weapons on him. we're hearing witnesses tell police that they saw him throw some sort of a canister, potentially two canisters, at the front of the theater, some sort of gas spewing out, that's when he opened fire. you're looking at live chopper pictures of the scene at the century 16 movie theater in aurora colorado. a very active scene. police in colorado revising the death toll numbers saying 12 people have died, not 14. 12 people have died, at least 50 more injured. the shooter telling police he may have more explosives at his apartment, not far from the theater, and these are new pictures in, police have that complex evacuated and s.w.a.t. teams are now investigating there. the suspect's name has not been released and police have not said if there was a motive, what sort of a motive he may have. also police are telling us they have no reason to believe there are more suspects.

again, one 24-year-old man is in custody, 12 killed, at least 50 injured in this mass shooting. we're hearing that the victims range in age from just 6 years old to 31 years old. again, that information is not confirmed but again, reports say victims range in age from 6 to 31 years old. of course i'm going to monitor the story all morning to bring you the latest. >> what a tragic and chaotic scene. thank you. president obama released a statement offering condolences to the victims of the shooting saying, quote, as we do when we're confronted with moments of darkness and challenge we must now come together as one american family. >> new this morning, a critical development in the shooting death of a 1-year-old oakland child. christie smith is live in oakland with what we learned about a new indictment. >> reporter: good morning to you, laura. the men are two alleged members of a gang called the acorn gang,

operating out of west oakland, charges include racketeering, weapons violations, but perhaps the most heartbreaking, murder tied to the shooting death of a 1-year-old boy last november. this according to the chronicle. that caught on tape near a west oakland liquor store. seven people injured when at least three people in hoods opened fire on a crowd that had finished shooting a music video in the area. the shooting according to the indictment, an ongoing feud tied to the acorn gang. it named two men but it was the shooting death of a 1-year-old that was so stunning and heartbreaking to the community. he was one of three young children in oakland shot around that time. it prompted the oakland police department to call in federal help in dealing with all of the gun violence.

the very gags that led to the indictment was part of a joint investigation between oakland and federal investigators. reporting live in oakland, christie smith, "today in the bay." >> also happening police on the scene of a home invasion in the east foothills of the city. officers tell ous man broke into a home, injured one of the residents, we have a crew on the way. we'll bring you the latest as we get them. >> while many of you were sleeping police announce three more arrests in what's called the largest porn sweep in northern california. 15 people now in custody and we were there when officers swooped in. more than 165 detectives taking part in what's called operation chicken hawk. a county wide effort to arrest child pornographers. >> people that thought they were in the privacy of their own home unfortunately they chose to trade child porn on line.

that's opening through decoy operations where they are trading with agents. >> san jose police department is the lead agency there in all of this but the operation does include detectives from santa clara, mountain view, los gatos t the fbi and homeland security. >> we are expected to get answers to lingering questions in the tragic shooting death of a san jose police officer's young son. this is the neighborhood in gilroy where the 3-year-old preston orlando died on july 5. investigators have said very little about the case so far but new details are expected today. police say the boy died of a gunshot wound but have not said if the child shot himself accidently or shot was someone else. the boy's father is a 9-year veteran of the san jose police department. the district attorney is reviewing the case to determine if any one will face charges. >> meteorologist christina loren has been telling us for days it's going to be a very warm weekend but if you're heading to

santa cruz you might want to skip that dip in the ocean. posted signs are out warning swimmers to stay out of the water because of this, yeah, right off some popular beaches, a 14-foot shark about 20 feet off the beaches about 2:00 yesterday afternoon. that shark apparently did swim away but not before the pilot was able to snap some shots from above in the air. >> it was in the zone where people swim, surf and play. hundreds of kids in the water and i was thinking you know, let's take a bigger deal out of this than normal because people should know that he's there. if we can prevent something that's good. >> that is very, very good. the warning signs will stay up over the weekend advising that swimming, surfing and other water sports at this point are not recommended. so here's the question. will surfers be out on the waves? our bob redell is heading to the beach and will have a live report coming up at 5:30.

inland so getting warm. bayside, 72 at noon, up to 80 at 4:00 p.m. at the coast pretty close to 70 degrees even in san francisco. 5:07, the last thing we want on a friday unexpected surprises on the road. >> so you can expect this. looking at a slowdown. we want to warn you because you don't see slowing at this time of morning on our maps we're seeing a slowdown from off the bridge past the racetrack into berkeley. a crew should have cleared through the area as well and that's probably why we see the low sensors. slower moving tractors and trailers, that slows it. add five minutes to be safe down westbound 80 toward the bay bridge. the bridge moves smoothly, though. the san mateo bridge, north of there for 101, across the bridge we take a live look and we'll see traffic slowing away from us westbound. you lost two lanes by construction, maintenance i should say. they should be reopening the

microsoft after the closing bell yesterday. yesterday we did see a boost in tech on the back of ibm's results and that helped stock rise for the third straight day. we also had germany's parliament voted to back that bailout for spain's banks. snow economic data but so far good earnings out of ge. the dow rising 34 points t nasdaq adding 23 on thursday. a new government study says it's risky lending by banks that seems to have caused student loan debt to balloon in the past decade. that's left many americans struggling to pay off loans that they may not have been able to afford in the first place. the report by the department of education and the consumer financial protection bureau says private lenders made loans without considering whether people could repay.

we'll continue doing that. thanks for joining us everybody. it is 5:29. i'm jon kelley. >> i'm laura garcia-cannon. this morning the fbi says a lone gunman is to blame for the massacre. federal agents, bomb squad, police swarming that theater in aurora 9 miles east of denver. marla tellez has been tracking all of this information coming in all morning. she joins us from the newsroom. i understand you are now hearing investigators the name. >> he is 24-year-old james holmes, they say he is the gunman who opened fire inside a century 16 theater at the aurora mall near denver. we're learning he does not have much of a criminal history. his record is showing nothing more than a traffic ticket a couple years back. officials say he has no known link to terrorism. you are looking at new cell phone video to show you from inside the theater. you can see confusion, look at this guy with the striped shirt,

you see blood on his shirt. mass confusion and chaos among moviegoer trying to figure out what's going on. again, 12 people dead, at least 50 others injured. after police say 24-year-old james holmes opened fire inside that movie theater. he opened fire after releasing some sort of gas inside that theater in front of the theater, nbc news is reporting the youngest victim is 6 years old. we're also hearing reports that the shooter's car has tennessee license plates but he is a resident of north aurora. here is a live picture where he lived. this apartment complex not far from the theater. you can see fbi agents and police agencies on scene. what they are doing is searching his apartment very carefully because he told police that he may have more explosives inside his apartment. this apartment complex has been evacuated. this is a fluid situation.

we'll continue to stay on the story and bring you the latest. jon. >> thank you very much. also new this morning a critical development in an oakland murder that really caught the national attention. a 1-year-old shot and killed after being caught in a shootout. this was caught on surveillance video. we're now learning two people have been indicted for the murder. christie smith is live in oakland with all of the latest on these suspects that were announced. good morning. >> reporter: good morning, jon. this really struck a nerve when it happened in oakland a. 1-year-old boy shot and killed, caught in the crossfire in a gun battle. two alleged gang members have been indicted tied to the shooting and what they call a spree of violence across west oakland. that according to the chronicle. he was shot in the head last november and later taken off life support by his family. at least three people opened fire on a group of people and all seven people hit, two people

in that group actually fired back at the shooters. the shooting caught on surveillance tape outside of a west oakland liquor store. the group had finished filming a music video. the indictment names two men as members of what they call the acorn gang. the shooting of the boy and two other young children prompted police to reach out for federal help. the investigation that led to this indictment was part of a joint investigation and one of the men named was arrested shortly after the shooting on a parole violation after a bag of cocaine was found in the home he was staying at. christie smith, "today in the bay." >> this morning santa clara's district attorney is expected to make it official, william lynch the bay area man acquitted of charges that he beat a priest, will not be recharged. lynch was accused of attacking

father jerold lindner. lynch claims that he was molested. lynch was found not guilty even though lynch never denied attacking lindner. >> suspended sheriff ross mirkarimi is due back in court along with his wife. an attorney for eliana lopez asking modification of an order to allow lopez and mirkarimi have face-to-face time before she returns to venezuela. she has been there the last few months caring for her ailing father. just last night she testified at her husband's ethics commission hearing saying that although he bruised her arm, that she does not consider it domestic violence. after the hearing she expressed her hope for the future. >> i just cannot wait the moment we are going to be together here in san francisco.

and this warning will probably be up the next few days, because of this. you're looking at a photo of a great white shark. the helicopterpy hot spotted it yesterday afternoon near a cement ship off the beach. it's not like this chopper pilot hasn't spotted great whites before. what concerned him, this shark was so close to shore and it stayed at the surface. it didn't disappear like the others have in the past. so he phoned it in. when word trickled down to the life guards they yelled "shark" and asked swimmers to get out of the water. >> where people swim, surf and play. hundreds in the water and i was thinking yeah, let's make a bigger deal out of this. people should know that he's there. if we can prevent something that's good. >> reporter: two week ago a shark took a bite out after man's kayak. that took place at pleasure

mitt romney today releasing a new ad on small businesses, this is the area he has been trying to hit the president the hardest. talking about exactly what he needs to do in order to get small business back on the right track in this country. but it has not stopped debate about romney and his taxes. this is what his wife had to say. >> he has been a generous man, he gives 10% to his church, he went to the olympics, took no pay, he went four years as governor of massachusetts, took no pay. >> a new poll essentially puts the campaign even though mitt romney is up by two points, it is a statistical dead heat but also shows that romney is doing better and closing the gap with the president in some key swing states that they both have been focusing on and it shows that the president has only a 39% approval rating when it comes to the economy.

>> thank you, tracie potts live from washington. there is fallout in the jerry sandusky sexual assault investigation. a former chairman of the penn state board of trustees has now resigned. steve garban says 18 letter his presence on the board had become a distraction. he is the first board member to leave in the wake of the jerry sandusky child sex abuse scandal. he was one of several criticized for his handling of the scandal. sandusky was convicted last month of molesting ten boys. >> if you are just joining us we want to get you in the loop on this. at least 12 people killed, 50 more injured in a mass shooting at a colorado movie theater overnight. we now do know the name of the suspect, a lone gunman, we know his age. marla tellez is tracking the details all morning long. she joins us live, she has all of the latest details. >> the shooter has been identified as 24-year-old james holmes. right now the investigation is

centering around his apartment in north aurora in colorado not far from the shooting scene where he told police he may have more explosives. we may have a live look, the apartment complex is right there in the center. we just had a closer look at this and i can tell that you fbi agents there are in a cherry picker at a top floor window. we suspect this is the shooter's specific apartment and they are using precaution as they search. in the complex has been evacuated. this is not far from the century 16 theater. you can see the chaos, this gentleman here is walking out with a police officer, clearly very much has quite a bit of blood on his striped shirt. this happened about 11:30 our time, 12:30 mountain time. the gunman opening fire during

the start of the batman movie. witnesses tell police he threw at least one canister at the front of the theater, moviegoer report hearing a hissing sound. that's when holmes opened fire. we have new witness accounts that just came in. >> before he did anything, before he made any move, then after it exploded that's when he begin to shoot. >> the first shot in the air, then he started shooting towards. >> no specific target. >> police say holmes was heavily armed. an assault weapon, a rifle and two handguns. 12 are dead, at least 15 injured. nbc news reports the youngest victim is 6 years old. we're hearing the range is 6 to 31 years old. we're working to get that confirmed.
