensions will keep some seniors from taking their finals. if they can't do that, then they can't get those diplomas. the students will not be allowed to walk in tomorrow's graduation ceremony. you made it to the weekend, it is 5:05, tracking a nice forecast for us. >> yeah, you know, a lot of graduations happening today. a lot of school getting out for summertime today with an abbreviated school day. and temperatures are going to feel summer like as of this weekend. today, though, another taste of spring. 53 to start you out in livermore. still wanting to point this out,

pretty unpleasant morning as far as the incidents go. we'll take you one not on the chp blotter. two major roadways at hellyer avenue. a major accident that laura just told you about. this woman involved in the accident we're told just got the update from local police, she's still on scene. they're still treating her on scene. we had earlier reports of live wires from pg & e, as well. avoid it if you're coming through the area. but your access on to and off highway 101 is closed at hellyer. 85 closer to 237, no major slowing as a result of those. we have the off ramp of cesar chavez closed, and that slowing for 280, that's just a blip. it's no accident and no incident going on into daly city, but we'll track that, as well.

meanwhile, the markets futures are mixed this morning after the markets ran out of steam in yesterday's session, ben bernanke told congress he still expects the u.s. economy to grow modestly this year, bernanke says the fed could step in with more stimulus measures, but he offered no hints that any moves are imminent. and investors were a bit disappointed by this. that managed to overshadow yesterday's surprise interest rate cut by china, asian and european markets are lower. we do get data this morning on the trade deficit and wholesale trade. the dow rising 46 points on thursday to close at 12,460, the nasdaq losing 13 points closing at 2,831. ladies, back to you. >> hampton, we know you're a local guy. we're wondering, any local hot spots you like? >> well, let's see, wow, that's a long and short list. i'm a somewhat old school guy when it comes to san francisco

play for the giants game which you can catch here on nbc bay area tonight at 7:00. 52 degrees in san francisco, 54 in sunnyvale. 56, mild conditions in san jose. take a look at this, though, we have very impressive storm system just to our north and the pacific northwest. this is ushering in that stronger onshore flow. the weak disturbance will come through, but fall apart right over the bay area as we head throughout the day today, and that's what's going to usher in the stronger winds, especially between the hours of 3:00 and 5:00 getting gusty for your commute home. you want to take it easy out there. but a little patchy fog, 70s and 80s for today in your inland cities, 78 degrees for livermore, and 80 degrees in fairfield, here it is, your giants' forecast, 59 degrees at 8:00 p.m., going to be phenomenal weather out there, great baseball weather and that wind could carry the ball out to the cove. i believe we'll see some carry out there. hopefully in favor of our giants. 93 degrees by monday, the warm-up continues and we're going to level off into tuesday and wednesday of next week.

but you'll need to wash your car because we don't have any significant rain in the near future. if you're hopping in your car, wait one minute, here's mike first. >> you want to avoid one intersection in the south bay. construction crews clearing out. 101 at story, the southbound side construction is slowing. but right there, that's the intersection you want to avoid silver creek valley road at hellyer, a car went into a power pole. emergency crews still onscene, the victim, a lady involved in that car crash is suffering major trauma. we're tracking this intersection, but so far the volume lighter through the area, it's not yet affecting the flow of traffic on to or off of 101 either, hellyer completely cleared as far as activity through san jose. livermore, we have slowing coming in out of the altamont pass, slowing into livermore, 14 or 15 minutes and no major issues as you get into pleasanton or dublin or the interchange with 680. moving closer to the water,

and this is a live look outside. sun up over san jose, way to start your morning at 5:24. pretty clear 280/880 interchange. we'll check in with mike in a moment. 5:24. well, they are cleaning up this morning in southeastern wyoming after being hit by a tornado on thursday. take a look at this video. storm chasers captured this tornado on tape as it cut through platte county. the twister destroyed five homes and damaged 12 others. it also knocked down several power lines.

garcia-cannon. >> and i'm marla tellez in for jon kelley. police in san jose on the scene of a deadly shooting at a karaoke bar. live at the scene where police are investigating the city's 18th homicide of the year. damian, good morning. >> reporter: good morning, marla, we are in the 2100 block of center road here in san jose across the street from the big costco store. not much new information that police are revealing at this point. we did -- we do have some video we shot just a short while ago. police taking away a witness here from the karaoke bar. he was led out to the san jose police department for more questioning to find out exactly what happened here at the karaoke bar. i did hear from one witness who told me there was a fight outside of that karaoke bar at about 2:30 this morning. that fight apparently erupted into gunfire. i do see a body still lying on the ground here in the parking lot of that karaoke bar. we do know that the victim is

defendant louis sanchez kicking stow before defendant marvin norwood led sanchez away. >> the most horrible sound. i don't want to say cracking noise, but something to that effect. >> the woman who drove the alleged get away car will continue testifying today. yesterday, doreen sanchez testified that she saw blood on norwood's hand. the hearings will determine if there's enough evidence to send the suspects to trial. 5:34. a twist in the case this morning, a new lawyer will take over the defense of a man accused of kidnapping and killing 15-year-old morgan hill teenager sierra lamar. the santa clara county public defender's office says it cannot defend garcia-torres because tls also representing the suspect's father in another case. garcia-torres is fortunate the conflict of interest was declared early on.

>> the last thing you want to have happen is a year or two goes by during a prosecution and now all of a sudden the defense attorney finds himself in a conflict of interest. that would be extremely unfair to mr. garcia-torres. and he would essentially have to start over again with a new lawyer. >> someone from the alternate defender's office will now represent garcia-torres. he's being held without bail at the santa clara county main jail. 5:35, a personal trainer on the peninsula is in legal trouble this morning after a search warrant turned tens of thousands of prescription pills inside the palo alto home. ramos works in menlo park. he was arrested yesterday after investigators seized $250,000 worth of narcotics. the drugs included vicodin, percocet, and valium. investigators say the ramos was ordering the drugs from other countries then reselling them. 5:35, san francisco police

investigating another stolen bike. but this one has special significance. it's a custom made hand-cranked bike valued at $13,000. it belongs to a disabled man from poland who is in san francisco for a charity ride across the country. the bike was stolen around 10:00 on wednesday night between hayes in the hayes valley neighborhood. police say the thief used a cutting tool to get inside that building. good morning to you, it is 5:36. christina loren, your boys are back in the bay for the giants this weekend. that's what i'm talking about. >> that's exactly right, marla tellez. and you know what? they're going to be here on nbc bay area. tonight all the action starts at 7:00. and we did have a completely socked in golden gate bridge just a half an hour ago. take a look at it now. you can see both towers straight up to the top as the winds are keeping our atmosphere clear for the time being. we lose that wind, though, and you can see the moisture trying to settle in here over this live look. different perspective from the transamerica pyramid, just completely clear this morning.

new this morning, more than a dozen prisoners, some with ties to the taliban have escaped from the jail in northern afghanistan, the afghan government says prisoners escaped after a bomb went off outside prison walls overnight. guards opened fire killing three prisoners, many others were recaptured, but the man hunt is underway for 14 prisoners who managed to escape. in new york this morning, the man who admits to plotting a

bomb in new york city subways pleaded guilty to conspiracy and uses of mass destruction and other charges back in february of 2010. he told a federal judge he was trained by al qaeda. he faces life in prison without parole. and in ohio, the 17-year-old accused of going on a shooting spree back in february will be arraigned today. a grand jury indicted t.j. lane on tuesday. he's being charged as an adult for shooting and killing three students and wounding three others. well, this morning, on the brink of fiscal freefall. president obama responds to warnings that the u.s. is on an economic cliff. tracie potts is live on capitol hill this morning with the political fire storm brewing. good morning, tracie. >> reporter: good morning. part of that has to do with the taxes that go up at the end of the year that the congress and president have yet to agree on to prevent.

and the other part is more immediately, student loan rates doubling for loans after july 1st if congress doesn't act. that is what president obama was talking about before students in las vegas yet today. he called congress stubborn saying that they need to prevent this from happening. but republicans say the president's out campaigning when he should be doing his job. >> he should be here working with us to ensure that they won't double. >> there is nothing fair about a government that favors political connections over honest competition. >> meantime, former president clinton has apologized for what he says appeared to be him siding with republicans on extending those bush tax cuts for the wealthy. he said he wanted to do it temporarily but didn't understand that the decision doesn't have to be made right now. it just has to be made before the end of the year, not before the election. he now says he agrees with president obama. back to you.

>> okay, tracie, thank you. 5:43. former secretary of state colin powell is in the bay area fairly often to do consulting work for a venture capital firm. but this time around, the visit was very different. general powell stopped by our nbc bay area studios for a candid interview. in a new book, powell is re-writing a controversial chapter in american history. his now infamous speech to the u.n. in which he outlined the united states' plan to attack iraq. >> you say that the president never once had you in a room and really asked you should we go forward? >> he didn't ask any of us. not just me. >> is this book then a way to maybe cleanse your reputation? or cleanse your -- >> my reputation doesn't need cleansing. >> is it difficult to digest with the lives lost almost 5,000 servicemen and women and innocent iraqi civilians to digest your part in history of

beautiful conditions out there. 56 degrees in concord to start you out. and as we head throughout the morning hours, winds are dropping off, so we are concerned with potential for a little fog formation, especially in san francisco where the winds are now calm at this point. half moon bay, as well. but as we head through the next couple of hours, the winds are going to start to pick up. by about 8:00, we'll eliminate that fog chance. throughout the day today, high pressure takes control, after a weak disturbance comes through. this is going to fall apart as it moves through the bay area and that's going to keep your temperatures a touch cooler. a touch cooler in some cities. little patchy fog gets hotter, though, as we head through the weekend. and i want to point out some of your beach cities because it's going to be phenomenal. as you hit the beach tomorrow, not just in pacifica, 73 degrees there, calmer winds for tomorrow. 74 degrees in half moon bay. and let's fly you into the warmest beach city as per usual santa cruz will get phenomenal conditions. the boardwalk is now open. here's your extended outlook.

85 degrees by saturday, 89 degrees on sunday. 93 by monday and that summer sizzle continues by tuesday. so here's a horse you can bet on when it comes to a smooth drive getting you to work on time, ladies and gentlemen, mike. >> all right. looking over here to the city, drive into the city around the bay bridge, just fine, but continuing south off that skyway to southbound 101. first it was, now it's back. the off ramp is currently closed because of the off ramp that was damaged after the rig got detached from the trailer it was pulling. a crew has to arrive on scene. so that off ramp continues to be closed. you can use the interchange just fine. no major problems coming from the northbound side to cesar chavez. 880 we have that issue, the off ramp at oak street closed, as well. one of the accidents has cleared from the roadway, but the other one still has the sand barrel

damage and the off ramp closed. broadway is still open and that's fine as you're getting through downtown. a slower, but smooth drive, down into the 20s around el street and pittsburg, bay point, as well as coming out of the altamont pass, 16 minutes registering on your drive time through livermore and over in towards pleasanton and dublin. residents have spoken, but their voices may not have been heard after all. a ballot initiative to improve san jose libraries has hit an 11th hour road block. the group save san jose libraries was told they needed more than 19,000 signatures to get an initiative on the ballot. the group met the goal, but this week the city clerk told the group the required number of signatures would have to be tripled by next week's deadline. the group says they spent more than $100,000 to gather those signatures and say it's not likely they can get those extra signatures in time. it is 5:50 coming up, psychic stalker fish.
