than a quarter of a mile away. crews also put out a garbage can fire there. several people were displaced. no one was hurt at either fire. >> in a few hours the lawyers in the william lynch trial asking again to have that case thrown out. lynch is the south bay man accused of beating up a retired priest who he claimed sexually abused him as a boy. bob redell is live outside the hall of justice in san jose with more on the legal maneuvering. what's happening out there? >> reporter: good morning, jon. the priest, father jerry lindner, the victim in this case, who exercised his fifth amendment right not to say anything else on the stand. this is a right that some people exercise in order not to say anything incriminating against themselves. this means that father lindner won't be able to testify further against william lynch, the man accused of beating him up two years ago. the defense won't be able to cross-examine him and all of his previous testimony will be stricken from the record. his decision to take the fifth

comes after his denial on the stand last week that he had ever sexually assaulted william lynch on a camping trip 35 years ago. both the defense and the prosecution believe father lindner lied when he made that denial. should be noted he has never been publicly -- never publicly admitted to the crime and was never charged because the statute of limitations had run out. this morning the defense will ask the judge to declare a mistrial. >> we are supposed to get the opportunity to question him and cross-examine him and we don't get to. i think it's a laughing stock of justice. >> certainly the main witness in this case is gerald lindner. who is to say what occurred in that room unless he is willing to say it. >> reporter: the defense has already asked the judge twice to throw out the case against william lynch. twice yesterday, first because they argued the prosecution knowingly allowed the father to falsely testify.

second, for prosecutorial misconduct. the judge rejected both requests. if he were to reject the third request expected later this morning, the prosecution says it believes it can proceed with the case against william lynch in spite of the fact it would not have the testimony of his accuser. reporting live, bob redell, "today in the bay." >> antioch police continue their search for an armed gun man whose crime was caught on camera. the suspect is seen confronting eric gilbert after he pulled into his drive way. very bold. several times that gun man pulled the trigger but the gun doesn't fire. gill sbe gilbert is able to get in his home. the neighbor certainly watch out for each other. >> we are a neighborhood here. the people here we for the most part try our level best to have a good neighborhood watch and do what we can to help each other.

>> gilbert says he installed the surveillance system last month for safety and as peace of mind. >> wow. so lucky to be alive there. on the peninsula, a teen under arrest after deputies say he tried to run them down in a stolen car, this all happened at the intersection of rutgers and fordham on monday night. the sheriff's office says its car theft task force was trying to arrest that teen. a deputy fired at least one shot at the car. the teenager was caught and arrested. >> a prostitution bust has turned into a rescue mission for a group of young teenage girls. the fbi says they were being exploited as sex slaves. the fbi along with police and sheriff departments say six teen girls at the center of the local ring were victims themselves, sometimes brought here from other countries. >> they are brought under false pretenses, they are told that for this amount of money they can get their visa, they can

live in this country and you can never get out of it. they are paying -- being prostituted and they are working their way for their rent, for clothing, for their trip over here. so, it's a never-ending circle. >> instead of being arrested the teenagers will get help with housing and counseling to ensure they do not return to those that exploited them. seven suspected pimps could face charges of human trafficking. >> the verdict 18 property tax fight, the state's top financial officer sided with the city of san jose and ordered leaders to release 86.5 million in property taxes. the county defended its decision to withhold those funds saying it was its interpretation of the law dealing with the money slated for the now defunct redevelopment agency. >> it's 5:05. a controversial refueling station at sfo may have run out of gas. negotiations have broken off between the airport and

operators of a planned hydrogen station. neither side could agree who would take full responsibility for any possible mishaps. the airport feared a gas explosion similar to what happened in san bruno. sfo leaders deciding tonight whether to kill the project. >> as the saying goes nothing in life is free but today something is for some people. ac transit giving away passes for free bus travel. christie smith is live with who qualifies for some of those free passes. good morning. >> reporter: good morning to you. we've been trying to speak with riders but it's still a little early. we haven't seen any yet. who doesn't like the word free. we're talking about eight days of free bus passes if you want to try something new and you travel between the east bay and san francisco. so, ac transit employees are going to be giving out free passes today between noon and 2:00 at the temporary transbay terminal in san francisco.

we are this morning -- they are doing this to kick off summer awareness about transbay service that some buss have wi-fi, you can check your e-mail on board. this is only for new riders and it's on a first come, first serve basis. a one-way trip which normally costs about $4.20. just trying this out would be a savings. the pass is loaded onto a clipper card, the terminal where we are now is bordered by howard, beale, main and folsom streets and the passes are good until july 3. >> thanks a lot. >> free is the magic number. some might say our forecast is free but i say it's priceless. >> trying to get on my good side. >> always. >> you want to keep this good weather in place. it has been beautiful out there. i wish i had more control over it. i'd keep it like this all year long. then we'd be hawaii. temperatures are going to be

comfortable. we're starting out in the 50s. it is crisp out there, a beautiful start in san jose. 55 degrees. if you had to work yesterday, didn't have an opportunity to get outdoors we're going to have a repeat. i believe the clear start over san francisco will change through the next few hours. i expect the marine layer to push all the way to oakland, probably not making its way to livermore or san jose. for us that means that it's not going to be as clear getting the best drive. we'll have your update in a moment. the calm conditions are leading to the fog. already noticing the fog in half moon bay. 65 at noon, 79 at 4:00. we do have changes on the way. temperatures are going to climb about 10 degrees through tomorrow and then level off as we head into the weekend. it's not too early to think about the weekend but you've got to work for it. the man to help you get there in a timely fashion, here's mike. >> unless you are driving a big

rig and your brakes are locked. that's what we're tracking. we're looking at southbound 680 around south main street. the off ramp is the landmark for this activity or inactivity. let's give it a traffic alert. chp don't have a sigalert b. half of the lanes are blocked. i expect another half hour at least. they need big rig tow truck to get it out of the area. further south we're looking at the issue off 680, foothill road, car down a ditch. use the main highway to stay away from all of this activity. a look at 880, oakland area, look at the smooth drive northbound with the taillights southbound. i almost mistook the oakland

a nice look over the bay. san francisco t water out there, old glory blowing in the wind. i like this time of day. very peaceful. no traffic either. 5:13. >> brain scans may be able to spot the signs of autism in children as early as age 2. researchers at children's hospital in boston compared the brain scans of autistic children to children developing normally. they found distinct differences in the brains of autistic children in the area that handles language. the researchers hope to use the results to develop a diagnostic test for autism. >> a common house chemical may raise the risk of a dry itchy skin condition. a new study shows women who were exposed to high levels of the chemical are more than likely to have children with exa ma.

to health reasons just four months into the job. after spain requested a bailout for its banks, now cyprus is the fifth country to ask for more aid. plenty of drama in europe. the dow will start today, the nasdaq at 2836 after falling 56. later today in the u.s. we're going to get home price data. home builder lanar is reportedly in talks with a chinese bank to secure $1.7 billion in capital. the "wall street journal" reporting it would use that money to jump start two projects in the bay area, treasure island and hunters point shipyard. it wants to transform the former naval bases into large scale developments with up to 20,000 homes, retail and office space and a sports arena. if the you are a mac user, listen to this. reports say that mac users tend to spend more. they are kind of bigger spenders, about 30% more per

a survey by bank rate.com shows 28% of americans don't have enough money to cover their bill they lose their job. only 25% of people say they have 6 months of savings. that's the minimum amount financial experts say you should have saved in case of an emergency. squirrel it away if you haven't. your boss may be taking time off this summer but you're probably not. >> a new survey shows more bosses are taking vacation than their employees. you know why, they are the boss a. survey shows 81% of managers have taken or plan to take vacation this year, that's compared to just 65% of full-time employees. the survey also showed vacations still financially out of reach for a lot of americans, one in five workers says they can't afford to take time off for vacation. >> they are the boss. pretty nice if you want to stay local. >> yeah, for the boss, great

looking weather for today. temperatures in the 70s. for your boss too. everybody getting spoiled across the bay area. l.a., it's going to be hot. we beat them last night. going to beat them in the weather department as well. 5:18. a live look over alcatraz. a beautiful start to the day, crystal clear even at the coast. there is some fog but doesn't look like the marine layer is getting further than oakland if it even pushes past the bay bridge. 54 in livermore. 55 in san jose. temperatures are on the mild side today. and that breeze will pick up for the second half of the day like it did yesterday. it won't be as gusty and that's good news if you suffer from allergies. we won't see as much pollen in the atmosphere but still, a little on the breezy side especially across the bay, the east bay hills in particular. sun and clouds today. tomorrow morning another round of drizzle. right at the coast. the immediate coast.

temperatures are going to be warmer by 5 to 8 degrees as we head through wednesday. today we're holding on to the upper 70s in livermore, 81 in concord, 67 in san francisco, and right around 73 degrees in oakland. tomorrow, we're going to peak about 85 degrees, thursday mid-80s, then the 70s return for friday through the weekend. but that means you want to make outdoor plans, you're not going to get too hot friday through sunday and that's good news if you have the kids home with you. let's check your drive. mike's got kids, keeping him busy. >> they are home. we have day camps, we just learned to ride a bike, one of them. i'm talking about me, actually. eastbound 237 and 880, that transition is closed by overnight construction for a few minutes. also here, 280 at 85 we have a crew there and the transition, currently closed there. i'll let you know when that reopens. the detour typical is still there and again, to about maybe 5:30, 6:00 the latest i've seen that reopen.

looking at construction at 101, around marshall university, we have crews clearing in the process from the scene where the dumbarton bridge has cleared. no slowing for 84, 92 a little to the north, san mateo bridge, a live look out there. very smooth drive. there is the high rise. a clear view, coming eastbound, and westbound away from the toll plaza, about even amount. a nice look at the low clouds but not a problem for visibility. to the east bay, our maps, the bay bridge, a smooth drive into and out of san francisco. southbound 13 at 580, a crew there for construction for a few minutes. we're following that alert here that i'm giving for folks, half of your lanes are blocked. south main, a truck with the brakes locked up. we don't know when they are going to clear that. we have 50 miles per hour through antioch t slowdown has started already. traffic tuesday. >> thanks so much. 5:20. tickets for this week's u.s.

bob redell joins us live outside the hall of justice in san jose with more. good morning. >> reporter: yes, good morning to you. the latest twist and the twist is father jerry lindner, the accuser in this case, has exercised his fifth amendment right not to testify on the stand anymore, a right that some people exercise to avoid saying anything that might incriminate them. this means father lindner will not be able to testify further about william lynch, the man accused of beating him up, the defense won't be able to cross-examine the father and all of his previous testimony will be stricken from the record. his decision to take the fifth comes after his denial on the stand last week that he had ever sexually assaulted william lynch on a camping trip 35 years ago. the defense and the prosecution believe father lindner lied when he made that denial. he has never publicly admitted to the crime and was never charged because the statute of limitations had run out.

this morning the defense, that woulding william lynch's team, will ask the judge to declare a mistrial. >> the jury has heard a lot of information that william lynch assaulted him. is the jury going to be able to disregard that if they strike his prior testimony. >> actually want father lindner on the stand. we want the chance to have the truth. >> reporter: the defense has already asked the judge to throw out the case against william÷q . this was yesterday, first because they argued the prosecution knowingly allowed the father to falsely testify, and secondly, for prosecutorial misconduct. the judge rejected both requests. if he were to reject this morning's request the prosecution believes it can proceed against william lynch without the testimony of his accuser. reporting live outside the hall of justice, bob redell, "today in the bay." sating a

pair of suspicious fires. both happening at the same time and same apartment complex near 85 and blossom hill road. a short time later around the corner on coy drive. firefighters were able to put those out which were originally called in as garbage fires. there's mostly smoke and superficial damage to the buildings but 17 people ultimately were displaced by the fires. >> 5:33. the san francisco district's office will decide whether to file charges against a veteran gay rights advocate over child porn. 66-year-old larry brinkin worked for the human rights commission before his retirement in 2010. he was taken into custody friday after police say he had child porn pictures and e-mail attachments linked to his account. he is out of jail. >> a man wanted for parole violation and recent child abuse

charge now under arrest for fighting with police. this morning an armed suspect recovering after being shot by antioch police. the police tell us paul morales pulled out handgun when offered approached him. investigators say an officer fired at morales in self defense. >> the contra costa fire district fighting to save a third of its fire stations. the district says the total of 28 fire stations are on the line, unless voters pass a tax hike in november. earlier this month a partial tax known as measure "s" fell short causing east contra costa to close three stations. they are expected to ask for an $88 annual tax for five years, about half the number of money and years as the failed measure "s." >> some of the most vulnerable could be taking a hit in sacramento's latest proposed budget cuts. the governor and democratic

leaders looking to eliminate the healthy families program. this will provide medical care for low income families. supporters say it would save tens of millions. critics say it would force nearly a million children into the strained medical system. a vote is scheduled for tomorrow. >> a free ride for bay area commuters. they see transit giving out passes to encourage ridership. christie smith joins us live in san francisco. good morning. >> reporter: good morning. say you carpool into the city every day for work, then think about trying something new. this would be the perfect chance to do that. ac transit offering eight days of free bus passes. ac transit workers will be giving them out today between noon and 2:00 at the temporary terminal in the city, the idea is sort of a summer kickoff to promote the service. they offer about 500 trips a day

they are going to have an effect politically. the health care law, that decision we're waiting for later this week, like we saw with the immigration decision yesterday, a split decision with the most controversial part of the law standing, the law enforcement offices can check the legal status of people they stop but they can't stop illegal immigrants from working or force them to carry papers or arrest them on small offenses like jay walking. president obama says that he hopes that it won't be enforced in a way that reinforces racial profiling. mitt romney in response said the states like arizona, do need the power to enforce their own borders. now we look forward to thursday when we expect the final decision from the supreme court on the health care law. the biggest question here is will they allow the individual mandate to stand, saying that the federal government can require everyone to buy health insurance. >> thank you for the update, tracie. it's back to the drawing board

for gilroy schools, attempt to raise the sales tax to pay for classroom improvements has failed. it would have been only the second district in the state to take a step but last night a proposal to put a quarter to a half cent tax increase on the november ballot came up short. >> we don't have the programs that we used to. and the thing is, we've got to let the citizens decide what they want. >> they could choose to go on internet sites out of the state to avoid even paying sales tax. so that's not something we want to encourage if we're trying to grow business in gilroy. >> gilroy is facing an $8 million shortfall in its school budget. both sides say it's possible they may revisit the issue in the future. >> internationally japan doubling its sales tax to 10% over three years, the prime minister says the radical step is needed to rein the growing deficit. the two main opposing parties

>> we're looking at the south bay with a nice flow of traffic for 101 up toward 680 where we often see the first signs on a tuesday. no slowing shows up there yet. construction still east 237 to 880, that crew should be clearing, we see a slowdown for 280 around 85. that should be clearing over the next few minutes. that may be an indicator of equipment moving in the area. no incidents reported for southbound 280 into the south bay. we're looking here to the construction between university and marsh. that section of 101 should be cleared and no slowing that showed up. they are clear as well as the dumbarton bridge. you see things moving smoothly westbound, that's your commute direction away from the hayward side to the peninsula, over the opposite direction an equal amount of traffic and smooth flow. 50s all the way across the span, the way it should be across that water. a live look at the sensors showing up the green. the bay bridge, an easy drive as well. construction crews have cleared.

they sprung on their users. good morning. >> reporter: certainly a big surprise for so many users, i put out a message on my facebook page today and many ever my friends say they did not know about this. this is news to a lot of people. the news is that your e-mail address linked to your facebook account has been changed, as jon said. it's now an at facebook.com e-mail. i logged on to my account because i was not aware and in my account settings there was my new facebook address with a message that says, quote, your facebook e-mail is based on your public user name, e-mail sent to this address goes to facebook messages. so sure enough, i to double-check i sent an e-mail to my new address and it showed up in my facebook messages. many of the 900 million users are not too happy because they say it's not necessary. they say they were not notified. the company says otherwise they say they announced it a couple
