>> plus, coming out of the tri-valley you're doing all right now but as you get closer to the bay i'll give you the update. east shore freeway had an early accident. the latest coming up. >> a live look outside this morning, golden gate bridge, welcome to monday morning. it's 5:00 a.m. this is "today in the bay." >> good morning. thanks for joining us. 5:00. i'm laura garcia-cannon. >> good monday morning everybody. i'm jon kelley. new this morning fire investigators at the scene of two suspicious car fires on the peninsula. they happened on lydon street in redwood city. the two cars were about a block from each other. one in a driveway of an apartment complex t other on the street. crews were able to put the fires out before the flames spread to nearby buildings. >> also new this morning, a destructive house fire in hayward, a home still standing

thanks to quick work by firefighters. the blaze broke out off mission boulevard. bars covered the windows. they had to use a saw to get inside. investigators say the fire started in the kitchen but spread to the attic. luckily no one was hurt. >> friends of a family lost -- that lost a father and daughter 18 deadly crash are demanding justice. they created an online petition asking to prosecute the driver suspect fd killing the two. police recommending the teenager face vehicular manslaughter charges. police say he was speeding when he jumped a curb and hit the father and daughter while they rode their bikes back in april. >> there is new information this morning on a crash in the south bay that killed a woman from mountain view.

investigators think they found the man that may have caused it. a woman lost control of her car and slammed into a tree in mountain view saturday night. witnesses providing the license plate of a car that was driving recklessly at the time of the crash. officers have since tracked down the owner of the car. so far he has not been arrested. >> two former san mateo county employees under arrest on suspicion of stealing from deceased residents. they believe that mandy yagi and peter wong toll money, jewelry and other valuables from the estates they were managing. both resigned last year. a county worker says after they left a box of items from several estates was found in a place only wong and yagi had access to. a controversial south bay trial could end today a. lawyer for the man accused of beating a priest decades after he says the priest molested him is demanding

the charge bs thrown out. marla tellez is live behind what's behind the legal tactic. >> the case of will yam lynch versus father lindner start add week ago and today the judge could declare a mistrial. lynch does not deny beating the retired priest about two years ago. he says he did it out of retaliation for the sexual abuse he suffered in mid-70s. last week the priest took the stand and denied the allegations despite the fact that the church paid a settlement to lynch and others. the father's testimony comes after the prosecutor told the jury the priest would likely lie under oath. so the defense is asking for a mistrial. here is the lead defense attorney. >> this is what is known as suborning perjury. you can be a defense lawyer, any lawyer, you can't get away with it. we know of at least three additional victims have come forward. this is what he wanted. he wanted this man out in the open, he wanted people to not be

afraid and i think he's accomplished what he wanted. >> if the judge declares a mistrial do both walk free. our legal analyst explains why that could happen. >> then the d.a. will be in the position do they want to try this again with a witness who they have already said is a liar and they also said he's a pedophile. >> in other words, it would be another uphill battle for the prosecution. the judge's ruling is expected at 8:30 this morning. >> thank you very much. the u.s. supreme court could rule as early as today on president obama's health care law. supporters say if the law is struck down it would mean an end to many protections for people and an end to financial people with insurance with small businesses. those with pre-existing conditions would likely see rates go up, young adults wouldn't be covered on their parents' plan and those suffering from a serious condition will have a lifetime

spending cap. the court's decision is bound to have a substantial impact on the november election. >> the supreme court finds itself in the middle of a political storm in the presidential election that's coming up because it's the president's signature achievement and this is about health care which touches all of us. >> those opposed to the bill say that government has no right mandating any citizen buy anything. coming up later on, we'll have a live report on this expected ruling and other rulings this week. >> a stadium snag. santa clara county and the 49ers wrestling over millions in tach funds. the county says it is keeping $30 mill i don't believe in tax funds promised to the 49ers stadium. christie smith joins us live with what is behind the move. >> reporter: good morning. this came as quite the surprise and unwelcome one for the 49ers that santa clara county decided

to keep tens of million of dollars, $30 million, apparently earmarked for new stadium construction and approved specifically for that by voters. this is according to the "mercury news" that reports the team objects and so does the city saying that voters earmarked this money as redevelopment funds and the county shouldn't be able to keep it and do what they want. but since then the state crapped redevelopment agencies and new state law gives counties control over those funds. the idea is to spend it at other public agencies, schools, but certainly really need money as well. on both sides this will likely be the start of a long legal fight. whether the construction will be impacted no word yet but the 49ers have reportedly said they'd eat the loss for now which is about 3% of the 1.2 billion stadium that's expected

to open sometime in 2014. what's expected to happen later this week is that the 49ers and the city are expected to draft an official response. christie smith, "today in the bay." >> colorado is facing its worst wild fire season 18 decade. eight fires burning across the state, the biggest is the high park fire burning for two weeks outside of ft. collins. it charred more than 83,000 acres, destroyed 248 homes. a fire near colorado springs erupted this weekend forcing 11,000 people oust their homes. >> this isn't something we haven't seen before but it is unusual to see a fire with this potential. >> half of the fire fighting fleet now battling fires in colorado. today military planes will start assisting. >> 5:07. we're not even a full month into the hurricane season and

tropical storm debby is a record-breaker. debby is producing rough surf and rain for much of florida's gulf coast. the tropical storm could grow to a category 1 hurricane. this is the fourth named storm of the season and the first time there have been four such storms before july since recordkeeping began 160 years ago. >> that's way out on the east coast. christina loren is here to join us. any of that affect us? >> no, not so much. what's interesting is that the peak of the season is september and october so we have a long season to go. the only impact we'll see is potential for rain, gas prices. a live look at the golden gate bridge. clear as a well this morning. 52 in san jose, good looking day shaping up. we have showers on the way but

>> welcome back everybody on a monday morning. a beautiful picture there of the bay bridge. the lights adding colors all over. you see the traffic flowing fairly smoothly. it's 5:14. >> decision 2012. when it comes to the economy half of americans say a new poll they say it won't really matter much whether barack obama or mitt romney wins. that is despite the fact the candidates staked their chances on which would be better at fixing the economy. the associated press poll found people were especially pessimistic about jobs. when asked about unemployment, 60% said the november winner's

impact would be slim to none. 31% think unemployment will grow worse over the next year t same number that predicts it will ease up. >> good news for your wallet which is always nice. gas prices continue falling across the nation and here in the bay area. the average price for a gallon of regular dropping 15% according to the -- actually 15 cents. the survey is $3.48. here the lowest was $3.77 in sacramento. drivers in san francisco paying some of the highest prices. aaa listing the average at $4, almost 40 cents down from a month ago. in san jose it's $3.89. >> perfect if you want to go somewhere. staying in the bay area is nice

if you're waking up north of the golden gate bridge you might get shower activity. i wouldn't wash your car. 70 degrees in fremont. 73 in san jose and 70 in los gatos, here are the numbers. 80 degrees on thursday. basically, we're not going to break out of mid-80s as we head throughout the week. we're done with the 90s, done with the triple digits, at least for quite some time so we're going to hold on to comfortable weather, something we like around here in the bay area. we pay for it after all. what else you're paying for, the gas. here's mike. >> right. you know, these folks have done their work later than we thought but it's clearing so that's good news getting you to work. 101 to 85, all lanes now open. the maintenance which was extended has now cleared from our reports. off the split off 101 and 85 all the way in the northbound directions. i'm watching it to blip. 280, we'll check on that.

i'll monitor that. no accidents reported there. to 580 for 15 minutes, slowing starts at livermore out of the altamont pass, through the heart of livermore. past al costa that we see with our sensors even though there is no overnight construction, not through san ramon. slowing down to the 50s, upper 50s for antioch and not a problem once you las over to easy creek, for 880 speeds you'll have to limit past the coliseum. one of those illusions as the curve kicks in but no slowing past the scene to the bay bridge. back to you. >> thank you. get ready for all of the magic of the olympics. you probably heard go off in london. this is an important preview in

the south bay. the trials all set. bob redell is there with a look at the local gymnast hoping to make the cut out this. good morning. >> good morning, jon. yes, inside the hp pavilion workers are busy turning the shark tank into a gymnastic arena. some of the best athletes will try to flip and tumble their way to the olympics. by sunday we'll know which five women and which five men will represent the united states in london. it's possible some of those have come from here in the bay area. a 6-time all american at stanford, he took the past year off to train for this competition and hopefully beat out 14 other men for a spot on the team. it has taken a lot to get to this point, not just hours in the gym but having to cope with the death of his moth tear cancer when he was 15. >> my sister and i have been

through a lot, through lots of downs and we've kind of gotten to a good place now. and to have made it through all of that stuff and to have me in this place where i'm like i said, i get named to the team. there are only five people in the country that can say that. i think i'll just be at such a loss for words. >> reporter: alex is one of three men from stanford competing. there is another from cal who will meet in a half hour. looking at four athletes getting on the u.s. team. at the trial this is week the top five athletes will not necessarily be the ones who make the team. a selection committee has the final say. you you've got the junior and senior gymnastics, men's on thursday, women starting here on friday. at the hp pavilion. reporting live in san jose, bob

more than $4 million in special ed funding. among the casualties several teachers and aides will not be rehired and class sizes will get larger. >> the san francisco police department is going high tech. a new mobile app helping to issue and allow officers to report from the field and share data in real time. the department says the program will help increase efficiency. mayor ed lee and other leaders attending a ceremony later on this morning to introduce the app. >> organizers are calling it one of the most successful gay pride weekends ever. nearly a million people made their way to san francisco to celebrate gay pride and organizers say the local economy got a boost when it took in $100 million. sunday's parade has special meaning for those who participated. marchers were energized by president obama's announcement that he supports same-sex marriage. >> we're so proud to have the

june 25th, "today in the bay." >> good morning to you. thanks for joining us. it is 5:30. i'm laura garcia-cannon. >> i'm jon kelley, new this morning fire investigators right now at the scene of two suspicious car fires on the peninsula. they happened in redwood city after 3:00 this morning. the two cars about a block from each other. one was 18 driveway, the other parked on the street. crews were able to put out the fires before the flames spread to any nearby buildings. >> also new this morning another fire, this one in hayward. a home there still standing thanks to quick work by firefighters. this fire broke out after 8:00 last night in a home on wood land avenue off of mission boulevard. bars covered the doors and windowes so firefighters had to use a saw to get inside. the fire started in the kitchen

but spread to theatic. crews climbed on the roof. the crews managed to put the fire out in ten minutes saving the rest of the house. look at that blaze. luckily no one was hurt. >> so also new, a small earthquake jolting some people out of their sleep in the south bay. the 3.4 magnitude quake striking at 1:13 this morning about 10 miles east of the villages on a remote area of san felipe road in south san jose. so far no reports of injuries or major damage. >> 5:31. in east palo alto police are investigating the murder of a 30-year-old man. his body was found sunday afternoon after shots were heard in the area. arriving officers didn't find any one down. when they were sent to a home on the same block about three hours later they found edmund beverly dead. no arrests have been made.

>> today san francisco police continue to search for a young man who went missing in the city, evan flannery has not been seen since meeting a stranger through social media last week. his family says it's out of character for the 22-year-old not to contact them. they have reached out through social ned working in hopes of finding himt. flannery was last seen wearing jeans, a gray sweatshirt and a cal baseball cap. >> one of the peninsula's largest independent book stores taking a summer break. menlo park's kaeppeler books will be closed about six weeks starting july 1. the owners using some down time there to remodel the building. they hope the new look will better serve their community. >> check your ticket. someone in sonoma county won $13 million in the super lotto jackpot. the lucky player hasn't come forward yet. jon is scrambling. pulling out his wallet. check it. the winning numbers 2, 3, 10,

it's crisp in the 50s at 8:00 a.m., 55 inland, 54 bay side and 54 degrees at the coast. with the fair amount of clouds. a mix throughout the day today. and temperatures will be comfortable. 72 degrees. we've got showers on the way. i'll talk about where in my next report. 5:34. mike's a busy man on a monday. >> great concern because 280 we were having an accident reported in both directions, turns out that chp and nav tech at page mill road, reports of sadly a very large deer reportedly hit and killed and in the second lane affecting the left two lanes as you head southbound on 280 passing page mill road, reports of slowing as well. we'll give them time to adjust the situation. likely having to have a traffic break. 101 is fine and again, i'll bring you an update if they have

additional delays. unexpected delay, 150 it's off of 580 as you head up off of the castro valley y, chp is helping out. sounds like traffic signals are out in all directions as you approach 580 so that will be an issue for local traffic onto and off of the freeway though no backups. still relatively light volume as you head up to the maze. smooth for eastbound 24 a little slowing shows up but only one eastbound bore. that's your kmucommute. back to you. >> appreciate it. you don't have to own a dog to know those four-legged friends love to go on long relaxing walks. have you contemplated the idea of ducks? look at this. a farmer in eastern china takes his flock out for a walk. how about with around 5,000 ducks. these ducks you can see they stop traffic and they do what they want.

starting to crank up the day here, a little sunshine out there. nice temperatures. brace yourselves. christina loren says another beautiful week ahead. >> two landmark cases hang in the balance this morning at the highest court in the country. this week the supreme court expected to rule on president obama's health care law and arizona's tough immigration law. "today in the bay's" claire lacka joins us live with the latest. good morning. >> reporter: good morning to you. with all of these critical issues coming to a head this week they are going to weigh heavy on the campaign trail. president obama will be stumping in new hampshire later today while mitt romney will be campaigning in scottsdale, arizona. on to a new poll by reuters, it shows that the majority of americans oppose president obama's health care law although they do support most of the provisions in that law such as letting parents keep their children on their policies until the age of 26. but 61% of americans are against

the individual mandate which forces americans to buy medical insurance. if the court strikes down the mandate or the entire law, analysts say it will be a political disaster for the obama administration. meanwhile, on to another hot button campaign issue, immigrati immigration. the supreme court also has that on its docket this week. a ruling could come on arizona's tough immigration law as early as today. the arizona law is controversial because it allows police officers to check a person's legal status during routine traffic stops. and critics say it amounts to racial profiling but experts say regardless whether or not that law is upheld or struck down as unconstitutional, it will affect immigration laws nationwide. we're live in washington. now back to you. >> so much to watch. thank you, claire. >> at least one person dead, another trapped after a roof collapses at a mall in canada. this happened yesterday in

ontario. this morning crews having trouble reaching possible victims because the building right there is unstable, at least 22 people suffering minor injuries. one part of the roof serves as a parking area which crumbled down two floors near the food court. >> they have collapsed on each other. the center beam in the premise is leaning over, there are very, very large, dangerous slabs of concrete that need to be stabilized and some removed before we could ever enter that premise. >> and a gas leak prompted evacuation. the city's mayor declaring a state of emergency. >> it's a dawn of a new political era in egypt as the country's first democratically elected leader gets to work. mohammed morsi has already moved into the office once held by hosni mubarak. the muslim brotherhood candidate

was declared the winner. president obama called morsi to congratulate him on his victory and offer support for egypt's transition to democracy. >> in mexico, at least 32 people were killed and seven injured after a bus overturned on a wet road. police and crews worked for hours at the scene about 2 1/2 hours south of mexico city. the bus is believed to have been carrying supporters of the country's leftist presidential candidate. mexico's elections on july 1. >> after four days the trial of a los gatos man accused of attacking a priest could come to an end. the defense asking the case be thrown out because of what the prosecution's star witness said up on the stand. marla tellez is in the newsroom with more. >> if the defense has its way the judge will declare a mistrial in the case of william lynch versus father lindner.

lynch beat the retired priest in 2010 he says out of revenge for sexual abuse he fell victim to at the hands of father lindner. the father took the stand and denied the charges even though there is significant evidence to prove he did molest lynch, and despite the fact that the prosecutor told the jury father lindner would probably lie about it so on friday the defense file add motion for a mistrial. we spoke to our legal analyst who says the judge almost has no choice but to declare a mistrial since father lindner could be subject to perjury. >> it's likely he is advised to get an attorney for further advice on whether to further testify f. he invokes his fifth amendment privilege, then all of his previous testimony will have to be stricken. and then the judge will have to try to unring that bell with the jury. that's probably too difficult to

do. >> the prosecution says they fulfilled their legal obligation when they warned the jury the priest may not tell the jury the truk truth. the case could be retried automatic as pointed out that would be a tougher sell for the prosecution. laura. >> thanks, marla. 5:44. stadium snag, santa clara county says it is keeping $30 million in tax funds despite the fact the money was promised to the 49ers stadium. "mercury news" reports county leaders want the money for teachers but the 49ers say voters earmarked the money for the stadium and the county has no right t keep it. voters approved the funds in 20 between. the front office says it would absorb the loss if the niners can't get it back. others suggested the battle will likely end up in court. >> the largest smart phone maker wants to take a bite out of
