>> good morning to you. yeah, we've got a warmer day on tap for today by 10 to 15 degrees but we're starting out nice and crisp. 54 degrees to start you out in san jose. 54 in san francisco. the 90s have returned in the forecast for today it's going to be warmer tomorrow, and then temperatures tumble. we'll take you through the full forecast. first, let's check your drive. >> not a lot of cars out there but a couple of incidents. the first one is northbound highway 13 at broadway terrace approaching 24, an accident blocking a lane. the light volume gets by fine. construction at fish ranch as you head westbound on 24. the on ramp is affected. we'll look at the toll plaza which is not affected by much except for the lanes to the right, there were a few cars waiting in the cash lane. starting to form again. looks like at least at one of the toll plaza openings not functioning. folks have to move to the next

lane. back to you. >> thank you. new this morning sheriff deputies are trying to track down the person who posted a comment on facebook claiming to be sierra lamarment deputies say someone posted a photo of an apparent post with the missing teen's name and sent a message, please call the police, he's coming back. then gave an address in saratoga. deputies say they investigated for several hours and the address does not exist. in the meantime, they are using new equipment to rescan the reservoir for any sign of the morgan hill teen. they are hoping to find clues that may have been overlooked in previous searches. it's three months since sierra disappeared on the way to school in morgan hill. police arrested torres and charged him with kidnapping and murder. >> camping out overnight trying to save kids schools. >> lake view elementary is one of five to be closed the end of

the year. stephanie chuang is live at the campus where parents are defying police orders now to leave. good morning. >> reporter: good morning, laura. it was not 24 hours ago that they had warnings, you're trespassing, you have to leave or face jail time. but there are still the nine or ten on campus, people inside and a few on the corner, standing guard acting as security. so the big question is, when will the district actually enforce this warning? i'm joined by kind of the face of the lead parent organizer. we were talking yesterday when the police from the district came with the flyers. what kind of effect has that had on the people here? >> i think that it shows tony smith and a blatant disregard for parents and teachers and students and where they put the property and administrators before what these schools are

intended for. it was handled very poorly. i know you got it on camera but they snuck in through the back gate and scared a bunch of parents and teachers, came in force, we were just about to start a summer school program and you know, the parents were in the parking lot. it was handled poorly. again that was tony smith's call, our superintendent, he put our officers and campus police in a hard position. >> as we speak there is an officer from the district across the street just kind of watching, maybe keeping guard. it's clear the district is keeping an eye on the camp here. are you prepared to face jail time? is that necessary? >> nobody wants to be arrested. but we believe in this cause because this is for our children and society. we have soldiers that go to war and give their lives for something they believe in. sometimes for something they don't believe in. i don't think spending a few hours in jail for some of these parents is going to be the end. compared to something like that that our wonderful people and

citizens in this country do. so that's not -- we shouldn't do that, we've been protective around the building but you know, i think it's time that police officers start protecting the people that they are meant to protect and not following orders to protect buildings. >> reporter: thank you so much. appreciate it. you can see not leaving any time soon. in fact, they went in the building yesterday with the first day of their summer school. again, no signs of leaving. live in oakland, stephanie chuang, "today in the bay." >> 4:35. parents came out in droves in east san jose demanding better education for their children. hundreds packed the community center to ask officials from the alum rock school district to replicate the high performing charter schools. the list of children waiting to get into those schools is in the hundreds. the parents say it's just not fair to those who don't get in. >> to ask for better school because you know, historically, it's not a popular thing to do,

and especially the family out there that cannot speak for themselves. >> alum rock's interim superintendent who just started the job last week says he is hopeful alum rock's school can look at the charters and replicate things like longer school days and individual learning. >> the motive behind two fires, one which destroyed a home, might abrelationship breakup. police arresting a 19-year-old last wednesday accused of setting fire to his ex-girlfriend's house not once but twice. the girl's mother says the first fire happened just after her teen daughter broke up with kramer. he posted a half million dollar bail and is out of jail. the mother says she is relieved an arrest has been made. >> a couple of bay area families mourning the loss of two men after a boating accident on father's day weekend. the small two-man fishing boat

capsized on saturday. johnny johnson and acemoore pittman died. a third man was rescued by a passing boat. the two victims leave behind a combined 17 children pittman's family celebrated his life. >> he's smiling. >> quite the fisherman. san joaquin county deputies don't know how the three ended up in the water but none of them were wearing a life vest. if you would like to help the families we have information on our website nbcbayarea.com. >> 4:37. a man is recovering after he was attacked with a taser and robbed in san francisco. police say the man was walking home near great highway and noriega street when he lost consciousness. he woke up to find his wallet and ipad had been stolen, there was a taser on the ground next to him. >> the ethics commission meets

again on the case of suspended san francisco sheriff ross mirkarimi. the board is considering his request to remove him from office. the sheriff pleaded guilty a false imprisonment charge after he bruised his wife's arm during an argument. the commission will look at a written statement from mirkarimi's neighbor describing a conversation she had with lopez after the argument. madison says lopez described much more physical abuse than what has been publicized. >> palo alto's animal shelter is safe for now t the counsel voting to pass a budget. the city was looking for funding. the budget allows the shelter to stay open. managers warning cuts are coming. the city council's next financial reports will likely include layoffs.

>> let's check the forecast now with meteorologist christina loren. how are we looking? >> looking pretty good. you've got the kids home with you for summer, you might want to take them to the beach. a little on the warm side inland. we're starting out with almost uniform temperatures, same in san francisco as in san jose, sunnyvale 55. temperatures are going to climb to the 90s, we're starting in the mid-50s. the warmest cities across the bay, 80 in oakland today and in san francisco we're talking about the upper 70s. so perfection later on. breezy conditions, that's what's preventing the fog from getting that dense. there's not much out there. there is a little mist out there. keep that in mind. whatever does form is not going to last as the winds pick up and continue to push offshore. 80 degrees at noon, 90 at 4:00 p.m. bayside 74 degrees at noon. 65 degrees at the coast. round out the day at 70,

welcome back. a live look at the courthouse in bellefonte, pennsylvania right now, where the jerry sandusky stril going on. the former penn state head coach has defense into day two of testimony, a trial that had a very emotional and at times graphic set of testimonies. as we said the trial of former penn state coach jerry sandusky is moving faster than a lot of people expected. the defense could wrap up as soon as tomorrow. yesterday another former assistant coach, richarding tha like sandusky, had actually

showered with young boys. the defense argues it's part of, quote, football culture. but on cross-examination anderson admits he had never hugged young boys in the shower or stayed with them in hotel rooms. >> the defense quite honestly has little to say. the character references, the character witnesses, have almost nothing to say. it takes very little time to say nothing. >> the defense has not hinted whether sandusky will testify in his own defense, closing arguments are planned for thursday. >> 4:45. the g-20 summit in mexico wraps up today with much of the focus on president obama. the president bet russian president putin to discuss the violence in syria. lawmakers in washington are pushing the administration to get russia's support and avoid putting the u.s. troops in syria. there is also pressure on leaders to get greece's economy back on track. the vice president will visit the monterey peninsula tomorrow

gone through a housing boom and bust. we'll get data on housing starts and building permits, so watch for that. the fed begin as two-day policy meeting. the dow fell yesterday t nasdaq gaining 22 to 2895. the government is launching an online data base to track credit card companies. the site will let users see what type of complaints have been issued against banks. you can see how banks responded to claims. it may include mortgages, student loans and bank accounts. microsoft unveiled its own line of tablets it's calling surface. there are two versions, a lighter one and a heavier device aimed at the light weight lap tops. they run on new windows 8 mobile operating software, have a 10.8 inch screen and come with an attachable key board and kick stand so you can set them up on a table top.

windows 8 goes on sale this fall. >> thank you very much. >> the federal government is extending its investigation into fires in cars made by toyota. it's focusing on the design of a power window switch installed in 2007-2009 camrys, rav4s and yaris subcompacts. the 2008 highlander hybrid are being investigated. the probe was launched in february and include nearly 1.5 million toyotas. investigators say the switches can overheat and spark electrical fires in the driver's door. toyota says it received more than 150 complaints. >> we get back with meteorologist christina loren. and another beautiful day in the neighborhood. >> a beautiful day. we kick off summer tomorrow. it's going to feel summerlike. even today as well. then temperatures, they come down by about 20 degrees and

level off all the way to the weekend. holding on to the 70s. so, the first week of summer is going to be much cooler than average. wait till i get to the seven-day forecast. plans for the weekend, tuesday, not too early to start thinking about the weekend. temperatures this morning in the 50s, if you wanted to do any outdoor activity if you are waking up in the east bay, tri-valley, san jose, probably want to get out early as we're going to start warming up rapidly. the sun's going to come out in about an hour, as it does temperatures will start warming with full sunshine inland and a little marine layer formation hugging the coast. 52 in san mateo where we're at 55 in santa cruz. later on today santa cruz the beach city of choice with 80 degrees in the forecast. winds are going to shift out of the north-northeast, that's the offshore flow. for us, that's a major warm-up from yesterday's highs. yesterday was beautiful, we only broke into the 80s, even the warmest across the bay the low 80s. today the low 90s return, breezy

conditions as well. then tomorrow, peak warmth appropriately for the first official day of summer. today 90 degrees at 4:00, 80 bay side and 70 degrees at the coast. summer begins tomorrow. 92 degrees, then we bring you down to 75 degrees thursday. we hold on to mid-70s all the way through the upcoming weekend and the first part of next week. so temperatures taking a significant dive all your summertime activities that you like to do outdoors probably want to get those in over the course of the next two days. back to you. >> thank you. this one became a bit of a side show but no charges for the bird man who interrupted that u.s. open trophy presentation. the guy's name, a bit of a clown, 40-year-old andrew dudley. there he is, get out of the way. got up in front of webb simpson and got yanked. that was sunday. made a little bit of a bird call. dudley called himself a jungle bird. the stunt was -- yeah, of course. is meant to raise awareness about global deforestation.

85 between evelyn where the on ramp is closed for the next half hour, to stevens creek to the south. the stretch has spots of road work but at most one lane is blocked. not a lot of slowing. northbound 17 and 880 out of well, campbell through san jose but no incidents reported. i see the slowdowns shifting so the averages are adjusting. we're looking at 101, limited traffic traveling north through menlo park. watch marsh, they may have that closed. 29, southbound with the truck fire. it's still there at tubbs lane. >> dogs and owners preparing for a pageant. >> we've got to add knit is not your typical beauty pageant. the uglier the better. >> it comes natural. i have to work at it. takes me a few minutes in the morning to get ready.
