then at that point i saw something come through the wall, multiple objects float through the wall. i saw holes in the walls. >> the investigation is currently centering around holmes' apartment in north aurora not far from the shooting scene. this is where he told police he may have more explosives. fbi agents are on scene. s.w.a.t. teams have the complex surrounded, that has since been evacuated as they cautiously search his apartment for more explosives. i'm staying on this story. i should mention that president obama was alerted to this mass shooting in the last couple hours. he released a statement, he says that he is shocked and saddened by the latest colorado shooting. >> as we all are. it's horrible. thank you very much for the latest. information continues to unfold and of course keep it tuned to nbc bay area and nbcbayarea.com all morning long and all day for

the latest updates as they become available. >> happening now, san jose police on the scene of a home invasion in the east foothills of the city. officers telling us a man broke into a home and shot one of the residents in the arm. no word on suspects in this case or information yet on how seriously the resident was injured. we'll continue following developing story and bring you updates as we get them. also new this morning, critical developments in a shooting that left a 1-year-old child dead. that child was shot in his father's arms and this was caught on video. we're learning two men have been indicted for that crime. christie smith is live with all of the latest details. good morning. >> reporter: good morning, jon. this struck a nerve here with people in oakland. a little boy, innocent victim caught in the crossfire. at the time of the shooting there was concern that this

could set off a gang war in west oakland. now comes word that two alleged gang members were indicted. this happened yesterday according to the chronicle. that shoot-out last november caught on tape near a liquor store. three people in hoodies opened fire on a group of people. in all seven were hit and someone in the group fired back on the shooters. the indictment names dionte houffe and how soon nathaniel. 1-year-old hiram lawrence jr. was shot in the head, later taken off life support at oakland children's hospital. his death along with two other child shootings moved oakland police to start working with federal investigators to try and get a handle on this. the indictment was part of a

joint investigation. reporting live, christie smith, "today in the bay." >> 6:03. while you were sleeping police announced three more arrests. in all 15 people are in custody and we were there when officers swooped in. more than 165 detectives took part in what is called operation hicken hawk. a county wide effort to locate and arrest child pornographers. >> they were in the privacy of their own home, unfortunately they chose to trade child porn on line. they are trading it with undercover police officers or agents. >> the police department is the lead agency in this but the operation does include others. >> hours from now suspended sheriff ross mirkarimi and his wife are expected to ask a san francisco judge for permission to see each other privately.

an attorney for eeliana lopez asking a judge to modify a protective order so the two can have face-to-face time before he returns to her native country of venezuela. she has been there to care for her ailing father. last night she testified at her husband's ethics commission hearing saying that although he did bruise her arm, that she does not consider it domestic violence. after the hearing she expressed her hope for the future. >> i just cannot wait the moment we are going to be together, here in san francisco. and i just looking for the day that i'm going to be just the sheriff's wife again. >> we can tell that you lopez is due back in venezuela monday where we understand she is working on filming a movie. the ethics commission is expected to make its recommendation on whether

sheriff ross mirkarimi should keep his job and that will take place on august 16. >> santa clara county's district attorney is expected to make it official. william lynch, the bay area man acquitted of charges of beating a priest, will not be recharged. lynch was accused of attacking father lindner, an elderly priest, at a retirement home. lynch claims the priest molested he and his brother when they were children. a jury found lynch not guilty of felony assault and elder abuse even though lynch never denies attacking lindner. >> it's friday. that means the weekend is here. and meteorologist christina loren will tell us about sunshine and warm temps. >> 6:06 now. the the micro climates starting to make a difference. as we head through the weekend, you made it to the weekend, welcome to friday. this is san francisco, mostly cloudy conditions. take to you san jose, show you

85 at the bottom of the screen, unusual slowing but there was a construction crew. that has cleared. northbound starting to clear. just in time for the build off 101. a live look and see how things are shaping up. southbound 101, the sun comes up. headlights are on and the smooth drive. 50s out of novato into san rafael. back to you. >> it is -- we have questionable charges, a san francisco civil grand jury seems to think charges on the menus are not what they should be. the jury investigated health care fees restaurants add to your bill and says it found some employees profiting from that practice. by law most businesses in the city must help their employees obtain insurance and one way is through the health reimbursement account. mows draw from it to pay for medical expenses. in the report, the grand jury

recommends restaurants no longer be allowed to add surcharges. san francisco's china town neighborhood is suing to put shark fins back on the menu. they are used in soup, a delicacy in chinese cuisine. the governor -- fins are cut off after live shark and its own body, then thrown back in the water. supporters of the ban say the practice kills millions of sharks but leaders in the chinese community they say the law discriminates against chinese-americans and does not protect the fish. >> coming up, we continue to update you on the breaking news we're following from colorado. 12 people dead, 50 others injured after a shooting spree in a packed movie theater. we'll have the latest details just ahead. >> anybody headed to santa cruz county you are warned to keep

>> welcome back everyone. we continue to follow breaking news out of aurora, colorado. overnight a mass gunman kills 12 people, injuring at least 50 others. the detail continue to spill into the newsroom. marla tellez has been following it for us all morning long. what is the latest? >> the latest is that we're hearing from homeland security secretary janet napolitano. agencies are responding. new information is that the associated press is reporting the youngest victim is a

3-month-old baby. currently being treated at the university of colorado hospital. that hospital alone is taking care of at least 21 victims. all innocent unsuspecting moviegoer who thought they were in for an entertaining night. some witnesses telling police they thought the gun fire and smoke was part of the movie, some sort of special effects. in fact, though, it was the work of the suspect who is in custody that is 24-year-old james holmes. he is talking to police. officials say he has no known criminal history, no length that they know about to terrorism. he is a resident of aurora where the shooting happened. his car is said to have tennessee license plates. he was carrying at least four weapons including a rifle, also wearing a gas mask, presumably to protect himself from the gas canisters he threw inside before

opening fire. again, at least 12 reported to be dead, and 50 more hurt in this mass shooting in colorado. staying on the story to bring you the latest. >> thank you very much. we will continue updating this on the breaking story throughout the morning. we have learned that a news conference will be set for 6:30 t doctors at the hospital where the people have been taken, the 12 that died, also the 50 that were injured. they are going to have a news conference and inform us on information they can give us on the latest. >> we continue to follow this morning. it is 6:14. switching gears we know it's friday. it's going to be warm. you may want to skip that dip in the ocean in santa cruz county. signs are warning swimmers to stay out of the water at a couple of popular beaches. bob redell is live where a great white shark was spotted not far from the shore. good morning, bob. >> reporter: we spoke with a

swimmer whose group might have encountered that shark. we'll give you a lay of the land. we're at rio delmar beach. you can see the cement ship that is a famous landmark where chopper pilot spotted this great white shark around 2:00 yesterday afternoon within swimming distance of the shore. the state has not shut down these beaches but posted warnings. you can see the warning and on other beaches. basically recommending people do not go into the water. and here's what has authorities so concerned. this is a photo of the shark, about 14-16 feet long. stayed near the surface off the shore, then it headed south. once word reached the lifeguards they yelled "shark" got people out of the water. we bumped into a group of triathletes who had a training swim but decided it wasn't worth

the risk. >> we got spread out and got out of the water. one of the women said man, i saw a dark shadow go right under me. she didn't see what it was but we don't know, really scary. then we find out the day after that there's a great white out there. >> reporter: that was the day before yesterday's sighting. they are water training in a pool. the sand man triathlon is in a week where that shark was spotted. it's possible that could turn into a duathalon. a shark took a bite out of a kayak at pleasure point. we spoke with an expert who did get a live look at yesterday's shark. they say they can't tell if that's the same shark that attacked the kayaker's boat. the good thing is this expert believes that yesterday's shark does not appear aggressive. reporting live, bob redell, "today in the bay." >> that is comforting.

thank you. the giants head to the city of brotherly love for a series against the phillies. this after seeing their five-game winning streak snapped in atlanta. madison bumgarner was on the hill against the braves. the giants had an early lead but the braves came right back, they tied it up in the second, jacking out that home run. atlanta only had three hits for the game but that was enough as the braves beat the men in orange, 3-2. as we know giants and a's fans, they had a history, a little bit of nipping at each other. >> this morning we have proof the rivalry crosses. the a's tried to set the record for the number of dogs. that's when the comcast cameras caught that. st. bernard gone wild. i thought those were docile. >> apparently not at the ball park. >> don't put your face up to any

bay. we're at 57 in sunnyvale. 57 to start out in santa cruz. as we head throughout the weekend, it's better to stay on the beach than head into the water in santa cruz. half moon bay, not too cold there. i wanted to show your satellite imagery. an area of low pressure has kept us cool. high pressure moves in. this is going to warm us up, the 90s return as of today. mid-90s by tomorrow. sunday, staying on the hot side inland so temperatures in the 90s and the warmest cities, i'm not talking every inland city. i think san jose about 80 degrees today. san francisco, 70 degrees for you and 73 down in santa cruz where you want to stay right by the beach. 74 degrees inland at noon on saturday. then you'll reach the 80s saturday afternoon is going to be on the warm side but not too bad as we head throughout the next week we get more moisture. you can see that, the clouds move back in, going to be

make another cent she would be worth hundreds of millions. she was number 20 at google. employee 20. yahoo! will pay her $1 million in salary. you add in stock options, bonuses and what we call make good, money to make up for what she left behind at google. it's tens of millions. between maybe 50 and $100 million which is why you'll see various numbers. with all of the high tech news this may have escaped notice. computer scientists have nearly won the war on spam. shutting down several huge servers overseas that accounted for as much as one third of all spam messages. most were pharmaceuticals. the guys work at fire eye security. brett joins us live. spam servers like this, you shut down one, another pops up. you say you were able to shut down like a big mothership.

>> that's right. this is the world's third largest bot net that sends an enormous amount of spam and it was a lot of people overseas involved. we feel confident that all of us in collaboration got the master servers that took down the bot net and essentially orphaned a lot of the pcs sending spam. >> you get a reward? is it just our thanks? why do it? well, thank you but why? >> that's a great question. we really don't. there is no monetary upgain at all. we have the technology, we project a lot of the largest corporations and agencies. we never that. a hot of it cyber expertise. why not help a world problem and collaborate with other people to bring down some of these big organizations. >> i thank you. my spam inbox thanks you as

>> sadly this morning the country waking up to news of a tragedy near denver, colorado as we've been telling you all morning. 12 people have been killed, another 50 injure affidavit a lone gunman opened fire in a midnight showing of the new batman film. a short time ago president obama releasing a statement on the shooting. tracie potts is live in washington with more on the shooting and the president's reaction. good morning. >> reporter: good morning. more of that statement, the president said he was shocked and saddened, he and the first lady, by what happened and that his administration will do everything they can to help the people of aurora. specifically he said my administration will do everything we can to support the people of aurora in this extraordinarily difficult time, we're committed to bringing whoever was responsible to

justice, ensuring the safety of our people and caring for those wounded and then he went on to say this. as we do when confronted by moments of darkness and challenge we must now come together as one american family. it is going to take a lot of support for the 12 who were twilled. the gunman believed to be a lone gunman, walked in shortly after midnight with a bullet proof vest and opened fire. now we hear the premier has been cancel canceled. >> thank you. interesting to see if the situation changes and we get releases from some of the local theaters as well. 6:27. as "today in the bay" continues we'll bring you that continuous coverage, the latest of that breaking news out of colorado.

following all morning long from aurora, colorado, a deadly shooting near denver. the latest count at least 12 dead, dozens are hurt in aurora, colorado, one suspect now currently in custody. marla tellez is live in the newsroom with the chilling details and news about the suspect and the victims. good morning. >> good morning. this mass shooting is turning out to have an international impact. we are learning the paris premier of the new batman movie "the dark knight rises" has been canceled because of what's unfolding here in the states in aurora, colorado. here is the latest. police have 24-year-old james holmes of aurora in custody. they are searching his apartment for more explosives. holmes telling police more explosives may be in the apartment, so fbi agents along with local law enforcement are on scene searching his apartment right now. they have that apartment complex evacuated as just a precaution.

holmes reportedly opened fire inside the century 16 movie theater during a midnight showing. this happened about 11:30 our time. prior to opening fire witnesses say he threw at least one gas canister at the front of the theater, that started to emit some sort of gas. that's when he began shooting. we're hearing from a couple of guys at the theater. >> he waited for the bomb to explode before he did anything, before he made any move. after it exploded that's when he began to shoot. >> the first shot was in the air. after that he started shooting towards. >> no specific target. >> aurora is about 9 miles east of denver, only about 20 miles from littleton, colorado where you may recall 13 people were shot and killed at columbine high school 13 years ago in 1999. officials say they have no reason to believe there are any more suspects other than holmes. we're also hearing unconfirmed

they hammered out the window, they shattered the glass there and i didn't see any one jump into the apartment complex itself but again, no information other than that coming out of his apartment complex neighborhood. >> marla, thank you. we'll check back with you and also keep an eye on the press conference as well. >> also new this morning, a significant development in an oakland murder that caught national attention. a 1-year-old killed in the crossfire of a shootout. christie smith joins us with what we've learned. >> reporter: good morning. when this happened it was heart breaking here in oakland. a 1-year-old boy shot in the head while his father held him. the father hit by a stray bullet in the hand. now, at the time there was concern that this could set off a gang war in west oakland. now comes word that two alleged gang members were indicted by a federal grand jury, that according to the chronicle.

that claimed the life of 1-year-old hiram lawrence jr. he was hit along with six others. three people in hoodies opened fire on a group that had finished filming a music video in the area. at least two people in that group actually fired back at the shooters. the indictment named dionte houffe and houston nathaniel iii as members of the acorn gang. the shootout caught on tape from a liquor store. the indictment says that this was part of an ongoing struggle, the tragic shooting. hiram and two others, moved police to go ahead and reach out and ask for federal help in dealing with it. the charges include murder, assault, racketeering and weapoweapon s charges. this did come from a joint federal investigation with oakland police. reporting live in oakland, christie smith, "today in the bay." >> taking you live to a news

conference at health one medical center where many of the victims were taken. >> 12 of which had gunshot wounds, three of which had some sort of fume chemical exposure. at this point we've admitted seven patients to the hospital, four as i said have gone to the operating room emer gently. i'm happy to say those patients are alive. we've had no fatalities so far. we have two pending surgery as well. we have had four total patients discharged. we don't anticipate further patients from this incident but we're always prepared. as a level 2 trauma center we have an internal disaster program that we activated and we were able to mobl mobilize surgeons and staff from the rest of the hospital to attend to our critically ill patients. i'm happy to say we had no fatalities so far. so if i could i could answer questions you may have.

most of the injuries were again, gunshot wounds, they varied from wounds to the chest and abdomen and trunk to extremity wounds as well. they appear to be of high caliber. i don't know how you could be prepare forward such a thing but i think the staff did an excellent job. they mobilized, did what they had to do and trained to do, and i think at this point they are starting to settle down a little bit. there's an intel program we have and support staff to go through a debriefing and support not only the patients and the families that we've seen but also the staff that had to take care of them. >> we're listening to a live news conference this morning from health one medical center of aurora, colorado where many of the victims of the shooting where a gunman went into a movie theater, killing 12 people t spokesperson there mentioned several people were exposed to some sort of chemical as well as

>> a man opens fire in a packed movie theater overnight, 12 people dead, 50 more injured, a 24-year-old suspect in custody. police right now searching his home for explosives as we speak. this all happened at about 12:00 this morning in aurora, colorado, a suburb outside of denver. this happened just as crowds packed in for the showinging of the batman movie. marla tellez is following the story all morning and is with all of the latest information. what's happening? >> we just heard from a doctor with health one's medical center of aurora where they are treating 15 patients from this

mass shooting. he says they began seeing patients about 1:00 this morning, they started pouring in at that time. 12 with gunshot wounds mostly to the chest and abdomen. he referred to them as high caliber wounds. three patients treated for some sort of chemical exposure as we've been reporting, police say the suspect who is in custody, 24-year-old james holmes, released some sort of gas at the front of the theater before he opened fire. the doctors say most of the patients at health one are teenagers, though the associated press is reporting a 3-month-old baby is the youngest person to be injured in this mass shooting. the youngest is a 3-month-old baby. we hear the oldest is 45 years old. a little bit of good news is the four out of the 15 taken to health one medical center have been discharged. that hospital is preparing to

give another briefing at 8:30 this morning. we're all over the story to bring you the latest. >> thank you so much, marla. we're following breaking news in the south bay where san jose police are on the scene of a home invasion in the east foothills of the city. looks like the deputies are out will. they tell us a man broke into a home, shot one of the residents, we learned the man shot was sleeping at the time. he is expected to survive. no word on suspects in the case. we'll be sure to bring you new developments as soon as we get them as well. right now police are asking for help in the search for two men connected to a string of credit card thefts across the bay area. they have committed at least five dlaers at tilden regional park and several more since december. police say the two men break into cars while the owners are in the park, they still credit cards, then they quick hi max out those cards before any one even knows they are gone.

shore. we spoke to a group of triathletes. a woman in the group says she did sense a dark shadow swim under her, it freaked her out. that's one reason why they are going to heed these warnings and not go in the water. >> we have to swim but we're going to the pool. no. just a little too risky. now it's been spotted we're not going. >> here is a photo of the great white yesterday. it's about 14-16 feet long. again it was close to shore near the cement ship, the chopper pilot said it then headed south. a shark expert did look at this and try to see if this might be the same shark that attacked a kayaker's kayak. the one thing they did think of is that it did not appear

aggressive. you've got these warnings from between sea scape to capitola, basically warning do not go in the water. it's their recommendation stay out. bob redell, "today in the bay." >> 6:52. we expect new answers to lingering questions in the tragic shooting death of a san jose police officer's young son. this is the neighborhood where 3-year-old preston orlando died. investigators have said very little. new details are expected today. police say the boy died of a gun shot but not whether the child shot himself or by someone else. the father is a 9-year veteran of the police department. the district attorney is reviewing the case to see if any one will face charges. in a few hours.

sheriff ross mirkarimi is expected at a courtroom with his wife. an attorney for eliana lopez will ask to modify a stay order so they can have face-to-face contact before she returns to her native counsel. she has been there caring for an iling father. last night she testified at her husband's ethics commission hearing saying that although her bruised arm or her arm was bruised during an argument. she does not consider it domestic violence. after the hearing she expressed her hopes for the future. >> i just cannot wait the moment we are going to be investigating. here in san francisco. and i just looking for the day i'm going to be just the sheriff's wife again. >> lopez is due back in venezuela on monday where we understand that she is filming a movie.

the commission is expected to make its recommendation whether sheriff mirkarimi should keep his job on august 16. >> thought on tape, now investigators want 4 help. take a look at these shots, the photos, police believe these are the two men connected to several blowers near tilden regional park and in half moon bay. the men have been using credit cards illegally at target and apple stores in emeryville, redwood city and palo alto. if you happen to recognize either of these men you are asked to call the east bay regional parks police department. >> three more arrests were announced in what's called the largest child porn sweep ever in northern california. in all, 15 people are now in custody and we were there when officers swooped in. more than 165 detectives took part in what's called operation chicken hawk. an effort to locate and arrest

child pornographers. >> there is new fallout in the jerry sandusky investigation. a member of the board of trustees has resigned, steve garb garban. he says his presence on the board has become a distraction. garban is the first board member to leave in the wake of the sandusky child sex abuse scandal. he was one of several people hashly criticized for his handling of this scandal. sandusky was convicted of molesting 10 boys. >> ford is telling drivers to stop driving their suvs. ford is recalling more than 11,000 of its 2013 escape suvs due to a fuel line problem. the company says the fuel lines can crack, leak and spill gasoline which could cause the engine to catch on fire. the issues will be fixed but they are urging affected drivers
