francisco where more drama is expected in a few hours from now. good morning. >> reporter: good morning to you, jon. embattled sheriff ross mirkarimi will continue his testimony today. yesterday, he testified for about an hour, and he did admit that he grabbed his wife's arm and bruised it. he also said that he took responsibility for that and that he regretted it. mirkarimi is being questioned by the city attorney's office as he fights to keep his job. the city attorney is trying to prove that the domestic violence altercation on new year's eve with his wife is official misconduct. first focusing on the sheriff's code of conduct that says a felony or misdemeanor conviction reflects poorly on the entire department. san francisco mayor ed lee charged him with official misconduct back in march after he pleaded guilty to misdemeanor false imprisonment. the city attorney pressed him about his ability to serve. >> when the sheriff doesn't live up to the department standards,

does it reflect poorlyn the department? >> yes, it can. >> reporter: today, mirkarimi's attorneys will try and paint a very different picture when they question him. mirkarimi's wife's attorney attended the hearing and says ileana lopez would like to speak with her husband, the commission did allow video into evidence of her showing that bruise. she says she's willing to testify if the city pays for her to return to her native venezuela. ross mirkarimi again expected to testify followed by san francisco mayor ed lee. reporting live, christie smith, "today in the bay." >> 5:02. a suspected serial killer will ask a judge to review dna evidence linking him to murders. 77-year-old joseph nasois acting as his own attorney. the photographer is charged with killing women police say have identified -- who police, rather, have identified as

prostitutes. nasohas been labelled the double initial killer because the victim's first and last names start with the same letter a. jury trial is set to begin in november. >> a 10-year-old boy in critical condition this morning after being shot walking home from squool his mother. police say somebody on a bicycle fired at car near 15th street and main avenue but instead that bullet hit the boy. he was taken to the hospital. good news he is expected to survive. police right now searching for the gunman. >> a peninsula man will be remembered. 30-year-old edmund beverly was found dead sunday. gun fire had been reported near glenn way but his body was not found until several hours later. no arrests have been made. tonight's vigil and walk begins at the victim's home at 7:00 and ends at the spot where his body was found. >> four months after a teen was killed in a drive-by shooting, police offer cash for more information.

michael dejuan jones was shot on february 10 as he left a friend's house near pleasant hill road. several people were seen leaving the area in a blue saturn vue. police put up a $5,000 reward for information. >> 5:04. the the man at the center of a high profile south bay trial is expected to take the stand this morning. william lynch is charged with assaulting a retired priest but he says it was retaliation for the priest's molesting him. bob redell joins us live with the next step in the highly publicized trial. good morning. >> reporter: good morning, laura. it's later today the defendant will likely take the stand. however, he will be limited on what he can tell the jury. in other words, it's not clear if what if anything the judge will let him say about the alleged sexual abuse he and his brother suffered at the hands of

lynch. allegedly in retaliation for the molestation for more than 30 years earlier. in court on wednesday a worker testified that she saw lynch punch lindner twice and heard lynch yell that lindner ruined the lives of him and his brother. last week the priest did testify on the stand, denying the sexual abuse but the judge ended up throwing out his testimony when the priest decided earlier this week to plead the fifth amendment. which protects people against self-incrimination. the team has tried to get the judge to declare a mistrial in part because they won't be able to confront lynch's accuser but the judge has refused all three requests. court was out of session yesterday, trial resumed today. again with will lynch likely taking the stand. bob redell, "today in the bay." >> new this morning the pair of fires in the south bay early this week have been ruled arson. both of those were in recycling

bins at the same apartment complex. this was near 85 and blossom hill road in san jose tuesday night. the one on spinnicer walkway scorched the side of the building and the fence, the second around the corner on coy drive damaged several gas meters and forced more than a dozen people out of their homes. >> a three-alarm fire under investigation. crews have been at the scene all night long. we're told the home on seventh street was still under construction when flames broke out. nobody was hurt. >> health care coverage for millions of americans is about to change. now that the supreme court has upheld president obama's landmark law. as of 2014 insurers can no longer deny coverage to adults with pre-existing conditions. in january of that year you'll also be able to buy insurance directly in affordable insurance exchange if your employer does not offer insurance. at the same time the so-called mandate goes into effect which mean

you can afford to buy health insurance you'll be required to or you'll have to pay a tax. for small business owners in the bay area the election may come down to how the health care ruling impacts their bottom line. this man offers health care to his 48 workers but if he increases his work force to 50 the law would require him to provide more comprehensive or expensive care or pay a penalty. he thinks for him the penalty makes more sense. >> the penalty is far below my premium, it will be cheap tear allow the employees to go and purchase insurance on the exchange by themselves. >> the insurance industry is said to not welcome the news or the law complaining it impose as sales tax that will drive costs up, costs that could be passed back to consumers. republican leaders in congress are promising to challenge the ruling starting with a house vote july 9. a full repeal is unlikely unless republicans sweep the november

extra marital affair with a stripper a. man approached him back in april demanding $5,000 for nude photos of jackson taken by the stripper. the coach says he finally had to tell team officials who brought the case to the fbi. >> there are no secrets, you confront it, you go to the fbi and say look, i'm the victim of a crime, go get them. >> the team confirms the stripper and her alleged accomplice were arrested earlier this week. >> on to the 49ers, they say they want $30 million back and are heading to court to get it. the team filing a lawsuit against santa clara county over money pulled from the project. a judge now says the county is not allowed to spend that money until this matter is resolved in court. the 49ers say the money was earmarked for the santa clara stadium but county leaders say they have the right to use that money how ever they see fit.

>> 5:18. in business news more facebook fallout for the nasdaq. >> for more on that let's turn it over to bertha coombs live at cnbc world headquarters. good morning. >> good morning, guys. facebook went public six weeks ago i guess it is. and the fall out continues. they went public on nasdaq, that's the exchange where they listed. we know what happened. all of this, now security regulators are looking at nasdaq to maybe update its trading system. that's clearly where the glitch happened. investigating what caused the mishap during the debut on the exchange. it had a big impact on brokers and investors who are suing the nasdaq over it. u.s. markets are looking to rally, futures are a lot higher after positive headlines out of the european summit in brussels, angela merkel may have been

upset with the euro cup but she didn't let it stand in the way to stabilize the debt markets and recapitalize banks in europe. overall we've seen rallies in europe t euro is higher, we're coming off of a down day in the u.s., we were in the red t dow down as much as 176 points but ended up down just 24 points at 12,602. s&p almost made it back to the even market, down two on the day to 1329. the nasdaq off 25 points to 2849. apple celebrating a milestone. the first iphone went on sale five years ago. major game changer. now we all swipe away on every device. it was a game changer for apple. the stock is up over 366% since 2007. 218 million iphones sold globally and there is what some

bars suspectedf molesting several teens. 65-year-old robert ruark lives in sasoom city. he was arrested last night based on allegations dating back to 1994. police say they were tipped off by clergy but already five alleged victims are now adults that have come forward. they claim ruark molested them at the church and in some cases took nude photos. >> a man hunt will resume for a suspect connected to a massive marijuana grow operation. santa clara county deputies raided the pot farm in a remote area near mt. madonna park yesterday. one of two suspects was shot in the arm during the raid and later surrendered. the second man got away that led to a massive search which caught the attention of campers in the area. >> the first time i've gone camping. the first thing i said there

must be a fugitive on the loose. >> the search for the second suspect is expected to resume. >> some help on the way for people who have been out of their homes for a m. a four-alarm fire in san francisco's mission district last month forcing 37 people including seven children right out on the streets. four people were hurt including two firefighters b. half of the building residents still have no permanent place to stay. a fund-raiser is being held this weekend at the sunday streets events in the mission. >> and it's official that massive fire that crippled b.a.r.t. service earlier this month was the result of arson. federal investigators not revealing specifics about the case, but they are working with local law enforcement to try and track down suspects. that fire caused more than $25 million in damage. destroying a senior housing complex under construction and seriously damaged a b.a.r.t.

concord to the coastline. look at the clouds. a blanket over the bay area, trapping some of the warmth so we're starting out close to 60 degrees just about everywhere. and that means we're going to see a really, really nice day easily touching on 70 degrees inland as of noon bay side 65 degrees as you break for lunch, 62 at the coast, rounding out the day at the upper 70s and low 80s inland. 75 degrees bayside at 4:00 at the coast. bat 4:00 p.m. if you wanted to hit the beach, now temperatures are going to swing in the other direction as we head through next week. the 7-day tells the story. first here is mike and your friday drive. >> we're looking at what was the usual pattern. we saw severe slowing for highway 4 at the transition for 242. that has cleared up over the last few minutes but it was sticking around for about 15. chp has nothing to report through the area. the other accident for 242, that cleared.

>> welcome back. 26 days after returning to jail the man who shot trayvon martin asking a florida judge for a second chance to set bail. the judge revoking george zimmerman's bail after learning he lied about how much money he had. zimmerman told the judge he is flat broke. but as it turns out he had access to at least $130,000. prosecutors wanting zimmerman to remain behind bars. defense attorneys saying it's not necessary. >> jail is not supposed to be punishment before trial. it's only to assure that you come back to the courtroom and he has shown that time and time again. >> zimmerman facing murder charges in the death of unarmed

teen trayvon martin. zimmerman insisting he shot the teenager in self defense. >> today president obama will travel to colorado to visit areas devastated by massive wild fires. it's confirmed the waldo canyon fire destroyed nearly 350 homes in colorado springs making it the most destucktive fire in the state's history. now, local police confirm they found the body of one person buried in the rubble of a house. in all, eight major wild fires are burning statewide. fema and other federal agencies are deploying additional resources to try to aid in the fire fighting effort. >> think of it as a congressional cram session. >> this morning lawmakers scramble to come up with deals before the fourth of july break. >> do it together. live on capitol hill this morning. >> reporter: i can't talk in

stereo but i can tell you what's going on on the hill. talking about a cram session. student loans that are set to double on sunday if congress doesn't do something about it. 3.4%, that's where the rate is now. it looks like congress may be able to keep it there and find $6 billion to do so by changes in pension insurance. that funding mechanism also being used for the highway bill, massive highway bill that again, they have got to get passed this week. it affects millions of construction jobs. the $100 billion bill wrapped up in federal flood insurance as well. looks like a vote is likely today so they don't miss that end of the month deadline. the other thing that congress has been busy with are two contempt citations against attorney general eric holder, it is the first time in history a cabinet member has faced a criminal contempt citation, 100 democrats walked out, the african-american -- the

>> you can try almost any olympic sport. the way we set this up is, everybody really needs to understand that to train like an olympian is stuff. you have to have intense physical fitness. we set up our interactive zone so you can see what it takes in terms of endurance, speed or agility. these are all common to the goal attributes. it's a great way to get fit and learn about olympic sports. >> you can ride a bike, get on a rowing machine, play table tennis. there is so much you can do. you wan watch us walk a balance beam. that's harder than it seems. this is the paralympics basketball stage. these guys are shooting and just really getting a sense of how hard it really is if you are bound to a wheelchair. so tough stuff out here. let's talk a lit basically the

57 degrees to start out. it's 60, so mild, no need for the jacket. you can see we've got an interesting setup u. probably heard about the heat wave for most of the nation. a ridge of high pressure that usually sets up over sus over the midsection of our united states. so as we head throughout the next couple of days the jet stream sits over us that's going to usher in an onshore flow. it will stay breezy at the coast. that gentle breeze is so good in the evening. low clouds, tomorrow thicker cloud cover, generating drizzle. today's highs look at this perfecti perfection. we are at the end of june. 78 degrees in fremont. when you consider the fourth of july is typically pretty hot around here and will be as we head through wednesday, temperatures warming up to about 86 degrees inland that could be

hotter. we're getting spoiled all the way to wednesday. then thursday, friday, saturday, the triple digits return. so everything in perspective. let's check that drive. mike makes that look prettier. >> that's nice. i don't like the triple digits. the double digits, there should be no triple digits. highway 85, construction cleared. no problems for the flow there. we're starting to see a little slowing from 101, heading to the airport. pretty typical. 680, a nice flow through sunol. a nice drive 680 and further north still construction going on but we don't see any slowing. we see it here as expected out of the altamont pass. by green valley coming up to the 50s and the 60s. a nice smoother flow through the

>> with the stroke after pen governor jerry brown sliced more than $195 million from the budget. among the line item vetoes, $54 myion from cal fresh t food stamp program. $29 million from preschool programs which cuts the number of slots available to poor children. a 5% cut of cal grants. >> just in time for the busy fourth of july holiday state parks will be spared from the budget cuts that would have shut them down. 70 parks were set to close on sunday but park operators now say 65 of them will stay open. the governor signing a bill allocating $10 million in new funds for the park system and donations from nonprofit groups

helping to keep the gates open. among the parks in northern california that will be closing, the benicia state recreation area and gray whale cove state beach in san mateo county. people can walk on the state beach properties but services like restroom maintenance and trash collection will be stopping. >> we know the weather has been great inland. what about heading to the beaches? >> it's going to be nice this weekend. for today, though, temperatures are going to hold on to the low 80s inland, bay side 75 and 68 at the coast. you're not going to get as much sunshine as you did yesterday but still getting pretty nice out there. now, if you'll be headed to the giants game, beautiful conditions, 57 degrees tonight. they shut out the reds last night. they hopefully do it again and it's going to be comfortable. catch that game. >> we're looking at highway 4 as is typical the pattern building for westbound highway 4.
