the judge could declare a mistrial after only four days of court. marla tellez joining us in studio with all of the latest details. >> the case of william lynch versus father gerald lindner started a week ago today in san jose and could come to an end today. lynch does not deny beating father lindner, about two years ago. he says he did it out of retaliation for the sexual abuse he suffered at the the hands of the priest in the mid 1970s. the priest took the stand and denied the allegations despite the fact that the church paid a settlement to lynch and a few others a few years back. the father's testimony comes after the prosecutor told the jury the priest would likely lie under oath, so the defense is asking for a mistrial. here's the lead defense attorney. >> this is what's known as suborning perjury. you could be a defense lawyer, you can be any lawyer, you can't get away with it. we know of three additional victims have come forward so this is exactly what he wanted.

he wanted this man out in the open, he wanted people to not be afraid and i think he's accomplished what he wanted. >> if the judge declares a mistrial, do both lynch and father lindner walk free? our analyst explains why that could happen. >> then the d.a. will be in the position do they want to try this again with a witness who they already said is liar and said he is a pedophile. >> the ruling is expected at 8:30 this morning. also expected outside santa clara county superior court, a big group of lynch supporters so it could get loud depending on the ruling. >> going to be interesting to follow. also new this morning a fire investigator at the scene of two suspicious car fires on linden street in redwood city after 3:00 this morning. the two cars were about a block from each other. one was in the driveway of an apartment complex, the other parked on the street. police are checking for

accelerants, crews were able to put out the fire before they could spread. >> we have new video, a flame shooting through the roof of a home in hayward. that broke out after 8:00 last night at the home on woodland avenue off mission boulevard. bars covering the doors and windowes so the firefighters had to use a saw just to get inside. investigators say the fire started in the kitchen but quickly spread to the attic. the crews climbed up on the roof to extinguish the blaze. we're happy to report nobody was hurt. >> in east palo alto police are dealing with a bizarre murder investigation. the body of a man found several hours after shots were heard in the area. shots sent officers to glennway. they went back and found edmund

beverly dead no. arrests have been made. >> more problems for oakland police, sky rocketing injury claims spreading resources thinner. it's forcing city leaders to address injury tracking and hire somebody to keep tabs. about 90 officers on medical leave. one out of seven is physically unable to work. in san jose, only one out of 17 officers is unmedical leave. >> 6:04. millions of dollars off the table for the new 49ers stadium. the county says it's keeping $30 million previously promised. what's behind the county's move? good morning. >> reporter: good morning. this is certainly not what the 49ers wanted or the city of santa clara. construction on the stadium had started back in april. still you can see work going on

this morning. now comes word of a setback, money that was earmarked for stadium construction. a new county board that oversees property tax made the decision that according to the merc, the decision was made sunnily. that they would rather spend the money on involve government and schools. voters approved redevelopment funds to help build the stadium. but the stay has scrapped those redevelopment agencies. and new state law gives counties control over where that money goes. whether this will be a problem for construction t niners haven't said but the front office is saying that they would go ahead and eat the loss, short-term and it amounts to 3% of the 1.2 stadium cost expected to open in the year 2014. next up expect a long legal battle and sometime this week an official statement from the city as well as the 49ers team.

>> the city of stockton working hard hoping to avoid becoming the largest city in the country to file for bankruptcy. city leaders to restructure 26 million in debt trying to beat a deadline. if an agreement is not wretched the city may decide tomorrow to adopt a special budget. that would reduce benefits. >> changes for bus commuters, for the next month ac transit bus stops will be moving from the wart station to accommodate a construction project. the relocated to nearby streets. meteorologist christina loren is here to bless us with beautiful weather ahead. some mild temperatures. >> mild. summertime, summertime. a good summertime you think air

conditioner, we have been blessed because we've not had to deal with any so far. it has not been extreme. we've had showers over the course of friday. what is interesting is it's crystal clear out there. the marine layer is not penetrating further than oakland at this point. i don't think it's going to make to the concord or livermore. 53 to start you out. mostly clear conditions. coastal drizzle. i think as we head throughout the next two days that will be a factor with an area of low pressure to the north. showers, keep that in mind. today keep that umbrella home, mix of sun and clouds. temperatures breaking into the low 70s even in the warmest city across the bay. we're going to warm you up through the next couple of days. 6:07. by on the you'll be peeling off the first layerment 65 inland.

>> this is a live look outside. ominous look, but beautiful at the same time. full forecast coming up. 6:12. >> we can tell you we're not even a full month into the atlantic hurricane season. a tropical storm debby already a record-breaker. debby churning in the gulf of mexico and producing that rough surf, high winds and rain for much of florida's gulf coast. the tropical storm could grow to a category 1 hurricane before making landfall later on this week. this is the fourth named storm of the season and the first time there have been four such storms before july since recordkeeping

began 160 years ago. we'll have a live update on the tropical storm coming up at 6:45. >> this morning at least one person dead after a roof collapses at a smaul in ontario, canada. crews having a tough time reaching possible victims because the building is very unstable. at least 22 people suffering minor injuries. yesterday part of the roof that serves as a parking area crumbled two floors right near the food court. >> one of the most revved shrines in india is now revered -- now reduced to rubble after flames ripped through the building. the cause of the fire unknown at this point. thousands of devotes making a pilgrimage to the shrine every year. >> it's the dawn of a new political era in egypt as the country's first democratically elected leader gets to work. 60-year-old mohammed morsi has

moved into the office once held by dictator hosni mubarak. on sunday, the muslim brotherhood candidate was declared the winner of the country's first presidential run-off. president obama called morsi and to offer support. morsi expressed appreciation for mr. obama's call during a televised speech on sunday night. morsi also said he had a message of peace and his government would respect all international agreements. >> decision 2012. when it comes to the economy, half of americans in a new poll say it doesn't matter whether barack obama or mitt romney wins that presidential race. the ap poll finding people were pessimistic about jobs. when asked about unemployment, 60% said the november winner's impact would be slim to none. 31% think unemployment will grow

worse next year. >> the clock is ticking for congress to come up with a way 40 keeping interest. it's to go to 7%. on the table a compromise to extend the current 3.4% loan rate for another year. the democrats and republicans are still at odds over how to pay for the $6 billion plan. in the meantime, 3 million road, rail and transit jobs hinge on the decision of a transportation funding bill. democrats want republicans to take up the senate version of the plan. but the two sides are getting hung up on the portion that would speed up construction on the keystone pipeline. the bill is do by june 30. speak ebjohn boehner says the house may have to vote on another extension if both sides cannot reach agreement. >> this morning the fight over overanytime pay for farm workers is heating up. hundreds will converge on the state capital to support a plan

team. >> good morning, laura and jon. san jose will be known as gymnastic city usa. the pavilion being the center of this universe. athletes will converge on this arena to swep and tumble their way to the summer olympics. you can see that work is being done. by sunday we'll know which five women and five men will he want the united states in london. it's possible some of those athletes could come from the bay area. an all-american athlete at stanford university, he took the past year off for fun suddenies, to train and hopefully beat out 14 other men for a spot on the team. it has taken a lot to get to this, but in having to cope with the death of his mother to cancer when he was 15. >> my sister and i have been through a lot, you know.

winds are calm and that's why the fog is starting to settle in along the peninsula. we're getting five miles or better. it's going to be a process for the fog to develop. not going to see too much. area of low pressure is keeping those winds active. a jet stream is over northern california. we're going to see an area of low pressure drop in. not much of this area of low pressure. the winds i think we'll see some showers back here tomorrow morning. we stop your block, mostly cloudy, by 1:00 a.m. between 6:00 and 8:00, i think we'll be tracking some showers on the radar. it will be active at this time. seven-day forecast tells the story. we're going to climb, then level off. here is mike. >> first the update. the accident 101 off of the upper deck, that has cleared in the last few minutes.

an end without a verdict. the defense asking the case be thrown out because of what the prosecution's star witness said up on the stand. marla tellez joining us in the studio with an update on this situation. >> good morning. if the defense has its way the judge will declare a mistrial in the case of william lynch versus father lindner. the decision is expected when court resumes at 8:30 this morning. lynch beat the retired priest in los gatos in 2010, he says he did it out of revenge for the sexual abuse he fell victim to at the hands of father lindner. the father took the stand and denied the charges even though there is significant evidence to prove he did molest lynch, and despite the fact that the prosecutor told the jury father lindner would probably lie about it. so on friday the defense file add motion for a mistrial. we spoke to our legal analyst who says the judge almost has no choice but to declare a mistrial considering father lindner could now be subjected to a perjury

charge. >> it's likely now he is advised to get an attorney for further advice whether to testify. if he invokes his fifth amendment privilege, then all of his previous testimony will have to be stricken, and then the judge will have to try to unring that bell with the jury. that's probably too difficult to do. >> the prosecution says they fulfilled their legal obligation when they warned the jury the priest may not tell the truth. either way it's up to the judge. his decision is expected in about two hours. >> thank you. 6:32. new this morning fire investigator on two car fires in redwood city. after 3:00 this morning. the two cars were about a block from each other, one in the driveway of an apartment complex, the other parked on the street. fire investigators checking for any accelerants found near the fires. crews were able to put the flames out before they could spread to nearby buildings.

>> less than two weeks ago a suspicious fire burned several cars and two apartments on stand bow street. >> a burglar busted caught in the act by the people he was trying to rip off. police receiving the call sunday night from a home on wild bill way off hearn avenue. thanks to the dog they realized somebody was trying to break in. the wife, she called police while the husband armed himself and confronted the burglary and held him for police. this morning a 17-year-old from santa rosa is behind bars. >> in the east bay, friends of a family that lost a father and daughter in that deadly crash are demanding justice. they created an online petition asking the district attorney to prosecute the driver suspected of killing the two. police have recommended that the teenager face manslaughter charges. police say he was speeding when

he jumped a curb and hit the father and daughter while they rode their bikes back in april. >> there is new information about the crash in the south bay that killed a woman from mountain view. investigators think they found the man who may have caused it. officers say the woman lost control of her car, slamming into a tree on highway 85 saturday night. there was a license plate of a car driving recklessly in the area at the time and officers have since tracked down the owner. so far he has not been arrested. >> special education classes in oakland they are going to look different with the new school year. the school district slashing more than $4 million in special ed funding. among the casualties, several teachers and aides will not be rehired and class sizes will get bigger. the district made these cuts to fix a budget shortfall. >> the new 49ers stadium could lose $30 million in funding. santa clara county is pulling

money out. christie smith is live with what's behind the decision. good morning. >> reporter: good morning to you. this is not what the 49ers wanted to hear or the city of santa clara and in fact, they are questioning whether the county has the right to do this. construction began on the new stadium back in april, now comes word of a $30 million setback, money that was ear marked for the new stadium construction. a new county board that oversees property tax apparently made the decision rather suddenly. they'd rather spend the money on local government and schools but two years ago voters approved $40 million in redevelopment funds to go to the new stadium. the the state has since scrapped the redevelopment agencies so the new state law gives counties control over where the money goes. as to wheth the will be a problem the niners haven't said specifically but the front office said it would eat the

>> 6:40. jeopardy host alex trebek could soon be back on tv after suffering a mild heart attack. he should fully recover in time for the 29th season of jeopardy. it starts taping next month. doctors in los angeles are continuing to run tests on the 71-year-old after he was admitted to the hospital over the weekend. this is the second heart attack trebek has suffered. >> a talent search continues as america's got talent shifts over to las vegas. that's for the process of whittling down the list of contestants gets under way for more than 100 acts as we strip to the strip. make or break time. contestants survived the initial auditions and will try to earn a spot in the top 48 and the live show that starts up next week. >> they clearly have to step up their game. vegas is treacherous.

history. right now eight fires burning across that state. the biggest one in the high park fire burning now for two weeks outside of ft. collins. this one has charred more than 83,000 acres and destroyed 248 homes. meantime, a fire near colorado springs erupting this weekend morsing more than 11,000 people from their homes. half of the country's fire fighting fleet is battling fires in colorado. >> in the southeast it's not fires but rain causing problems. tropical storm debby causing torrential rain and heavy flooding along the gulf coast. jay gray joins us live in pensacola one of the areas getting drenched. >> reporter: fortunately, we're getting a break from the rain right now. the wind has picked up. along with concerns along the gulf coast as you talked about and part of the problem is that debby, tropical storm, is not moving very quickly at all. in fact, at all for parts of this morning.

sitting in the gulf churning in that warm water is continuing to dump rain on the state, and areas that don't need that rain. over the last couple of weeks they have seen torrential rains across florida in some areas record flooding and now adding more water. it's a desperate situation in those areas and it's going to continue for the next several days. forecasters uncertain of where and when the storm will make landfall. some saying it could reach category 1 hurricane status before that time. even if it does not this is going to be a dangerous storm already blamed for one death. one person died as a result of tornados and there is another concern that more tornados will come as a result of this system. so it's very dangerous, it's continuing to churn in the gulf and a lot of people wondering where it's going to make landfall. >> thank you very much, jay. >> 6:46. meteorologist christina loren is here to tell us about cooldown but --

>> one more reminder why this great state of california why we love calling it home. we have beautiful weather. this time of year typically we could suffer from extreme heat but that's not the case. look at that. the natural cooling back on. the golden gate bridge. the marine layer and the good news is the marine layer is forming, it's 1200 feet this morning but what we are noticing is that it's starting to thin out. quite a bit as the sun is now out. so we're not going to have completely cloudy conditions, a mix of sun and clouds. taking a live look now, beautiful bay bridge. just a beautiful start. and temperatures today are going to be just about as comfortable. we're not climbing by that much. a shot of cool air. the good news is calm conditions in half moon bay up to santa rosa. a gusty day yesterday especially by the water. as we head throughout today on the breezy side. we're going to see winds pick up for the second half of the day as the area of low pressure starts to get closer to the bay area. 53 degrees to start out in

livermore. here is that counterclockwise rotation. pretty potent storm for the summertime. we're now in summertime. it's going to take a ride on the jet stream, crossing to our north. we'll see the tail end move through the bay area. as it comes through instability, that will bring in the winds and we're going to get shower activity, a little moisture through the bay area as we head through tonight into tomorrow morning. we stop the clock at 1:00 a.m. mostly cloudy. 6:48. and right now it's nice and clear out there. as you get ready to head out the front door, if you're leaving for work, i want to say extra cautious. grab your shades. though it might be cloudy as you walk out you'll need them in concord, fair field, san jose. 73 degrees. looking for the 80s, we've got that a couple days away. wednesday, 84, thursday to friday, level off and cool down enough to keep your ac off as we head into the upcoming weekend yet again. take that pg&e.

priest. his trial began a week ago and on friday the defense filed a motion for mistrial. here's the issue. during opening statements the prosecutor told the jury the priest would likely lie under oath and deny the molestation charges that lynch brought forward 10 years ago. father lindner did at any the charges despite the fact that the search paid a settlement and others so. the defense flames that prosecutors broke the lie by putting acknowledged lies before the jury. by warning the jury they have fulfilled their legal obligation. it is now in the judges hands, he will announce his decision when trial resumes at 8:30 this morning. >> thank you. 6:55. a surprise turn of events in the construction of the new 49ers stadium in the south bay. santa clara county is yanking $30 million promised for the project, pulling it off the table.

christie smith is live at the stadium site where -- with where all of the money will go. good morning. >> reporter: good morning to you. this came as a surprise to the 49ers and the city, and they question actually whether the county has a right to do this. what's happening is that the county is looking at pulling about $30 million according to the "mercury news," that is voter approved money that was apparently earmarked for stadium construction. the stadium has been under construction since about april. the money is redevelopment money. the state law now gives the counties power to control where the money goes. the county wants to spend it for other things. so will this affect the stadium construction? the front office apparently said it would eat the loss, at least short-term which amounts to less than 3% of the cost of the entire stadium.
