christie smith is live in oakland on the effort to eradicate what was once nothing short of a death sentence. good morning. >> good morning to you, john. it's estimated by the centers for disease control that 1.1 million americans are infected with hiv, but up to 20% of them don't know they have it. this program aims to make testing easy and free at places you already go to like pharmacies, including this one here in the fruitvale district. two dozen walgreens stores are among dozens across the country giving free hiv testing today through friday. the centers for disease control is launching a pilot program to train staff at pharmacies to actually do the testing. $1.2 million program will offer fast and free hiv testing year-rou year-round. mike's pharmacy in oakland will soon start. the idea to make it quick and easy.

>> they have a source. they're not intimidated. they can come down and feel free to get that test done. >> reporter: now, here in alameda county, the health department says they need help to get people to take the cheek swab test. nearly 5,000 people have been diagnosed with hiv here, and reaching those most at risk has been a real challenge. it takes about 20 minutes it to get your preliminary results. reporting live in oakland, christie smith, "today in the bay." they have called off the search for a baseball fan that fell into the bay after amonday night's giants game. friends last saw the 27-year-old as they headed for cars parked on pier 32. searchers in fire boats and a helicopter scoured the water looking for that man on tuesday, but the search was called off around noon. police say the missing fan is from the sacramento area. you want to talk about a scary start to a summer vacation for a livermore family. 16-year-old sage sinclair was

swimming with her father at a resort in maui yesterday when a shark swam up and bit her. they were 10 to 15 away from the shore in shallow water. the grenada high school teen suffered a 4 to 5-inch gash in her left gash. we spoke to her mother, kim sinclair, by phone. >> my husband felt something hit his back, and then the next thing went quickly. i heard sage scream. >> authorities posted shark warnings signs out there on the beach and closed it for a portion of it. sage's mother says her daughter right now is doing pretty well, and she's actually tweeting about the attack to her friends. sign of the times. shark attacks we can tell you are rare in hawaii, pretty rare globally. about 100 shark attacks reported each year. there were 17 recorded deaths caused by shark attacks all of last year throughout the entire world. right here in the u.s. we average 16 attacks each year and

about 1 death every two years. a5:03. oakland investigators suspect charles electric ket killed a manager of a sizzler steak house. he pleaded not guilty and says he was out of town at the time. investigators say dna evidence and eyewitness accounts will link him to the murder. more police officers will soon be patrolling one east bay city, antioch spending more than a million dollars in federal funds to hire five officers. the city was the only one in contra costa county receiving a grant from the department of justice. recent budget cuts reducing antioch's police force to 35 officers. a new budget disagreement this morning in sacramento. both houses are set to vote on 21 budget trailer bills today, laying out detailed plans for raising revenue and cutting costs. some lawmakers and public say

more time is needed to review the bills. republican leaders say it could lead to more unnecessary spending. jerry brown reached pay cut agreements with more than half of the safe public unions. the seiu signed off. the fill her up may take on a whole new meeting in san francisco. they're introducing a bill to require building owners to install tap water billing stations. they say it will reduce the number of plastic bottles in landfills. right now water bottle filling stations are located at airports and schools. p if approved, the law would go into effect next year. we'll chex the forecast right now. it's been so nice lately. >> it's just beautiful. it's that time of year that we look forward to in the cold winter months, and it could be scorching hot next week. it's looking much warmer.

we're at 53 in oakland and 55 comfortable degrees here in san jose headed towards the 80s for today. the hour by hour forecast looks like this. 55 degrees bayside as you break for lunch and 62 degrees at the coast roupds out the day. noticeably warmer and 75 degrees at 4:00 p.m. and bayside at the coast and 68 degree. your forecast is moments away. >> we have a car fire i was telling you about. this was over on the shoulder at westbound 580. a light volume of traffic, and this is not a big inferno so it sounds like traffic is getting by without a problem and no injuries are reported. i'll continue to track this until they clear it from the scene or until they tell us otherwise. we're looking over the drive, and 580 and 880 through oakland move without slowing. a note for 880 up past 980. the fifth street off ramp might be affected, although chp isn't

doing traffic control. a truck is on fire around seventh and market off the freeway, and we'll tell you if chp gets called in to assist. they had the report and cleared it. oakland fire says they're putting that fire out. we're looking at a live view past the bay bridge toll plaza with a nice easy drive right now. that's a pleasant look with all the colors, but none involve the meters lights because they're off right now. back to you. >> that makes it pretty as well. thank you. pretty great news for summer beach-goers in california. a report ranking the cleanest beaches in the nation is due out today, and california is leading the way. the national resources defense council gives only 12 beaches five-star ratings and parts of newport beach making the grade. in our ratings is consistent water contamination problems and beach safety. the full list is released this morning. >> you can take some nice surf

welcome back, everyone. this is a live shot over colorado springs. over the weekend, yeah, about 30,000 residents over that amount were forced out of their homes. this fire burning more than 6200 acres since saturday. that's about 10 square miles, and they say that the temperatures rising into the 90s and high winds making this all the tougher to battle. we will keep you posted on this one. >> tough go of it there. >> no doubt. the olympic spirit is a much brighter note in sum swing in san jose as the u.s. gymnastics trials continue. >> some of the best athletes around the country including here in the bay area are competing to represent the red, white and blue. we're live at san jose's hp pavilion with an update on today's competition. it's exciting that it's here. >> reporter: you know what, laura? you're absolutely right.

this is the first time that san jose has hosted the u.s. olympic trials, any olympic trials. as you mentioned, it's the gymnastics and it kicks off tomorrow. hp pavilion is empty right now, but later on what's going to happen is more than two dozen gymnasts compete and fill up the floor here and train for the cameras because today it is media day ahead of the official start to the trials tomorrow. they're going to do interviews for the cameras. joining me this morning is jim sparako with hp pavilion. he let us in this morning. this is a first for san jose. how big of a deal is this? >> it's a very big deal. i think right now the country's starting it to get olympic fever, and this weekend the entire country is focused on san jose. this is the biggest event that's going on this weekend in terms of the olympics and preparation.

games. hundreds of american law enforcement is in london right now to keep the olympics safe. they team up with the british, who have an arsenal of weapons in their disposal like anti-aircraft missiles. intelligence officials say there have been an increasing amount of chatter among extremist groups, but there are no specific threats to olympic games. make sure to check out all of our exclusive olympic coverage on air and online. you know how to do it. online go to nbcbayarea.com, sign up for our newsletters on our local athletes, and you can subscribe to something very hot. it's called the torch. the day's most talked about olympic stories. turning to other news this morning, the judge is blocking all sales the samsung's galaxy tablet in the u.s. a temporary injunction is in place while the court decides if the tablet is a rip-off of apple's popular ipad design. the judge says apple has built a strong case and says the company's two tablets are

virtually indistinguishable. samsung says it's disappointed with the court's decision. the ruling is a small part of a much larger patent battle between the two tech giants scheduled to go to trial next month in san jose. speaking of tablets, today a bay area tech giant is hoping to give apple's ipad a run for its money. >> we've seen challengers get knocked out in this field. for that and the rest of the news before the bell we go to ber at that live at cnbc world head cquarter headquarters. good morning, bertha. >> the tablet wars continue to heat up. microsoft recently unveiled one of its own. google holding it's annual developers forum in san francisco today, and it's expected to show off a google tablet device. reports say it will be one of the 7-inch screen ones and compete more directly with the amazon kindle than the ipad. it runs on mobile software called jelly bean. i love the name of their

software. features include a voice activated assistant similar to apple. yahoo! is adding the popular music streaming service to its site filling the void after it shut down yahoo! music in 2008. spodi p fy has 3 million active users. yahoo! will add an app on spod fi's site. the futures are a touch higher after stocks ended up yesterday. it was a roller coaster session. early on we were down on negative comments through germany, angela merkel threw some cold water on the fiscal plan. markets recoveried after we got data the home prices rose in april. it was up over 3% in terms of prices from march to april. that was the first monthly increase since last fall, and that offset the negative consumer confidence number. consumer confidence is down for

four straight months now. this morning we get data on demand for durable goods and on pending home sales. the dow rising 32 points to 12534 to end the day. the nasdaq starts today at 2854 after gaining about 18. you know, so far this year the nasdaq is up about 12% for the year, and half of those gains come from apple's stock, up 40%. >> we'll take that. very positive. bertha, you inspired me this morning. jelly beans and ice cream sandwiches. breakfast of champions. i'm all in. >> there you go. >> thank you very much. >> see you later. the air force reserve says it needs high-tech help. leaders are looking for someone to design an app for the branch to help recruits adjust to basic training and military life. the app wish list is very long including a feature combining exercising and nutrition and a way to count calories based on

picked up by a light breeze out there. as we head throughout the day, that breeze will pick up like it did over the past couple of days. it this morning we're in the 50s. 54 in livermore, 49 in napa and 46 degrees to start you out in navado. cool enough for a jacket this morning. today you'll shave that jacket right off at about noon inland. it will be warm. temperatures in the 70s, so about as warm as it was in the heat of the day yesterday. high pressure is the reason why. it will drive those winds out of the north, and that is a warm-up for us. warmer weather today, 5 to 8 degrees warmer than yesterday. by tomorrow holding onto temperatures. a little cooler. we cool off as we head to the upcoming weekend. we have that seven-day forecast in a few moments. 81 degrees and 67 today in san francisco, and you hit 83 degrees in santa rosa. here's that seven-day forecast. 82 degrees by thursday, so a little lower than the seasonal averages by 1 or 2 degrees. then we continue to drop off in

temperature through sunday, but look at the difference between sunday and monday as we hit wednesday of next week, we're going from the mid-80s on monday, hold onto the mid-80s on tuesday and jump into the 90s by wednesday. hotter weather on the way. enjoy this tranquil, light breeze. beautiful conditions while they last. 5:21. let's see how nice it is on the actual roads. here's mike. >> the freeways move smoothly, but we have incidents to call out. northbound 101 at old oakland road. we have the accident to the shoulder after the earlier traffic break. not a lot of slowing there. we see slowing for northbound 87 around capitol. we'll watch that and see if it's a blip. no incidents reported. we'll track that. we look at the construction there for 85 between 237 and 101. even the moffitt on ramp opened early. that's great news. opening up all lanes both direction between mark and university. 101 might see slowing as crews clear but not a big deal right

this is "today in the bay." welcome back, everyone. 5:25. take a look at this in florida. tropical storm debby now downgraded to a depression. a massive amount of rain caused a lot of damage. look at all the flooding adding up there. more than 2 feet of rain deluged the gulf coast since the storm moved in on friday prompting that massive flooding. debby will head out into the atlantic today, so good-bye, debby. >> that is mind-blowing.

let's find out about our wednesday weather. >> we have a good-looking forecast for today. temperatures are going to be in the 80s, but i want to start with your seven-day just to show you the drop-off and pick up. we keep swinging temperatures up and down, and no different as we head through saturday and sunday. temperatures in the 70s. by monday and tuesday we start to heat up, and wednesday into thursday, the 90s and triple digits return. enjoy beautiful conditions while they last. tomorrow is the best day for outdoor fifactivities inland. >> we got another update from chp. this truck fire over at oakland is off near the end of the market street off ramp. if you get off in oakland at market taking you over towards seventh west of the freeway, there may be traffic control in place. we're getting word from chp on what they're doing farce that oakland fire and the big rig off of the freeway on those surface streets just by that off ramp. we'll track this and send it

of aattacks a retired priest. he admits he beat father jerry linder two years ago at a retirement home. he said he attacked father linder because he sexually abused him and his brother nearly 40 years ago. the judge in this case says he will not hear testimony from lynch's niece who claims linder abused her as well. >> if i were to testify, he would be in there, and i wanted, you know, him to have to face me. >> the judge has also thrown out father linder's testimony after he decided to take the fifth. lynch could take the stand later this week. this morning we're learning more about a violent death that rocked an upscale east bay city. they have arrested a 62-year-old man for killing his long-time girlfriend tuesday in the kitchen of the home on marago way. off officers arrested the man after he went to a neighbor's house to call the police. the murder weapon was dropped between two the houses, but so

far they will not confirm the type of weapon. the name of the 51-year-old victim has not been released. this is the first homicide in orinda in about a decade. pg&e claiming the cause of the san bruno pipeline lies deep in the past. they say a strength test done on the pipeline in 1956 is ultimately to blame. the company says an already defective weld was damaged during the test, and more than 50 years later it burst triggering the deadly explosion. state regulators questioning that claim insisting there was no such test. in a statement the president of pg&e says, it is important to note that while pg&e disputes many of the cpsd's findings, we do not dput our liability for the accident. the city of stockton is set to become the largest u.s. city ever to file for bankruptcy. the city council will file for chapter 9 protection as early as this morning. council members will vote on a

special bankruptcy budget to help close next year's projected $26 million deficit. at a meeting last night, dozens of stockton residents r outraged. >> we appointed you and put our faith and trust in you and you disappointed us and let us down. the world is watching so they can see he we're victims of a society failing us. >> the city is reeling after making drastic cuts to employment as well as staffing of both the stockton police and fire departments. no doubt about it, a busy time of year as state lawmakers have a lot on their plate this morning. top democrats say they're focused on accomplishing four items before going on vacation next week. first on that list, finishing up the budget, which lawmakers are now set to vote on today. they also want to pass foreclosure relief legislation, secure for funding for high-speed rail and pass pension reform. >> these are big issues, and i don't think they ought to be -- i'd prefer that they not linger over a long, hot summer.

>> steinberg adds all of the issues have been properly vetted in public and should now be decided before the break, but critics claiming there simply isn't enough time to get everything done. california teachers and students could have an even shorter school year. a new education budget bill allows schools it to cut 15 days of each of the next two years if voters reject tax hikes in november. that means districts could go down to 160 days for the school year. the standard used to be 180 days. 5:34 right now. the last couple days has been nice to get out and take a stroll out there and enjoy the weather. christine says get ready and smile, more of the same. >> we're getting spoiled, and yes, we're the envy of the nation. those dodgers, lucky to be here. they're lucky. hey, we're luckier because we beat nem twice in a row. bring your brooms tonight, dodgers it's on.

temperatures are comfortable for the day game. beautiful sunrise over the city by the bay this morning. 52 in sat mateo in start and 54 degrees in san francisco. he stopped the clock at 10:00 a.m., and you can see one little patch of clouds, that's it. that's all we see today. not much. full-on sunshine, good air quality. embrace it, as things are changing through the next few days. 73 degrees as of noon today and 85 at 4:00 p.m. and bayside 65 degrees at noon and 75 degrees in the heat of the day. the seven-day outlook is coming up in the next report. first is mike and your drive. >> focusing on that big rig that was on fire, i say was because it sounds like the fire is now out in oakland just off of 880 at the market street off ramp. we have a temporary closure of that off ramp. chp says it's of an unknown duration. from what i can tell, it sounds like the fire is out. they confirm the fire is out for

that big rig, and it's off to the shoulder. we should see that off ramp re-opening. for the meantime, consider using the broadway off ramp as you get there as you alternate into downtown, which is relatively light right now. >> it's in the northbound direction on the right slowing a tad bit at the high street off ramp. the flow of 880 is smooth through downtown and not a problem. very manageable to the bay bridge toll plaza, but the volume is building up, the east shore freeway is an 18 to 19-minute drive until you get to this spot, guys. back to you. right now we update you on colorado fires burning out of control. this is a live look out there in colorado springs. forcing the evacuation of more than 30,000 residents there. now threatening the u.s. air force academy. the waldo canyon fire has burned more than 6200 acres since saturday. if you want to check that amount, that's nearly 10 square miles. forests of dead trees from the

this is "today in the bay." welcome back. a live look outside, golden gate bridge. that's about the only place so far this morning. some of these live looks that we take, kind of cloud cover and fog hanging on just a bit. should be a nice day on top. we'll check in. the microsoft office is under attack in athens, greece after three people drove a van through the front doors and set off an explosion and set fire to the building entrance. there are no reports right now of any injuries, however, as a result of the pre-dawn attack. there are no immediate claims of responsibility. greece has seen similar attacks by domestic terrorist groups for decades. in syria this morning, gunmen raided a headquarters of a pro-government tv station damaging the building and killing three employees. it happened in the town just south of the capital of

damascus. hours after the attack, the station was still on the air. the privately owned station strongly supports president assad regime. just yesterday assad addressed his new cabinet telling them, quote, we live in a real state of war from all angles. he also dismissed calls from western countries for him to step aside. he gave no sign of taking a softer proesh tosoft er approach to a pro-democracy revolt. a tabloid is calling a woman a soccer mom madam. she posted bail last night after spending four months behind bars. they say she ran an upscale brothel at a manhattan apartment for 15 years. christina says she was running a dating service. although she's free from jail, she has to wear an ankle mon for until she returns to court in august. congress right now

scrambling trying to might important deadlines before the start of that summer break. >> if you're looking to pay for college or looking to work, the deadlines could affect you. tracie potts is live on capitol hill to explain. good morning. >> reporter: good morning. let's talk about work. it's aa thing on everyone's minding, including congress. they have 2 million jobs to be created or saved by this it weekend by passing a big highway bill. we understand that there is a plan in the works to try to get that done. tack onto that highway bill student loans. those rates double july 1st if congress does not act. they are trying to keep them low at 3.4%, but it's going to cost $6 billion. we understand, again, there's a deal in the works to raise the cost of pension insurance company for companies in part to try to pay for that. then finally federal flood insurance, that actually runs out next month. the senate is already working on that, but according to the democratic leader there, there is one republican who wants to force a vote on conception

in the weather department as we head through this afternoon. tomorrow, even this weekend hoing on to really comfortable conditions. 5:48 now. taking a live look, here's san jose, crystal clear already. hard to find a cloud in the sky over the bridges that could be socked in with fog. we have no june gloom to point out. we really didn't have much all month long. taking a live look now over san jose, and you can see that mountain range very, very vividly there. 54 degrees in system, 52 in san mat mateo. this afternoon your temperatures are noticeably warmer as high pressure builds in. this is a big, strong ridge of high pressure. it will bring the temperatures up quickly by 5 to 8 degrees from yesterday's highs. warm enough in some cities where you kick on the air conditioner. of course, the extreme east bay and south bay is where we expect the warmest conditions. by thursday temperatures level off a touch. today's highs work out like this.

81 degrees los gatos and 86 in concord. as we head through thursday, 82, not too shabby, and then by friday we hit the low 80s. saturday and sunday we get the best weather in the extended period. mother nature is timing things out nicely for us i will say. 79 degrees as we head through sunday, and then the warm-up kicks into high gear monday into tuesday of next week. we'll let you know how hot and which cities could break records towards the end of next week. we have a heatwave on the way so enjoy cooler than average temperatures. here's mike and your drive. >> this is an update. the south bay is looking good as you might expect. we have the earlier accident on the shoulder northbound 101 around oakland road, and also as you come northbound on 87, we have some slowing that we've seen around capitol, and it continues to be in the 50s just as you approach there. that might be what's going on. a little slowdown off 85. no big drama for this portion of your commute.

we look over here to 582 westbound. we start to see the slowing into livermore and through livermore as well. pretty typical for the commute direction, but eastbound there's construction going on as you pass over towards north flynn. keep that in mind. further over to the west we had an earlier car fire at eden canyon road. that's moving slowly now past the earlier scene with no more activity on the freeway. a smooth drive coming up in and through oakland, but just off of 880 we continue to follow this. this is the truck fire at the bottom of the market street off ramp. the off ramp re-opened, but the fire is out. there's a burned-out cab attached to a trailer there now. the big rig tow could be another half hour before it gets there. you might want to use broadway to get around the whole thing. just a precaution, but we'll let you know if they have to close the off ramp for any other period of time. if any do after 6:00, that could get ugly. a live look across the bay. we look at the goemden gate

bridge. a nice, easy drive through the north bay. no clouds in the sky in this shot and a huge flow in traffic southbound. we will send it back to you. >> mike, thank you very much. if you love whale watching and who doesn't, this is a great site to see. blue whales feeding a little closer to the golden gate bridge than usual, but while it's gorgeous to see, actually putting the whales in danger. they're near a protected marine sanctuary. this is the hazards out there. big ships. a rare fin whale washed up dead just last week. that's sad. experts say a ship strike actually killed it. some groups fighting for a slower speed limit for shipping in the sanctuary. they're floating out other ideas. last week scientists documented where whales actually congregate, information they will pass on to ship captains. >> looking at dynamic management areas, so if there's a large

congregation of whales in one area, we can notify the shipping companies and they can avoid that area and enter theorts from a different direction. >> they're also asking the international maritime association to consider changing the shipping lanes right into the bay hoping to reduce the chances of whale and ship contact. something you probably would never see at a zoo is leaving visitors in shock. it's disturbing. visitors watched in horror as a 3-month-old chimp is brutally killed by an adult male chimpanzee. this is recent video of sweet little gracy. it happened yesterday at the los angeles zoo. witnesses say the male chimp grabbed that infant and began beating her. zoo officials say they couldn't stop that attack due to worker safety concerns. it's really an upsetting story. >> i can't imagine the kids there seeing that take place. so sad. it is 5:52 right now. coming up, student i.d. numbers, passwords and user names posted

the northbound segment near market street. christie smith has arrived on scene. what's the latest? >> reporter: good morning. jon. the situation has improved in terms of the traffic, and that's because the two lanes of the off ramp here are back open. you can see traffic is moving again. this is the off ramp at market street from northbound 880. the situation has improved here. this was completely shut down when firefighters arrived because they had to put out the fire in the big rig cab. if we can go over here, i want to show you a situation hasn't improved for the driver although all. you can see the cab up there

completely burned out this morning. i spoke briefly with the driver. he said that he heard a noise, a boom sound from the engine area as he was driving on northbound 880. he decided to pull over, see what was going on. then he saw smoke, and he says that then it caught fire. everyone got out okay. he says that he just doesn't know what happened here. he didn't know what he was carrying, but he was bringing it from long beach to the port of oakland. i believe it's going to a walmart store. at this point i hear it will be another 20 to 30 minutes before they can get a tow truck out her and clear it completely, but the good news, no fuel has leaked at all. reporting live in oakland, christie smith, "today in the bay." 5 a. 56. san jose state is trying to track down a hacker that leaked thousands of user names and passwords. they confirm a security breach. now more than 22,000 student
