court's chief justice, the affordable care act was deemed legal and constitutional. nbc's steve handelsman reports. >> attention! >> listen up! >> attention! >> reporter: the crowd outside the court was surprised. >> oh, yes! the obama health care law was upheld. conservatives were outraged. >> american will never be the same. >> reporter: conservative chief justice john roberts sided with court liberals to say the penalty in the obama law for not buying health insurance is a tax. because the constitution permits such a tax, roberts wrote for the five-justice majority, it is not our role to forbid it. the court did limit the federal government's power to force states to take more medicaid patients, but the affordable health care act goes forward, guaranteed coverage and every american included, like it or

american included, like it or not. >> i was hoping for the whole thing to come down. >> we have to unite and fight this. >> i'm very happy with the decision today. >> we've worked for this for a long time. >> reporter: president obama praised the high court's decision. >> with today's announcement, it's time for us to move forward, to implement and where necessary improve on this law. >> reporter: but house republicans scheduled a repeal vote for july 11th. mitt romney said he would sign a repeal if he wins. >> if we want to get rid of obama care, we're going to have to replace president obama. >> reporter: but it's barack oba who got a boost. i'm steve handelsman, nbc news, washington. elsewhere attorney general eric holder has become the first cabinet member to be held in contempt of congress. all but two republicans voted in a resolution in dispute over access to documents from the gun tracking operation known as "fast and furious." the house could try to go to court to force the attorney general to hand over the documents, but that could become a long court fight. holder called the vote a politically motivated act in election year. well, president obama

travels to colorado today to get a firsthand look at the areas devastated by these wildfires. the waldo canyon fire has destroyed some 346 homes in colorado springs, and it's making it the most destructive fire in that state's history. so far the remains of one person has been found in one of the destroyed homes. nbc's jinah kim has more. >> reporter: after waiting in agony for much of the week, hundreds of evacuated families in colorado springs learned they no longer have homes. >> we have preliminarily 346 residences that have been destroyed. >> today we're going to be incredibly aggressive on this fire. we've have the first break in the weather that we've had since we've been here. >> reporter: fire crews now numbering near 1,500 -- >> seven officers with crews ready to go. >> reporter: -- switched from defense to offense for the first time in four days. >> as far as what's happening up in the forests and the areas that we can't really get to, it's going to be difficult. it's going to take time. there's going to be smoke and

fire for quite some time. >> reporter: for evacuees like stephanie kaufman, this fire has been both an emotional and a physical roller coast. >> we evacuated a couple of days ago due to the smoke, came back, and then we had to mandatory evac again, came to monument, and now monument's on pre- evacuation. >> reporter: the waldo canyon fire is just one of nine major wildfires burning throughout colorado. there are dozens of other fires burning in other western states. jinah kim, nbc news, colorado springs. and now here's a look at some other stories making news early today in america. in new york city, police have released dramatic video of a gunman opening fire in what's being described as a random act. investigators say the man walked up to two people and just started shooting. the victims were wounded but are now in the hospital recovering. the gunman is still on the lose. in texas, tragedy at a construction site. a worker was killed after becoming trapped in the collapse of a crane north of houston.

the crane was hoisting the wall of a new store when the accident happened. the cause is under investigation. and, finally, in ohio it's okay to envy these kids. who wouldn't. they were able to beat the sweltering heat and have a great time doing it after the mayor of columbus ordered a small group of fire hydrants opened under supervision. it's something that's normally forbidden but allowed under the city's "operation cooldown." the hydrants will likely be turned on again today as the thermometer inches closer to that triple-digit mark. and for more on that, we head over to the national and regional meteorologist who has everything covered. bill karins. >> steal some of his mojo. >> had some serious moves. >> i have a feeling we'll be talking about this for a good chunk. summer and the draw the goingou along with it. 110 in phoenix. little rock, arkansas, 107.

everywhere in the red coloring was temperatures in the 90s. east coast all the way up here through the northern rockies. the only areas not in the 90s was along the west coast and up towards the pacific northwest. amazing that everyone in the country is talking about how incredibly hot of a summer where people in the northwest are asking me when is it going to warm up and when can i wear my summer clothes? yesterday, 72. portland, and 81 in medford. the desert southwest, typically warm. what's next? we are watching the one storm that's already kicked through. weakening and washing itself out. there's another little ripple behind it. not a lot of moisture. it will keep the clouds and showers and cloudy forecast in the northwest probably right into your weekend. light rain around medford this morning. trying to head up to some of the mountainous areas. that's about it. i don't think too many showers will reach the ground in portland. the forecast, today on and off

good morning and welcome back to "early today." i'm lynn berry, and here are some of your top headlines this morning. another big decision from the supreme court yesterday. it struck down a federal law that made it a crime to lie about having received the medal of honor and other prized military awards because the law violated freedom of speech. at ft. bragg, north carolina, a u.s. soldier shot and killed a battalion commander during a safety briefing. the gunman shot and wounded himself and is in custody as the army investigates his motive. major defense contractor united technologies has been fined $75 million for violating u.s. export laws. the company admits covering up the illegal sale of software to china that was later used to develop beijing's first attack helicopter.

a source tells reuters former international monetary chief dominique strauss-kahn and his wife have separated after his headline-making sexual assault case in new york and allegations of involvement with a prostitution ring. and starting tomorrow some of the world's most spectacular diamonds will be on display in buckingham palace in london as part of queen elizabeth's diamond jubilee celebration. they're displaying the priceless and historic jewels until october. and now here's an early look at how wall street's going to kick off the day. the dow opens at 12,602 after losing 24 points yesterday. the s&p was down 2. the nasdaq fell 25. taking a look at overseas trading this morning, in tokyo the nikkei spiked 132 points, while in hong kong the hang seng skyrocketed 416. progress on europe's debt crisis could help stocks recover some of thursday's losses. asian markets rally this morning after eurozone leaders agreed to

take emergency action to bring down italy's and spain's borrowing costs. the group also agreed on new bank supervision and okayed bailout funding for its struggling banks. earlier the supreme court's health care ruling pushed hospital stocks sharply higher. meanwhile aetna lost 3% as investors worried about the ruling's impact on health insurers. blackberry's research in motion plunged 15% after a big quarterly loss and news it's new smart phone won't be ready until next year. after the bell, nike tumbled 13% on weaker than expected earnings. elsewhere ford flagged investors ahead of its next quarterly report, warning europe's economic woes are taking a much bigger toll on its bottom line. jpmorgan chase fell after new york times reported losses from its recent risky trading blunder could reach $9 billion. that's more than four times the original estimate. barclays slumped 12% after britain said it brought in the

know that anthony davis was selected first in the nba draft. but who went number two? >> with the second pick in the 2012 nba draft, the charlotte bobcats select michael kidd-gilchrist of the university of kentucky and somerdale, new jersey. a pair of kentucky wildcats go one and two. florida's bradley beal received the perfect gift on his 19th birthday. wizards selected him third overall. it's the first time the top three picks were all freshmen. a couple of big signings in the nhl. sidney crosby inked a 12-year $104 million extension with the penguins, and the kings locked down the stanley cup finals mvp. jonathan quick agreed to a ten-year $58 million deal. now to the diamonds, rocky blew a seven-run lead, but had enough left in the tank to pull it out. marco scutaro with an rbi single in the 11th. colorado did everything they could to lose but ended up beating washington, 11-10 in extras. yanks and white sox, chicago down a pair in the ninth when

around $40 million. when we say younger, we mean older than ted. channing tatum and matthew mcconaughey star in the male stripper dramedy "magic mike," loosely based on channing's early days as an exotic dancer. insiders say it's going to be a big hit with females -- i wonder why -- and it could take in as much as $25 million. >> that's not the date movie i'm going to. >> i guess not. tyler perry returns as a loud-mouthed grandmother in "madea's witness protection." it is the seventh of this kind. experts say it should fall in line with the others, opening in the $20 million to $25 million range. and, finally, the fourth release, the family drama, "people like us." starring chris pine and elizabeth banks, it's expected to bring in only $5 million to $7 million. what we meant about the "teddy bear" movie -- >> what did you mean? >> when we say younger, we mean over 18. rated "r."

>> you shouldn't take your young kids with you to see the cute little teddy bear? >> there's the warning. you probably don't need me to tell you that. moving on. and this comes to us from whec, news 10 nbc in rochester, new york, where in nearby brockport, a group of visually impaired children are learning what many of us take for granted, how to run. and they couldn't have found a better trainer than marla runyan, the only legally blind paralympian to ever compete in the olympics. she used her experience to teach the kids even if they can't use their eyes, they are able to run. one sixth grader says his goal was to make it to the paralympics, but now he wants to aim higher. i'm lynn berry, and this is "early today," just your first stop of the day, today on your nbc station.

well, london looks more like a ski town these days. newly installed cable cars that span the river thames give passengers a beautiful view of the city. the amazing scenery isn't the only attraction. the 44 million pound system can carry 2500 people per hour, which will be vital to the new transportation system, which is expected to be strained during the olympic games. well, with a face only a mother could love. one dog has plenty to be proud of. mugly has been named the world's ugliest dog, beating out 28 other pooches in one contest in california. the 8-year-old chinese crested dog returned home to his hometown of london with the dubious honor. the first place prize of the year's supply of food and $1,000 will be donated to charity. and, finally, forget chocolate, vanilla, and strawberry.

how does garlic ice cream sound? owners of one ice cream shop in israel hope these unique flavors like garlic, avocado, and even hummus will reinvent their business. the unusual ingredients are mixed with sugar and vanilla. what's the verdict? one customer says of the hummus, the texture's a little bit strange, but it's good. it's the garlic that i don't know -- >> avocado sounds all right. i've actually had olive oil ice cream, which doesn't sound fantastic. >> you're so riske. >> riske, no. adventurous, maybe. it's time for now for an early look at some of the stories we'll follow throughout the day on nbc. the house of representatives is expected to approve a sweeping bipartisan package that would save millions of highway construction jobs and prevent rates on new student loans from doubling. the compromise comes after months of political bickering over how to pay for the legislation. a florida judge will decide whether to give george zimmerman another chance at freedom as he awaits trial for the shooting
