>> i'm laura garcia-cannon. >> good morning everybody. i'm jon kelley. and he was at the center of one of the bay area's biggest murder trials. today, he's heading back to court. hans reiser, an interesting twist, his own children are suing him. christie smith is live in hayward with details on this new trial and the murder of his wife six years ago. good morning. >> reporter: good morning. there's bound to be drama here in the courtroom even with opening statements that are expected a little later today. as you said hans reiser is being sued by his own children over the loss of their mother and he is acting as his own attorney in court. reiser was convicted of murdering nina reiser in 2008 and now the children are seeking more than $15 million for emotional damage. the attorneys say he is capable of generating income even from behind bars. reiser looks to be focused on

defending himself. he says he actually killed his wife to defend the kids from harm. their attorney says that is ludicrous but one legal analyst says expect fireworks with this. >> any time hans reiser enters a courtroom there is going to be high drama. you never know what he's going to do next. the jury by seeing the way hans reiser acts may punish him and reward more money than they may otherwise. >> reporter: the children are now living in their mother's native russia with family. he has subpoenaed them to appear in court but it is doubtful that they will actually come. they have not had contact with hans reiser since he was convicted. reporting live in hayward, christie smith. >> a desperate search in the east bay for an autistic man who has been missing for more than a week. deputies say chris galarpi ran away from his family last

monday. they say he is severely autistic and cannot communicate. he is 5'6", weighing 170 pounds. he also uses a cane to walk. he was last seen wearing an orange short-sleeve shirt and brown pants. >> this sounds like something out of a script. they did this, predicting a crime before it happens. this was in morgan hill. police using a new technology to do that. it's called predictive policing. special software takes all of the crime information from the past month and puts that into a map. this allows the officers to see where the crime hot spots are. morgan hill police say the technology also helps when you have a smaller staff. >> tremendous because we've always been short for as long as i've been here which is 12-plus years. just to be able to go out there and know where maybe there is

some crime pattern occurringing. >> very unique. on the other side critics worry this could lead to stereotyping and racial profiling. >> keeping up with apple. the city of cupertino bolstering staff and moving ahead with a revised budget that will add two more positions. the new associate planner and associate engineer will help handle the extra workload, the apple campus is expected to generate. the council must approve the campus 2 project adding 2.8 million square feet of a project planned for the prune ridge avenue. >> a first for the san francisco giants. four players will be on the field at tonight's all-star game in kansas city. bob redell is live at at&t park in san francisco with what's behind this distinction. good morning, bob. >> reporter: good morning. you have four giants players starting in the national league

laura. temperatures are going to stay mild right by the water. however, i wanted to point out the best way to tell the story is with pictures. 55 degrees now in concord, by noon in concord, 86 degrees. you'll be at 91 in antioch. 90 already in livermore so a really hot day shaping up. substantially warmer than yesterday. yesterday was a cooker in the east bay. 100 at 4:00 p.m. livermore at 83 bayside and 69 at the coast. temperatures start to tumble as we head into the weekend but we have a couple more hot days and we're sparing the air today. unhealthy air quality in the east bay. try to limit your activity but the heat will probably help you do just that. let's check your drive. >> we'll take to you the peninsula. i told you, you're down to one lane through palo alto. we're showing no slowdown on our sensors. also getting out of the area,

eastbound 84, that's the dumbarton bridge. two lanes get you by. this is a traditional spot heading to fremont and newark. san mateo bridge smooth in both directions. we have construction southbound 880 from 23rd off of fifth to 23rd. southbound no slowing so it doesn't matter. there is only one lane blocked. commute direction for 580 and 24 toward the toll plaza and the east shore freeway will move smoothly as well. opposite we have one lane blocked to 24 to the walnut creek interchange. that is easy light volume. 242 out of concord. great speeds there. slowing in about a half hour, 20 minutes maybe. and the eastbound direction for highway 4. looks like it's clearing but still chp has not given me the

the new california law prohibits the products derived from force fed birds. the restaurants that break the rule could receive a $1,000 fine. this saturday the club plans to introduce it. >> a bay area world war ii landmark. some want the ship museum to start paying rent. the operators insist a 1990 agreement gives them the space rent free. the city is poised to vote on the issue tonight. >> no secret wall street seems rife with cheating with bankers and stockbrokers soaking their clients. a new study out says the financial world seems okay with that. >> a wall street law firm says a quarter of the financial executives it surveyed said that cheating was necessary for success. about the same percentage one

out of four said they had personal knowledge about someone cheating on wall street, all of this as regular investors, mom and pop investors leave the stock market in record numbers. scandals on wall street include galdman sacks executives calling investors muppets. jpmorgan chase losing money it wasn't sure if it was 2 or 3 or 4 billion. mf global taking client money before collapsing. this is all in the last year or so. oh, and bob diamond when it got caught monkeying with the offered rate he says he is going to give back $30 million of bonuses. british lawmakers are holding more hearings. there are some honest faces on wall street. those include sima mody with a market check. >> good morning. futures are higher after markets

suffered from a case of the mondays, the dow has closed down the past six mondays in ten of the past 11. in a quirk the dow has also closed up for the past six tuesdays, and europe, that's what we blame. stocks under pressure after yields on spanish government bonds rose to levels seen as unsustainable for the government to be able to refinance its debt and pay its bills. the european markets are trading higher. asia did fall overnight. the dow dropping 36 wouldn'ts to close at 12,736 t nasdaq losing 5 to close at 2531. consumers are ramping up borrowing a possible sign they are willing to spend despite the economy. borrowing on credit cards, student and car loans and other debt rose 8% in may, twice as much as expected. that was led by an 11% surge in credit card debt. the highest increase in nearly five years. that's the latest.

the climb even more so than yesterday. it was not that bad in san jose. i didn't have to use my ac, today i likely will. temperatures will approach 90 degrees. we're talking about the triple digits in the extreme east bay. this is the time of year when the micro climates really make themselves known. if you're looking for cooler weather, maybe you have the kids, you want to get them out of the house, take them to the beach. that's the safest bet. downright hot conditions, you risk overheating if you're staying out there for any duration of time. stay hydrated. we're still dealing with what we call a dry heat. you're not going to be sweating as much as if we had more humidity in the atmosphere. that means it's harder to detect when your body cannot keep itself cool. make sure you monitor yourself and of course we have plenty of tips on our website nbcbayarea.com/weather. air quality forecast is back in the mix base we are now sparing the air. in the east bay that's where we have the unhealthiest readings

when it comes to pollutants. that will continue to get worse. the worse air quality typically at 5:00 when we have most of the cars on the highway and the hottest point of the day. throughout this afternoon, temperatures, 5 to 10 degrees warmer than yesterday. tomorrow we'll peak. hot humid weather only a few days, though. so livermore, 100 degrees, about 101 tomorrow. and then we'll start to cool off thursday, not by much thursday. but we'll cool you off friday, saturday, sunday, temperatures falling back to seasonal averages. in addition more of an onshore flow. that purifies our air quality. so we'll probably be sparing the air tomorrow, thursday as well. and then give it a break friday through the weekend. let's check your drive. >> we'll take to you the south bay where we're talking construction for 85, already starting to clear. el camino, either direction, still construction probably into the morning commute. we'll continue to follow that. they typically pick it up earlier than they say they are

going to. we have a smooth drive but south of 237, keep in mind a lane or two. we do have an incident, this is a disabled vehicle northbound 101 around julien. the sensor says 70. that's obviously too fast. 65 is the limit but it shows that the light volume is able to get by without much distraction. sounds like one of the lights is out and the flashing blinkers. an issue until the tow truck gets there. a smooth drive for 101 has construction cleared from palo alto. a smooth drive past the scene across 84 t dumbarton bridge, crews there. no problems there or across the san mateo bridge so take you for a look. see the volume of traffic. here, westbound your commute direction showing you the value. in the 50s as you cross over. the high rise visible but the blanket of lower clouds over to

one. the rescuer becomes the rescued. a helicopter crew was trying to help a hiker who had broken his leg. when the crew got out to help the hiker one of the helicopter's blades hit one of the rescuers. get this. that's when the injured hiker, he's an air force medic, stepped in to help. the medic and three other hikers provided first aid and helped the officer back into the helicopter. both the injured medic and the officer were then taken to the hospital in redding for treatment. >> fortunate for a happy ending. goodness. my broken leg but i got you. let's check in with meteorologist christina loren. no injuries out there. weather looks good. >> no. so far so good. but we do want to keep in mind that with triple-digit heat in the bay area something we're not accustomed to even in the summertime, you really want to monitor yourself outdoors today. you don't want to overdo it.

heat exhaustion is a problem when we get this hot. 100 degrees at 4:00 in livermore, 83 degrees bayside at 4:00 p.m. that's oakland at 4:00. 80s. we do have cooler weather on the way but two more hot ones first. we'll sort it out coming up. here is mike. >> we'll take to you the nimitz freeway. a smooth drive, lighter volume of traffic but let's talk about the construction. crews have cleared or are clearing at southbound 880 between fifth and 23rd we had construction blocking one lane. we have reports that they are on the move, caltrans says that's the case. no brakes. this volume of traffic able to pass the coliseum now. you might see flashing lights for a few but so far no problems southbound. the taillights going northbound, that is your commute direction and no disruption to that all the way to the bay bridge toll

>> i'm laura garcia-cannon. >> today right here in the bay area convicted killer hans reiser returning to a courtroom. >> he is facing a wrongful death suit brought on by his own children for the murder of their mother. christie smith is live in hayward where new information is coming to light why reiser says he killed his wife. good morning, christie. >> reporter: good morning to you. we'll get to that in a minute. but expect fireworks, that is the word of one legal analyst who says with hans reiser acting as both a defendant and his own attorney, things are bound to get dramatic in the courtroom as soon as today because with hans reiser you just don't know what he's going to do next. but the jury could punish him and award more money depending on his behavior. the reiser children are suing their father in a wrongful death lawsuit for $15 million over the death of their mother nina reiser. hans was convicted of her murder

and the children's attorney says reiser is a gifted computer scientist, very capable of generating income even behind bars and the children, he says, have suffered. >> they are obviously traumatized by what happened. how do you get over this. they lost not only their mother but they lost both parents. it's affected them a great deal. >> reporter: again, hans reiser has decided to act as his own attorney and mentioned in court documents that he killed his wife to defend his children from harm. the children's attorney says that is absolutely ludicrous, jury selection continues this morning, and then it's on to opening statements. reporting live in hayward, christie smith, "today in the bay." >> we can tell you a second suspect in a bay air triple murder facing extradition. that is wilfredo reyes. investigators say he has been

hiding out for four years. he is wanted in connection with the murders of tony bologna and his two sons. the victims' family relieved to hear of the arrest. >> it's been very hard for them that one of the individuals responsible was still out there, so to hear this news was a great relief. she was really pleased. >> while reyes' alleged accomplice was convicted last month in the murders, he claims reyes was actually the gunman in the shooting. the san francisco d.a. is working to bring reyes back to the area to face a list of charges including three counts of murder. >> president obama will make a fundraising trip to the bay area. for the first time since taking office it will be in oakland. the president has been a frequent visitor to the bay area in the past several months collecting millions of collars in donations. but he's only been along the peninsula and in san francisco. but in two weeks on july 23 he

will host three separate fund-raisers in oakland including a stop at the historic fox theater. tickets range from $100 up to $35,000. >> a battle over the november ballot certainly heating up in sacramento. a second group has filed suit on the placement of the governor's tax initiative as the top item. the first suit was thrown out. the attorney argued she filed petition signatures ahead of the governor and should be higher on the ballot. the judge rejected that and now the taxpayer association filed a similar challenge. they say balance hot placement is important because voters pay less attention to lower items. >> cash only for cannabis. that's because credit cards are now being denied at california medical dispensaries. the government ordering banks to no longer process medical marijuana or face fines.

some clubs have always been cash only but for the other clubses their customers have to carry cash. >> pg&e claims new technology that will help prevent another pipeline disaster. the company will start using a 14-long machine to inspect pipelines. the utility plans to inspect more than 200 mile this is year and will continue for the next three years. back in 2010, a damaged well caused a pipe line to explode, killing eight people and destroying homes. >> that brown blanket will appear over the east bay and the valleys, this marks the first spare the air day of summer. marla tellez is live at the lexington reservoir with how people are being urged to conserve. good morning. >> reporter: jon, good morning. we are in the middle of the lexington reservoir surrounded by plenty of dry brown hills.

santa clara county, we found who else, smoky the bear warning everybody that fire danger is high today. so all of us have to do our part to prevent fires. we had a relatively dry spring so our landscape is ripe for high fire danger. the fire warning is coupled with our second spare the air day which means our air quality is deemed unhealthy. temperatures expected to reach the 90s in spots. this means it's a good idea to limit outdoor activity if you can. for some, though, that is hard to do. we spoke to one young man who delivers the newspaper. >> really hard to get used to it. then you get dehydrated and you don't want to work. >> reporter: well, even if you have to work today you are encouraged to drive less. so always a good idea to try

san francisco, 51 in san mateo. and comfortable 59 degrees in sunnyvale. the story of the day, a foggy start, foggy inland and we have increased fire danger as smoke the bear pointed out. a cooler weekend on the way. it works like this, your forecast shows you 100 degrees at 4:00 p.m. bay side, even hitting the 80s so pretty hot in the city. especially downtown where you have all of that pavement. it's going to be hot in the city. maybe you have the luxury of wearing a short sleeve suit. >> you can't see if i'm wearing long pants or short. 101, good news as more comes in about indisabled motorcycle, it's on 101 north of the 92 transition so it will not affect you getting on the bridge. sounds like the motor cycle,

there is no driver around so no one is at risk except for the people driving past the seen. this is the fast lane. the person who reported it almost hit that. across the bay, 92, easy drive and the castro valley y it new problem. a blip for 238. we also always see some flowing as we should. looking at 580 out of the altamonte pass. the volume is relatively light so no big surprises so far. we'll look to the south bay for a live look at the san jose region. northbound 280 with these headlights under the 88/17 interchange. this is a light flow but i'm following a disabled vehicle on 101 at julian. i'll bring you that and slowing coming up in the next report.

bullying finding its way to the halls of congress. >> there is a bill that would give money to states for anti-bullying programs in schools. brian mooar live on capitol hill with more for us this morning. good morning, brian. >> reporter: good morning, laura, jon. this is an issue so troubling so immediate that even republicans and democrats in this bitterly polarized congress can find common ground. what the idea here is, is an update, a 2012 spin on a 1968 law that provides grant funding for schools for security. congresswoman sheila jackson lee, a democrat of texas, has managed to get together ten co-sponsors. republicans among them. they are going to provide $40 million a year over the next five years to provide not just bullying prevention but also education. this stretches into the areas of cyber bullying and also gang prevention. so it's a big deal here. how big of a deal is it?

statistics show one out of every four teens is bullied. 168,000 students every single day, staying out of school because they fear being beaten or taunted or just made to feel like they don't belong. so laura, jon, this is an effort in washington, a bipartisan effort, to try to provide some cover, some haven for these children. >> nice to see they are agreeing on that. >> indeed. >> thank you very much. because the battle lines are being drawn over several key election year issues the house could soon vote to repeal president obama's health care reform law, it comes after the supreme court recently upheld the measure. even if it passes the democratic led senate is likely to shoot it down. the senate will debate extending bush era tax cuts. >> the consequences of taking more money from successful people. >> let's not hold the vast majority of americans and our entire economy hostage while we

debate the merits of another tax cut for the wealthy. >> president obama has promised to veto any across the board tax cut extension. >> the president of venezuela "hugo" chavez says he is cancer free and ready to campaign for re-election. he declared himself cured and then suffered a relapse. his health and ability to campaign will of course be important to voters in what could be a tight election. >> the south sudan marking its first year as an independent state with shakespeare. a group of actors staging a performance of the play at london's globe theater. it's one of the lesser known works and tells the story of britain preparing for war with rome over taxes. the south sudan had a long dispute with sudan over how much it should pay to pump its oil.

degrees from yesterday's highs. under strong high pressure. great beach weather. look at this. you're headed to pacifica only i'd say about 20 days out of the year do you hit mid-70s. 73 degrees in pacific today. half moon bay, 75 with wind, 10 to 15 miles per hour out of the northwest. the warmest beach city getting toasty, santa cruz breaking into the low 80s. 82 between 4:00 and 5:00. that's when you'll likely turn on your air conditioner. 87 for los gatos and the closer to the water the cool ter weather. you get that room temperature weather in the city by the bay for today. 99 by thursday. then those 80s return as we head into the weekend so we'll fall back to average. got a hot remainder of the work week to get through first. we are sparing the air. mike has tips on what you can do to help out in that department. >> you do that and that and it's
