and i've got one sig alert that just cleared an off ramp from oakland. other side of the bay, we have that off ramp closed. i'll sort things out for you coming up. and a live look outside. isn't that beautiful? alcatraz island, nice way to start our friday, june 8th, "today in the bay." good morning, thanks for being with us. it's 6:00, i'm marla tellez in for jon kelley. >> and i'm laura garcia-cannon. we begin with breaking news this morning. right now police at the scene of a deadly early-morning shooting in san jose. good morning. >> good morning, laura. it appears a coroner has arrived here in the 2,100 block of center road. this is a trs is a strip mall, industrial area. the shooting happened at about 2:34 this morning and police arrived, pronounced the victim

dead at about 2:53 this morning. all we know is that he is a 24-year-old male. he was outside of a karaoke bar. one witness told me that he heard there was a fight outside that karaoke bar, and then the shooting. i did go out to the parking lot area and there is the body still lying out in that parking lot area. however, the coroner has arrived and so the crime scene should be cleared, i would say within the next hour or so. they have not identified the victim. they are still waiting to notify kin before they do that. but i asked one of the commanders out here if the suspect was still at large or if he was in custody. all he would say is that we are pursuing some initial leads and can't really say much at this point. we've been waiting for someone to talk to us at this point, the public information officer or one of the commanders out here at the scene. it's kind of unusual for the san jose police department not to provide someone in cases like this. they're usually very good at something like that. in fact, they've gotten a lot of training on how to speak to the

media before we can in turn relay that information to you at home. what we have is one person dead, not sure if the suspect is at large or in custody. we'll keep you posted. for now we're live in san jose, "today in the bay." >> thank you very much. and this isn't the first time this year that the karaoke night turned into chaos in san jose. one person was shot, two others stabbed outside the creek side bar and grill on west alma avenue. all three victims survived. it doesn't appear that that the january shootings are linked at all to the shooting this morning on center road. crews are starting to clear the scene of a crash in the south bay. a car slammed into a power pole this morning bringing down power lines. we now know, though, those wires are not live. one woman has major trauma as a result of this crash. we have a crew in route to the scene. and we'll bring you updates as soon as we get them. well, this morning, a concord teenager could be a step closer to facing charges in a

crash that killed a father and his 9-year-old daughter. bob redell is live at the scene of the easter weekend accident with what police are recommending. bob, good morning. >> good morning to you, marla. well, concord police are recommending vehicular manslaughter charges. now it's going to be up to the d.a.'s office to decide whether they want to charge the 17-year-old driver with that charge or whether they want to charge them at all with regards to the father and daughter who are hit and killed on this sidewalk near oak grove road on easter weekend. you can see that workers are still fixing the damage done to this building after the teen's cadillac escalade rammed into it. police say he was speeding down tree boulevard when his suv jumped the curb and hit solomon and his 9-year-old daughter. this was on easter weekend as i mentioned. both of them were killed. his 12-year-old daughter was hurt but did survive. one factor the d.a. will take into consideration, just try to figure out, was the teen distracted when this accident

happened? in other words, was he texting or talking on his cell phone? and is if he is going to be charged, was he an adult or juvenile? it would take the d.a. a while to announce their decision. because as police have pointed out, there is a lot of evidence to consider. that teenage driver is out of jail. we have learned this cadillac escalade was linked to a drugs and weapons citation of a juvenile the week prior to the crash. whether that juvenile is the same juvenile as the 17-year-old driver, police have not said. reporting live here in concord, bob redell, "today in the bay." a cyclist who struck and killed a 92-year-old woman is expressing remorse this morning. jean smith was crossing arlington boulevard near brewster drive and a cyclist came around the corner and saw her too late. he yelled to alert smith but could not stop in time. smith died from her injuries. the cyclist says he feels horrible about what happened. the woman's family says they have no hard feelings.

>> we have sympathy for him too. >> you do have sympathy for him? >> oh, i would hate to live with that. and i know he was hurt too. >> smith's family and friends say they would rather celebrate the life of a woman with 20 grandchildren and 28 great grandchildren. and someone who lived each day to its fullest. there's no word if herring will face charges. 6:05, wrong place at the wrong time. this morning, an east bay woman is recovering after being hit by a stray bullet. police say two groups were arguing thursday night near sycamore drive in mandarin way when gunfire broke out. a woman standing nearby was hit by a bullet. police say she was not involved at all. but she is expected to be okay. the suspects are still on the loose. the wife of embattled san francisco sheriff ross mirkarimi is fighting back, accusing mayor ed lee of misconduct after releasing what she calls private video. nbc bay area obtained court papers filed thursday by ileana

lopez' attorney. right here, this is the video in question showi inin ining lopezr new year's confrontation with her husband. the video was released to the public last week. the video has gone viral and any attempt to secure a protective order is pointless because of its prevalence online. she says lopez' privacy has been shattered. we have reached out to the mayor's office, he has yet to respond. the man accused of murdering morgan hill teenager sierra lamar has a new lawyer. attorney ken mandel will no longer defend antolin garcia-torres. a conflict of interest was declared after it was discovered the office was also representing garcia-torres' father. he's charged in an unrelated case. the alternate defender will take over the garcia-torres case. well, tomorrow's graduation at a contra costa county high school will be overshadowed by controversy.

51 students have been suspended for what they insist was a series of harmless pranks at brentwood's heritage high school last week. the principal calls it vandalism. including painting messages around campus in washable red paint, tagging windows, and tieing a lamb to a light pole. the suspensions will keep some seniors from taking their finals. without their finals, they cannot receive a diploma. the students will not be allowed to walk in tomorrow's graduation ceremony. 6:07. apple's icloud led police to a pair of teen suspects. a 15-year-old and 16-year-old girl for burglary for stealing an ipod back in may. they found them after the suspects took a picture of themselves. that automatically uploaded to the owner's cloud account helping the owner and police locate the pair. well, the weekend is here, so is meteorologist christina loren with a look at our forecast today. >> i always come in a little

more quiet right before the weekend, right? take a look at this stunner this morning, just beautiful out there. but i wanted to point out a couple weather observations. you see, a little bit of moisture in the atmosphere here. and this camera has a bit of a shake to it. the fog is trying to form. and as you can see, you're seeing some of that fog drifting by, visible with the naked eye this morning. it's not able to develop because we still have some pretty strong winds in the bay area. so that is a great-looking sign that we're going to get a lot of sunshine throughout the day today. 58 degrees in san mateo to start. one thing we have to deal with in the winds and the dry pattern we've had. we still have a moderate pollen count. keep that in mind. winds will strengthen throughout the day today. you see the pinks and reds are on the high end and 4:00 p.m. getting very gusty, but by tomorrow morning, those winds will start to drop off substantially. 5:00 a.m. tomorrow waking up to a nice calm morning and temperatures tomorrow are going to soar. so 72 degrees at noon today, 78 degrees by 4:00 p.m. adding an additional ten degrees

to your high and warmer for sunday. the seven-day in my next report. first, mike, how busy is it on a friday morning? >> it's a pretty standard friday flow, but a lot of incidents to report because of key eshs out there. one of those, southbound 101 at cesar chavez going to continue until 9:00 this morning. caltrans has requested the continued closure of the off ramp until then so they can repair guardrail. early this morning, they had a postal truck pulling the trailer, the trailer, well, basically disconnected from the rig and that's what caused the damage there. the off ramp's still closed on that side of the bay. 880 northbound at oak street, that off ramp reopened. told you about that earlier just before the end of last hour's show and a smooth drive as we're heading past the area through downtown oakland. no more slowing there. we'll show you the south bay for slowing northbound 101, standard just north of 680 because of the flow of traffic. we have the activity on center road just north of tully where damian is following the

overnight shooting and police activity there, so keep that in mind. and also, the bottom of your screen, wires down the earlier accident. silver creek valley road, an active scene, across that intersection if you can, guys. back to you. >> talking about slow traffic, mike. from soma to slowma, the drivers in san francisco will have to slow down a bit today. the city's actually lowering the speed limit on four major streets in the area from 30 miles an hour to 25. affected streets, howard, folsom, harrison, and bryant. it goes into effect immediately. time is ticking to pick up the tab with a power lunch with a billionaire. warren buffett is auctioning off a lunch date on ebay. the money benefits the glide foundation which helps the poor and homeless in san francisco. bidding ends tonight. right now, 82 people have actually bid on the lunch. the highest bid so far is $410,000. keep in mind the big bids

fourth reported mass slaying in the last two weeks. at least 10,000 people have been killed in the 15-month uprising. activists say the number is even higher. more teens are smoking marijuana than cigarettes according to a new government survey. the centers for disease control and prevention says 23% of high school students said they smoke marijuana, 18% said they smoked cigarettes. the number of teens who smoked tobacco have been falling for decades, marijuana use has fluctuated. last year was the first time marijuana use was clearly higher. a cal swim coach will be able to hold her clinic at a country club after all. kristin kunan had planned to speak to the club where she grew up, the cal coach recently went public about being a victim of sexual abuse years ago. this week, the president of the country club canceled her talk over concerns about the recent publicity.

horses winners. doug o'neill, the trainer for i'll have another breaking with that today and actually bringing his horse out early just as the sun was coming up here at 5:30 or so, i'll have another got out on the track, did a brief jog for about half of a lap and then a gallop, not getting into a full sprint. and that's it. that's the last time the horse will circle this mile and a half oval until tomorrow evening. he had been running a bit later in the morning between 8:30 and 9:00. but what they said was it's very crowded getting out of the barn area here, that there's a lot of things going on at that time of the day. and they wanted their horse to have a clear mind and get a lot of rest before the race. something, i guess, that we all need, laura and marla, for tomorrow's race here at belmont. that's the latest. back to you. >> it's going to be a lot of fun. i'll be curious to see what that jockey is doing in preparation, as well. you can find out if i'll have another will have another claiming the triple crown live tomorrow right here on nbc bay

onshore flow, but that fog is just not able to develop and move inland and that's because we have some strong winds. so they're kind of keeping the fog from developing. and that fog, i don't even think that fog will breach the coastal mountains of santa cruz, 51 degrees, 51 in san mateo, and that wind has strengthened yet again in san francisco. northwest at 5 miles per hour. that's the direction that takes the ball out to the cove. you want to keep that in mind when it comes to future games, getting a little scientific when it comes to baseball. area of low pressure is actually pretty significant area for this time of year, not going to impact us all that much. it's what brought the fog back, though, a little disturbance as it makes its way through the bay area for today. and as a result, your temperatures will be just about as warm. they will keep from soaring, though, until tomorrow. hot weekend on tap. you'll likely to have to use your heater in the morning hours, but then turn it off for the second half of the day. and if you live inland, you

"today in the bay's" tracie potts is live on capitol hill. good morning. >> marla, good morning. if we're on a financial cliff and there are two big bolders on the edge of that cliff, one of them is taxes. your taxes will go up at the end of the year if congress does not act. and right now the president and congress are not in an agreement on whether or not the wealthy should continue to get that tax break. also, student loans, those rates after july 1st set to double if congress does not act. that is what president obama was talking about out on the west coast yesterday in las vegas to students there. he said that congress is stubborn in terms of not having

we continue to follow breaking news out of the south bay this morning. police in san jose are investigating a deadly shooting at a karaoke bar. live at the scene where police say a 24-year-old man is dead. damian? >> reporter: well, what we know so far, the details are very slow in coming out here to the command post out here. we do understand that the coroner has just removed the body of the victim at this point, and he is a 24-year-old male. what we know so far is that the first call came in at about 2:34 this morning. one witness told me there was a fight outside of a karaoke bar here in the strip mall at the 2,100 block of center road. at that fight, gunfire and the victim lay dead on the ground when police arrived. they found him dead here at the scene. he was laying out on the parking lot of this karaoke bar for the last three hours or so. they have not identified the victim, and when i asked one of the commanders out here at the crime scene if they were still

looking for a suspect, the gunman if you will, he said they're still pursuing initial leads and they don't want to give out too many details at this point. the crime scene here should be cleared in the next few minutes or so. because now that the body is gone, the crime scene is now will be -- the crime scene will be cleared off within the next few minutes or so we're being told. and so just a wait and see, we don't know much information to report other than that. one man dead, 24 years old, san jose's 18th homicide. for now, live in san jose, "today in the bay." police still at the scene of a major accident in south san jose. we've actually got live pictures from the scene. it happened at silver creek valley road near hellyer avenue. take a look at the damage to the car. there was a woman in it, she hit a light pole and that car flipped over, completely crushed there. we understand that police are still on the scene this morning waiting to get that car removed

as they continue their investigation. 6:32, testimony in the preliminary hearing for the bryan stow case should where wrap up today. thursday, a woman who saw the brutal attack outside dodger stadium has become the first eyewitness to identify the two suspects in court. testifying yesterday, mary donnelly said she heard a horrible noise and saw stow's head hit the ground. she then saw defendants louis sanchez kicking stow before defendant marvin norwood led sanchez away. >> it was the most horrible sound. i don't want to say cracking noise, but something to that effect. >> now, the woman who drove the alleged get away car will continue testifying today. yesterday, doreen sanchez testified that she saw blood on norwood's hand. the hearings will determine if there's enough evidence to send the suspects to trial. another lawyer will take the case as a man accused of kidnapping and killing 15-year-old morgan hill teenager sierra lamar.

ken mandel will no longer defend garcia-torres. the office says it cannot defend garcia-torres because it's also representing the suspect's father in another case. garcia-torres is fortunate the conflict of interest was declared early on in the case. >> the last thing you want to have happen is a year or two goes by during a prosecution and now all of a sudden the defense attorney finds himself in a conflict of interest. that would be extremely unfair to mr. garcia-torres. and he would essentially have to start over again with a new lawyer. >> someone from the alternate defender's office will now represent garcia-torres. he's being held without bail at the santa clara county main jail. a 15-year-old boy shot to death by police in south san francisco. the family of derek gaines has hired attorney john burress to look into this case. burress has been a player in several well-publicized police

shooting cases including representing the family of oscar grant. gaines died tuesday night. police say he was carrying a gun when he ran from police. 6:35. concord police are recommending vehicular manslaughter charges be filed against a teenage driver who hit and killed a father and his 9-year-old daughter on easter weekend. bob redell live from concord. what's next in this case, bob? >> reporter: well, this goes to the hands of the d.a.'s office. they've got to decide, a, do they want to charge this teenage driver? b, if so, is he going to be charged as a teenager or an adult? and c, are they going to take the recommendation from concord police to charge him with vehicular manslaughter. he's accused of of hitting and killing a father and daughter who were riding their bikes on easter weekend. the damage still needing to be repaired, the cadillac escalade the kid was riding in was slammed into -- police say he

even up in novato, by noon, temperatures in the 60s and low 70s inland and we'll round out the day with the 80s in the warmest inland cities across the bay even with an area of low pressure, broad area just to our north. now, what will happen is we'll see a weak disturbance come through as we head throughout the day. it's going to fall apart once it gets into the bay area. for us, that's going to keep the winds in place. keep that medicine handy or limit your outdoor activity for one more day. by tomorrow, though, high pressure takes control. we're going to lose a lot of that wind. it will get very warm, though. temperatures in the 90s. and don't forget, you can catch those giants right here on nbc bay area tonight. it's going to be a big game. we have full coverage for you starting at 7:00. and i think winds will be a factor. pretty strong winds expected between 15 and 20 miles per hour out of the west-northwest that could carry that ball straight out to the cove. and tomorrow, adopt-a-thon. if you've ever thought about adopting an animal, we are seeing shelters across the area

possibly noon. there will be confusion on the streets. all in the area, just plan on delays and avoid that interchange just under 101 if you can because that's what's going on after the early morning accident involving the trailer that dislodged from its big rig there. also 880 northbound at oak street, just got word that they may have to close that off ramp yet again after another accident. this time a hit-and-run happening there and maybe one lane closed as you're approaching. but no major slowing through the area. we do have some slowing here because of the metering lights held up at the toll plaza, that's pretty standard for the bay bridge, though. slowing northbound 238, as well, just as you're approaching the flyover, an accident happening in the last few minutes causing considerable slowdown back to 580. we'll continue to follow this scene, this car overturned, the pole taken out there as they had a collision at westbound silver creek valley boulevard, silver creek valley road approaching hellyer. it is open past the scene. >> i heard that car is actually a truck.

account helping the owner and police find the two. a personal trainer on the peninsula is in legal trouble this morning after a search warrant turned up tens of thousands of prescription pills inside his palo alto home. works at peak performance gym in menlo park. he was arrested yesterday after investigators found $250,000 worth of narcotics in his home. the drugs included vicodin, percocet, valium, along with steroids and the drug ecstasy. the investigators say ramos was ordering the drugs from other countries and reselling them. the wife of ross mirkarimi is fighting back. she's accusing mayor ed lee of misconduct after releasing what she calls private video. nbc bay area obtained court papers filed by ileana lopez' attorney. the video in question shows lopez shortly after her new year's eve confrontation with her husband. the video was released to the public last week. now, in the filing, the attorney

claims the video has gone viral and any attempt to secure a protective order is because of its prevalence online. she says lopez' privacy has been shattered. we reached out to the mayor's office. he has yet to respond. this morning an east bay woman is recovering after being hit by a stray bullet. two groups were arguing thursday night near sycamore drive and mandarin way when gunfire broke out. a woman standing nearby was hit by a bullet. police say she wasn't involved and she is expected to be okay. the suspects are still on the loose. the man accused of murdering sierra lamar has a new lawyer. attorney ken mandel will no longer defend garcia-torres. the public defender's office declared a conflict of interest after it discovered the office was also representing his father. garcia is charged with 13 counts of child sex abuse in an unrelated case.

the alternate defender will take over the garcia-torres case. concord police say they've completed their investigation, and this morning, they are recommending manslaughter charges against a teenage driver who killed a father and daughter. bob redell live with what happens now. good morning, bob. >> well, good morning. it goes to the d.a.'s office, it will be up to the district attorney's office on whether to charge this 17-year-old driver with vehicular manslaughter for the deaths of a father and his 9-year-old daughter who are riding down the sidewalk on easter weekend. you can see that workers are still fixing the damage done to this building after the teen's cadillac escalade rammed into it. police say he was speeding down the boulevard here when his suv jumped the curb and hit soloman nuri and his 9-year-old daughter. both were killed, his 12-year-old daughter was also hurt, but she survived. one factor the d.a. will take in consideration, was the teen
