>> it's expected to be a pivotal day in the priest sex abuse trial. >> a judge could declare a mistrial after only four days of court. "today in the bay's" marla tellez is in our newsroom with the latest. good morning. >> good morning. this is a case of william lynch versus father lindner accused of beating the retired priest. he says he did it out of retaliation, claiming lindner molested him and his brother more than 30 years ago. the judge is expected to rule on a request for a mistrial. this all happened on friday when lynch's attorneys claimed misconduct from prosecutors. in opening statements one week ago, the prosecutor told the jury the priest would likely lie under oath and deny the allegations. father lindner did take the stand and say the molestation charges are false despite the fact that the church paid a settlement to lynch and others. they claim that the prosecutors

broke the law by putting acknowledged lies before the jury. it's now in the judge's hands, he will announce his decision when the trial resumes at superior court at 8:30 this morning. laura. >> thank you for the update, marla. it's 9 -- it's 4:33. that clock is wrong. u.s. supreme court could rule as early as today on president obama's health care law. a decision that could affect millions. the court ruling that strikes down the law would mean an end to many protections for people with an end to financial help with insurance for small businesses. those with pre-existing medical conditions will likely see their rates go up. young adults will not be covered on parents' plans and those suffering from a serious condition such as cancer will again be faced with lifetime spending caps that end coverage once a patient has racked up a big enough medical bill. the court's decision is bound to

have a substantial impact on the november election. >> the supreme court finds itself in the middle of a storm a political storm, in the presidential election that's coming up because it's the president's signature achie achievement and this is about health care which touches all of us. >> those opposed to the bill say the government has no right mandating any citizen buy anything. >> new this morning a small earthquake jolting some people out of their sleep in the south bay overnight. the 3.4 quake striking at 1:13, east of the villages on a remote area in south san jose so. far no reports of injuries or major damage. >> also new this morning, a home in hayward still standing thanks to quick work by talented firefighters. that fire broke out last night at a home on woodland avenue. bars covered the doors and windows so you can see the firefighters had to use a saw to get inside.

investigators say that fire started in the kitchen but it pred to the attic and crews climbed up to extinguish the blaze. crews saved the rest of the house from damage. we're happy to report nobody was injured. >> friends and family that lost a daughter and father in a deadly crash are demanding justice. they created an online petition asking the contra costa county district attorney to prosecute the 7-year-old driver suspected of killing the two. police have recommended that the teen face vehicular manslaughter charges. police say he was speeding when he jumped the sidewalk curb and hit the father and daughter while they rode their bikes back in april. >> there is new information on a crash in the south bay that killed a woman from mountain view. investigators think they found the driver who may have caused it. officers say the woman lost control of her car, slamming into a tree saturday night. there was a license plate of a

car driving recklessly in the area at the time of the crash and officers have tracked down the owner of the car. so far he's not been arrested. >> looks like there is a little stadium snag. santa clara county says it's keeping $30 million in its tax fund despite the fact it was promised to the new 49ers stadium. the "mercury news" reporting that county leaders want that for the teachers but the 49ers say the voters earmarked the money for the stadium and the county has no right to keep it. voters approving the funds in 2010. the 49ers front office says it would absorb the loss if the niners can't get it back but others suggesting the battle will likely end up in court. >> 4:36. special education classes in oakland are going to look different when the new school year begins. school district is slashing more than $4 million in special ed funding. among the casualties, several teachers and aides will not be rehired and class sizes will get

higher. there was a budget shortfall discovered a month ago. >> san francisco police department is getting high tech help. a new mobile app being issued will allow officers to report from the field and share data in real time. the department says the program will help increase efficiency. mayor ed lee and others are attending a ceremony to introduce the app. >> the san francisco police also continue searching for a young man who went missing in the city. evan flanary has not been seen since he met a stranger in social media setting last week. his family says it's out of character for the 22-year-old not to contact them. they have reached out through social networking in hopes of finding him. he was last seen wearing jeans, a gray hooded sweatshirt and a cal baseball cap. >> colorado facing its worst fire season. the hyde park fire burning two

weeks outside ft. collins. it's charred 83,000 acres, destroyed 248 homes. in the meantime, a fire near colorado springs erupted this weekend forcing more than 11,000 people from their homes. >> this isn't something we haven't seen before but it is unusual to see a fire with this potential. >> half the country's fire fighting fleet now battling fires in colorado. today, military planes will start assisting the fire fight. >> we're not even a month into the atlantic hurricane season and tropical storm debby already setting a record. debby churning in the gulf of mexico producing rough surf, high winds and rain for much of florida's gulf coast. the tropical storm could grow to a category 1 hurricane before making landfall later this week. this marks the fourth named storm of the season, that is the first time this has happened with four such storms before july since recordkeeping started 160 years ago.

candidates have staked their chances on which would be better at fixing the economy. the associated press poll found people were pessimistic about jobs. when asked about unemployment 60% said the november winner would be slim to none. 30% think unemployment will grow worse, the same number that predict it will ease up. >> time for good news for your wallets. gas prices continue to fall across the nation and here in th bay area. nationwide the average price on gas of regular, dropping 15% over the last two weeks, always very nice to hear. according to a lundberg survey it's $3.48. here it was $3.77 in sacramento. drivers in san francisco paying some of the highest prices in the entire nation, aaa listing the average for a gallon ever regular at 4 bucks in the city. that's down almost 40 cents from about a month ago. san jose it's $3.89, oakland,

westbound 580, celebrations, it's open again. 580 and 880 no problems. as far as speeds toward the bay bridge. away from the bay bridge it's early slowing, we see it on the maps north of that accident symbol i added. eastbound 80. there is an accident reported. sounds like it's moved out of the lanes, no injuries reported but activity enough to cause slowing over the last few minutes. we talked about in san francisco over the weekend road closures that are still going on until possibly 6:00 a.m. a couple of local street closures. fulton might still have a closure. this is left from the activity and the staging for the pride festival parade and activities. that's cleaning up going on but a lot of celebrations. we'll show you more pictures. northbound 101 to southbound highway 1, there is an accident there causing an issue on city streets. across the golden gate bridge it's fine.
