>> and we hit that stride. temperatures yet again gorgeous for outdoor activities today. 80s inland. 70s bayside. 60s at the coast. change is on the horizon. the forecast is moments away. >> we haven't hit that stride for the morning commute. a new accident near the castro valley y, we'll give you the effects and the situation across the water. >> san francisco this morning, you made it to thursday, june 28. this is "today in the bay." >> good morning. thanks for joining us. i'm laura garcia-cannon. >> i'm jon kelley. this morning a major ruling on health care coming down from the supreme court in a couple of hours from now. this one is a decision that could affect millions of californians. the latest from christie smith live in san francisco with what all of this can mean to you. good morning. >> reporter: good morning to you, jon.

there is a lot at stake with this, particularly here in california where the state has moved aggressively to go ahead and implement this law that was signed in 2010. already about 400,000 low income californians receive some sort of service through this. the law contains a number of consumer protections. we spoke with one woman among million who is have health insurance because of the affordable care act that many call obamacare. it was signed into law by president obama in 2010 and at least 26 states are among those challenging it. a key question for the supreme court, can congress require americans to buy something. under the law everyone will have health insurance or pay a penalty. for this woman it works giving the teacher a break. >> it saved me a lot of money simply on doctor visits and dental visits and health care and reproductive care and saved

road. investigators don't know how it happened but they don't believe other cars were involved. >> speed is likely the cause of another fatal crash at 101 and trimbell. the off ramp was shut down for several hours. >> a san francisco lawyer insisting she innocent 18 fatal hit and run. spencer smith free on bail after pleading not guilty to running down a bicyclist last month. investigators say car parts found at the scene matched smith's damaged mer scedemerced. cell phone records place him at the scene at the time. >> oakland mayor jean quan says her program was based on bad

data. a group claimed that the numbers didn't add up and now the mayor is apologizing saying she was wrong. >> many of these neighborhoods have for decades been dealing with ongoing violence and homicide rates. and that is the issue we're trying to address. we think that we have the right strategy t right plan and frankly, the right team. >> nevertheless, quan says the mistake will not undermine her plan to use extra resources to affected areas. >> in colorado firefighters there still trying to get the upper hand on massive wild fires near colorado springs, this one is an epic scene. more than 30,000 people have been forced from their homes. dozens of houses have gone up in flames. the fire is burning along the southwest boundary of the air force academy. so far no damages reported there. two new wild fires already burning more than 1,000 acres in

utah. those flames have burned down one building since yesterday. a total of six wild fires now burning across that state. all of the devastation in colorado and utah is a reminder for us here in the bay area that fire season is in fact here. but firefighters in one east bay county say they are not prepared to deal with the threat of wild fires. on sunday three fire stations in east contra costa county will be closing and 15 firefighters laid off, all because voters rejected a tax that would have cost homeowners $197,000 a year. sorry, $197 a year. >> a little over 6200 calls with six stations and now we're doing that with three stations. >> i think it's pretty serious. i know there are only so many stations here and response time has been a concern.

>> east contra costa fire will keep the three remaining stations. >> signed, sealed, deliver. governor brown signed a new state budget in sacramento. the spending plan for the fiscal year is meant to bridge a $15.7 billion gap. the governor will release det l details of vetoes but it relies heavily on voters approving a proposed tax initiative. if those don't pass expect a revised budget plan. >> an anti-fracking measure, a key panel passed the bill that would ban fracking in california until its use is regulated. the technique involves injecting chemical laced water and sand deep into the ground to tap oil. it has been the subject of reports by our nbc bay area investigative unit, you can read more at nbcbayarea.com.

>> in the meantime, a bill banning the use of dogs to hunt bears and bobcats in california has stalled. a assembly committee voted down the ban yesterday. critics say the use of dogs is part of a long standing hunting tradition but supporters call it animal cruelty. lawmakers will reconsider that bill next week. >> assembly committee passed a bill that would create a volunteer recertification program for the pet grooming industry. the bill was introduced to prevent injuries and death during grooming. it now heads to the assembly appropriations committee. >> 5:07 now. the committee in charge of picking the next head of the cal state system is asking for input. the committee holding a public meeting at the chancellor's office this morning. students, faculty and staff members all invited to offer their thoughts about what they want to see in the system's next chancellor. charles reed resigned last month after 14 years as chancellor.

>> want to check the forecast with meteorologist christina loren. it's been a glorious week. >> it has. we're so close to the weekend. good morning. 5:08. still dark here over the golden gate bridge. the sun is starting to make its first appearance of the morning and it's gorgeous out there. right off the bat clear here, we're not expecting fog to form. if we see any it will be at the coast, like pacifica, half moon day. clearing by about 10:00 a.m. completely clear skies over the bay area. 54 to start out in sunnyvale. we're at 58 degrees this morning. right now in san jose which means it's perfect for dog walking, any outdoor activities that might cause you to get a little warm in the heat of the day. we will approach 85 so it will be toasty inland at 4:00 p.m. at 4:00 p.m. by the bay, 75 degrees. 68 at the coast. a gorgeous day to hit the beach. i'll have the forecast coming up, also the giants are back at it.

around the bay. almost feels like christmas with that look. 5:12. >> not july yet. football legend joe montana getting a go ahead to build a luxury hotel across from the stadium. not bad. the legend first introduced -- a little higher than that. the legend, first introduced that idea of the luxury hotel last summer and last night the council voted to approve plans for that four-star hotel. now the question is, how much montana will have to pay the city for the right to build on its land. the hotel is due to open in conjunction with the stadium at the start of the 2014 season. >> the best male gymnasts are putting hours of training to the test. >> the magic rolls on. the men's competition taking center stage at hp pavilion. marla tellez has been doing cal

thentics all morning long. a look at today's competition. >> reporter: i'm all stretched out now you two. good morning. we're less than 30 days away from the u.s. summer olympics in london or from the summer olympics in london i should say. before all of that happens, it's the olympic trials in gymnastics at hp pavilion, you two said that. before that happens how about a morning workout here in downtown san jose next to the fairmont hotel, the circle of palms. the palm trees all lit up, some folks getting the stage ready for a morning workout. it's a way to get the fans and community members warmed up for the olympics so you can come down if you're up for it. the workout is at 6:30 this morning. maybe looking at a trampoline would get you motivated. we know who is heading to london representing the u.s. on the

rupert murdoch will be the chairman of both companies. futures are a bit lower, the main event for investors is that supreme court decision on president obama's health care overhaul that's going to have people on the sidelines until mid morning. as far as trading this morning in europe we've got stocks are a little in the red. wednesday the best day for the dow and s&p in a week. closing up to 12,637. and the nasdaq, to 2875. i was thinking this morning i could never be a supreme court justice. >> you don't like the outfits? >> they made this decision -- no. it's keeping a secret this long. i could never keep such a huge secret. >> the judges here at nbc have judged your score today a

says a sigalert from chp. for the definition, a lot of people ask me. a smooth drive heading to the bay bridge, down the east shore freeway we have reports of that vehicle having problems with the gluch. watch for that on your right. stay to your left. we'll move to the area where we're looking at early slowdown potential here. the 56 speed. that's a trend for westbound highway 4, eastbound the construction, back on the freeway. not a big concern. pretty typical there. no real flowing come out of the altamont pass. a live look at the south bay. we're looking at 28, a light drive for the south drive. we have construction crews at the interchange. looks like a tow truck. that should be clearing. i'll track that and bring you

gate bridge a golden view, that is real nice. christina says get ready to enjoy the weather, feel good. it's friday eve, june 28th, "today in the bay." >> good morning. thanks for joining us. the time is 5:30. i'm jon kelley. >> this morning in a few hours the highest court in the country is set to decide the fate of president obama's affordable care act. the ruling by the justices will affect millions of americans. christie smith joins us live in oakland with what it means to the bay area. good morning. >> reporter: good morning to you. the affordable care act was signed into law by president obama in 2010. coming up in less than two hours the supreme court is expected to issue a key ruling on a challenge to the constitutionality of that law. one of the key questions is can congress require americans to

buy something. the changers include 26 states. the question is, can congress require americans to buy something when it comes to health insurance. under the law everyone would have to have health insurance or pay a pen a. many call the law obama care and the government argument is health care reform was passed in part because 50 million americans lacked health insurance twoyn 009 and the cost for caring for those without insurance was spiraling out of control. even after the ruling many predict the health care crisis will go on. >> people who come into health care today and it's a great frustration for doctors and hospitals to not have resources associated with insurance to help take care of people. >> reporter: the supreme court could do a couple of things. it could uphold the law as s strike it completely, or decide to allow parts of the law to stand. reporting live, christie smith,

"today in the bay." >> thank you so much. so how will the supreme court decision affect the campaign trail in the presidential race for the white house? we'll discuss that point in a live report from capitol hill. we'll also have a live interview with our political analyst larry gerston. >> a crime scene tape and flashing lights as officers investigate an early morning homicide. neighbors in san francisco say they heard at least eight gun shots this morning. that was at the intersection of howth street and mount vernon avenue. no word on suspects or arrests. >> the gunman who shot an east bay teen in the face is still on the loose. police thought they had the suspect surrounded but after a search no one was found. investigators say the suspect fired from the passenger side

window of a green bmw suv. >> an oakland raider in court trying to tackle off-field legal problems, wide receiver darrius heyward-bey is facing dui charges. he was pulled over last april on the bay bridge. officers say he failed a breathalyzer test on scene. >> the suspended sheriff will get a chance to keep his job. ross mirkarimi will testify before the ethics commission. the mayor wants mirkarimi permanently removed from office for official misconduct. it stems from his guilty plea to a charge from bruising his wife's arm during an argument. for his wife, she is siding with her husband telling the court, ross has never hit me, punched me, battered me or beat me. if i were called to testify the

above would be my testimony. she issued a statement criticizing her nab here reported the incident to police. maybe ed lee will testify tomorrow. >> 5:34. an oakland family will not have to worry about cuts to education. yesterday both parents and teachers pleading with board members to save special ed funding. the board agrees sand reversing a previous decision. they originally wanted to cut staff and create larger special ed classes to try to close the gap. >> more california teens graduating from high school. the state superintendent released two years of data. it shows more than 70% of california students graduated from high school, nearly 15 period dropped out. improvement from the previous year. in most of the bay area graduation rights were better

than the statewide average. >> california college students have a reason to celebrate the budget deal reached in sacramento. a little thing known as a tuition freeze. leaders say they will not recommend a tuition hike if voters approve the tax increase in november. regents were considering a $730 increase but the budget includes funding for the cu system to avoid increased feeds. it's all contingent on passing the tax hikes. >> we do have various microclimates across the bay area. i wanted to show you san francisco, a live look over the bay bridge a. beautiful start this morning. a little bit of a marine layer formation here but it's not going to penetrate inland. probably not pushing past the bay bridge into oakland. beautiful conditions off the bat

in san jose, a gorgeous morning. we'll start you out in san jose. if you wanted to hit the beach, 75 degrees, 74 in santa cruz so gorgeous beach weather. we'll be at about 73 degrees at noon, 85 at 4:00, 75 bay side and 68 degrees at the coast. you're almost to the weekend. one more day. i've got the full forecast coming up. here is mike. >> opening of all lanes soon but for now we still have the big alert and one lane closed. the eastbound 580. clearing through the castro valley after the injury accident. we're looking at the commute direction, still a steady build out of the altamont pass. 680, no slowing for either direction. crews are still there. cleared from eastbound highway

>> welcome back everyone. a good thursday morning to you. taking a live look outside, city by the bay. that's the bay bridge. sun coming up across the bay area. we'll have a look at the forecast and the morning commute. 5:40. >> officials, an epic scene. a wild fire continues to burn out of control prompting mass evacuations and threatening major land marks. fire crews trying to get the upper hand on flames near colorado springs. a lot of homes have burned but more neighborhoods are now being threatened. in a few hours wednesday the fire managed to double in size. wowment it's now threatening the air force academy campus. firefighters say all of the smoke there is so thick as you can see, and the heat is so

intense they can't estimate how many homes have been destroyed. >> it's been house to house, door to door, hill to hill, kind of activity all night long, it's continued all day today. >> that is rough out there. in all, half a dozen major fires are burning throughout the state of colorado, more than 30,000 people have been forced out of their homes. president obama expected to tour the fire damage during his visit tomorrow. >> history could be made today in washington, d.c. beyond the halls of the supreme court. attorney general eric holder could become the first sitting member of a president's cabinet to be held in contempt of congress. holder is refusing to turn over additional documents surrounding a botched gun investigation. the house will consider two resolutions, one asking the u.s. attorney to file a criminal case to force holder to comply. the second could lead to a civil suit with the same demand. >> less than two hours we'll

find out if president obama's health care law will stand up in the highest court in the country. >> this one has a major ruling that will impact your health and the presidential campaign trail. tracie potts live outside the supreme court this morning. she has a look at how the decision will affect politics. >> reporter: and jon and laura, good morning. it's going to affect nearly everyone in this country, whether or not they have health insurance. you can probably hear some noise. there are demonstrators for and against this health law and frankly, for other unrelated health issues here as well. like medicare which is really not part of this health law. what the court will look at today mainly is the individual mandate. can the federal government require everyone to buy into the system, to buy health insurance f. that doesn't stay in dan rest of the law stand like the provision that allows young adults to stay on their parents'

insurance or banned discrimination against people who are older or have pre-existing conditions. the other chunk is medicaid t government's insurance for low income americans, can that expansion happen, is it constitutional. and then there is a chance, not very likely, that the court may say we can't make a decision until much of it is implemented, that penalty is not actually going to happen for a couple more years, 2014. >> if the court does not strike down the entire law the house will move to repeal what's left. >> if they say looks it passes the constitution, it's still bad policy and that will mean if i'm elect weird going to repeal it and replace it. >> reporter: we're expecting to get that decision shortly after 10:00 a.m. eastern time in about an hour and a half or so from now. it will be an historic decision that will certainly have an

impact on the presidential campaign. i'm tracie potts. >> thank you. that's why we bring in larry gerston to talk about the political ramifications. good morning, larry. thank you for getting up early. >> of course. >> this is a huge decision that is coming down. i guess it depends on what the public stance is. you think people are going to feel relieved or angry? >> that's always the question. there has been a divided opinion about this case just about as many have been opposed as in favor. when you ask them what do you think about kids under 26, pre-existing conditions. but when you ask them about the act itself, no, a lot of people say not a good idea. how dhauz come down to the presidential election. that's a good question. no question that if the court strikes down the individual mandate that's the heart of the case. that's what the president and mr. romney will be talking about from now until november 6.
