clouds on this thursday, july 5th, "today in the bay." >> good morning everybody. thanks for joining us. the time is 6:01. i'm jon kelley. >> i'm laura garcia-cannon. a developing story we're following, a nightmare commute on the bay bridge. several lanes have been blocked for hours as the chp investigates a shooting. christie smith joins us live with the latest. >> reporter: good morning to you. traffic is still barely moving along here on the lower deck of the bay bridge, this is just past the tunnel the eastbound direction toward oakland. lower deck of the bay bridge. the latest information i have, it looks like two lanes are open. i got an update from the chp. what they tell me happened here is that an officer spotted a driver flying across the lower

deck, possibly over 100 miles an hour. the chp officer tried to catch up with that driver but this was they say not necessarily a pursuit because the driver was so far ahead. by the time the chp officer caught up with the driver the driver had crashed here at the "s" curve, then there was some sort of exchange of gun fire. but no one hurt in that, instead, two people were actually hurt that were in the vehicle. they were hurt in the crash and transported to the hospital. i spoke with the chp and asked when we might see improvement. what they tell me is the earliest we could start to see traffic moving at least a little bit faster than this morning is maybe 6:30. you can see things moving very slowly. what they tell me this is just a really wide area that they are investigating this morning, so again, 6:30 before we can start to see things improve.

when it will reopen they don't have an estimatement and how traffic is impacted i turn it over to mike. >> your picture shows the most. we're looking at the lower deck. that's the commute direction. the lower deck out of san francisco that's the issue this morning. the headlights are moving smoothly. from inside treasure island tunnel, allen is moving the camera to show us the closures. four out of the five lanes. that's restricting the traffic. another accident happened but that's cleared from the reports. still very slow. 6:30 they hope it moves smoother and it looks like caltrans or somebody may have put a request in for the emergency closure to last until 10:30. the san mateo bridge, that is moving smoothly, much better

than the jammed up lower deck. >> mike, look forward to it. announcement expected in the sex assault investigation involving san francisco giant pablo sandoval. bob is live at the sheriff's office where we should learn if sandoval will face charges. good morning. >> reporter: good morning, jon. yes, after a month-long investigation in this case, the sheriff's office told us that they will put on a news release at 10:00 this morning. this investigation has taken time because it's our understanding investigators were waiting on test results on forensic evidence that pablo sandoval's accuser. the accuse ser a 21-year-old woman accused the star third baseman with the giants of sexual assault. she allegedly melt sandoval at a bar on thursday night of may 31. from there she went with him,

his brother and agent, to a resort where she says the assault occurred in the wee hours of june 1. the sheriff's office questioned sandoval later that day. he was not charged. he has been cooperative and what happened between him and the woman was consensual. whether or not investigators agree we expect to find out in a few hours when they are supposed to announce any recommendation for charges. reporting live, bob redell, "today in the bay." >> the fireworks may be over but local businesses are celebrating. big crowds meant big bucks for many. several charter companies sold out most cruises yesterday. >> the fireworks, we've been sellg out all day. so all of the boats are pretty much full. we do this every year. everybody has a great time. >> many smaller shops along the wanterfront also report big profits. >> this was one company's celebration to show you.

the giants treated crowds to a spectacular fireworks show. it started after the game. >> we can tell you not all of the fireworks were legal. in oakland police confiscating everything from bottle rockets to m-80s and issued citations which carry a $1,000 fine. it's illegal to carry anything but safe and sane fireworks without a valid permit. police and fire departments say dry conditions make shooting off fireworks dangerous. >> hundreds of thousands gathered to view. they got it but all at once. talk about a big boom. a glitch caused all of the fireworks to launch at the same time. it happened about 5 minutes before the show was actually scheduled to start above

san diego harbor. in two minutes it was over. the company behind the show is looking into what went wrong. >> people were evacuated from boston's july 4th tradition, they were waiting to see the boston pops show. severe weather moved in. the show eventually resumed about 25 minutes later. >> crazy in san diego. i'm sure a lot of people went home thinner. we check in with meteorologist >> i feel bad for the guy who planned that event. years of planning, a live look at san jose. we're reaping a benefit from all of those phi fireworks in san jose. you can see the yellow, the oranges, that's particulate matter left from big explosions in the sky. moderate air quality. you want to keep in that mind.

temperatures are comfortable. mid-50s headed to the 80s in the warmest cities across the bay. no more 90s for a couple days. a much warmer week next week. 74 at noon. if you are waking up in bay side, not a much sunshine as we did yesterday. that fog will likely be a factor until probably noon. but you'll hit 68 at noon, rounding out the day with the low 70s. your full forecast in moments. here is mike. >> the bay bridge is your lower deck commute, can't use that this morning. you can but i wouldn't. i would use b.a.r.t. there's all of the jam. restricted flow. police activity on the bridge, on the oakland side. we continue to follow that but the commute and the upper deck out of the maine that is moving

smoothly. a lighted volume this week. so we have a litter volume of traffic. we're seeing livermore 580 down into the 16-minute range. 50s, then at the dublin on your left. aches 80 and 880, a nice drive as well. the 101, 87, 85, 280, not a lot of slowing. a blip or two. the big issue the bay bridge lower deck. avoid if you can. >> thank you, mike. lawmakers speeding to a vote on the california bullet train, a vote expected tomorrow on funding for the start tv68 billion project. 18 twist the money for the bullet train will be tied to a train to save cal train commuter service. the governor releasing his final proposal yesterday to cover construction of the first face of the project.

>> welcome back everyone. the bay bridge near treasure island this morning. the lower deck has been a mess. that's headed eastbound this morning. as you can see from these live pictures. a shooting investigation was going on earlier, traffic just kind of at a crawl. we'll continue to check that morning commute, help you through the bay area there and elsewhere. 6:13. >> the jury taking timing very, very methodical with this one in the trial of a south bay man

accused of assaulting a priest. marla tellez is live with the charges being considered on the second day of deliberations. >> reporter: good morning. the prosecution in this case says this case is solely about assault, well, the defense argues the case has many layers. lynch is facing two counts of first is felony assault with intent to cause great bodily injury. the second is one count of elder abuse under circumstances likely to produce great bodily harm or death. lynch could spend up to four years in prison if found guilty on both charges. the defense contends that lynch confronted father jerry lindner in 2010 at his retirement home to get the priest to admit in writing that he molested lynch in 1975. lynch admitted to the beating while on the stand. the prosecution says lynch took the law into his own hands, and

the jury needs to recognize the assaults. our legal expert weighs in. >> the case from the d.a.'s point of view is about the rule of law and they did a good job of explaining that even when their victim is someone who is a despicable human being, they still have to prosecute the case. >> more than 10 years ago lynch settled. the church paying the brothers about $600,000. lynch is pleading not guilty both of the charges. the jury resumes deliberations at the hall of justice in san jose at 9:30 this were mooing. >> a prayer service planned to honor the people found buried in a south bay potter's field. construction crews working on the expansion of the medical center discovered the graves, some all the way back to the 19th century. a ceremony on saturday will heb

those and help bring closure to family who believe their relatives are among them. a judges that give at any county permission to remove the coffins. >> today on road to the london olympics. already there is history in the making. >> that is right. oscar will make a run for south after friday california take a look at this. he is the first amputee to ever compete in track at the olympics. the 25-year-old had both legs amputated while a baby. he runs track using carbon fiber blades known as cheetahs. the story inspired people all over the globe including a man here in the bay area. >> he is at a level as an athlete where he is able with prosthetic adaptation he is able

ro rosa. tlous the day, high pressure has moved to the south so it's able to grab the moisture, pump it through southern california. that's high pressure picking up that moisture. for us we're not going to see too much impact. potential for isolated thunderstorms will develop. also it will feel more humid. while that ridge stay to our south, taking your temperatures down with the additional cloud cover which will clear as you can see by about noon for most of your inland cities a. little fog at that time. all the way up to san francisco and will roll back in tonight. not as thick and tomorrow we'll be able to bring your temperatures up 3 to 5 degrees. still not soaring to the 90s yet. wait until i get the seven-day forecast. 79 in concord and about 75

degrees in san travel. we continue to the weekend. 89 on sunday. so to 89 sunday. monday, tuesday, wednesday it gets interesting. we seat some of that, maybe rain in the mountains and our hills, that's a good sign. we could see dry lightning strikes. we'll watch to watch for warnings. 6:20. a big warning on the roadway. before you head out. heading into oakland mike has that for you. >> start with a positive. b.a.r.t., no delays. you might want to consider b.a.r.t. you avoid the voer lech into ocean. there is a big issue as you head over from san francisco. crawls over to treasure island where all of the activity continues. just approaching the "s" curve.

a live look getting out of san francisco, that her tech you be, these are break lights. anything jammed. getting over to the -- there you go, to this scene. the activity blocking four out of five lanes, restricted flow. it will take as long as it takes because of the investigation that continues, christie smith is following the details after what kunds hike an overnight smooting. we may have an issue with someone running out of gas. man, that's why i say don't necessitate. there is a dig delay. >> rough morning. >> scott mcgrew is enjoying a much deserved vacation. the business show and news must go on.

>> a show start this morning. futures, and the nasdaq and the dow jones all down after having yesterday off, markets off the close a little lower. >> moody's investor service downgraded the outlook on barclay's bank from stable to negative. the change reflects concerns about execute 5 resignations. the bank's ceo and chairman will step down following an interest rate rigging scandal. >> this sounds like out of the movies. coming on monday, the fbi planning to shut internet services down as it deals with a fraud wing. that could get down, many internet services a tornado providers are preparing. very have been beach iing. >> they say it's an easy fix.

>> 6:wo 5. in washington, d.c. and several states people spend july 4th as our founding fathers did, without electricity. tracie potts joins us live from washington where another day of unprecedented temperatures really getting under way. people having a tough run of it. >> reporter: simply put, people are hot and it's frustrating. and it's frustrating because they don't have air conditioning. 735,000 people, that's three quarters of a million people almost, in this region, the surrounding states without power. that was the count as of last night. crews are making steady progress. it's taking a long time. because this is so widespread. the challenge here is that it's getting hot and hotter. we're predicting to hit 100 today. 101 tomorrow. 105 here in d.c. on saturday. after that we're expecting to get relief into the low 90s and maybe even the 80s which

>> 6:31. thanks for joining us. i'm laura garcia-cannon. >> good morning. i'm jon kelley. we're following developing news on your morning commute. several lanes of the bay bridge remain closed now as the chp investigates a shooting. christie smith is live in san francisco with all of the latest details. good morning. >> reporter: good morning to you, john. earlier and the last time we checked in with you the chp told us it might be 6:30 until the traffic situation started to improve here on the lower deck of the bay bridge. i have to tell you that has not happened yet. they tell me at this point they don't know when all lanes might reopen because of the ongoing chp investigation now in its fifth hour. because this started actually about 1:30 this morning, when the chp says they spotted a driver flying across the bay bridge, possibly 100 miles an hour on the lower deck. there was a pursuit but the car

was so far ahead by the time the chp caught up the driver had crashed, gone through the "s" curve, crashed into the side wall. there was an exchange of gun fire. two people hurt but they were hurt in the crash, not by the gun fire. and taken to the hospital. at this point it's unclear who fired first or how that went down. that is part of the investigation. but this has gone sometimes to a complete closure and again right now it looks like we have two lanes traffic squeezing by. this is the reverse commute direction but certainly something you would still want to avoid. it's a mess out here this morning. for more on how traffic is looking i'll turned over to mike. >> yes, she's talked about it's been a fluid situation but the traffic flow has been far from floud as you travel out of san francisco to the oakland side.

let me get you a look. bay bridge we see the commute direction and the bay bridge toll plaza. the petering lights turned on and the backup is there. but the upper deck moves smoothly. what we're looking at is christie's action there in the tunnel. treasure island is the lower deck out of san francisco as she said it's opposite the commute. san francisco to oakland avoid the lower deck. we have restricted flow, down to two lanes and investigation continuing and we don't know when chp will reopen the lanes so avoid that. one of the alternates is the san mateo bridge. 101 between san francisco and san mateo or 880 between oakland and the bridge. it's moving as well. it adds a few more miles but it might be a more pleasant drive. a look at the rest of your commute coming up as well as following that bay bridge lower deck. >> busy morning. thank you, mike. we could learn whether giant

player pablo sandoval will face sexual assault charges. bob redell joins us live with the latest on the investigation. good morning. >> reporter: good morning to you. it's our expectation we should get the results of this investigation when the sheriff's office releases a press release around 10:00 this morning to announce whether or not they intend to recommend charges against san francisco giant pablo sandoval a. 21-year-old woman accused the star third baseman of sexual assault. she alleged hi met him 18 bar in santa cruz on thursday, may 31. from there she went with him, his brother and agent to a resort where she says the assault occurred in the early morning of friday morning, june 1. the sheriff's office questioned sandoval later that day, his lawyer says he has been cooperative and what happened between him and the woman was consensual. he has not been charged and has not been arrested.

this investigation has been going on for a month and we understand that the reason why it's taking so long is the sheriff's office had been waiting for the test results on forensic evidence that pablo sandoval's accuser submitted to a hospital. bob redell, "today in the bay." >> 6:35. three of four children missing in north oakland are now safe. police had been looking for them in connection with a child abuse investigation. officers found a 3-year-old boy unresponsive and suffering from signs of abuse monday in a home on 63rd street. he is still in the hospital in critical condition. his babysitter, mother and stepfather have been arrested. police were concerned about four other children but the youngest were found at a relative's home. 16-year-old allayia marie johnson is still missing. >> fans getting more than they bargained for in san jose.

all of the action wasn't just on the field but up in the sky. look. all of the excitement happening as the san jose giants played those modesto nuts. the crowd enjoyed watching the ball game as the home team beat the nuts 8-2, the show that followed was the real attraction. >> good. it was nice. i liked it. very nice. me and my brother and my nephews, had a good time. >> i like it very much. a nice family scene. >> the fireworks show, the annual event there and well, you can say there is nothing minor league about it. clever. sometimes you feel like a nut, sometimes you don't. >> let's check in with meteorologist christina loren. >> yeah. like that, jon. like that a lot. a great looking day shaping up taking a live look over san jose

so far this morning. cloud deck has broken apart here. a great looking sun rise for you. sun sets at 8:34 tonight. so a lot of sunshine in the forecast for today. and you can see how clear it is even with all of that particulate matter left from the fireworks off in the sky. last night looking pretty good, in the moderate air quality range. temperatures are crisp in the 50, sunnyvale at 55 san mateo also at 55 degrees. so hopefully you had a good night last night. waking up this morning with the traffic alert. we'll get to that but i did want to point out at 9:00, dealing with a fair amount of cloud cover hugging the coast and that will be the case throughout the day. the first part of the day in particular. not as much sunshine in san francisco. 74 degrees at 4:00. your full forecast, first, let's check the drive. >> avoid the lower deck of the bay bridge because of the investigation going thereon on the span. live look out there shows you the view as you travel through

>> welcome back everybody. on a thursday morning we follow developing news on your commute. several lanes of the bay bridge remain closed as chp investigates a shooting. >> christie smith is live in san francisco and joins us with the latest. >> reporter: good morning to you. i can tell you this story just keeps getting more interesting, now the san francisco police department is getting involved. they are sending homicide investigators in as well as csi. why, though, unclear. the chp telling us that they caught up with a car on the bridge coming from san francisco at 1:30 this morning on the lower deck. they tell me it was flying

possibly up to 100 miles an hour. and that the driver crashed at the "s" curve. there was some sort of exchange of gun fire between someone in the car and an officer, two people injured in the accident. not by the gun fire itself. but exactly what set off the exchange chp says it's part of the investigation. there was a full closure overnight on the lower deck. now it looks like two lanes are open. boy, i tell you, this has been a crawl all morning. no eta when this will be clear when the entire thing will reopen. so certainly something you would want to avoid if at all possible. for more on how to get around this i'll turn it over to mike inouye. any ideas? >> we have a lot of ideas, we'll explore them. the bay bridge, we have talked about it and usually people assume that means the upper deck. there is the backup by the toll plaza. the metering lights are on but the incident is on the lower

deck. christie showing that shot it's backing up at the curve. the "s" curve, this is the tunnel at treasure island over from san francisco to oakland or i should say that's the direction but you're not getting there from san francisco to oakland because of all of this activity continuing. avoid that lower deck. take the san mateo bridge. that's with the headlights coming toward us. it's an easy drive down 101 to 92, back over to 880 and back up in toward the east bay or the richmond bridge to the north, the golden gate bridge is not having problems either and the b.a.r.t. is a great alternate. over 50 trains on time. the rest of the commute coming up. >> moving to international news, japan's government and the operators of the fukushima daiichi power plant being blasted. among the findings of the final report released this morning the

disaster was the result of, quote, poor earthquake safety planning and faulty post-tsunami communication. the report concludes what happened in fukushima daiichi was a quote profoundly man made disaster. >> time to check the forecast with meteorologist christina loren. it's pretty mild, very nice. >> it's such a good reminder we live in earthquake country here and your own personal plan is extremely, extremely important. make sure you have water in particular, and when you're at the grocery store grab a couple of extra cans. that's going to keep you and your family safe if something happens. we're overdue. something else, hot weather. it's been so mild we've got it at the end of my seven-day forecast. stay tuned for that. let's start with this live look at san francisco. mostly cloudy conditions out there this morning. the fog has returned, even drizzle up through the santa cruz mountains and along the peninsula. old glory blowing in the light

76 degrees today in san jose. can't beat that this summer. 87 degrees by friday inland, temperatures will start to climb. monday, tuesday, wednesday, it's going to be noticeably warmer though we're wrapping temperatures up in the 90s. the humidity makes it feel warmer. we call at heat index. so temperatures are going to feel like 95 degrees on wednesday. make sure you're ready for that. before you head out the front door, trying to get into oakland, mike, at least you have a smile that makes it easier. how are we looking? >> you know what, we focus on this like a traffic index because an accident on the bay bridge makes the whole commute feel worse because of the lighter volume of traffic. the holiday traffic keeps this out of the main focus. the approach all the way to treasure island where christie continues to follow that shooting investigation. the upper deck, very smooth

drive, the metering lights are on. no problems getting in from the oakland side. we follow the flow of traffic south, you might want to take 101 to the san mateo bridge which i told you is moving smoothly for 92 as an alternate to the lower deck. the san mateo, no problems down the peninsula. 101 and 280 smooth, the lower peninsula as well. north of 680, we'll likely see speeds dip for 87 around capital and curtner. 280 to the 880 interchange likely see slowing in the next 20 minutes to a half hour. it's a lighter build and a slower build. past the oakland coliseum, this is how light the traffic flow is. here at 6:51 we're going an easy drive at the limit from 238 up to the bay bij toll plaza. the westbound direction, the issue and the investigation, the lower deck. consider b.a.r.t.

>> okay. jam with your toast. 6:51. scott mcgrew is off today but there is news to report from his field of expertise. china all set to post its worst growth since the 2008 crisis. china's economy slowed in the second quarter. investments, output and retail sales weakened. they think china's economy will recover in the third quarter. and a frightening prospect por the silicon valley and around the world. on monday this might be coming, the fbi planning to shut down internet services as it deals with the internet fraud ring they are chasing. that could cut off the web for millions of users on monday still connected to the servers. many internet service providers are prepared and have been reaching out to customers to try to check their computer configuration. >> a woman is hoping to carry on her son's willing gassy by giving a gift.

shafl walsh donated $10,000 to help the department buy, train and equip them with a new police dolg. she presented the gift yesterday on the fourth of july. her son, specialist sean walsh, dreamed of becoming a police officer with the canine unit. he was killed in combat in afghanistan last november. >> all of these holidays where i realize now that someone like my son, and somebody else's son, made a sacrifice. >> to honor her son, cheryl walsh created a foundation to help out the canine program. the new canine will start training with police next week. >> what a great tribute. san jose jury resuming deliberations this morning in the trial of a man accused of assaulting a priest. marla tellez is live at san jose with the charges under consideration. good morning. >> reporter: good morning.

in about 2 1/2 hours the jury will begin deliberating again. they are considering two counts against 44-year-old william lynch. he is facing one count of felony assault and one count of elder abuse. if found guilty he faces up to four years in prison. this is centered around the beating that he admitted to on the stand. he says he beat up jerry lindner after trying to get the priest to sexually assaulting him and his brother in the mid 1970s. to some extent lynch has won. >> he has exposed father lindner. >> this was a serious assault, there were significant injuries and you can't just overlook that because the message it sends is that it's okay to do certain criminal behaviors but not others. >> reporter: though father lindner initially took the stand the judge ordered the jury to

strike that testimony. the the priest is now pleading the fifth and the defense says he created reasonable doubt for the jury. we'll be on standby waiting for the verdict to come down. marla tellez, "today in the bay." >> some closure this morning for the family after baseball fan who disappeared in san francisco last week. police confirmed that a body found in the water along the embarcadero is that of 27-year-old victor. he disappeared june 25 after attending a giants game. the discovery comes four days after his family carried out their own search for him. an announcement is expected in the sexual assault investigation involving giants player pablo sandoval. bob redell is live at the sheriff's office where we should learn if sandoval will face

charges. >> reporter: after an investigation into this the sheriff's office tells us they will be putting out a news release at 10:00 this morning, so in just over three hours from now this investigation has been taking time because it's ourn understanding they are waiting on test results on the forensic evidence that the accuser. she accused him of sexual assault. she allegedly met sandoval in a bar thursday, may 31. from there she went with him, his brother and agent. the assault occurred the next morning. the sheriff's office did question sandoval. he was never arrested or charged. his lawyer says he has been cooperative and what happened between him and the woman was consensual. whether or not investigators agree with that we expect to find out in a few hours when

they announce whether there will be a recommendation for charges. bob redell, "today in the bay." >> updating you on developing news on your commute. several lanes of the bay bridge do remain closed as the chp investigates a shooting. christie smith live in san francisco, she has all of the latest. how is it looking? >> reporter: good morning to you. this is the reverse commute direction we're talking about but you certainly wouldn't know it. it's been at a standstill or near standstill pretty much all morning. this is down to one lane. new, san francisco police homicide now involved and csi. why, though, they haven't said. they picked up this pursuit on the lower deck of the bay bridge toward oakland around 130 clork that was flying bay, possibly up to 100 miles an hour and couldn't navigate the curve and crashed.
