i'm laura garcia-cannon. >> good morning everybody. i'm jon kelley. and new this morning, santa clara county deputies investigating a mysterious internet posting with sierra lamar's name on it. the picture claiming to be sierra appearing on her personal facebook page. marla tellez is live at the sheriff's office in san jose with an update what investigators are saying about this post. good morning. >> reporter: jon, good morning. i can tell you that investigators are saying that this facebook post is a hoax. this is straight from the department behind me here, and the post has been deleted. we can give you a look at the original posting that appeared sometime before midnight on sierra lamar's facebook page. it appears to come from the missing 15-year-old. it says, quote, please call the police, he's coming back. then an address in saratoga, about 30 miles from morgan hill where lamar was last seen on march 16. she is missing over three

months. the sheriff's deputy saying the deputies have checked out the physical address, they say it is not real. we ran our own search on map quest and the address comes up, but it does not belong to an actual existing property or any sort of home. the interesting thing is the street that's listed does, in fact, exist in saratoga. you can imagine the posting has caused alarm and even excitement on her facebook page, some friends writing like i hope this is real, we miss you. again, deputies saying this is only a hoax. it was back in april about a month after sierra went missing that someone hacked into her twitter account, again deputies say that instance was also fake. as for who is responsible for this latest hoax, well, at this point it is not known. we are waiting to hear back from the spokesman here at the sheriff's department to see if they were going to continue

investigating that portion of this. live in san jose. marla tellez, "today in the bay." >> a driver shot in the neck on interstate 580 still in critical condition this morning. now oakland police hope a $15,000 reward will help them catch the shooter. this is a follow-up to a story we brought you yesterday. 26-year-old man was shot driving east on 580 near the fruitvale avenue exit sunday night. the victim's brother was not hurt. police shut down the freeway for several hours to investigate. any one with information should call police. this morning two peninsula men behind bars accused of trying to run down bike riders with their truck. boys telling the police that the two tried to hit them sunday afternoon. one of the boys had to jump off of his bike to avoid being hit when the driver came at him. the suspects both are booked in san mateo jail. >> two families are mourning the

loss of two men in a boating accident on father's day weekend. the two had gone fishing in the delta saturday. the boat capsized, tossing them and a third man into the water. their friend was rescued. but johnson and pittman drowned leaving behind a total of 17 children. pittman's family celebrated his life. >> he's here. he is smiling with two gold teeth. >> deputies say they don't know how the three ended up in the water but none of them were wearing life vests. if you would like to help the families find out how by heading to nbcbayarea.com. >> also this morning an east bay couple accused of stealing hundreds of credit card numbers and going on a shopping spree. under arrest, the deputies

searched the couple's home and found hundreds more cloned credit cards. investigators say there could be as many as 500 victims in this case with hundreds of thousands of dollars in losses. >> california lawmakers passed a budget but the wrangling over cuts is not over. democratic leaders resist governor brown's proposal to restructure the state's welfare program. brown wants deeper cuts to ease an estimated $15.7 billion shortfall. he want as rigorous welfare to work program that would cut off benefits until certain requirements are met. democrats want to extend cuts but critics say the savings doesn't go far enough. >> more happening now. leave or face arrest, that was the message teachers, parents and activists at lake view elementary. stephanie chuang is live where the protesters are still at this point refusing to leave. good morning.

>> reporter: jon, good morning. that's right. day five since they have been out here since friday, at last check about nine tents in the yard. a few on the corner acting as security. across the street there is a school district police officer keeping watch. here there is an air of concern if the and when the district will order its police officers to come in and enforce that trespass warning. they had flyers warning protesters to leave immediately, duant come back for 30 days or risk getting arrested. >> campus police showed up and handled the situation poorly. scaring a lot of parents and teachers and students, handing out whatever notices that they put out. >> it's not something that we want to do. this is something that we are trying to do in an effort to help prevent to make any arrests. >> reporter: that was from the police sergeant yesterday. the protesters were given a

couple of days but now are trespassing. they may be escorted off the property f. they don't comply, possibly arrested. the thing is there are kids in this camp with their parents and teachers and activists. there are safety concerns should there ever be a confrontation with police. >> parents are calling for major changes at their children's middle school. hundreds packed the community center demanding the alum rock union district replicate the handful of high performing charter schools. half of the eighth-graders test proficient in english and math, many are testing above grade level and are college bound. hundreds of children are waiting to get in. parents say it's not fair to those who do not get in. >> to ask for better school because historically it's not a popular thing to do. and especially the family out

there that cannot speak for themselves. >> alum rock's new interim superintendent who just got on the job is hopeful that alum rock's traditional schools can replicate longer school days and individual learning. >> city leaders expected to adopt a new budget t the $135 million spending plan chuds staff reductions, program cuts and fee increases. this is meant to help close a $2 million deficit. leaders admitting it will not address the need of maintenance of roads and city facilities such as pools. if you want to go to tonight's meeting it's at city hall at 7:00. >> palo alto's budget includes funding for animal services. it was threatening to outsource its shelter after one of its partners backed out. the council members found some money. while it does allow the shelter to stay open, leaders warn that cut is still coming including

up 4% from last year. people are encouraged to hit the road as gas prices have dropped. aaa expecting gas to average $3.57 a gallon. the futures are higher after stocks lost ground on monday though the s&p 500 did extend its gains no. relief rally after the greek elections as investors turn to other trouble spots, mainly spain. yields hit record highs as loans on the books of the country's banks climbed to the highest level in more than a decade. like in the u.s. spain has gone through a housing boom and bust. here we're going to get data on housing starts and building permits so watch for that. the fed begin as two-day policy meeting. the dow fell to 12,741. the nasdaq to close at 2895.

and if you want to get your feet in the sand, go ahead and hit the beach. we'll get some great beach days, then temperatures tumble into the 70s. i'm talking about the low to mid 70s inland and a stretch of cooler than average weather that extends all the way from this upcoming thursday through monday. i wanted to point out we're in good air quality range. throughout the day today, temperatures are on the mild side. we're starting out in the 50s so temperatures are cool to start. headed toward the 70s at the coast t 80s bayside and the 90s, the return of the low 90s and some of your inland cities. pull up a live picture, i want to show you the golden gate bridge and how fog is starting to settle in a touch. we're not dealing with as much as we had yesterday so temperatures in the 50s to start. throughout the day winds play a factor, more northerly. that's the downsloping winds that create a concern when it comes to fire danger. 5:18. you can see how clear it is.

that's an indication of how warm it's going to be. let's get to the maps. warm conditions courtesy of high pressure moving in. this ridge of high pressure is only going to hang around for two days. a warm-up, then temperatures tumble. as you make those plans, maybe you have the kids home, today is a good one for the beach. tomorrow is good for the beach, then you want to stay inland. 75 by thursday, mid 70s friday, saturday, sunday. even as we kick off next week, staying below average. you think about it like this. 79 degrees in livermore where the average is 85 degree this is time of year. so a cooler trend finally getting the june gloom at the end of the month. >> we're looking to the south bay where we have a change going on. construction crew pretty much picked up but we still have the crew blocking that on ramp. we'll watch for that but no big drama. 880 and 17, both had slowing.

that has cleared. moving clearly 101 around 680 and 87, a couple of the first to show you slowing. not there yet. the slowdown out of the altamont pass, 15 minutes into livermore. where it's yellow are in the 40s and 50s so starting that dip through the area. but a smooth dry through the dublin interchange. not a big concern as volume is starting. we're looking at a smooth drive through that zone and up to danville and the walnut creek interchange. highway 4 a couple of things. eastbound, a closure has construction crews there for a half hour. westbound, that blip kicking in for the 49 as well. the commute has started for the east bay. the bay bridge toll plaza with no big drama. an easy drive.

>> i'm laura garcia-cannon. new this morning, brief hope turns into another hoax in the search for sierra lamar. someone pretending to be sierra posted a picture and disturbing message. marla tellez is live at the sheriff's department where investigators spent time trying to check it out. good morning. >> reporter: laura, good morning. you referenced it. this is not the first time that this has happened. you may recall it was in april when someone hacked into sierra's twitter account, that was determined to be a hoax, this time it seems to be a similar situation, but this time it's a whole lot eerier. look at the original posting that was left on her facebook page. it appears to be from her, you see her picture there. and it says, quote, please call the police he's coming back. then it goes on to list an address in saratoga. deputies have checked out the post and the location and say it's only a hoax, according to

our own map quest search t street does in fact exist but the physical address does not. the 15-year-old was last seen about 30 miles south of saratoga in morgan hill. she was last seen on march 16 so just over three months ago. investigators are not saying who is responsible for this latest post but one thing that's for certain it's stirring up a lot of reaction on her facebook page from friends not giving up hope. marla tellez, "today in the bay." >> thank you. in the meantime, dive teams have been searching for any sign of the missing teen using new sonar equipment in hopes of finding clues that may have been overlooked. the investigators are careful to point out this new search is not based on any new lead. it has been three months since sierra disappeared on the way to school. police arrested a man with

kidnapping and murder. >> a man who once cared for vulnerable children behind bars on child predatory charges. the investigators say joaquin bailey sexually molested two young girls in his care as well as an 18-year-old woman with the mental capacity of a kindergartener. bailey worked as a staff member at the eastfield ming quong facility in los gatos which houses children who are dpe dependents of the court. >> the family of a young girl who died tragically over the weekend is asking for help to pay for her funeral. tatiana wandered out of the house and drowned in a lagoon. neighbors held a vigil for her a few hours later.

her father works as a security guard. in addition to raising two older children t family cares for tatiana's twin brother who suffers from cystic fibrosis and he is autistic. donations can be made at any wells fargo branch. >> a man found guilty in a nightclub shooting will be sentenced later today, convict forward the 2010 killing of a 19-year-old outside of san francisco's should be suede. a security guard shot davis and arrested him. the second suspect fled. davis could face 50 years to life in prison. >> san francisco's suspended sheriff will continue to fight for his job during an ethics hearing. the mayor wants to remove ross mirkarimi as sheriff after he pleaded guilty to false imprisonment charges stemming from an argument with his wife

ileana lopez. during that he reportedly squeezed lopez's arm so hard it left a bruise. a judge says mirkarimi will be allowed to visit their son during a week-long trip. >> happening now, some bay area parents camping out trying to save their kids' school. lake view is one of the five schools slated to be closed the end of this year. stephanie chuang is at the campus where parents defied orders to leave. >> reporter: good morning. there is a police officer with oakland unified school district parked across the street here. it is his usual shift, it is not his usual location so it is clear that the district is wanting to keep an eye on this camp. we're coming up on five days. the district police officers arrived not 24 hours ago posting up and handing out flyers

warning of possible arrests. a rep tells me they allowed the small tent cityto stay up a couple of days but it's time to leave. organizers say they belong here. they are teachers and parents and even have some of their kids here. >> they don't need to do that. we're protecting the property, we're not letting people enter, not the property but the building. only one person in the building, not to make sure no one sneaks into the building. >> the building is set to house administrative offices. protesters claimed it as a location for their unofficial summer school. it was day one and they will have that every day monday through friday no matter what even if they are forced to move across the street. stephanie chuang, "today in the

bay." >> pension costs for the uc system are on the rise. $240 million will be spent next year on benefits for retirees, that is expected to soon double as more than 100,000 employees are nearing retirement. there are plans to raise the retirement age to reduce costs and uc officials are asking the state for financial help. but sacramento leaders have not provided funding in over two deck kates. >> we're following breaking news in the south bay this morning. firefighters on scene after two-alarm fire in campbell, this one is burning on mcglinsy lane and westchester drive. we have a crew on the way to that scene and will update you as soon as we get more information. let's check in with meteorologist christina loren to find out what's happening on our tuesday forecast. >> good morning. elevated fire danger for today and my hometown is campbell, we want to take it easy out there. we'll have up dates coming up

happening here, this is because it's tuesday and we're talking about highway 4. crews are on the move from the eastbound direction of highway 4. westbound the opposite of clearing, congestion has started. on a tuesday, through antioch, that g street center has 36 there as your westbound direction. no other problems through concord and 680 through canville into san ramon. we still have a couple of crews as well. keep those in mind as you pass through the areas. a smooth drive on the approaches to the bay wrij. that holding steady but the volume out of highway 4 and 580 will build. a look 880, also the construction is fine i cleared those. the crews have cleared. a smooth drive all the way down to the san mateo bridge. >> coming up new details in the

mexico. tracie potts joins us live from capitol hill this morning with a look at why analysts say the pressure is on president obama. >> reporter: good morning. the pressure is on president obama and the rest of the g-20 nations to find a solution to what seems to be a growing financial crisis in europe, spain and greece. they wrap up today, they are expected to issue a statement. we've seen a draft of that that will push more government spending, not less, to stimulate the economy. syria, another big issue addressed in a one-on-one meeting for two hours behind closed doors with russia's president. ment obama talked about that and what the two nations have in common in terms of dealing with syria. >> we have been able to find many commonalities pertaining to all of those issues. >> we agreed that we need to see a deflation of the violence, that a political process has to

be created to prevent civil war. >> reporter: there was no public talk between the two of whether president assad of syria should be forced to step down. the u.s. has pushed that, russia has not. >> thank you. >> a former rutgers university student convicted of spying on his roommate will be released from jail. dharun ravi was found guilty for using his webcam to post a video of his roommate kissing another man. the roommate ultimately committed suicide. ravi was sentenced to 30 days in jail for second degree bias but is released early for good behavior. >> police investigating the death of rodney king. several pot plants and tools were taken into evidence. there were no outward signs

drugs played a role in his death. his death is being investigated as an accidental drowning. details of the autopsy report will be released in about a month. >> this one is a tragic sad story. a mother whose 2-year-old son plunged to his death after a lakers game, she is the one that put him on the ledge to take a photo. the mother tells defense attorneys she wasn't concerned about putting her baby on the ledge because fans sit on the ledge. the baby ended up dying after falling 50 feet. this is back in november 2010. the mother right now suing the managers of the staples center for wrongful death and negligence. the arena company, their attorneys, are asking the judge to throw this case out in a hearing set for thursday. >> 5:45ment the trial of a former football coach moving faster than expected. chris joins us live. we understand the jury could be

deciding jerry sandusky's fate by thursday. >> absolutely. this trial is moving quickly. we expect today in about 15 minutes. jerry sandusky arrived about 15 minutes ago. the big question, will he take the stand f. he is going to do that it likely has to be today because the judge informed the jury yesterday that the defense will wrap up its entire case by lunch time tomorrow. the defense will call witnesses. yesterday they called several character witnesses to the stand, many of whom testified that jerry sandusky was an exemplary citizen, that he helped a lot of children. one even testified that he himself had taken showers with young boys after various athletic events and practices,
