catches the attention of investigators. it prompted deputies to check it out. good morning, marla. >> reporter: good morning. sheriff deputies here tell us this post was noticed just before midnight. it has been removed but we can give you a look at it. we must say it is extremely disturbing. take a look, you can see an instagram photo of sierra and a message attached to it. deputies say it is only a hoax. the message reads please call the police he's coming back. then it goes on to list an address in saratoga. investigators say they spent the morning checking out the post and location but it turned up nothing. what is interesting is the street itself does in fact exist in saratoga. about two months ago someone hacked the missing 15-year-old's twitter account, that was determined to also be a false alarm. lamar was last seen in morgan

hill more than three months ago. less than a month ago deputies arrested a man and he is now facing kidnapping and murder charges though her body has not been found. today deputies are going to be heading south to search once again the reservoir about three miles west of morgan hill looking for any sign of the missing teen. live in san jose, marla tellez, "today in the bay." >> thank you. 6:02. san jose man who once cared for vulnerable children is now behind bars on child predator charges. investigators say 33-year-old joaquin bailey molested two girls in his care as well as an 18-year-old woman with a mental age of a kindergartener. he work ed at a facility in los gatos which houses children who are dependent of the court. he has also worked at achieve kids, a facility for the

developmentally disabled in san jose. investigators say they are looking for more victims. >> this morning a test of wills. oakland parents and teachers camped out at lake view elementary. stephanie chuang is live in oakland where the protesters are still ignoring police orders to leave immediately. good morning. >> reporter: jon, good morning to you. there's a core group of people here who have a very clear message, they are not going anywhere. most of them are still sleeping in this camp of about nine tents or so. this is day five of their sit-in protest here at lake view elementary. this is despite the fact that the school district sent its police officers out here yesterday morning. flyers in hand that warn teachers, parents and the activists to leave or face jail time. a spokesman says the board made the decision to shut down the five schools and if protesters

don't leave they may be escorted off or even arrested. >> campus police showed up and handled the situation poorly and scared a lot of the parents and teachers and students. >> it's not something we want to do. it's something we're trying to do in an effort to prevent to make any arrests whatsoever. >> reporter: the lake view elementary building is said to house administrative offices so protesters went in and claimed it as the location for their unofficial summer school for kids. back here live you can see one of the many signs, this is their primary demand. the superintendent reopen all five schools or resign. live in oakland, stephanie chuang, "today in the bay." >> parents are calling for major changes at their children's middle schools, hundreds packed a community center to ask officials from the alum rock union district to replicate the handful of high performing

charter schools. while just half in the district are testing proficient in english and math, many are testing above grade level and are college bound. hundreds are on the waiting lists to get in. and parents say it's not fair to those who do not get in. >> to ask for better school. historically it's not a popular thing to do, and especially the family out there that cannot speak for themselves. >> alum rock's interim superintendent who just got on the job says he is hopeful that traditional schools can look at charters and replicate things like longer school days. >> the state says $240 million will be spent next year on benefits for retiring university employees, that number expected to double when more than 100,000 more hit retirement age. uc administrators asking for

state help. >> lawmakers passed a budget. democratic leaders resist governor brown's proposal to restructure the state's welfare program. brown wants deeper cuts to ease $15.7 billion shortfall. he wants a rigorous welfare to work program that would cut off benefits unless certain requirements are met. democrats want to action tend to child care assistance but critics say the savings do not go far enough. >> two men are behind bars accused of trying to run down bike riders. two boys say the men tried to hit them sunday afternoon. one of the boys had to jump off his bike to avoid being hit. the suspects are 24 and 31, both now booked in the san mateo jail. >> 6:06 now. felt like a cool start when i

that one is near union avenue. firefighters are up on the roof punching holes in trying to threat air in and hopefully knock this fire down. we'll keep you posted. >> we have amateur video this morning showing the destruction caused as syria continues to shell the city of homs. homs has been the center of the 16-month uprising against the president assad. the u.n. now estimating about 10,000 people have been killed in the uprising. but activists say that number is actually a lot higher. >> a land slide in eastern indonesia killed at least four people. rescue efforts are under way. officials fear six people are still trapped under the rubble. the slide was triggered which two days of continuous rain. floods and land slides are common in indonesia, especially this time of year. >> the trial of jerry sandusky

moving faster than a lot of people expected. chris is joining us from pennsylvania and at this point we understand that the jury could get the case in the next few days. >> reporter: that's right, jon. court has reconvened for the day about 15 minutes ago. jerry sandusky arrived about 8:30. the big question is will sandusky take the stand in his own defense f. he does take the stand in his own defense it likely will be today because the judge yesterday informed the jury that the case is moving faster than expected and the defense is expected to wrap up its entire defense which lunch time tomorrow. that means that jury could get the case as early as thursday and start deliberations. yesterday the defense started calling witnesses, they called a couple of penn state football coaches, one of them had recently retired. he was a character witness for sandusky testifying that

sandusky was a stand up guy, well known, very active in his second mile charity. the coach also testified that it was not unusual for coaches to take showers with young boys. however, he did have to admit he had never given hugs to young boys in the shower which is a point of contention in this trial. the prosecution closed their case yesterday with the mother of one of the alleged victims, it was a powerful moment as she sobbed and felt like she was responsible for sending her child to jerry sandusky's home over and over when he didn't want to go. a big day of testimony yesterday. today the big anticipation. whether jerry sandusky or his wife dottie might take the stand to try to explain away some of the information from eight accusers who took the stand for the prosecution last week. keep an eye on this one. back to you. >> roger clemens is acquitted

but his legal fight is far from over. monday's jury announced not guilty verdicts on all six counts of perjury. he was accused of lying about taking steroids to congress -- about taking performance enhancing drugs. his chief accuser sued clemons back in 2009. attorneys say there will be a conference with a judge as early as next week. discovery could start in a few months. >> back out on the field tonight, the game against the angels starts off at 7:10 and matt cain back. saying things not that easy but he gets the job done, pitching 6 innings, four walks, four strikeouts. but good enough is the giants hang on to win it, 5-3. check out tomorrow's game. i guess what, here on nbc bay area average starting a it 7:00

only two more days before temperatures drop off. seven-day outlook tells the story. 89 in san jose, 90 in concord. tomorrow we'll reach the low to mid 90s in the warmer cities but look where our temperatures are headed. the difference between wednesday and thursday, 92 degrees inland to 75 and that translates to the 50s returning to the coast. cool enough for a jacket in half moon bay all day. temperatures will increase a touch. below 80 all the way through monday. see if you're driving the speed limit. >> you have to stop at the toll plaza. we showed the backup. and into the last few minutes they turned the lights on as well. not a problem down the east shore freeway. that will build.

san mateo bridge moves without incident but we're watching the bum b.a.r.t.en, coming out of fremont, mid span, a disabled subsuv. so far no showing shows up but if a lighter volume can get through. a smooth drive t construction crews should pick up. this is picking up now. the slowing and northbound because of the volume of traffic north tv680/101 interchange. we're tracking this fire in campbell. it's off of highway 17. it's near basscom. a concern for the community so we can track that with our photos on the scene. >> an east bay couple is in jail accused of stealing credit card numbers and going on a shopping

spree. police found the cards in hickman's car. deputies then searched the bay point home and found hundreds of other cloned credit cards. there could be as many as 500 victims with hundreds of thousands of dollars. >> investigation of a fire risk in some toyota vehicles. the vehicles include the camry, camry hybrid, the rav4 and the 2008 highlander hybrid suv. focusing on the design of a power window map. the government is receiving 32 complaints. electrical fires in the driver's door switch. >> microsoft is looking to take bite out of apple. the company had its new defight about the same size as an apple ipad. the front cover doubles as a key

>> good morning. we appreciate you joining us. the time is 6:30. i'm jon kelley. >> i'm laura garcia-cannon. firefighters cleaning up after a fire at a campbell business. the industrial building is on mcglinsy lane and westchester drive close to union avenue and bascom. they were on the roof trying to vent smoke from the attic. it started about 5:00 this morning in the end unit. all six units did have smoke damage no. one was inside at the time. firefighters still watching for hot spots this morning. at this point it's not clear what started the fire. >> a moment of hope turning out to be a cruel joke. investigators say a facebook posting supposedly by missing teen sierra lamar is nothing but a fake. marla is live where deputies spent the night checking out this report. good morning. >> reporter: not just the night

but deputies here telling me they spent most of the morning investigating this. they say as you said it is merely a hoax. they noticed it just before midnight. it has been deleted so if you search it you will not kind it. we can show that to you. it is extremely disturbing, appears to come from the missing 15-year-old that says police call the police, he's coming back. there is also a saratoga address lifted. they say there is nothing there. we went ahead and did our own map quest search. while the street does exist, the physical address does not. at this point who is behind this posting. investigators are not saying but we can tell you the search for sierra continues near morgan hill. a dive team will use new sonar

teachers, patients and activists camping out at lake view elementary since friday. stfrp is live where protesters are still refusing to move. good morning. >> reporter: good morning to you. so far really pretty quiet here, there has been no police activity although through the night there has been at least one officer camped out across the street. it is clear the school district wants to keep a close eye on protesters and the activity here. it was almost 24 hours ago when officers arrived on the campus not 24 hours ago posting up and handing out flyers warning protesters ever possible arrest if they didn't leave immediately. a district rep tells us that they allowed the small tent city for a couple of days so that the protesters could express themselves. but that now time's up and they have to leave. organizers say they belong here, they are teachers and parents with even some kids. >> that's the reason they shouldn't. i mean, they don't need to do that. we're protecting the property,

not letting people enter the property, the build withing. there is only one in the building that the to make sure no one sneaks in. >> reporter: the lake view elementary building is said to house administrative offerses so yesterday protesters went in the building and claimed it as their location for an unofficial summer school. the district tells us there is no time table for an enforcement that yesterday it was unlikely for police action but there is no indication of when that will all change. live in oakland, stephanie chuang, "today in the bay." >> in walnut creek city leaders expected to adopt a new budget tonight. the $135 million spending plan includes staff reductions, program cuts and fee increases. this is meant to help close a $2 million deficit. city leaders admit it will not address the need for maintenance of roads and city facilities such as pools. and if you want to go to the meeting it's at walnut creek's city hall at 7:00. >> palo alto's budget will

>> a driver shot in the neck on interstate 580 is still in critical condition this morning. oakland police hope a reward will help catch that shooter. this is a follow-up to a story we brought you yesterday. a 26-year-old man was shot driving east on 580 near the fruitvale avenue exit late sunday night. the victim's brother who was riding in the passenger seat was not hurt. police actually shut down the freeway for several hours to investigate. any one with information should call police. >> 653. davis convicted for the 2010 killing of 19-year-old la juan hall. an officer shot davis, then arrested him. the second suspect fled the scene. davis could face up to 50 years to life in prison. >> the motive behind two deliberate fires one of which destroyed a home might be a relationship breakup.

19-year-old landon kramer is accused of setting fire to his ex-girlfriend's home twice. the mother says the fire happened after her daughter broke up with kramer. kramer posted bail last week and is out of jail. the girl's family has renovated their home and the mother is relieved there has been an arrest. >> a man is recovering this morning after he was attacked with a taser, then robbed in san francisco. police say the man was walking home near the intersection on saturday night when all of a sudden he lost consciousness. he woke up to find his wallet and ipod had been stolen. there was a taser on the ground next to him. police still looking for the suspect. >> parents are calling for major changes at their children's middle schools. hundreds packed to ask officials to replicate the handful of high performing charter schools.

though a district police officer was waiting across the street, keeping a close eye on this camp. seems the district wants to keep a close eye but no plans on leaving. if or when the district will take wx their police officers coming out to enforce a warning, it came yesterday, flyers warning protesters to leave, not come back for 30 days or risk getting arrested. the protesters were given a couple of days to express themselves but now are trespassing. if they don't leave they may be escorted off the property and if they don't comply, possibly arrested. the people here say they don't want the district plan to go into effect to turn the building here at lake view elementary into district offices so they went in, opened the building as a classroom for summer school and today, this morning at 9:00 will open to kids who want to come for the second day of

class. live in oakland, "today in the bay." dwl the san francisco ethics commission meeting again on the case of suspended sheriff ross mirkarimi. the board considering the mayor's request to remove mirkarimi from office in the wake after domestic violence charge. the sheriff pled guilty false imprisonment after he bruised his wife's arm during an argument on new year's eve. the commission will look at a written statement from his neighbor which describes the conversation she had with lopez after the argument. that is mercury and his wife. madison says lopez described much more physical abuse than has been pub sized. >> a disturbing facebook post by someone claiming to be sierra lamar is dubbed a hoax. deputies were checking out the reports. good morning. >> reporter: good morning. investigators here tell thus post is nothing more than a disturbing hoax. we can show it to you.
