winds. your full forecast for the first day is summer is coming up. we have a smooth drive and if you use 580 i have a couple notes for you. a live look over san francisco. the sun is getting ready to rise on this wednesday, june 20th. this is "today in the bay." >> narrator: from nbc bay area, this is "today in the bay." good morning to you, and thanks for joining us. 5:00 right now. i'm laura garcia-cannon. the man accused of attacking a priest in a retirement home will see him victim today in court. damion joins us live outside the san jose courthouse this morning where the defendant insists he's the actual victim. good morning. >> reporter: good morning, laura. the national spotlight will surely be inside the san jose hall of justice. william lynch intends to draw

attention to priest sex abuse. the opening arguments begin at 9:00 this morning in san jose. back in 2010 police say lynch went into the jesuit sacred heart retirement center and beat up darrell linder. he said as a child he aabused him and his brother. the 44-year-old is facing felony assault and elder abuse charges. lynch has not denied the attack and says it was justified because of the aabuse decades earlier. he denies molests lynch and his brother, but they settled a suit against the jesuits. lynch's attorney told us last night that his client is eager to talk. >> mr. lynch will definitely take the stand. he's waited 40 years. he hasn't had a voice for over 40 years of his life. everyone has ignored him. he's not had a voice. tomorrow he gets his voice. >> reporter: if convicted lynch faces four years in prison.

a statute of limitations prevented prosecutors from going after father lindner for the alleged sex abuse. the testimony is expected to be very difficult, very graphic, not easy to listen to. again, opening arguments begin at 9:00 a.m. we're live at the san jose hall of justice for today in the bay. 5:02 now. a san francisco couple says they only wanted to save their 17-year-old daughter from a life of prostitution, but prosecutors say they went too far by killing the girl's pimp. they're scheduled to appear in court again this morning. they face premeditated murder charges in the deadly shooting of calvin snead near candlestick park on june 4th. the couple's attorney says they didn't do it. the d.a. says prosecutors have substantial evidence of the couple's guilt and taking matters into their own hands was not an appropriate solution. a bicyclist in san francisco

who admits hitting an elderly pedestrian will be arraigned today on manslaughter charges. the 71-year-old died after being struck by the bicycle in a busy crosswalk at market and castro last month. he wrote in a blog that he couldn't stop in time and plowed through the crowd. prosecutors say there is evidence he was speeding and running lights to break a record for riding through the city. a former san jose police officer faces sentencing today for molesting two teenage boys. he pleaded no contest to charges in march, but sentencing was delayed. he worked as a campus officer at leland high in san jose for years. he resigned from the police department last fall. he faces more than three years in prison and will have to register as a sex offender. this morning a special team of federal investigators are trying to figure out if the fire near the west oakland b.a.r.t. station last week was set intentionally.

"today in the bay's" stephanie trong is live at the scene with the latest for us. stephanie, good morning. kw >> reporter: good morning. several security guards are here at the scene walking around the property guarding what's the scene of a federal investigation. this senior housing complex under construction, you can see just to the right of it is the west oakland b.a.r.t. line just after the west oakland b.a.r.t. stop. it's an estimated $25 million worth of damage here anyway so far. the question is, was this an intentionally set fire? a security guard says that right before the building went up in flames, three young men harassed him and chased him off the property. special agents with the alcohol, tobacco, firearms and explosives or atf were called in, many who worked complex fire scenes with access to dogs trained specifically in detecting accelerants. >> the fire was a large magnitude fire, about a city long block. due to the dollar loss of the building and that b.a.r.t. was shut down and such, we want to be completely thorough and they

have a lot of resources to utilize to help with the investigation. >> reporter: federal agents were here last thursday, but they had to wait for engineers to shore up the integrity of the structure before they could take a closer look. the atf says there will be agents from around the country responding and something else that playing a major role, b.a.r.t. security cameras. investigate onnors are reviewing footage hoping something caught on camera, on tape will help move this investigation in the right direction. we're live in west oakland, stephanie trong, today in the bake. we know who will testify in the case of sheriff's mirkarimi. the ethics committee metaphor five hours about the evidence. commissioners are considering the future of the shefshg's job. mirkarimi pled guilty to false imprisonment in connection with with a domestic violence incident involving his wife on new year's eve. he called the case against him

smeared sensationalism. >> they're throwing whatever they can against the wall to see what sticks. p. >> mirkarimi is expected to testify next week. the commission is also expected to decide if the videotape of lopez showing a friend a bruise on her arm will be allowed as evidence. this morning volunteers will gather again in morgan hill to search for sierra lamar. at the same time a high-tech crime unit launched its own search for the culprit in a--tech hoax. the react task force is trying to locate the person that hacked into the missing teen's social media accounts. a post appeared on the internet monday night claiming to be sierra saying she was held in a home in saratoga. cyber experts say it's not hard it to clone ktss. >> find pictures online and create a fake profile and add information that isn't true. >> sierra lamar's facebook and

twitter services have been hacked since her disappearance in march. one of the previous incidents was traced to a hacker in the philippines. 5:07. get a check on the forecast with meteorologist christina loren. good morning. >> the sun is about to come up in a half hour. this is the longest day of the year with almost 17 hours of sunshine, and it looks like we see sunshine for each and every hour. 59 degrees to start you out in livermore, 57 in sunnyvail and 51 degrees this morning in santa rosa mostly clear from the coast true the inland cities. summer begins at approximately 4:09 this afternoon. temperatures drop off as we head through tomorrow, so make sure you're ready for that. almost a 25-degree difference from where we were yesterday. highs today work out like this. at noon you're at 80 degrees inland, 93 degrees aat 4:00 p.m. by the bay it's on the cool side until noon, but you break into the 70s at that point and 80 degrees today and at the coast, nice conditions.

70 degrees at 4:00 p.m. you drop up into the 50s tomorrow in apacifica and half moon bay, so enjoy the sunshine while it lasts. >> the solstice, i'm heading to stone hedge later on today. grant line road had a stall. they made their way to the center divide, and aaa will head over to help them out. no problems hurting the freeway flow for 580. 680 and just north of there we have construction heading into santa ramone. but the traffic is so light it doesn't cause slowing for folks on the freeway. the traditional blip off 238 and into oakland and i had a second incident at fruitville, but the big metal box in the roadway cleared without incident. also clearing is the construction at 24 for the fishing ranch and both the construction spots on enter at a time 80 off the maze. we'll see how traffic flows across the bay.

livermore, and that's good for your pets as well. get them out there early before it gets too hot as they have a hard time in the heat especially if you have a pug like me. 54 degrees in san francisco and 51 in santa rosa. this morning that sun is out in full force. it's already coming up with a special sunrise at 5:38 this morning. this is the longest day of the year and mostly clear conditions to start. temperatures warm off the bat. summer officials starts at 4:09 and as we head through tomorrow, the first official week of summer we're going to fall below our seasonal averages by 25 degrees. jet stream takes a significant dip and ushers in a series of storms and mostly pass to our north. that means for you a stronger onshore flow. foggy start and drizzle back in the forecast as of tomorrow. so dramatically changing weather between today and tomorrow. today's highs look like this. 93 degrees in places like livermore, 94 in gilroy today,

80 in santa cruz, 89 in los gatos and 66 in san francisco today. as we head through the next couple days, temperatures really, really drop off. we talk about a return of the 50s in some of your coastal city, so keep that in mind. this weekend looking comfortable inland for any sort of outdoor activities. you can get out there, and for more than four hours without overheating. that's the good news. as you get in your car before you head for that drive, mike is here to help you out. >> so check the tires and the windshield wipers. this is a preflight check, and then get onto the road because you can use the antioch bridge. you're okay there crossing the bay. there was overnight closure there. so no longer that long reroute. good thing you stuck around with us. eastbound highway 4 forces you off the roadway, that's another ten minutes or so. westbound is starting to slow down a little bit heading through antioch, though. no big drama. no drama for 680. both directions have spots with

construction, and we see a little slowing right here off the dublin interchange and bollinger canyon road. that off ramp is currently closed for construction as well. let's get a live look for the volume of traffic. you see the northbound side, and no major problems. a nice, smooth drive. you're at the limit all the way from hayward up to the bay bridge and vice versa for the southbound direction right there. other side of the bay we see a smooth drive for 101 and 280 for the speed sensors. we have the overnight crews across the dunbarton bridge and no slowing in either direction for highway 84 and a nice drive through the south bay and 85 has clearing spots and up towards el camino with the off ramp blocked by a crew hanging around there. with those temperatures, summer temperatures still today, so expect a lot of traffic over that back and forth between here and santa cruz. back to you. >> thanks so much, mike. 5:19.

>> reporter: good morning. this is the focus of a federal investigation, and security guards are walking around this property, what was under construction a senior housing complex just mangled now, just debris. a security guard on duty the night of the fire says he was chased away by three young men harassing him right before the building went up in flames. was this fire intentionally set? that is what a team of special agents with the bureau of dh alcohol, tobacco, firearms will focus on in a few hours. they would to shore it up before investigators came out today, the first day of taking a closer look with specialized resources. >> we have access to accelerant detection canines, should we need them. we have access to a team of individuals within atf that have worked fire scenes. >> reporter: oakland fire and police will be helping in the

federal investigation. this has, of course, become a top priority considering thousands of people here in the bay area were impacted after b.a.r.t. was forced to shut down lines between san francisco and oakland. now, investigators are also taking a look at footage from security cameras from b.a.r.t. and that, of course, could play a major role in moving this investigation forward. live in west oakland, stephanie trong, "today in the bay." >> 5:31 now. an emotionally charged case gets under way today in the south bay. the man accused of beating up an elderly priest who he says molested him as a child goes on trial. today damion is live outside the san jose courthouse where the defendant is eager to tell his side of the story. good morning. >> reporter: good morning, marla, and the testimony expected to be very graphic throughout this trial. william lynch says he plans to tell all about the abuse he allegedly suffered at the father lindner here. he was a priest over at one of

the congregations that took the kids over to a camping site in the santa cruz mountains, and that's where the alleged abuse occurred. police say william lynch walked into the lobby and beat up father jerrold lindner. in fact, lynch had not denied he beat the up priest, but he did that after keeping a dark secrets. he alleges father lindner aabused him and his brother as little boys nsdz a tent during a camping trip to the santa cruz mountains. father lindner denies the accusations and a statute of limitations prevented prosecutors from looking deeper into the alleged assaults. lynch has said he intends to use the trial to draw attention to clergy abuse and the system that protects the priests. last night lynch's lawyer told us -- >> okay. obviously, we're having trouble with damian's audio there. we'll bring you continued coverage as that supposed to get

under way today. it is 5:32 right now. a south bay man accused of molesting vulnerable children at work remains behind bars, but his fiancee says he doesn't belong there. she claims 33-year-old joaquin bailey would never harm kids. he's charged with three felony counts of lewd acts on a child and one count of sexual assault on an incapable person. the judge denied his bail and ordered him to make no kwakt with the alleged victims. he worked ate group home for children and as a teachary aide at achieve kids which serves the mentally disabled. >> that's the thing, he have no proof or evidence of anything. they're just coming out with stuff, going after these random, vulnerable kids trying to get them to admit to stuff he hasn't done. >> the deputy district attorney on the case believes there are more victims. bailey is due back in court next tuesday. a santa cruz jail inmate says love, not freedom, inspired him to make a run for it while

being booked. 34-year-old craig souza is back behind bars this morning after detectives talked him into surrendering. while he was being rebooked he told a local tv reporter he escaped because he wanted to see his wife. >> my actions were wrong, and i need to take responsibility. but i did it for love. i wasn't trying to hurt anybody in the community, and santa cruz is awesome. >> souza has a lot history of drug orchss and has been jailed more than 20 times before. a stern warning for oakland mayor gene kwan, miss a deadline and face a potential fine. they say the city's internal affairs department is investigating dozens of complaints stemming from "occupy oakland." the department has been ordered to complete investigations in a timely manner because after one year state law prevents any legal action against officers found of wrongdoing. the judge says if deadlines are missed, the city and possibly the mayor herself will be fined.

last february that left more than 30 people dead. the seven troops involved said they were cleaning an area and they did not realize they were burning the muslim holy book. a key vote today on an embattled cabinet member. they will vote whether eric holder should be held in contempt of congress. holder has been criticized for withholding documents linked to the fast and furious gun running investigation that allowed weapons to reach mexican drug gangs. if the vote gets out of committee, it still needs to go before the full house. some world leaders have reached an agreement to keep europe out of economic disaster. stand, but today jurors heard from -- rather yesterday jurors heard from the woman who spent 45 years by his side. >> chris pallone is live outside the courthouse in pennsylvania with more on dottie sandusky's very powerful testimony. good morning, chris. >> reporter: good morning, marla. court is tote to reconvene in a few moment. jerry sandusky arrived here at the centourthouse 15, 20 minute ago. as he entered this morning, he was asked if he would testify today. his attorney says, guys, we can't talk about that. you can read into that what you want. now, as you mentioned yesterday was a big day of testimony for the defense, topped off by the testimony of jerry sandusky's wife, dottie, his wife of 45 years. on the stand she said that she had never seen or heard anything that would give her any indication of any of the crimes that her husband is accused of. however, under cross-examination she did admit when asked why would eight alleged victims and

a potential witness make all of this up, she said i don't know. most of the other witnesses on the stand for the defense yesterday were so-called character witnesses, people who talked about jerry sandusky's sterling reputation in the area and his hereputation for being dha charitable guy. >> the witnesses really do nothing other than the fact that they signal to the jury that there are people who have come forward who are reputable in the community standing by sandusky. >> reporter: there's a lot of anticipation this morning. some potential spectators who wanted to watch the trial this morning were lining up as early as 3:30 to get into the courthouse today. that is in anticipation that jerry sandusky may indeed testify this morning. the defense is set to wrap up by lunchtime today, and it's a chance for the prosecution to have rebuttal witnesses. closing arguments are still scheduled for tomorrow morning. that's the story here, and i'm

welcome back. a good wednesday morning to you. taking a live look outside golden gate bridge this morning. a nice, cool start to the morning. first day of summer hits later this afternoon at 4:09. >> good news at the gas pump, gas prices have dropped for the tenth straight week. the nationwide average price for a gallon of regular fell to $3.49 on tuesday. that's down from $3.76 a year ago. here in the bay area the average price for a gallon of regular in san francisco is $4.01, oakland 3$39.09 and in san jose 3.97. they say the price drop is due to oil's declining price and a weakened global economy. just a few hours ago, economists at ucla released their forecast for california. sk scott mcgrew has been reading as fast as he can. >> it's pretty thick. if you wait long enough, it does
