somewhere. i promise to find it for you. i'm jim cramer. see you tomorrow. this morning on "early today," split decision. the supreme court strikes down key provisions in arizona's controversial immigration law. taking the plunge. a wedding party finds out the hard way how much weight a dock will hold. and royal elegance. it's your chance to own couture headgear once worn by duchess it's your chance to own couture headgear once worn by duchess kate. captions paid for by nbc-universal television hello and good morning. welcome to our viewers across the nation, including the pacific time zone. i'm lynn berry, and today we begin with an up-and-down decision. the u.s. supreme court delivered a mixed verdict to both the obama administration and the state of arizona yesterday, ruling it is constitutional for arizona police to check immigration status.

however, other sections of the state's controversial immigration law were thrown out entirely. nbc's steve handelsman has more. >> reporter: both sides had something to celebrate as the high court handed down the arizona decision. by 5-3 the justices upheld the most controversial part of the law, requiring police to check the immigration status of anyone they stop and suspect is not in the u.s. legally, the court rejecting the claim that that's only the federal government's job. swing justice anthony kennedy sided with court conservatives, writing for the majority, "the mandatory nature of the arizona status checks does not interfere with the federal immigration scheme. consultation between federal and state officials is an important feature of the immigration system." that's what arizona's governor jan brewer had argued. >> this is the day that we had been waiting for, and, make no mistake, arizona is ready.

civil rights will be protected. racial profiling will not be tolerated. >> reporter: but opponents of the so-called "show me your papers" provision will fight on. >> i believe it's the most venomous part based on race, based on nationality, and based on racial profiling. >> reporter: and the high court made it clear if arizona cops do profile or bend the rules to make arrests, the law could be back in court. struck down were the parts of the law banning living and working in arizona without papers and police arresting those suspects without warrants. president obama celebrated that but played up instead what he did on immigration. >> it's time to stop denying citizenship to responsible young people just because they're the children of undocumented workers. >> reporter: mitt romney, too, was cautious, saying in a statement the nation needs comprehensive immigration reform. i'm steve handelsman, nbc news at the supreme court.

well, elsewhere tropical storm debby is absolutely drenching florida's gulf coast. strong winds and heavy rain are expected to continue for several days there, causing flooding and power outages. nbc's jay gray has that story from panama city beach, florida. >> reporter: the winds have intensified, but it's the rain that's defined debby to this point, a driving rain, as much as five inches an hour in some of the hardest hit areas. rivers are spilling over their banks. water has swallowed countless roadways and now threatens homes, businesses, and even this church in apalachicola. >> we've been pumping for six hours and we're still pumping, hoping to get ahd of the storm surge. >> reporter: but in some places the race with mother nature has already been lost. >> thank god it didn't happen while we were here, but it's still emotional. >> reporter: emotions stretched to their limits in venice, florida, where a young mom died

protecting her little girl from debris during a tornado. forecasters say at least 20 tornadoes have been spawned as a result of the storm system, and there's a chance of even more before it's all other. high winds have knocked out electricity for at least 35,000 residents, and even as crews work to restore the power, they must still deal with all the water, understanding that in many areas more is on the way while the slow-moving storm continues to churn just off the coast. jay gray, nbc news, panama city beach, florida. well, now here is a look at some other stories making news early today in america. in michigan a wedding party met a watery fate after the small dock celebrants were standing on collapsed, sending everyone right into the lake. now, everyone was okay and they were able to even laugh about it. the groom says he could feel the dock leaning and tilting just before the whole thing gave way,

and the bride was remarkably good-natured about the whole thing. good for her. in california, it is paradise restored. a gunman tried to rob him after going to his door. the victim was able to get inside and lock the gunman out. the robber then tried shooting at least three times but the weapon jammed. the attacker is still on the loose. and, finally, in ohio if you had to give a name to an octopus, what would it be? the four-foot-long sea creature picked the winner herself using her tentacles to grab the toy ball with the name "cora" as in corral written on it. there were more than 2,000 entries. the other two finalists were scarlet and octavia. very creative. and now for a look at your national and regional weather, here's nbc meteorologist bill karins. he has your weather channel forecast. >> it's been pretty incredible.

the heat. salt lake city, one of the places been off the charts. we continue with hot conditions in the desert southwest. even for them it's been hotter than normal. we'll start and give you the latest on debby. it's a weak tropical storm but it's been moving slowly. these are notorious for producing a lot of flooding. the problem is in southern georgia and continues in north florida. sunshine state anything but once again. the storm system will remain pretty weak. it will be on the move to the east. should be right over the top of florida on thursday and exiting out into the atlantic as we head into the week. they'll get a little bit of relief as we head into the weekend. the heat, triple digit club is expanding. denver 105, billings 101, phoenix, 108. texas, kansas, oklahoma was in the 100s. the west coast remains kind of cool along the coast. also we're cool up in new england. so on each coast it's a little chilly. in the middle of the country we have the record and in sometimes some cases all-time record heat.

good morning and welcome back to "early today." i'm lynn berry, and here are some of your top headlines this morning. intelligence officials at the cia and other agencies are facing possible lie detector tests to stop information leaks to the news media. the director of national intelligence yesterday announced new rules to conduct investigations into leaked secrets. >> a general in syria's army is the latest to defect to turkey, and a nato meeting is being held today to discuss syria's shooting down a turkish plane. a lawyer for jerry sandusky says the former penn state

assistant football coach is defiant, says he is not guilty, and he is not suicidal. after his conviction on 45 counts of sexually abusing boys, sandusky wants a psychological evaluation done quickly so he can have visits from his family. a new study found h1n1 swine flu outbreak in 2009 was 15 times more deadly than originally thought. at the time more than 18,000 deaths were confirmed by the centers for disease control, but now researchers estimate over 284,000 actually died. and here's your chance to buy a hat worn by the duchess of cambridge. an auction today in london features two worn by kate middleton before she married england's prince william. and now here is an early look at how wall street's going to kick off the day. the dow opens at 12,502 after stumbling 138 points yesterday. the s&p sank 21. the nasdaq plunged 56. taking a look at overseas

trading this morning, in tokyo, the nikkei fell 70 points, but in hong kong the hang seng gained 84. well, europe's debt crisis dogged investors once again on monday. hours after a formal bailout request from spain, moody's slashed credit ratings on 28 spanish banks. that rattled investors over just how much cash spain will need. bank of america led the dow's losses as u.s. banks with european exposure took a beating. meanwhile walmart was the only blue chip in the black, thanks to its canadian expansion plans. chesapeake energy dropped 8% after a report it conspired with a canadian riff val to keep land prices down in oil and gas-rich areas. new home sales hit a two-year high in may, but debt worries overseas outweighed any optimism there. pfizer and bristol-myers squibb both sank after federal regulations delayed approving their highly touted blood-thinning drug. microsoft sealed its $1.2

billion deal to buy yammer, the so-called social network for the workplace. speaking of social networks, check your facebook settings. yesterday without asking users, default e-mails were changed to their facebook.com address. starting today, spirit airlines is charging a dollar to print your boarding pass at the airport. "the wall street journal" reports orbits has been showing mac users different and sometimes pricier travel options after finding apple users spent as much as 30% more on hotels than p.c. customers. >> and, finally, who says gambling doesn't pay? well, sort of. it turns out an anonymous donor who gave $1 million to united way, which was distributed in $500 gift cards to nevada families over the weekend was las vegas casino owner steve wynn. well, some good news there. coming up, the cards win in extras, the yanks tee off, and a pair of upsets at the world's oldest tennis tournament.

good morning. if you're just waking up, this is "early today." and in sports last night arizona knocked off two-time defending champion south carolina in the college baseball world series. here's nbc's fred roggin with an early look at all of your sports headlines. >> good morning, and we will start with high drama in the college world series. off to omaha we go. arizona and the two-time defending champ south carolina tied at one in the ninth. brandon dixon was put into the game for his glove, but came up with a huge at-bat. ripped a double down the line. scored the go-ahead run. dixon with his first hit of the college world series, and it was a big one. that opened the floodgates. wildcats exploded for three in the ninth. we go to the bottom of the inning. last chance for south carolina. sacks full for grayson greiner. hit one high and deep, but not deep enough. arizona held on to win 4-1 and capture their first national title since 1986. now to the bigs, cards and marlins needed extra innings. rafael furcal, a double just

inside the third baseline. tyler greene hustled all the way around from first to score. marlins blew a four-run lead in the ninth, and the cards won it, 8-7 in ten. robinson cano continues to hit the cover off the ball, smashed his 17th homer of the year. he's now had six in the last eight games. yanks had their way with the indians, 7-1. the nats' stephen strasburg was cruising, along and then this happened. nailed mark scutaro in the head with a fastball. thankfully scutaro was okay, but strasburg wasn't. clearly rattled, he gave up a pair of runs in the inning, and the rockies won it, 4-2. tough day to be an american at wimbledon. five-time champ venus williams lost her opening round match, and on the men's side, the highest ranking american john isner is also heading home after losing in five sets. and, finally, the party continued in miami. the heat celebrated their nba title with a ticker tape parade. hundreds of thousands lined the streets to catch a glimpse of dwyane wade, lebron james, and company. it's the franchise's second title. right now they're the favorites in vegas to win it again next year. that's your early look at sports on "early today."

the 71-year-old trebek who's hosted "jeopardy" for 28 years is expected to fully recover and be back to work for a new season in july. celebuzz reports that "hangover" star zach galifianakis will marry longtime girlfriend quinn lundberg. celebuzz obtained a wedding invitation, and reports -- it includes a drawing of the couple that makes him look, quote, like a little troll while quinn is a stunning tall blond princess. ouch. and, finally, uggie, the canine star of the oscar-winning film, "the artist" became the first dog to put his paw prints in cement outside hollywood's landmark, grauman's chinese theatre on monday. i can never say zach's last name. >> are you glad that i was in charge of that today? >> so happy. i don't get a lot of practice. did you practice that? >> that's what i do. there are some other ones. as you know, i definitely check them.

and this comes to us from kare-11 news in minneapolis where in nearby maplewood, minnesota, it was a family reunion nearly eight decades in the making. 76-year-old betty lou and her 83-year-old sister delores had never met until now. delores had been given up for adoption when she was just a year old, and their mother later died, and betty lou herself was adopted. well, delores eventually went on line and found her long-last family living in michigan. isn't that amazing? they call it a missing piece that now gives them some peace. i'm lynn berry. this is "early today," just your first stop of the day, today on your nbc station.

well, in switzerland it wasn't a bird or plane, but a jet man flying in the sky. that's right. the first jet-powered pilot in full flight dropped from the sky traveling at speesds of 127 miles per hour about 4,000 feet in the air. after seven minutes of flight, using his body and legs to steer, the pilot parachuted safely to the ground before exhausting the fuel supply. well, one training camp in germany is putting a new spin on two traditional sports. olympic hopefuls took their stab at throwing a seven-foot long javelin at a giant dartboard. while it is far from a sport they're hoping it will give them the edge in london. participants say the relaxed atmosphere and novelty made it a fun competition. and, finally, one
