about two fatal crashes on south bay roads a few hours ago a motorcyclist killed on north first street and nortech parkway in san jose. police found the 38-year-old driver down in the middle of the street. investigators at this point don't know exactly how this happened but they don't believe any other cars were involved. speed suspected as cause of another crash in san jose, a driver died after being thrown from his car in a rollover crash. the off ramp shut down for several hours for that investigation which included using infrared technology. >> all eyes on the supreme court this morning. in one hour the highest court in the country will issue a ruling on president obama's affordable health care act. it's a decision that touches millions of americans. christie smith joins us live with how it could impact the golden state. good morning.

>> good morning. there is a lot at stake here where the state has moved aggressively to implement this law. more than 400,000 low income californians receive some sort of service under this affordable care act law, also the law contains a number of consumer protections. we spoke with one woman among millions who have health insurance because of the affordable care act that many call obamacare. at least 26 states are among those that are challenging this. a key question for the supreme court, can congress require americans to buy something? under the law everyone will have health inches or pay a penalty. for the young teacher a financial break. >> it saved me a lot of money on doctor visits and dental visits and it saved me probably over

to domestic violence charges for bruising his afs we arm during an argument. mayor ed lee will testify tomorrow. >> oakland mayor admit as crackdown on crime is based on faulty facts. jean quan says her 100 blocks program was based on bad data that 90% of shootings happen in a small perimeter. a group challenged saying the crime numbers didn't add up the mayor is apologizing. >> many ever these neighborhoods have been dealing with on going violence and homicide rates. that is the issue we're trying to address. we think that we have the right plan and frankly t right team. >> she says the mistake will not undermine her plan to allocate extra resources and police patrols to affected areas.

>> signed, sealed, delivered. governor brown signing a new state budget overnight. the spending plan for the upcoming fiscal year to bridge a $15.7 billion gap. the governor will release details of the items cut but at this point we do know the new budget relies heavily on aproo proving the proposed tax initiatives. if those do not pass expect revised budget plans. >> college students have a reason to celebrate. a tuition free. they will not recommend a tuition hike. regents were considering an increase but the newly approved state budget includes funding for the uc or the cu system to avoid increased fees. it's all contingent on voters passing the tax hikes.

>> rough in colorado. >> we'll get to that. the committee in charge of picking the next head of the cal state university system actually some input. they will hold a public meeting at the chancellor's long beach audien audience. students, faculty, are invited to offer their thoughts. charles reed resigned after 14 years as chancellor. >> on to colorado, the evacuation area expanding but hoping the coming winds will -- more than 15,000 acres burning. 36,000 people chased from their homes. the fbi now looking into the cause of the waldo canyon fire. they'd like to know if yorman bazardo actually set this fire. we'll have a live report from colorado springs.

good thursday morning to you. taking a live look outside from the east bay. overlooking oakland this morning. christina has a look at the forecast, talk about our micro climate. >> this one reminiscent of "titanic." officials at a newark port searching containers from a ship looking for possible so aways. the coast guard boarded the ship for inspections and say they heard knocking coming from inside some of the containers. since then authorities have been conducting inspections. so far they searched 150 of the 200 containers that could carry people. the ship started its voyage to the u.s. from the united arab emirates and last made port in egypt. >> colorado's second largest city a giant wild fire is burning out of control threatening major land marks. >> the waldo canyon fire is called the worst fire in that state's history.

jenna kim joins us with the latest. >> reporter: good morning. we have nine massive wild fires burning throughout the state of colorado. as you said where i am in colorado springs appears to be the worst of it. this is the second largest city in the state of colorado, and the fire came so close to homes over the past couple of days when the flames erupted and started coming down the mountain at such speed toward the community here. that's why everybody was up in arms and this morning we do have devastating news. the "denver post" reports that at least 300 homes appear to have been destroyed and that's within about the past 36 hours. that's also just within one community so they are expecting the losses could be heavier than that. this morning, however, we do have a little good news. the calmer weather that we had over the past 24 hours really helped to settle this fire at least from our vantage point. you kind of see what it's doing now. there is a little bit of smoke

there at the base of the mountain but nowhere near what we were seeing this time yesterday. having said that it's a little too close to the homes late to at the foothills so you can bet hundreds of firefighters are there now doing active structure protection. 32,000 people remain evacuated for a city of about 400,000. that is quite a bit and they are sitting in agony now, not sure whether their home is still standing and when they can go back. the size of the fire is about 18,500 acres, 5% containment. >> it is tragic what they are having to deal with. thank you very much. switching gears certainly, 6:17, sports news this morning. the giants rking the reds to town for the start of a four-game series. maybe the reds will manage to score runs. the dodgers couldn't yesterday. the giants wrapped up the series, they won it 3-0. completing the series sweep and

shutout. now the giants tied at the top of the national league west standings. >> how was the game? >> i was out there and it was glorious. the weather was spectacular. tim lincecum was pitching. >> shut them out. >> you were coming. had to be big. >> i'd go to every game if i could. >> also nice, more good weather. >> that's right. and timmy is back. we've been waiting for it. go giants. let's go ahead and take you outside, show you what it looks like in san francisco. home of our giants, nbc bay area proud to be the broadcast home and they have got another game today. we'll get to the forecast in a moment. temperatures are looking really good this morning for any sort of outdoor activities, the sun's up. you want to go for a jog, you can certainly do so in san francisco, 55 degrees. 54 in sunnyvale, perfect jogging weather. the jet stream is kind of sitting to our north. we have a series of storms that

have come through basically impacting the pacific northwest so what happens is that the jet stream to our north keeps the wind in place, keeps that on shore flow in place so we're getting some of the natural cooling off the pacific, keeping our temperatures right at seasonal averages. next week especially toward the end of next week, temperatures soar so make sure you're ready for warmer weather. if you have any outdoor activities you want to take care of before it gets hot, before we hit the dog days of summer do it now. a little drizzle tomorrow. great today. hit the fair, 84 degrees at 4:00 p.m. brilliant sunshine. put on that spf 30, though, a lot of sunshine, high uv index. 80 in los gatos, 79 in san jose. we're going to creep down as we head through saturday and sunday, down to 76 degrees. still that's pretty nice for the weekend. if you want to hit the beach you can do so. beautiful conditions for

mariners with calm winds. monday, tuesday, wednesday, things start to change. our temperatures come up a little bit. wednesday the fourth of july, 84 degrees. in places like livermore and san jose, 74 in san francisco, and 64 degrees at the coast but here is the kicker. it looks like it's going to be clear with offshore flow so you'll be able to vividly see the fireworks. we'll let you know if anything changes. mike knows what's going on. >> fortunately no fireworks on the roadway, much different. early this morning we had a lot going on. now the east shore freeway, 18, 19 minutes from the carquinez bridge down to richmond and the toll plaza where the metering lights have been turned on. just after my last report, we've got notice that was the case and that's keeping the upper deck moving. further south a smooth drive, 18 minutes between the san mateo bridge and the city. we have an accident northbound 101 at 92. sounds like all of the activity is off to the shoulder. there is activity and it will be

distracting through this area in the commute direction coming off of that san mateo bridge as well. we'll look to the san mateo bridge and see how traffic flows over the high rise, eastbound with these cars, that commute direction starting to build. speeds toward about 50, 55 along the flat section and the high rise as it should be and to the south we're looking at the flow of traffic. construction at the evelyn on ramp so use 237, 101 and 87 just kicking in. >> coming up, today's supreme court decision on the president's health care reform law expected to affect that presidential race. find out how next in a live report from washington. >> a live look outside, san francisco this morning. look at those painted skies.

>> history could be made in washington, d.c. beyond the halls of the supreme koufrmt attorney general eric holder could be the first member ever a president's cabinet to be held in contempt of congress. holder is refusing to turn over documents surrounding a bofrped gun tracking investigation. the house will consider two resolution, one asking the u.s. attorney to file a criminal case to force holder to comply. the second could lead to a civil suit with the same demand. >> today is the day just hours the supreme court announcing its decision on president obama's

health care reform law. tracie potts live outside the u.s. supreme court in washington. here to tell us how today's decision could affect all americans and also that race for the white house. good morning. >> reporter: good morning. you are going to hear it behind me though you can't see it from this vantage point demonstrators who gablth gathered to hear thi decision, the supreme court deciding whether the obama health care law can stand, whether the individual mandate requiring everyone to get health insurance is constitutional, whether the rest of the law, like the part that protects people with pre-existing conditions, can stand if that mandate is taken out. they will look, we understand, at medicaid, the government's insurance for low income americans, greatly expanded under the law, can the federal government do that. and can they really even make this decision now two years before the penalty question

kicks in. we'll find out in the hour if the court will strike down this entire law which would have huge implications for president obama, it is his number one achievement as the administration will put it since he has been in office, will they allow this law to stand, that would be a huge blow for republicans who still say they are going to take it apart if it's constitutional, or come up with a mixed decision here and how many decisions will there be, how many opinions will they read today if in fact there's more than one that could muddy the waters for those coming after. providers, americans, and congress trying to cope with what the court decides. >> all of that noise. hard to think straight. >> interesting to see that. we'll carry it live with the

good morning. >> reporter: good morning. e of the key challenges and questions here is can congress require americans to buy something. under the law everyone would have to have health insurance or they would have to pay a fine. the affordable care act establishes a number of reforms including banning insurance companies from denying insurance coverage to those with pre-existing conditions. it also extends dependent care eligibility up to 26 years old. 26 states, though, say that people cannot be forced to have insurance. the answer, well, that will affect an estimated 8 million californians because the law provides billions of dollars in federal funding for low income residents and without it california could not afford to cover them. even after this ruling, one doctor says the health care crisis will continue. >> those who come into health

care it's a frustration to not have resources associated with n to help take care of people. >> reporter: the supreme court could do a number of things today. it could uphold the law, strike it down or decide to allow parts of the law to stand. reporting live in san francisco. christie smith, "today in the bay." >> 6:33. police investigating a homicide. people heard at least eight gun shots this morning at the intersection of howth street and mount vernon avenue. they saw paramedics trying to save the victim before covering the body with a blanket on the sidewalk. no word on arrests or suspects. >> today san francisco suspended sheriff ross mirkarimi will get a chance to try and save his job. mirkarimi testified before the city's ethics commission the mayor wants mirkarimi permanently removed from office

for official misconduct. this stems from his guilty plea to a misdemeanor domestic violence charge for bruising his wife's arm during a new year's eve argument. as for mirkarimi's wife she is siding with her husband telling the court, quote, ross has never hit me, punched me, battered me or beat me f. i were called to testify the above would be my testimony. lopez also issuing a statement criticizing her neighbor who reported the incident to police. mayor ed lee set to testify tomorrow. >> an oakland raiders player will be in court. wide receiver darrius heyward-bey is facing dui charges. he was pulled over on the bay bridge. officers say he failed a breathalyzer test at the scene. >> it's on, the pressure, the cooker, a chance to make the olympics, the gym gastic team trials in high gear.

before the olympic games but if you don't make the team you don't get to go to the olympics so for these athlete this is is it, the road to london could end here for many of these. it's going to be a great competition. >> when it was your turn to do this how did you deal with the pressure? what advice do you give? >> i think these athletes know what they are doing. they are going to stay focused. going to keep their eye on the ball and try to shut everything out around them and know it's the same events there are six. that's how i treated it. you have to do that to move forward. >> what is it is it like for you to abspectator here? >> well, it's great. i moved over to the broadcasting side. i'll do the in house radio for usa gym nats nastics and yahoo! sports so for me it's a wonderful opportunity to stay involved in the sport. >> what about the parents at home thinking about getting their kids involved. you start really young. what's your advice to them? >> i think gymnastics is a great

academy. so far no damage reported there. in the meantime, two new wild fires have burned more than 1,000 acres in utah. firefighters say the flames have burned down one building sparking near new harmony yesterday. >> the devastation in colorado and utah a harsh reminder for us here in the bay area, it is fire season here. but firefighters in one east bay county say they are not prepared at this point to deal with threats of wild fires. ond sunday three fire stations in east contra costa county will be closing 15 firefighters will be laid off. this is happening because voters rejected a parcel tax that would have cost homeowners 1$197 per year. >> last year we handled a little over 6200 calls with six stations and now we're going to do that with three stations. >> i think it's pretty serious. i know there are only so many

good morning. >> reporter: good morning. this decision could certainly affect millions of californians. this decision just minutes away. the supreme court expected to rule on the constitutionality of the affordable care act. one of the key issues here is whether congress can require americans to buy something. under the law basically everyone would have to have health insurance or pay a fine. here in california the state has aggressively implemented the law. the law provides billions of federal dollars and coverage for low income residence. without the federal expansion california couldn't afford to cover them all. the supreme court could do a number of things including upholding the law, striking it down or allowing parts to stand. live in san francisco, christie smith, "today in the bay." >> joining us live to talk more about the political ramification

our political analyst, larry gerston. what do you think, the public is going to feel relieved or angry with the decision? >> wow, it depends who you ask. some people are going to say good deal, we don't have to worry about paying this tax, we're out of the woods. others thank goodness there is coverage. we know large groups have benefitted from this, laura. kids under 26, now going on with their parents' insurance. people with pre-existing conditions no longer denied health care. the question is what kind of health care opportunities will there be if in fact major parts of this law are struck down. it remains to be seen. >> we're really minutes away from hearing that decision. what about this year, election year. what fallout can we expect? >> president obama put so much of his political capital on this thing, it took him 18 months to get it passed. so, you have to believe that he's going to be very disappointed if this thing gets

burned by the court. on the other hand it gives governor romney, campaigning against as he calls it obamacare. this will be a talking point for the next four months. let's not overdue it. it's still the economy, the economy and the economy. while health care remains important, especially for the 50 million people not insured it's going to be an issue of jobs, how the economy is recovering and those issues between now and november. >> it will be interesting to see. thanks for joining us early this morning. stay with nbc bay area for a special report on "today" as soon as the decision is handed down at 7:00 a.m. we'll bring it to you live. >> a bay area native will play a role in the future of the space program. >> we're talking about rex wallheim. he is a graduate of uc-berkeley. he took part in the final shuttle mission last year but is now preparing for an unmanned spacecraft first test flight. that's the orin.

the scheduled launch in 2014 and wallheim tells me it's the perfect complement to commercial explorations. >> we have the entrepreneurial spirit, companies sending cargo to the space station. then we're also freed up to be able to go and do what we do well, exploration. we'll be manning the space station where we're going to do great discoveries and push out farther with orin to go to an asteroid, to the moon, mars. >> cool stuff. it will go further than any manned spacecraft since apollo 17. >> more california teens are earning high school diplomas according to a report. the state superintendent released two years of graduation and drop-out data. it shows more than 70% of california students graduated from high school. nearly 15% dropped out. in most of the area graduation

rates were better than the state wide average. >> today, the search committee holding a public hearing in long beach. students, faculty and staff invited to offer thoughts about what they want to see in the system for their next chancellor. charles reed resigned last in the after 14 years as chancellor. >> a budget deal is reached in sacramento has a secured tuition freeze for california students. uc leaders will not recommend tuition hike if voters approve the tax increase in november. regents were considering a $730 increase but the newly approved state budget includes funding to avoid increased fees. again, this is contingent on voters passing the tax hike. >> is a crackdown on crime laid out the wrong way. jean quan admits now her 100

blocks program is based on faulty information. the program is based on a theory that 90% happen in the perimeter of 100 streets but the city never identified those areas or released the data. a public group challenged city hall claiming the crime numbers didn't add up. now the mayor is apologizing saying she was given incorrect information. >> many of these neighborhoods have for decades been dealing with ongoing violence and homicide rates. and that is the issue we're trying to address. we think that we have the right strategy, the right plan and frankly, the right team. >> quan says the mistake will not undermine her plan to allocate extra resources and police patrols to the areas. >> this morning a gunman who shot a teen in the face is still on the loose. police thought they had the suspect surrounded at an

apartment complex but after a search nobody was found there. investigators say the suspect fired from the passenger side window of a green bmw suv. the victim is in critical condition. >>san francisco's suspended sheriff will make his case today. ross mirkarimi is fighting for his job after mayor ed lee charged him with official misconduct back in march the mayor suspended mirkarimi after the sheriff pleaded guilty to domestic violence charge for bruising his wife's arm during a new year's eve argument. mayor lee will testify tomorrow. >> it is time, the south bay in the olympic spotlight as the u.s. team trial ises are getting under way. >> fans are getting into the spirit by doing some gold medal winning work outs. marla tellez is live in downtown san jose this morning with an update on the u.s. gaymnastic
